Policy Guidelines

I.

Respect the Plan With respect to individually assigned spaces, enforcement shall be based upon the reliance of each resident to be a "good neighbor Residents are expected to respect the spaces assigned for use by other residents. ft



2.

Notify Your Guests All residents are responsible for notifying their guests of the parking restrictions at Franconia

Conunons. 3.

Towing. The Association reserves the right to (OW vehicles ITom Reserved or open spaces for any violation of this policy and to do so at the expense of the vehicle owner. A resident has the right to tow an unauthorized vehicle from their Reserved space. Residents

are hereby advised, however, that lhey assume all responsibility associated with towing a vehicle inappropriately. The resident is fully responsible for:



Calling the tow company and making all arrangements with the tow company, including signing the impound slip.



Notifying me local police (Section 46.1-551 of the Virginia Code requires that the local police department be notified before a vehicle is removed from private property by towing).



Providing verification, if requested, of your aumority to tow .



Most importantly, assuming all liability in connection with removal of the vehicle.

4.

Towing Information The only tow company which may be used is the contractor that is provided by the Association. The telephone number for the contractor currently retained by the Association will be posted on signs within the conununity.

5.

Courses of Action The violations for which an owner or resident may tow are restricted by paragraph V(C)(I) of the policy resolution. Other violations should be reported to the management company at the address given above. When reponing any violation of the Parking Policy. be prepared (0 provide, at a minimum, your name, address, and phone number along with the make/model, license plate number and location of the vehicle and the nature of the infraction. Specific courses of action for some conunon violations are as follows:

A vehicle is obstructing andior parked in your Reserved parking space.

You may contact the management company or you may follow the steps outlined above for calling a towing company and having the vehicle removed. You assume all liability in connection with removal of the vehicle.

A vehicle is parked in a fire lane.

You notice a commercial vehicle routinely parked overnight in the community.

Call the management company with the name of the company the vehicle belongs to and other required information.

TITLE II.

PETS

§ 02.01 In accordance wilb Fairfax County ordinances, dogs are not permitted to be wi1hout leash when off Ibe pt operty of Ibeir owners. Excessive and continuous noise from a pet will not be allowed and should be constrained. § 03.01 No repair or maintenance of vehicles in Ibe streets, parking areas, or olber common areas resulting in extended work, dismantling, disturbance, or cluttering will

be allowed. The owner of Ibe car will be held responstble for any damage or spillage caused by repairs Ibereto. § 03.02 The washing of vehicles in Ibe parking areas will be pennitted provided all residual trash is removed and all soapsuds are washed down street drains. § 03.03 A speed limit of 10 m.p.h. should be observed wilhin Ibe paIking areas and courtyards . .

§ 03.04 As a safety consideration, playing in Ibe streets is discouraged. § 03.05 No trash or refuse, including tree or shrubbery cuttings, will be dumped on the common areas. § 03.06 No motor-driven vehicles will be driven upon Ibe grassy portions oflbe common areas. § 03.07 Generally, digging, planting, or olber a1teration oflbe common areas, campfires, and barbecues are proluDited. Exceptions will be pemritted only by written

authorization of the Board of Directors or appropriate committee. § 03.08 Bicycles, tricycles, wagons, carts, and olber playthings should be removed from walkways and other common areas during all hoW"S of darkness or when not muse.

TITLE IV. MAINTAINING OR PERMIITING A NUISANCE § 04.01 GENERAL § 04.01.01 Noise - Loud automobiles, motorcycles, or other vehicles will not be permitted on the streets and common areas of the community. Laud parries. music, or other noise should be avoided. The Fairfax County noise ordinance must be observed at all times. (Hour of II :00 p.m.). § 04.01.02 Vehicles - No unlicensed,. inoperable, abandoned, or junked vehicles will be permitted on the streets. parking or common areas. § 04.01.03 Trash .-\ccumulation - Substances which generate obnoxious or offensive odors should be removed rrom the resident's property or enclosed within a suitable container as soon as possible. Trash, refuse. garbage, or rubbish will not be allowed to accumulate or remain outside a proper container upon the homeowners property. § 04.01.04 Trash Pickup - Trash containers, except plastic bags, will nOt be put out for collection earlier than the evening before collection day. Trash in plastic bag will only be put out the moming of collection.

