The project included a review of the operations and closure of the old Mariscal Sucre Airport. Operated by Quiport, the project consists of the initial due diligence phase and subsequent monitoring of environmental, safety and social considerations to International Finance Corporation (IFC), IDB and national standards.

Golder was contracted in 2007 to undertake an assessment of health, safety, environmental and social issues at the Mittal Steel Temirtau (MST) operations in Kazakhstan. The work comprised of an integrated steel plant, its associated eight operational mines and seven closed coal mines in Karaganda. This assessment was required to support a proposed EBRD loan to MST for health and safety investments at the mines.

Golder was retained by Endeavour Financial Ltd. on behalf of potential future lenders to perform an independent environmental, social, health and safety compliance review of Guyana Goldfield Inc.’s (GGI) Aurora Gold Project in Guyana. The proposed mine site is located in tropical rainforest in a high rainfall environment. The scope of work consisted of conducting a due diligence review of the environmental and social impact assessment and bankable feasibility study to determine compliance with the Equator Principles, International Finance Corporation (IFC) Performance Standards on Environmental and Social Sustainability, and Good International Industry Practice.

She develops fit for purpose solutions to complex or simple project settings and risk profiles. Alex has also undertaken CSR policy development with miners looking to expand into new regions or more developing economies, and provides strategic support and capacity building for teams and local professionals.

At Golder, Ed has led in excess of 90 due diligence and HSEC system and compliance audits on chemical manufacturing, transportation and mining companies, throughout Australasia, sub-Saharan Africa and South America. Prior to consulting, Ed held management level environmental positions for base and gold mining companies within Australia and internationally, this included five years within eastern Africa. Mr. Hartshorn’s primary focus is the identification, assessment and management of environmental liabilities, often through the development and implementation of environmental management systems. James has been trained as an ISO 14001 (Environmental Management) Lead Auditor and as an OHSAS 18001 (Health & Safety Management) Lead Auditor by SGS International Certification Services (Canada) Inc., and is a Certified Environmental Auditor with the Canadian Environmental Certifications Approvals Board (CECAB). James has considerable experience in consulting on a range of project sustainability issues, principally environmental and safety management, with clients throughout Canada and the U.S., in a variety of industrial sectors. He also has substantial experience in environmental, health, safety and social due diligence reviews, having been the lead assessor for several environmental and social due diligence (ESDD) projects (transportation, infrastructure and manufacturing) for the IDB in Paraguay and Ecuador, and an assessor for the ESDD for an oil exploration project in southwest Kazakhstan, on behalf of the lenders KMG Kashagan, Société Générale, Citibank and BNP Paribas. Michael Raine

Mr. Raine is an Environmental and Social Impact Assessment (ESIA) Specialist who provides practical advice to industry and government clients. His main work interests include preparation of ESIAs, development of Environmental Management Plants, and third party review of ESIAs. His professional experience has primarily been in the field of ESIAs for resource development projects. He has considerable experience in preparing ESIAs for industry in Africa, Latin America, and Canada. His experience includes issue scoping for issues, the design and implementation of baseline studies, analysis and reporting, development of mitigation strategies and determination of residual (including cumulative) effects. Mr. Raine has conducted numerous third party reviews of ESIAs on the behalf of lenders and buyers. Mr. Susi is an Principal and Senior Engineer and Project Manager with more than 29 years of experience in for domestic and international inter-disciplinary environmental projects, including mining, oil and gas, transportation, power plants environmental impact studies, compliance audits, air resources, environmental permitting, waste management services, and transactional audits in the U.S. Mr. Susi has directed, managed, or been lead engineer for over 150 projects involving all aspects of industrial development throughout the U.S. Mr. Susi has been the project manager or project director on Environmental Impact Assessments for power plants in Panama and the Dominican Republic, pipelines in Bolivia and Nicaragua, and LNG facilities in Mexico, the Dominican Republic, and Peru. He has also managed mining projects in the Dominican Republic.

Marion is a senior environmental practitioner with experience in mining, oil and gas, land development, infrastructure development, waste management, and industry. Marion is a lead auditor and has undertaken numerous environmental audits and due diligence projects; she is also proficient in ISO 14001 projects. She has undertaken due diligence on behalf of international funding institutes, potential investors. Independent reviews have been undertaken against Equator Principles and international standards for private companies who are assessing their in-house environmental and social performance and ESIAs with a view to applying for funding. She has been project manager on numerous environmental and social impact assessments (ESIAs) and Environmental Management Plans (EMPs) for mines, quarries, infrastructure projects, flood management schemes, waste disposal sites, gas and industrial projects. Site decommissioning and closure plans with costs of rehabilitation have been completed in association with projects. Marion is also a qualified engineering geologist and has undertaken site investigations e.g. for roads, water reticulation projects, landfill sites, cemetery sites and housing developments. What’s at stake for companies that may be at higher risk?

The financial and statutory liability associated with regulatory non-compliance may pale in comparison to the costs associated with the impact on a company’s brand and image from a significant environmental, labour, or safety incident. There are many examples of organisations that have lost this public license to operate, or suffered significant damage, as a result of not identifying a risk that was foreseeable.

Clients with multinational interests are facing increasing expectations and obligations from a range of stakeholders. These expectations are described in local regulations, international standards, industry commitments, corporate policies, and public manifestos that place a substantial burden on internal compliance departments. They also differ greatly by location, and the ability to comply often relies as much on local knowledge and cultural sensitivity, as it does on technical and legal acumen. Due diligence has evolved, from conventional site assessment, with a focus on legacy impacts, to include compliance auditing, and a strict exceptionbased approach to evaluating compliance with applicable regulations and standards. Today, due diligence encompasses enterprise risk assessment, a forward-looking evaluation of environmental, labour safety, and community risks that can influence business continuity, brand and image, and public license to operate.

How is this different from environmental due diligence for legacy issues that impact asset acquisition or divestiture?

As the name suggests, Performance & Assurance is designed to provide information and knowledge about any potentially material EHS risks on new or existing projects. In particular, it assesses the ability of the target company to protect the health and wellbeing of its employees, contractors, and the general public; its capacity to control and mitigate significant impacts on the environment; and the acceptance of the project in the local community.

With an operating plant, the scope of due diligence should really consider all potentially material liabilities associated with current and future operations. Environmental, health and safety, labour, and community requirements are complex, and may impose strict conditions on future operations, requiring a range of controls that may be very expensive to implement. P&A helps clients identify, evaluate, and manage these operational issues.

South America is a fast-emerging region. Are we providing these services there? We are conducting a lot of this work in South America, in support of investment due diligence. Many of these countries lack a sophisticated regulatory regime, so we typically refer to international standards of care for environmental management, labour safety, and social responsibility. Our recent work in Paraguay for an international bank is testament to this. It has resulted not only in enhanced performance of the project, but also will indirectly influence the standard of care employed across the country. In many cases, we hold meetings with local regulators who are very interested in learning about a project. They are also keen to know about the performance standards being employed and the opportunities to develop the local level of knowledge and capabilities.
