NEW BUSINESS: PRELIMINARY PRESENTATION OF PROPOSED P.U.D. BY NORTHERN HOMES COMMUNITY DEVELOPMENT CORPORATION. Jan Bassett introduced Jane Mackenzie, Executive Director, Northern Homes Community Development Corporation, a non-profit corporation, who presented to the Commission a preliminary presentation of a proposed Planned Unit Development project to be located on the Elk Rapids Bible Church property on E. Third St. The project will consist of 56 affordable workplace dwelling units of two-story townhome style,

with possible single-story end units providing for more ADA accessibility. The project is being proposed for development in two phases. Ms. Mackenzie informed the Commission that the application filing to MSHDA is required to be submitted by April 1, 2016. After further questioning by the Commission, it was Moved by BRONKEMA, Second by DAKE, that a Public Hearing on the proposed project be scheduled for the Planning Commission regular meeting on January 2, 2016. All members present voting YES. Motion Carried. CORESPONDENCE: NONE. REPORTS: Chair Hibbard stated that in the past the December meeting of the Commission was usually cancelled because of the Christmas holiday. All members agreed that the December 22nd regular meeting will be cancelled. Planning & Zoning Administrator, Steven Ravezzani, Activity Report for the month of October, 2015 was included in the packet. Council Representative, Doug Bronkema submitted his written report on Village Council proceedings at their November 2nd and 16th regular meetings. Planning Representative to ZBA, Lauren Dake - Zoning Board of Appeals November regular meeting was cancelled due to no request for Appeal being received. VILLAGE OF ELK RAPIDS IMPACT ASSESSMENT STATEMENT Applicants for all Special Use, Planned Unit Development or Commercial Site Plan Review Permits are required to complete the following written Impact Assessment information as applicable:

1. A written description of the environmental characteristics of the site prior to development, such as topography, soil conditions, plant materials, drainage, streams, creeks, or ponds: The site has a church and parking lot on the north 1/3 of the property. The topography is open and relatively flat in the middle 1/2 of the property then slopes down to an existing large storm water retention area (=/- 1.5 acres) located at the south 1/4 of the property. There is a row of spruce trees along the east side of the property and woods line along the west side. The soils consist of group A, group B, and group B/D classifications. 2.

Types of uses and other man-made facilities: The site is currently used by a church. This proposal is for the construction of 56 two-bedroom apartment units on the middle 1/2 of the property.

The number of people to be housed, employed, visitors or patrons, and vehicular and pedestrian traffic to be generated: Estimated population for the apartments is 112 persons at full occupancy. There will be an estimated 112 round trips made from/to the new development daily. There will be one fulltime and one part-time employee and private contractors for landscaping and other maintenance duties.

Phasing of the project, including ultimate development proposals: The project will be built in 2 phases with 28 units in each phase. The ultimate development proposal is for 56 two-bedroom apartments and an office/community room.

Natural features which will be retained, removed, and/or modified, including vegetation, drainage hillsides, streams, wetlands, woodlands, and water. The description of the areas to be altered shall include their effect on the site and adjacent properties: The row of spruce trees on the east side and most of the woods on the west side will be retained. 6. The method to be used to serve the development with water and sanitary sewer facilities: Village water main and sanitary sewer will be extended to the development. 7. This shall include runoff control during periods of construction: Drainage will be controlled with storm sewer and grassed swales. The existing retention area will be utilized for this development.

8. If public sewers are not available to the site, provide a current approval from the Antrim County Health Department or other responsible public agency indicating approval of plans for sewer treatment: Not Applicable 9. The method to be used to control any increase in effluent discharge to the air or any increase in noise level emanating from the site, and consideration of any nuisance that would be created within the site or external to the site whether by reason of dust, noise, fumes, vibration, smoke or lights: Not Applicable 10. An indication of how the proposed use conforms with existing and potential development patterns and any adverse effects: The proposed residential project is in a residential and school area. There is no indication that there will be adverse impacts. 11. Description of measures to control soil erosion and sedimentation during grading and construction operations and until a permanent ground cover is established. A copy of Antrim County Soils and Erosion Control Permit is required prior to start of construction: Silt fence and temporary sediment basins will be placed to control soil erosion and sedimentation during construction.

VILLAGE OF ELK RAPIDS GENERAL REQUIREMENTS STATEMENT Applicants for all Special Use, Planned Unit Development or Commercial Site Plan Review Permits are required to comment on the following General Requirements information as applicable to show that the proposed project/use:

Be compatible with adjacent land use, the natural environment and the capacities of public services and facilities affected by the land use, and the use shall be consistent with the public health, safety and welfare of the Village residents: The development is a residential development in a residential neighborhood. It will be built on relatively flat open land. It is able to be served by public services and facilities. The use is consistent with the public health, safety and welfare of the Village residents. 2. Be designed to protect natural resources the health, safety, and welfare as well as the social and economic well-being of those who will use the land or activity under consideration, of residents and land owners immediately adjacent to the proposed land use or activity, and of the community as a whole: The development is designed to meet the above criteria. 3. Be related to the valid exercise of the police power and purposes which are affected by the proposed use or activity: The development meets this criteria through compliance with the PUD ordinance. 4. Meet the standards established in the Village of Elk Rapids Zoning Code: The proposed development meets the Village of Elk Rapids standards. 5. Be requested by an applicant who may legally apply for the permit requested and has submitted all required information: The application for the PUD permit has been submitted. 6. Be a development, exclusive of Planned Unit Developments, which conforms to all regulations of the Zoning District in which it is located: The development is a proposed PUD development.