§ 04.01.05 Pests - Homeowner's property mUSt be kept free of rats, roaches, mice, termites or other vennin. § 04.01.06 Yard Sales - Once or twice each year, as determined by resident interest, a group yard sale will be conducted in one of the common areas of Franconia Commons. This event is for all Franconia Commons residents participation. Other individual or group yard sales. moving sales ('If similar activities and the advertising or promotion of such activities are prohibited within Franconia Commons. § 04.02 ENFORCEMENT § 04.02 Violations of any of the above provisions should be reported to a member of the Board of Directo~ or managing agent. The Board will take the necessary and appropriate action to insure compliance with these provisions. Such action may include, but is not limited to:

TIILE V.

"!RASH GUIDELlNFS

§ 05.01 GENERAL § 05.01 The Association maintains a contract for the collection and removal of trash to promote a safe, sanitary and attractive community. In addition. a recyCling program mandated by Fairfax County is now in effect The county may change the schedule for the collection of recycled materials from time to time, of which residents will be informed in a timely manner. Residents are urged to contact Fairfax Cowny directly for further information. § 05.02 TRASH COLLECTION Monday and Thursday

§ 05.02.01 Refuse will be collected by the contractor every Tuesday and Friday. including all holidays except Christmas, unless conditions beyond the control of the contractor should exist, such as impassable streets, prevention of access to the community, mechanical breakdowns. etc. In the event of impassable streets/prevention of access to the community, trash will be removed on the next regularly scheduled day. § 05.02.02 Trash containers may be placed at curbside no earlier than 6:00 p.m. on the evening before, and no later than 7:30 a.m. on the day of collection. NOTE: Plastic bags may not be placed at curbside earlier than the morning of collection. § 05.02 03 Refuse shall be collected at curbside. All trash will be placed in covered garbage cans with handles, weighing less that 30 pounds, or in tied, dark-colored plastic bags. White plastic is not acceptable (white plastic tends to attract the attention of birds and other scavengers which can result in trash being strewn throughout the community). § 05.02.04 Brush and limbs will be collected at curbside when securely bundled.

§ OS.Q3.01 Newspapers

§ OS.Q3.01 All newspapers must be bundled securely with twine or placed in PAPER bags. The contractor will not accept newspapers stored in plastic bags. Newspapers are Monday collected on Friday mornings, and must be placed at curbside no earlier than 6:00 p.m. on the evening before, or before 7:30 :un. on the day of collection. § OS.03.02 Glass and Metal § 05.03.02 Glass and Metal may be intermixed in the recycling receptacle and placed at curbside after 6:00 p.m. on the evening before, or before 7:30 a.m.on the day of collection.

§ OS.Q3.Q3 Other Materials § 05.03.03 At present. only glass, metal and newspapers are mandated as recyclable materials in Franconia Commons; however, other materials may be added from time to time. Residents will be notified by the Association of changes in the list of recyclable materials and/or colleenon schedules; however, they may check with property management if they have any questlons. § OS.04 TRASH CONTAINERS § 05.04.01 Covered., plastic trash cans with handles are the most widely used., acceptable trash container. Trash containers may be of any size, but should not weigh in excess of 30 pounds when full. § 05.04.02 All trash containers and recycling: recepucles must be picked up by residents for storage within their fenced-in back yards on the same day as collection. The storage of trash containers and/or recycling receptacles in front or sid,e yards or outside rear fences on Commons property is strictly prohibited.

§ OS.04.03 In general, heavy-weight, dark-colored plastic trash bags are acceptable but may be placed at curbside only on the morning of the day of collection. White plastic bags are not acceptable as they attract birds and other scavengers that could SC3.ner the refuse about the community, § OS .OS SPECIAL TRASH PICK UPS

§ 05.05.01 Appliances., furniture. paint or solvent containers, etc., will be picked up free of charge when prearranged. to the specifications and scheduling of the contractor. Please indicate to the conttac:tor if paint and solvent containers are a part of your trash. as these are classified. as hazardous waste and require special handling. 8

§ 05.05.02 Fences and remodeling debris are excluded from the free service. Costs of pick up for these items will be negotiated separately by the individual homeowner/tenant and contractor. § 05.05.03 Christmas trees. A notice will be circulated within the community providing the date that Christmas trees will be picked up. Fairfax County controls the

collection process, thus, our trash. contractor must abide by the County's schedule. § 05.06 ENFORCEMENT

