This approach often costs money, time, and effort that could have been minimized with upfront planning. We’ll discuss the timing for the inclusion of risk management, and how to track and ensure the decisions which come from these efforts are successful.

Insurance Track 4a – Construction Risk and Language (1 CPE Credit)

Moderator: Tracy Meyer, Risk Insurance and Contracts Manager, Broward County Aviation Department Speaker: Debbie S. Crockett, Attorney at Law, Cheffy Passidomo, P.A. It is almost inevitable that problems arise during construction. Construction contracts can include provisions to minimize litigation expenses and liability. Such provisions include pre-suit provisions that require the parties to come to the table to settle matters prior to filing suit and without stopping work. Risk managers and attorneys who draft construction contracts hold the keys to inserting provisions that will mitigate client expenses and even liability, when disputes arise. Careful and thoughtful contract drafting can lead to significant reductions in litigation costs and exposure which in turn leads to tremendous savings for companies and clients. But, if pre-suit resolutions cannot be reached, counsel must ensure certain risk shifting provisions are in place, which includes understanding the interplay of construction contracts with insurance, contractual indemnity, and additional insured requirements.