Meet the requirements of the Village for fire and police protection, water supply, sewage disposal or treatment, storm drainage, and other public facilities: The requirements are met as shown on the submitted plans. 8. Meet the standards of other governmental agencies, where applicable: The standards for other governmental agencies will be met prior to a building permit being issued. 9. Be designed such that natural resources will be preserved to a maximum feasible extent and that areas to be left undisturbed during construction shall be so indicated on the site plan and at the site per se: 10. Respect floodways and flood plains on or in the vicinity of the subject property: Not applicable. The site is not within a regulated flood plain. 11. Be constructed where soil conditions are suitable for excavation and site preparation. Organic, wet or other soils which are not suitable for development will either be undisturbed or modified in an acceptable manner: The development will not disturb regulated wetland areas. 12. Not cause soil erosion, sedimentation, or ground water pollution problems: The development will receive an erosion control permit prior to the start of construction and will use erosion control measures during construction. The development will have no measurable effect on ground water. 13. Be designed to handle anticipated storm water runoff and to prevent runoff onto neighboring property or overloading of water courses in the area: Drainage will be controlled with storm sewer and grassed swales. Not destroy the character of the property or the surrounding area or adversely affect the adjacent or neighboring properties: The property that will be developed is mostly an open field in a residential and school area. There will be no adverse impacts on adjacent or neighboring properties. 15. Not disturb air drainage systems necessary for agricultural uses: Not Applicable 16. Be designed such that phases of development are in a logical sequence, so that any one phase will not depend upon a subsequent phase for adequate access, public utility services, drainage or erosion control: The phases are shown on the plan. 17. Be designed such that the plan provides for the proper expansion of existing facilities such as public streets, drainage systems and water and sewage facilities and will not create excessive additional requirements at public cost for public facilities and services: The public facilities have capacity for this project. 18. Provide for landscaping, fences or walls if required by the Village Council, Planning Commission or Zoning Administrator in pursuance of the objectives of the Village of Elk Rapids Zoning Code: We will provide what is required. 19. Provide that outdoor storage of garbage and refuse is contained, screened from view, and located so as not to be a nuisance to the subject property or neighboring properties: Two enclosed garbage storage areas are noted on the plans. 22. Not be hazardous or disturbing to existing or future uses in the same general vicinity but will rather be a substantial improvement to the property: Cornerstone Court Townhomes will make good use of vacant land in the Village of Elk Rapids and is designed for low impact on surrounding properties. 23. 4. Landscape Plant Material. a. Plant Materials: It is the intent of this Section to encourage thoughtful, environmentally sensitive, and bio-diverse nature of the mixture of plantings, including those plantings native to the northwest Michigan region, and to discourage the use of invasive plant materials during the landscape design process. In order to meet this intent, the Village of Elk Rapids will utilize the “Recommended Planting Guidelines for Municipalities”, as published by the Northwest Michigan Invasive Species Network, as may be amended from time to time, to determine what plant materials shall be considered “native species” from “invasive species”. b. Plant Quality: All plant materials shall be of nursery quality, obtained from a licensed grower, hardy to the climate of northern Michigan, and free of disease and insects. c. Plant Mixture: The overall landscape plan should promote a mixture of native species plant materials as described below. d.

Approved “Native Species” planting materials: The following “native species” plant materials, may be used for landscape purposes. Additional selections of “native species” planting materials may be found under “Recommended Plants for Ornamental Landscapes” within the “Recommended Planting Guidelines for Municipalities”, noted above: •

Shrubbery: Round-leaved Serviceberry, Black Chokecherry, New Jersey Tea, Buttonbush, Alternate-leaf Dogwood, Silky Dogwood, Red-osier Dogwood, Michigan Holly, Meadowsweet, and Nine Bark.



Ground Cover: Spreading Juniper, Wild Strawberry, Little Blue Stem Grass.

Planning Commission completed its review of the village Landscaping Ordinance to encourage the use of native plantings and discourage the use of invasive species in landscaping plans. The Commission requested the Planning and Zoning Administrator schedule a Public Hearing on the proposed amendment at their regular meeting January 26, 2016. VILLAGE COUNCIL ACTIVITIES RELATED TO PLANNING: 1. Village Council conducted a First Reading of Ord. #463, proposed amendment to the Village of Elk Rapids Code of Ordinances, Chapter 1, General Provisions. After review of the proposed amendment, Council requested some changes be made relative to Food Trucks and then be brought back to Council for further review at their regular meeting on December 7, 2015.