§ 05.06.01 Any method practical andlor feasible to identify offending resident will be utilized to enforce the trash guidelines. § 05.06.02 A Warning Notice will be issued to first time offender.; for the following violations: -Trash containers and/or recycling receptacles located in from or side yards or outSide rear fence on Commons grounds. -Trashlrecyciables not in proper container. -Trashlrecyclables put out more than 12 ho'urs earlier than regularly scheduledpick.ups. -Trash/refuse or grasS/shrubbery cuttings dumped on common grounds. -This Norice 'Nill be kept on file by property management. All subsequent violations will be subject to an assessment of S50 per occurrence and added to the regular quarterly assessment of the non-complying Association member. § 05.06.03 Special pickups on non-scheduled trash/recycle days cost the association S50 for each occurrence. These costs will be passed through and added to the quarterly assessment of the violating homeowner/member, together with a copy of the contractor's bill for the service. § 05.06.04 Absentee homeowners are responsible for all assessments and are required to inform. their lessee/tenants of the trash guidelines, and all other Franconia Commons Homeowners Association Rules and Regulations.

FRANCONIA COMMONS SWIMMING POOL RULES AND REGULATIONS (Revised May 28, 20112012) The following Rules and Regulations for use of the Franconia Commons swimming pool shall supersede any and all previous Rules and Regulations:

I.

RIGHT TO USE POOL

1.

All unit owners (or their designated tenants) are entitled to use the swimming pool facility. This privilege may be suspended by the Board of Directors for owners who are delinquent in their assessment payments for thirty (30) days. Unit owners who lease their unit must designate, in writing, using a form authorized by the Association, those tenants living in the unit who are entitled to use the community facilities, including the swimming pool. A unit owner who leases his unit is not entitled to use of these community facilities.

2.

A pool pass will be issued to all unit owners, members of their families residing in the unit, and to the designated tenants of unit owners. Only those persons with a valid pool pass shall be entitled to use the swimming pool. Pool passes will be issued or validated on an annual basis prior to the beginning of the swimming season.

3.

Guests of Franconia Commons owners must be escorted by a person with a valid pool pass who is seventeen (17) years of age or older. Guests will not be admitted to the pool without such an escort. The person with a valid pool pass will remain with the guests at all times. The conduct of the guests is the responsibility of the escort.

4.

Pool passes are the property of the Association and are for the exclusive use of the residents of Franconia Commons. The passes are not transferable and may be suspended by the Association for violations of the Association's legal documents or rules and regulations.

5.

All unit owners may be held liable for their family, tenants, or guests. Guests are limited to two (2) guests per household. Any user of the pool facility, property, equipment, etc. responsible for destruction or damage to said property will (or their parents, if minors) be held responsible for replacement and/or repair of any and all damage as deemed appropriate by the Franconia Commons Homeowners Association.

6.

All persons with a valid pool pass will be asked to sign in upon arrival at the guard station and present their pool pass to the lifeguards for verification. II.

RULES FOR USE OF THE FRANCONIA COMMONS POOL

General

1.

The Association is represented by the managers and lifeguards who have been instructed in the rules of the pool. Any conflicts shall be addressed with the pool manager, or assistant manager, who will bring the issue to the Association if it cannot be satisfactorily resolved .

2.

Certified lifeguards will be on duty at all times that the pool is open. They have the authority to use their discretion to enforce the rules to maintain a safe and healthy environment. The manager is in charge of the pool and is there for the protection of persons using the pool. The manager has the authority to ask anyone to leave the pool area for infractions of the rules or when safety is threatened.

3.

At least one lifeguard assigned to the Franconia Commons pool shall remain on the lifeguard stands at all times during regular pool operations hours.

4.

Safety is of primary concern to the Association and its members. All persons using the pool do so at their own risk and agree to abide by the rules for the use of the facility. The Association assumes no responsibility for any accident or injury in connections with such use or for any loss or damage to personal property. Members (unit owners, tenants, and non-resident members) are responsible for the actions of their children and guests.

5.

Children under thirteen (U) years of age must be accompanied by a responsible person seventeen (17) of age or older while in the pool area.

Pool Operating Regulations 6.

No person shall use the pool facilities unless the pool is offiCially open and lifeguards are on duty. Unauthorized persons found inside the pool enctosure when the pool is closed will lose their privileges for the remainder of the summer and risk prosecution for trespassing.

7.

