THE CORPORATION OF THE TOWN OF PERTH BY-LAW NO. 4084

A by-law to authorize the Mayor and Clerk to sign an Agreement with the County of Lanark regarding Rescue Services to the Town of Perth

WHEREAS under the Municipal Act, 2001, S.0.2001, c. 25., as amended, by-laws may be passed for the purpose of entering into agreements; AND WHEREAS the Corporation of the Town of Perth has previously passed By-law No. 3568 for the purpose of designating the Mayor and Clerk as the signing authority for the Corporation;. AND WHEREAS Council has reviewed COW Report 2010-8.5 and has concurred with staff recommendation that the Mayor and Clerk execute an agreement with the County of Lanark regarding Rescue Services to the Town of Perth. NOW THEREFORE, the Council of the Corporation of the Town of Perth hereby enacts as follows:

1. That the Mayor and Clerk sign an Agreement with the County of Lanark regarding Rescue Services to the Town of Perth, attached hereto as Schedule' A' and forming part of this By-law. 2. That this By-law shall come into force and take effect immediately upon the passage thereof.

Read a first time, second and third time and finally passed this 31 st day of August, 2010.

AGREEMENT CORPORATION OF THE COUNTY OF LANARK LANARK COUNTY RESCUE SERVICE PROGRAM herein referred to as the "COU,NTY", OF THE FIRST PART - and Township of DRUMMOND/NORTH ELMSLEY and TAY VALLEY Township with the provision of Fire Protection Services to be provided by and under the authority of the Drummond North Elmsley Tay Valley Fire Board Town of MISSISSIPPI MILLS Township of MONTAGUE herein referred to as the "SERVICE PROVIDERS" - andTownship of BECKWITH Town of CARLETON PLACE Township of LANARK HIGHLANDS Town of PERTH herein referred to as the "NON SERVICE PROVIDER - LOCAL MUNICIPALITIES",

OF THE SECOND PART

WHEREAS the County has purchased vehicles and equipment to augmentexisting firefighting and rescue services in the County of Lanark; AND WHEREAS by the provisions of the Municipal Act, S.O. 2001, Chapter 25, as amended, Section 20, the County wishes to enter into an agreement with the SERVICE PROVIDERS concerning the maintenance, control and responsibility for certain firefighting and rescue equipment; AND WHEREAS, LOCAL MUNICIPALITIES agree to use Lanark County Rescue Services as needed;

NOW WITNESS THAT in consideration of the mutual covenants contained herein and other good and valuable consideration the parties hereto agree as follows:

The parties agree to the continuous operation of an Emergency Rescue Program and any vehicle and/or equipment under this program provided by the County shall remain the property of the County subject to the terms and conditions of this agreement.

2.

The provisions in Schedule 1, 2, 3, 4, and 5 of this agreement may be varied from time to time by agreement in writing among the parties to this agreement.

3.

Rescue Services within the jurisdiction of a Local Municipality shall be rendered by the respective Local Municipality Fire Department. If a request for assistance of the Lanark County Rescue Services is necessary, the response will be provided as outlined in Schedule 5.

4.

The SERVICE PROVIDERS will provide to the County a Certificate of Insurance acknowledging this agreement by naming the County of Lanark as an additional named insured, a clause providing 30 days notice of any material change or cancellation of a policy and indicating their Insurance Company, expiry date of policy, and limits of liability of at least $5,000,000.

5.

Reporting of call outs, training records and submission of claims will use the prescribed forms as designated by the Emergency Service Coordinator.

6.

The recovery of costs associated with the Rescue Services will be the rrent Ministry of Transportation approved fees.

SCHEDULE "1" Terms of Reference RESCUE SERVICE COMMITTEE

The Fire Chief's Rescue Service Committee shall consist of: 1. The Fire Chief's from each of the three municipalities where the Rescue Vehicles are housed, more specifically, the Drummond / North Elmsley Tay Valley Fire Rescue, the Town of Mississippi Mills Fire Department - Station # 1 and the Township of Montague Fire Department. The Fire Chiefs may designate their DeputycChiefs to attend meetings of the Committees, in their absence 2. The Chief Administrative Officer and Emergency Services Coordinator and/or Designates from Lanark County. The Emergency Services Coordinator or designate, shall be the Chair of the Fire Chief's Rescue Service Committee. MEETING SCHEDULE

1. The Committee will meet at a minimum quarterly, or as required, at the request of any Committee Member. Minutes of meetings will be prepared by the Chair, and distributed to members. OPERATING BUDGET

1. Each year, an Operating Budget will be prepared by the Fire Chiefs, and submitted to the Lanark County CAO for review and presentation during the County Budget process. The Budget shall include sufficient funds for the maintenance of all vehicles and equipment that forms part of the Rescue Program. The Fire Chief's Rescue Service Committee will also make recommendations for Capital expenditures, for the addition and/or replacement of equipment, to be considered by the County, as funds become available. County Chief Administrative Officer and/or Emergency Services Coordinator shall be responsible for presenting the Budget requests during the Budget process. 2.

