Rancho San Joaquin Homeowners Association Rules and Regulations Page 1 RULES AND REGULATIONS SECTION I – PARKING RULES 1. Authority Generally, the following Association Rules are promulgated for the purpose of safety, for the preservation of the aesthetic values of the development and community, and for the enjoyment and benefit of the Association members and their guests. These Association rules are adopted pursuant to Article VI, Section 2 and Articles XI, Section 5, 11 and 13 of the Declaration and Article V, Section 1 (1) of the By-Laws of the Association. 2. Meaning of Terms Except as may be otherwise expressly provided herein, the capitalized terms in these Association Rules shall have the same meanings as set forth in the Declaration. 3. Private Streets With the exception of San Joaquin, all streets contained within the boundaries of the Rancho San Joaquin planned development are private. San Joaquin is a public street and is subject to the California Vehicle Code as well as to the ordinances of the City of Irvine. The private streets are subject to the recorded Declaration of Covenants, Conditions and Restrictions for Rancho San Joaquin (“Declaration”) the California Vehicle Code as incorporated in Article XI, Section 13 of the Declaration, as well as to the following Association Rules. A.

GARAGE AND CARPORT USE 1. Parking Families with one or two vehicles shall keep their vehicles parked within their garage and/or carport at all times when not in use. Additional vehicles, if any, must be parked without violation or the Declaration or any of the Association rules. 2. Street Parking Limits No vehicle may be parked on the private streets of Rancho San Joaquin for a period of more than 96 hours without a permit. Movement of the vehicle to avoid penalty will not suffice. 3. Guest Parking These sections are reserved for non-resident guests only, and parking is limited to 96 hours in any seven (7) day period. 4. Storage in Garages Garages may not be used for storage to the extent that the maximum designed parking space of the garage cannot be utilized to accommodate the vehicles of persons residing in the corresponding unit. 5. Carport Storage Storage is not permitted in the carport.

VEHICLE PARKING RESTRICTIONS 1. Driveways a. No parking is permitted at anytime on any common area or shared driveway. b. Parking is permitted on individual driveways only where the parked vehicle does not extend over a common or shared driveway or over a street. 2. No Parking Area No parking is permitted at anytime in front of mailboxes, fire hydrants or curbs, which are painted red. 3. Trailers, Recreational and Commercial Vehicles No trailer, camper, boat, motor home, commercial or similar vehicle or bulky or unsightly equipment shall be permitted to remain upon the Development unless placed or maintained within an enclosed garage, nor permitted to be parked other than temporarily on any street, alley, Development common area, or common area within the Development. Temporary parking shall mean the parking for a responsible amount of time (up to 24 hours), of vehicles belonging to guests, delivery trucks, service vehicles and other commercial vehicles used in the furnishing or services to the association or the members, and parking of vehicles belonging to or being used by members for loading and unloading purposes.

ENFORCEMENT 1. Removal of Vehicles a.

All vehicles or other equipment parked or stored in violation to these rules will be subject to tow-away removal or such other action by the Board, as it may deem necessary. All costs incurred in the removal of such vehicles and equipment, including but not limited to towing and storage expenses and attorney’s fees, if applicable, will be charged to the owner of the unauthorized vehicle involved.

The Association, acting through the Board, reserves the right to issue citations or other warnings when appropriate, but the assurance of such warnings shall not affect the validity of these Association rules and shall not constitute a condition precedent to the removal of any vehicle parked, stored, or maintained in violation thereof.

SECTION II – GENERAL RULES 1. Balconies and Patios No storage is permitted on balconies or patios, except appropriate patio furniture. (No bicycles or woodpiles are permitted). Trees, bushes and plants may be kept on the patios in appropriate containers and on balconies, decks and entryways only in containers raised from the surface to prevent water damage. No plants are permitted on the wooden railings of entryways, landings, decks or balconies of stacked units, and are permitted on other railings only with containers raised from the surface to prevent water damage.

Rancho San Joaquin Homeowners Association Rules & Regulations Page 3 2. Garage Doors Garage doors are to be kept closed at all times, except when entering or exiting. 3. Antennas Exterior TV and satellite antennas are permitted only with the authorization and approval of the Architectural Committee. 4. Architectural No additions or modifications of any kind may be made to the buildings and other common areas unless prior authorization is obtained from the Association’s Architectural Committee and necessary City permits obtained as required. Air Conditioners Awnings, Exterior shades and window coverings Deck coverings and modifications Driveways Exterior Lights (including Security Lights)

Garage Doors Gates Outdoor Spas Replacement Doors or Windows Skylights Screen Doors Trellises, Arbors, etc.

5. Signs No signs or billboards are permitted within the Development except as authorized for the sale or lease of a unit. (Contact the Management Company to purchase an authorized sign). 6. Animals Every dog must be on a leash at all times when in the common area. Owners are responsible to clean up immediately after their pets. Only dogs and cats and other household pets are permitted in the association. 7. Noise No obnoxious activity, excessively loud noise and other sounds, such as business or trade activity, stereos, animals, etc. are permitted in the Development. 8. Garage Sales Garage sales and other commercial activities are not permitted in the Development. SECTION III – POOL RULES 1. Pool Hours Sunday through Thursday Friday and Saturday 2. No Lifeguard is on duty.

Rancho San Joaquin Homeowners Association Rules & Regulations Page 4 3. No pets are allowed in pool or spa area. 4. No glassware is allowed in the pool area. 5. No surf mats, surfboards, or Styrofoam floats are allowed in the pool or spa. 6. Pool is reserved for use by owners, tenants and invited guests only. 7. Please keep gate closed at all times. 8. No children under the age of 14 permitted in the pool area without an adult. 9. Any activity creating undue noise, such as yelling or loud radios, is prohibited. SECTION IV – LANDSCAPE 1. The Association is responsible for maintenance-grass cutting, trimming, fertilizing, watering etc. and all landscape elements in the common area of the Development. 2. Owners are responsible for any plantings in the exclusive use common areas of their units. 3. An owner wishing to have special plant materials in the common area immediately adjacent to their exclusive use common area may request authorization from the Landscape Committee of the Association, providing the committee with details of the plants to be installed etc. Of the committee approved, the owner must agree to maintain the new planting and must mark the area with an indicator specified by the committee so that the contract landscaper will not maintain. 4. An owner may add supplemental irrigation systems for planting in their exclusive use common areas, whether the added system is attached to the Association system or is separate. An owner desiring such as supplemental system must obtain authorization by the Landscape Committee of the Association, providing the committee with details or the type of irrigation proposed and must assume responsibility for the maintenance of the are irrigated and for any part of the common are affected by the supplemental irrigation. SECTION V – ENFORCEMENT 1. First Offense – Warning Letter 2. Second Offense – Hearing before the Board, Fine of $100.00, plus legal fees, if applicable or the Board may choose to fine the homeowner $25.00 per day maximum for each day the violation exists. 3. Third Offense – Fine of $200.00, plus legal fees, if applicable. 4. Continuing Offense – Fine of $100.00 times the number of offenses.

Note: Any fines not paid will result in a lien being filed against the property and legal action to gain compliance.