All swimmers are encouraged to take a shower using soap and water and thoroughly rinsing oft before entering the pool. (Parents are urged to instruct their children.) This will keep the water disinfected and sanitized, as well as cut down on costly chemicals. The lifeguards have the authority to restrict pool usage to those swimmers who have followed these rules and have taken showers before entering the water.

8.

Persons who have obvious infections (colds, lesions, open sores, etc.) will not be allowed in the pool.

9.

Swimmers must wear proper bathing attire (proper women's Iycra/spandex bathing suits and men's swimming trunks or briefs). No cut-ofts, blue jeans, tee shirts, shorts, or similar street attire of the type which will unravel and cause drain clogging, or hinder the life guard from proper rescue, are permitted. Additionally, street shoes are prohibited in the pool area (examples: street sandals, loafers, and tennis shoes). Since this is a family pool, appropriate attire must be worn, for example, shirts with obscene graphics are not allowed.

10.

Urination and defecation are performed in the rest room area of the bath houses and PROHIBITED in the main pool and the wading pool. Parents whose children have accidental leaks who are properly diapered and attired according to the pool rules and potty-trained will be permitted to keep their pool pass for the season. Please notify the lifeguards immediately if this happens. Persons who urinate or defecate in the main pool will be asked to leave the pool area immediately, and will have their pool pass revoked for the remainder of the pool season .

11.

Persons must stay clear of guard stations at all times and in no way distract on-duty life guards.

12.

No bicycles, roller skates, skateboards, roller blades, or other wheeled vehicles (except wheelchairs and strollers) are permitted in the pool area.

No pets (except service animals such as seeing-eye dogs with an unsighted person) are permitted in the pool area.

14.

Instructional flotation devices may be used under the direct supervision of an adult. Tubes, rafts, balls, and other objects specifically made for water use are allowed in the large pool area and in the wading pool under adult supervision and at the lifeguard's discretion. Objects not specifically made for water use which may cause injury (such as footballs, basketballs, hard balls, etc.), are not permitted in the pool area.

15.

Running, pushing, wrestling, dunking, or standing or sitting on other swimmers shoulders is prohibited, as this endangers other swimmers.

16.

Children wearing diapers must wear a swim diaper, swimsuit, and rubber pants to inhibit bacterial contamination of pool waters and/or drain-clogging from any materials.

17.

There will be a (15) minute rest period for children each hour. During this period, children must be COMPLETELY out of the pool, no dangling legs in the pool, to allow adults 18 and older to swim.

18.

The pool may be closed at the discretion of the pool manager on duty in case of thunder, lightning, rain, operational breakdown, or "unsanitary conditions."

19.

Radios in the pool area are permitted so long as they do not disturb others use and enjoyment of the pool.

20.

Obscene and/or inappropriate language or behavior will not be tolerated at the pool. Use of such language or behavior will result in immediate expulsion from the pool facility and loss of pool privileges for the remainder of the year's pool season.

21.

Swimmers shall remain clear of ladders except when entering or exiting the pool.

22.

Due to possible damage or personal injury, holding onto pool ropes is prohibited.

Smoking, Food and Beverages 23.

Smoking, chewing tobacco and chewing gum are PROHIBITED in the pool area, and in the bath houses. Smoking will be allowed outside of the pool fence area only at a designated area or areas, such as not to infringe upon the enjoyment of the pool by other bathers. Smokers are asked to keep such area{s) clean and not to leave matches or lighters unattended, as these are attractive to young children.

24.

Food or beverages are allowed in the pool area.

25.

Breakable objects, such as glass containers, are not permitted in the pool area for safety reasons.

26.

Intoxicants will not be allowed in the pool area during normal hours. Intoxicated persons will not be allowed in the pool area at any time.

27.

All refuse must be placed in containers provided for this purpose. Keeping the facility clean is everyone's responsibility.

No cut-offs, blue jeans, tee shirts, shorts, or similar street attire of the type which will unravel and cause drain clogging, or hinder the life guard from proper rescue, are permitted. Since this is a family pool, appropriate attire must be worn, for example, shirts with obscene graphics are not allowed.

Urination and defecation are performed in the rest room area of the bath houses and PROHIBITED in the main pool and the wading pool. Parents whose children have accidental leaks who are properly diapered and attired according to the pool rules and potty-trained will be permitted to keep their pool pass for the season. Please notify the lifeguards immediately if this happens. Persons who urinate or defecate in the main pool will be asked to leave the pool area immediately, and will have their pool pass revoked for the remainder of the pool season.

