Request to Declare Lands as Surplus to the Town’s Needs – Road Widenings and daylight triangles for three FIIT Projects: Arts & Entertainment Centre/Central Library, Milton Sports Centre Expansion and Campbellville Community Centre

RECOMMENDATION:

THAT Council does hereby declare a 2.0 metre road widening on the south side of Main Street as surplus to the Town’s needs (Arts & Entertainment Centre/Central Library) ; AND THAT Council does hereby declare a road widening along Derry Road, a daylight triangle at the intersection of Derry Road and Santa Maria Boulevard, and a 0.3m reserve along Derry Road and the daylight triangle, as surplus to the Town’s needs (Milton Sports Centre Expansion); AND THAT Council does hereby declare a road widening along Guelph Line, a daylight triangle at the intersection of Guelph Line and Campbellville Road, and a 0.3 m road reserve as surplus to the Town’s needs (Campbellville Community Centre); AND THAT the Town Clerk is directed to give public notice of Council’s intention in accordance with By-law No. 34-95.

REPORT Background •

The Facilities Infrastructure Implementation Team (aka FIIT) was established specifically to manage the capital projects related to facility development. In particular, the need to have a coordinated, dedicated approach to delivering the projects that have received funding under the Federal/ Provincial Infrastructure funding programs is critical. The timelines for these projects are very aggressive.



Certain road widenings/ daylight triangles are required by the FIIT projects for the Arts & Entertainment Centre/Central Library, the Milton Sports Centre Expansion and the Campbellville Community Centre.

Discussion The following declarations of surplus land are required by By-law 34-95 and the Municipal Act, 2001. Staff will provide public notice of Council’s intention to declare these lands as surplus to the Town’s needs. Arts & Entertainment Centre/Central Library – 55 Thompson Road

The site is located on the former Milton Hydro lands at the south-east corner of Main Street and Thompson Road South. The site abuts the Milton Leisure Centre to the east, and Milton Memorial arena followed by the Milton Lions Park to the south. The Town of Milton Official Plan (consolidated August 2008) designates Main Street East (between Bronte Street and James Snow Parkway) as a 35.0 metre multi-purpose arterial road. Currently, the Main Street East right-of-way width on the Main Street East side of the Town owned property located at 55 Thompson Road South is 33.0 m. In order to comply with the Official Plan, a 2.0 metre road widening is required in this location. These lands will change from “institutional” to be conveyed as a road allowance. This change is necessary even though the Town owns the road and is in essence dedicating the road widening to itself.

Milton Sports Centre Expansion – 605 Santa Maria Boulevard

The existing Milton Sports Centre is located at the south-east intersection of Derry Road and Santa Maria Boulevard. The building expansion will be located along the east and south elevations of the existing building. The parking expansion will be constructed to the south of the building addition.

The Region of Halton requires conveyance of lands for road widenings. Specifically, any lands identified in the Derry Road (Regional Road 7) Environmental Assessment Study (Bronte Road to Tremaine Road, 2006) as required for the widening of Derry Road from 2 to 4 lanes, that are part of the subject property, shall be dedicated to Halton Region. Additionally, a daylight triangle at the intersection of Derry Road and Santa Maria Boulevard is required and a 0.3 metre reserve is also required across the entire frontage of the subject lands along Derry Road and behind the daylight triangle. These lands have been identified as Parts 2 and 3 on 20R-15606. The above noted lands shall be dedicated for the purpose of road right-of-way widening and future road improvements; these lands shall be dedicated with clear title (free and clear of all encumbrances) and a Certificate of Title shall be provided, in a form satisfactory to the Commissioner of Legal Services or his designate. Landscaping, fencing, sidewalk connections, trails or any other encroachments will not be permitted within the Region's easements and/ or right-of-way limits, unless appropriate landscape drawings are submitted to the Region for review and approval. Upon consideration, if approved, an encroachment agreement and Regional Council approval will be required. All costs and fees associated therewith shall be the responsibility of the Owner. Campbellville Community Centre 9267 Guelph Line

The Town is the recipient of funding for the redevelopment of the existing Campbellville Community Centre, which is the home of the Nassagaweya Tennis Club. The project includes full reconstruction of the building, tennis courts, parking areas, landscaping and passive open space areas. The Region of Halton requires conveyance of lands for road widenings. Specifically, any lands within the 35 metre right-of-way; 17.5 metres from the centreline of road allowance of the original 66 foot right-of-way of Guelph Line (Regional Road 1) that are part of the subject property shall be dedicated to Halton Region. Additionally, a daylight triangle at the intersection of Guelph Line and Campbellville Side Road is required and a 0.3 metre reserve is also required across the entire frontage of the subject lands along Guelph Line and behind the daylight triangle. The above noted lands shall be dedicated for the purpose of road right-of-way widening and future road improvements. These lands shall be dedicated with clear title (free and clear of all encumbrances) and a Certificate of Title shall be provided in a form satisfactory to the Commissioner of Legal Services or his designate. Halton Region is aware that there is an existing well within the Region's designated right-of-way limits. It should be noted that future road improvements to Guelph Line within the vicinity of the Campbellville Community Centre have not been identified within the 2021 Capital Program.

Relationship to the Strategic Plan Goal – Well managed growth, well planned spaces. Part of this goal is to encourage the efficient use of land to make the best use of infrastructure and services. Financial Impact These FIIT projects are being funded through provincial and federal grants dedicated to community infrastructure projects. Costs for the conveyance of the lands described in this Report will fall under this funding.