Expenses shall be authorized by the Emergency Services Coordinator or designate. The Fire Chief's Rescue Service Committee will be responsible for equipping the three vehicles, as per Schedule "6",

STRATEGIC PLANNING

1. The Fire Chief's Rescue Service Committee will recommend the most strategic locations for the vehicles, so as to provide the best possible service to the County and its Local Municipal partners.

SCHEDULE "2" COUNTY RESPONSIBILITIES

The County's responsibilities shall be: 1. The Emergency Services Coordinator or designate shall be the Chair of the Fire Chief's Rescue Service Committee. 2. The County shall provide vehicle and equipment licensing and insurance, as required under provincial law. 3. The County shall provide funding for training and the repairs and maintenance to the vehicles and equipment, other than that provided by the SERVICE PROVIDER municipalities under Schedule "3". 4. The County will make available to the SERVICE PROVIDER the equipment listed in Schedule 6, at the effective date of this agreement. 5. The County shall, during its budget deliberations, consider recommendations from the Fire Chief's Rescue Service Committee for new and replacement equipment, both operating and capital.

SCHEDULE "3" SERVICE PROVIDERS RESPONSIBILITIES

The SERVICE PROVIDERS responsibilities shall be: 1. To provide emergency rescue services within its jurisdiction with County-owned equipment. 2. To house the rescue vehicles and to maintain them in good working order, implement a schedule for regular maintenance and to ensure they are ready for immediate emergency response, including the provision of gas, oil and lubrication. 3. To ensure that the equipment is maintained to the standards as required of the Standards of Ministry of Labour, Ontario Fire Service Health and Safety Advisory Committee under Section 21 of the Occupational Health and Safety Act. 4. To deliver the rescue vehicle, with a minimum of six (6) personnel, to an emergency in response to any call that cannot be handled by the Local Municipal Fire Department, or made by Police or Ambulance Service personnel requesting their assistance where rescue equipment is required. 5. Authorization to respond outside the County boundaries will be at the discretion of the SERVICE PROVIDER Fire Chief or his/her designate. 6. Non emergency use of the County Rescue Vehicles/equipment may be permitted on the authority of the SERVICE PROVIDER Fire Chief or his/her designate. 7. Responsible to complete and file a Rescue Call Out Report, to be forwarded to the Emergency Services Coordinator on a monthly basis for each incident for which the Rescue Vehicle responds. Such reports shall be summarized by the Emergency Services Coordinator, and provided annually to the Fire Chief's Rescue Service Committee. 8. If an incident occurs on a Provincial Highway, the SERVICE PROVIDER Fire Chief or designate will send a rescue claim to the Ministry of Transportation Ontario (MTO) and a copy to the Emergency Services Coordinator. 9. If an incident occurs on any roadway within Lanark County, the SERVICE PROVIDER Fire Chief responsible for the Rescue Unit will forward a Rescue Claim (prescribed form) to the Local Municipality in which the incident occurred, a copy to the Emergency Services Coordinator. Lanark County will be paid, upon receipt of revenue, the amounts received for its costs as determined by the SERVICE PROVIDER Fire Chief responsible for the Rescue Unit on the following basis:

Individual and/or registered owner of the vehicle involved in the accident, lives outside the County - the revenue from the incident will be shared 50/50 between the County and the SERVICE PROVIDER municipality. Individual and/or registered owner of the vehicle responsible for the accident lives within the County of Lanark - there will be no additional charge. Where a criminal charge is laid the revenue from the incident will be shared SO/50 between the County and the SERVICE PROVIDER municipality.

10. Each SERVICE PROVIDER Municipal Fire Department will have a geographical response area as defined by Schedule 5. 11. SERVICE PROVIDER will ensure personnel are trained to the minimum standard as required of the Standards of Ministry of Labour, Ontario Fire Service Health and Safety Advisory Committee under Section 21 of the Occupational Health and Safety Act.

SCHEDULE "4" NON SERVICE PROVIDER - LOCAL MUNICIPAL RESPONSIBILITIES

The Local Municipalities responsibilities shall be: 1. To request Emergency Rescue Services of County-owned equipment when the situation exceeds the capabilities of the Local Municipality. 2. If an incident occurs on a provinciai highway, the Local Municipality Fire Chief or designate will send the Rescue Claim, after having received it from the Service Provider Fire Chief, to the Ministry of Transportation Ontario (MTO). If an incident occurs on any roadway within Lanark County, the Local Municipal Fire

Chief will be responsible for recovering its costs and those of the Rescue Vehicle (after having received the RESCUE Claim from the Service Provider Fire Chief), either from the vehicle owner or their respective Insurance Company. Lanark County will be paid, upon receipt of revenue, the amounts received for its costs as determined by the SERVICE PROVIDER Fire Chief responsible for the Rescue Unit on the following basis: a. Individual involved in the accident, lives outside the County - the revenue, applicable to the Rescue Unit, - from the incident will be shared SalSa between the County and the SERVICE PROVIDER municipality. b. Individual involved in the accident lives within the County of Lanark - there will be no additional charge. c. Where a criminal charge is laid the revenue, applicable to the Rescue Unit, from the incident will be shared salsa between the County and the SERVICE PROVIDER municipality.