Persons must stay clear of guard stations at all times and in no way distract on-duty life guards.

No bicycles, roller skates, skateboards, roller blades, or other wheeled vehicles (except wheelchairs and strollers) are permitted in the pool area.

No pets (except service animals such as seeing-eye dogs with an unsighted person) are permitted in the pool area.

Instructional flotation devices may be used under the direct supervision of an adult. Tubes, balls, and other objects specifically made for water use are allowed in the large pool area and in the wading pool under adult supervision. Objects not specifically made for water use which may cause injury (such as footballs, basketballs, hard balls, etc.), are not permitted in the pool area. Baby float are permitted provided the float is within arms reach of the parent/guardian. No rafts permitted.

15.

Running, pushing, wrestling, dunking, or standing or sitting on other swimmers shoulders is prohibited, as this endangers other swimmers.

16.

Children wearing diapers must wear a swim diaper, swimsuit, and rubber pants to inhibit bacterial contamination of pool waters and/or drain-clogging from any materials.

17.

There will be a (15) minute rest period for children each hour. During this period, children must be COMPLETELY out of the pool, no dangling legs in the pool, to allow adults 18 and older to swim.

18.

The pool may be closed at the discretion of the pool manager on duty in case of thunder, lightning, rain, operational breakdown, or “unsanitary conditions.”

19.

Radios in the pool area are permitted with headphones and/or earbuds.

20.

Obscene and/or inappropriate language or behavior will not be tolerated at the pool. Use of such language or behavior will result in immediate expulsion from the pool facility and loss of pool privileges for the remainder of the year’s pool season.

21.

Swimmers shall remain clear of ladders except when entering or exiting the pool.

22.

Due to possible damage or personal injury, holding onto pool ropes is prohibited.

Smoking, Food and Beverages 23.

Smoking, chewing tobacco and chewing gum are PROHIBITED in the pool area, and in the bath houses. Smoking will be allowed outside of the pool fence area only at a designated area or areas, such as not to infringe upon the enjoyment of the pool by other bathers. Smokers are asked to keep such area(s) clean and not to leave matches or lighters unattended, as these are attractive to young children.

Food or beverages are allowed in the pool area.

25.

Breakable objects, such as glass containers, are not permitted in the pool area for safety reasons. 3

Intoxicants will not be allowed in the pool area during normal hours. Intoxicated persons will not be allowed in the pool area at any time.

27.

All refuse must be placed in containers provided for this purpose. Keeping the facility clean is everyone’s responsibility.

court. § 07.03 Residents may have guests with them. Non-players are not allowed in coun area. § 07.04 TIME LIMIT: Singles. I hour. Doubles· 1·112 hours. However. players may extend use of the coun if no other players are waiting. § 07.05 Children WIder sixteen (16) must be supervised by an adult when on the tennis courts.

§ 07.06 Play allowed only during daylight hours. § 07.07 Beginning at 6:00 p.m., courts are limited to adults (21 years or older), or play including an adult. § 07.08 TENNIS SHOES ONLY! No one is allowed on the

TII1.E VUL ARCBIIECIURAL GUIDELINES

§ 08.01 GENERAL § 08.01 The Architectural Committee of the Franconia Commons Homeowners Association is charged with the duty of preserving the aesthetic qualities of the community. These guidelines are to assist homeowners with maintaining their properties and in submitting applications for exterior changes. It is the responsibility of the non-resident homeovmer to advise their tenants of these guidelines and to ensure compliance. § 08.02 INSPECTIONS § 08.02 The Architectural Committee will periodically inspect the community. and notify the owners of any architectural violations andlor repairs that need to be made. The homeowner will then have sixty (60) days to accomplish needed repairs. Extensions of time to effect repairs may be granted on a case-by-case basis by the Architectural Committee. All extensions will be reponed, for the Recor~ to the Board. If repairs are not completed within that time, the Board may suspend Association privileges. If repairs are not completed at the end of thirty (30) more days, then the Association in 3ccordance with the Declaration of Covenants. Conditions and Restrictions will make the necessary repairs at the owner's expense. § 08.03 APPLICATION PROCEDURES FOR ARCHITECTh1tAL CHANGES

