WORK SESSION Overnight Parking – Commercial Vehicles There was a discussion about the weight of commercial vehicles and what should be allowed in driveways overnight. Supervisor Hay stated that according the NYS Motor Vehicle Bureau, anything over 5,500 lbs is considered commercial. He showed a picture of a popular four seat pickup truck that weights about 9,200 lbs. The 5,000 lb weight needs to be changed and made more reasonable. Supervisor Hay stated that the Building Inspector recommended 12,500 lbs. Supervisor Hay agreed but the consensus of the rest of the Board was 10,000 lbs. A Public Hearing will be scheduled for July 25, 2013. Opportunity Park Supervisor Hay stated that there is a lot of misinformation being spread around about Opportunity Park. The idea was first presented to the Town through the recreation department in 2010, but nothing was brought forward until recently. Opportunity Park is a project relating to a recreational complex that is currently in front of the Planning Board. That is where all questions and comments should be directed. The meeting schedules and agendas are posted in the Town Offices and the website, and will go out to you by email if you sign up on the website. It is in the Planning stages and all comments by the public are welcome. The residents of Fieldstone Pond have a few concerns, the biggest being the proposed soccer field. They would like to communicate this to the Planning Department and will leave their email information with the Supervisor to be notified if it comes before the Town Board.

RESOLUTION NO. 52 / 2013 AUTHORIZE EXPENDITURE TO PURCHASE VAC-ALL TRUCK TO BE REIMBURSED UTILIZING “WQIP” FUNDS

INTRODUCED BY: Supervisor Hay SECONDED BY: Councilman Alvarez WHEREAS, on May 1, 2013, the Putnam County Legislature by Resolution #100 of 2013 approved the use of Putnam County’s East of Hudson Water Quality Investment Program Funds (“WQIP Funds”) for the purchase of a Vac-All Truck for the Town of Southeast for a sum not to exceed $260,000.00; and WHEREAS, prior to the expenditure of WQIP funds, Putnam County is required to notify all interested parties to the New York City Watershed Memorandum of Agreement (“Interested Parties”) regarding the use of the WQIP funds for the purchase of a Vac-All Truck for the Town of Southeast; and WHEREAS, provided that there is no substantial objection from Interested Parties to the purchase of a Vac-All Truck for the Town of Southeast, to qualify for reimbursement by the County, the Town of Southeast must first purchase the vehicle with its own funds, and upon receipt of proof of such expenditure by Putnam County, Putnam County will reimburse the Town of Southeast with WQIP funds. NOW, THEREFORE, BE IT RESOLVED, that once the Town of Southeast receives official notice from Putnam County that there was no substantial objection by Interested Parties to the purchase of the Vac-All Truck for the Town of Southeast, such notification will be forwarded to the Southeast Superintendent of Highways by the Town Supervisor, at which time the Southeast Superintendent of Highways is hereby authorized to expend Town funds to purchase the Vac-All Truck, at a cost not to exceed TWO HUNDRED SIXTY THOUSAND ($260,000.00) dollars which is the maximum amount to be reimbursed by Putnam County, and be it further RESOLVED, that if the Southeast Superintendent of Highways requires any addition funds above the amount allotted, he will need further authorization by the Town Board to make such expenditure. INTRODUCED BY: Supervisor Hay SECONDED BY: Councilwoman Hudak WHEREAS, the Town Board of the Town of Southeast is proposing improvements to the existing Little League ball fields at the Town owned Volunteer Park, located at 67 Zimmer Road, in the Town of Southeast; and WHEREAS, the proposed project involves the relocation and installation of new fencing around the existing Little League ball fields, and installation of a new building pad for a bathroom, concessions and storage building, as well as utility connections to that building; and WHEREAS, the project site is approximately 4 acres, including the existing ball fields and parking area and the total disturbance is approximately 0.25 acres; and WHEREAS, pursuant to §617.6(b)(3) of the State Environmental Quality Review Act (SEQRA), the aforementioned information must be mailed to all involved agencies notifying them that a Lead Agency must be agreed upon within thirty (30) calendar days of the date that the aforementioned information is mailed to involved agencies, and NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Southeast hereby authorizes the mailing to all Involved Agencies of the aforementioned information, together with Notice that the Town Board of the Town of Southeast intends to declare itself Lead Agency for purposes of SEQRA for this Unlisted and Coordinated Action, unless objection to such designation is received within thirty (30) days.

/ 2013 NOTICE OF CLAIM DESIGNATION OF SECRETARY OF STATE

INTRODUCED BY: Supervisor Hay SECONDED BY: Councilman Cullen WHEREAS, General Municipal Law, §53 requires towns to file a certificate with the Secretary of State as an agent for service of a notice of claim; and WHEREAS, General Municipal Law, §53 requires the certificate to include the applicable time limit for filing the notice of claim and the name, post office address and electronic mail address, if available, of an officer or other person for the transmittal of notices of claim served upon the Secretary of State as the town’s agent; and WHEREAS, pursuant to General Municipal Law, §50-e(1)(a), the applicable time limit for the filing of a notice of claim with a town is 90 days after the claim arises, or in the case of a wrongful death action, 90 days from the appointment of a representative of the decedent’s estate. NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Southeast, County of Putnam, designates Michele Stancati, in her capacity as Town Clerk of the Town of Southeast, to receive notices of claims served upon the Secretary of State by mail at Town Hall, 1360 Route 22, Brewster, NY 10509 and email at [email protected]; and be it further RESOLVED, that the Town Board hereby directs the Town Clerk to file the required certificate with the Secretary of State informing him or her of the Town’s designation and applicable time limitation for filing notice of claim with the Town on or before July 14, 2013. SPRINGHOUSE ELECTRICAL BID Supervisor Hay made a motion to waive the rules and add the Springhouse Electrical Bid to the Agenda. Councilman Alvarez seconded. All in favor. Supervisor Hay made a motion to award the Springhouse Electrical Bid to Black Electric in the amount of $142,000.00. Councilman Alvarez seconded. All in favor.

SUPERVISOR’S REPORT Supervisor Hay reported that everything is going well and within budget. The report is attached at the end of the minutes.

PUBLIC COMMENT

Stuart Arbeit stated that a current business owner in the Town should have been on the Comprehensive Plan Committee and also on the sign committee. He suggested that in the future there be someone from the community directly being affected by change on the Board. He also felt that 5% outside storage isn’t enough

for business. Councilwoman Eckardt stated that the business owners were represented by Mr. Joiner from the Chamber of Commerce, and that the residents and business owners have more input than the committee.

TOWN BOARD COMMENT Councilman Cullen reminded the Public that there will be fireworks on the 4th of July up at Independent Way. Everyone can park in the DeCicco, Kohls, Home Depot or Applebee’s parking lots to view the fireworks. They will begin at 9:30 PM. Councilwoman Eckardt made a motion to close the meeting and Councilman Alvarez seconded. All in favor.