§ 08.03 Applications must be made in writing to property management for the Committee's review and approvaL The application should include a complete description of the proposed change or project. Upon receipt and full clarification of the applic3rion, the Committee is obligated to review within thirty (30) days and inform the applicant of its decision promptly thereafter. § 08.04 REAPPLICATION § 08.04 If an application is denied for any reason, the applicant may reapply to the Committee, through property management,. for reconsideration; however. the reapplication must be made in writing to the Committee, through property management,. within seven (7) days of receipt of notice of denial. The Committee is then obligated to act upon the reapplication within seven (7) days of its receipt

The Board will rule within thirty (30). days and notify the applicant of its decision. § 08.06 LANDSCAPING A.c'ID PLANTING § 08.06 Generally, landscaping aod planting do not requite the approval nf the Committee if it is compatible with the existing l~dscape and surrounding. No climbing plants or ivy will be allowed on the outside of buildings and chimney or on the Commons side of fences. § 08.07 WALKWAYS § 08.07 Walkways require committee approval. Asphalt and mvel walkwavs are not

acceptable. Brick. natural concrete or slate walkways are generally acceptable, depending upon location and size. Painted or covered concrete is not acceptable. § 08.08 TREES, HEDGES AND SHRUBS

§ 08.08.01 Trimming. and mulching of trees, hedges md shrubs 'Within the boundary of homeowner's lot are the responsibility of the homeowner. § 08.08.02 Trees, hedges and shrubs on homeowner's property which restrict sight

lines for pedestrian and/or vehicular traffic shall be cut back or removed. Trees, shrubs, hedges or plantings which protrude through or over fences in an obstructive or unsightly manner onto adjacent property, to include the Commons, are not permitted and shall be CUt back and maintained by the owner. Dead shrubs or trees shall be removed by the owner. § 08.08.03 the resident.

§ 08.09 ALTER.;"TIONS, ADDmONS AND DETACHED STRUCTIJRES

§ 08.09.01 Any addition to an existing building, any exterior alteration. modification or change to an existing building, or any new detached structure must have the approval of the Comminee before any work is undertaken. Examples of such projects include fireplace, storage shed in backyard or change of trim and shutter colors, § 08.09.02 Any addition. exterior alteration, modification or change to an existing building shall be compatible with the design character of the original building. Any new detached structure shall be compatible with the parent struc:ture.

§ 08.09.03 Approval of a project by the Committee does not relieve the owner from

obtaining building permits from the county. § 08.10 MATERIALS AND COLOR.

§ 08.10.01 Only the exterior materials existing on the parent structure or compatible with the architectural design character of the community Vlill be approved: Painted aluminum or vinyl coverings may be used for wood window aim, door trim and roof trim. § 08.10.02 Exterior color changes will be approved only if the proposed color is similar to the colors originally employed in the community. For all but China Grove Court, Martin-Senour Williamsburg exterior paints are the official colors. For China Grove Court, McCormick Colonial Exterior paints are the official colors. Contact the managing agent or a comminee member for assistance with approved colors. § 08.10.03 In general, only those areas that are painted may be repainted; only those areas that are stained may be restained; unpainted surfaces such as brick and narur31 concrete shall remain unpainted.. uncovered. and unstained. § 08.10.04 All exterior painted surfaces mUSt be properly maintained. Tnis includes all trim and shutters - front, sides, and back. Swfaces should be scraped. cleaned. caulked.. and primed as necessary. Painting is required when surfaces begin to peel or fade. Protective covering or capping of wood surfaces may be used as long as original design is maintained.. § 08.11

STOR.'.f DOORS k'ID WINDOWS

§ 08.11

Storm doors shall be painted to match the existing door or to match the predominant trim color of the house. Unpalnted aluminum or white doors are not acceptable. Grill work motif storm doors are acceptable. Painted storm Vlindows are acceptable only if painted to match or harmonize with the predominant mm color. Replacement windows may be installed, may be of metal or vinyl design but must have window panes matching the original window configuration. These windows may be white in color. § 08.12

ATTIC F k'!S AND CHIMNEYS

§ 08.12 Attic fans and metal chimneys shall be the standard a1uminwn finish or painted flat black: or to match the existing roof and stack colors. They shall be located to the rear of the roof beam and if possible, shall not be visible at ground level from the front of the house. § 08.13

AWNINGS AND ARBORS

§ 08.13 Awnings are generally not acceptable; however, semipennanent awnings made of canvas or canvas-like material will be considered by the Committee, Aluminum awnings are not acceptable. Colqr of the awning material, design of the support structure, size, location and public exposuie will be taken into consideration and will be grounds for approval or denial. Wooden arbors are generally acceptable; however, size, location, design and public exposure will be taken into consideration and will be grounds for approval or denial. . . § OS.14

SEEDS.

Numbers will not be displayed on front doors or storm doors. Numbers may be displayed by end unit owners on the side of the residenc~ which faces the court parking lot or Street.

§ 08.15.03 Exterior antennas are nOt permined to be visible from the Commons areas. § 08.15.04 Cable for cable TV. etc., must be beige in color; black is not permined. Cables are not pennitted to run over the top of roofs to enter into the residence. § 08.15.05 Exterior lighting shall not be directed in such a manner as to create an annoyance to neighbors.

§ 08.15.06 Trash and garbage containers may not be kept in front or side of houses or outside fenced yards except as allowed in the Association's Rules and Regulations. § 08.15.07 Storage of fire wood shall be restricted to rear yards and may not be stored on the Commons grounds. § OS.16 RETAINING WAILS § 08.16.01 Approval - An.y retaining wall must be approved by the Comminee before 17

installation is initiated.

§ 08.16.02 Restriotions - Retaining walls whicll divert ground water onro adjoining properties or which otherwise subStantially change the existing drainage panems will not be approved. _ § 08.17 FENCES, SCREENS AND WALLS § 08.17.01 Any fence. screen or wall above grade must have the approval of the committee before installation is undertaken. § 08.17.02 No fence. wallar screen will be approved if its installation will obstruct sightlines for vehicular traffic.

§ 08.17.03 Any fence. wall or screen must be consistent with the existing architectural character of the community. § 08.17.04 Broken or fallen fences must be repaired or replaced with lDpe3.r:mce identical to the original.

§ 08.17.05 Fences. walls and screens must confonn with the architectural design of Franconia. § 08.17.06 Chain link. galvanized. or other metal fencing 3.I'e not permitted.. § 08.17.07 Walls above grade should be constructed of natural stone, masonry or attractive lumber.

§ 08.18

REAL ESTATE SIGNS

§ 08.18.01 Signs relating to real estate transactions by agents or by OVlYlers shall be displayed only as provided for below: § 08.18.02 There shall be no more than one sign on a lOL § 08.18.03 The sign on lot shall be no larger than four square feet in 3.tea. nor exceed six feet in heighL § 08.18.04 All signs shall be removed within seven (7) days of settlement or leasing of the property.

Each real estate company or owner shall place only one directional sign at each entrance of Flat Rock Road. There shall be no additional directional signs other than o·pen house signs placed within the confines of Franconia Commons.

§ 08.18.07 Open house signs are permitted on the day of showing and shall be removed prompdy at the conclusion of showing. Up to three additional open house signs are allowed within the confines of Franconia Commons.

FRANCONIA COMMONS HOMEOWNERS ASSOCIATION SATELLITE ANTENNAS

I. Covenants superseded: The Federal Telecommunications Act of 1996 contains provisions that Yoid

cenain franconia Commons covenants prohibiting antennas. n. Antenna Size and Type a. Antennas that art designed to receive direct broadcast satellite service (DBS) or multi point distribution senices (MDS) that are one meter (39 inches) or less in diameter are permitted. Larger antennas are prohibited.

b. Antennas designed to receive television broadcast signals. regardless of size, may be installed. C. All other antennas not covered by the FCC rule. including tr.uLml.ission only antennas.. are prohibited.

Ill. Location a. Antennas shall be installed solely on indi,,;dually owned property as designated on the

recorded deed The shall not encroach on common areas or any other owner's property. b. If acceptable quality signals may be received by placing antennas inside a dwelling, without unreasonable delay or unreasonable cost increase. then owdoor installation may be prolubited. c. Tenants may install antennas in accordance with these rules and with \\onnen pennission of the homeowner. A copy of this pennission must be furnished with the notification statement.

VITI. No Additional Regulation by tbe Association: Antennas that meet the requirements ohhis section may not be further regulated by the Association as to type or placement. Residents are encouraged to use care in the selection and placement of antennas to preserve the appearance srandards and natur.ll character of Franconia Commons.
