EXHIBIT "E" HEATHERWOOD HOMEOWNERS' ASSOCIATION, INCORPORATED RULES AND REGULATIONS

A. Pets – THIS RULE IS A PROTECTIVE COVENANT All pets shall be walked on a leash at all times. Any animal outside any unit must be leashed and at no time shall it create a nuisance of any kind. Animal owners should exercise common courtesy and avoid walking their pets within close proximity of people or other pets or animals. 1. All dogs shall be attended by the owner or owner’s representative and kept on a leash. 2. All dogs shall wear a visible Washington Township registration tag when outside of pet owner's residence. Any dog found unattended without a tag will be turned over to the Washington Township Dog Catcher. 3. Pet owners shall not walk or allow their pets on other homeowners’ properties. 4. Pet owners shall not allow their pets to defecate or urinate on other homeowners’ properties. 5. Pet owners shall not allow their pets to defecate or urinate in the grass area between the curb and the sidewalks. 6. Pet owners are responsible to clean-up their pet’s defecation on owner’s property and all Heatherwood’s common grounds. Dog owners are responsible for adhering to the ordinances of Washington Township regarding care and walking of pets. B. Trash – THIS RULE IS A PROTECTIVE COVENANT 1. All trash shall be placed in a sealed trash can (before being placed at curbside). This will help eliminate odors and avoid any possible disturbance from animals and further avoid loose trash from blowing throughout the community. Any excess trash shall be placed in heavy duty tie bags. Exception: Recyclable cans are uncovered.

2. All trash containers shall be stored inside a dwelling. At no time may storage containers be stored outside of a dwelling. 3. In accordance with Township ordinances trash shall not be placed at the curb before 6 p.m. on the day preceding trash pickup. Excess trash in heavy duty tie bags can only be placed at the curb on the day of trash pickup. 4. Be aware that holidays generally delay trash pickup by one day.

C. Nuisances and Noise – THIS RULE IS A PROTECTIVE COVENANT At no time shall any member or any member’s guests use any object that creates noise, smoke, odor, soot, or vibrations in such manner as to disturb any other member or lawful user of the common properties, nor shall they have any signs, banners, pennants, flashing lights, wires, clothes, or any other unsightly object beyond the interior walls of any dwelling so that they are in any way visible from the outside. D.

Flags 1. Large decorative flags, other than the traditional American Flag, are prohibited. American Flags shall be of a size no larger than 3 ft by 5 ft. 2. Small decorative flags/banners/plaques (not to exceed 24” by 24”), as part of the total allowed ornaments, are permitted in front or side flower beds.

Common Properties 1. No member shall place trash, garbage, or excess materials of any kind on or about the common properties, nor burn, chop, or cut anything on the common properties. 2. Common property shall not be used for the storage of any homeowner’s personal possessions. 3. Common property shall not be altered in any way by any homeowner. Plantings, namely trees and shrubs, will be considered for approval by the Board of Trustees. Applications are to be sent to ARB.

Firewood

All firewood kept outside shall be neatly stacked or stored in ring or holder on rear patios only. Homes that do not have patios shall store firewood closest to rear wall near door. Firewood must be on a platform, i.e., pavers. G.

Hoses

Hoses shall be placed on a holder when not in use. Holders can be plastic/vinyl, wood, or wrought iron. All colors are acceptable. Holder may be a stand-alone or attached to the side of the house. Height for post is not to exceed 4 feet. Decorative containers are permitted. Holders or containers shall be stored on a platform, i.e, pavers or bricks, or in flowerbed; not on the grass.

I. Mailbox and Mailposts 1. Replacement mailboxes and mailbox posts shall conform to the original style and color. Mailbox posts maybe white wood or white vinyl. 2. Ornaments, stickers, ribbons, planters, etc., are not permitted on the mailbox or mail-post. 3.

Decorative mailbox covers are permitted.

4. If you choose not to protect your mailbox post i.e., edging around base of mailbox post, you do so at your own risk. Heatherwood’s Landscaping Company is not responsible for any damage that may occur as a result of weed whacking. J.

Use of Dwelling – THIS RULE IS A PROTECTIVE COVENANT

No residence shall be used to conduct business or be the location of any commercial enterprise(s). No business or trade shall be permitted upon any lot. Yard sales are permitted and shall be in compliance with Township guidance. K. Signs – THIS RULE IS A PROTECTIVE COVENANT 1. One unlighted sign advertising a property for sale may be placed inside a window provided it does not exceed 30 inches by 48 inches overall. 2. One “For Sale” sign (not to exceed 24” by 24”) advertising a property for sale is permitted on front lawn.

3. Open house signs are permitted only on the day of the open house. Sign shall be removed within two (2) hours after the open house is closed. 4. One Political sign (not to exceed 24” by 24”) is permitted in front yard. Sign may be displayed two weeks prior to the election and be removed one week after the election. 5. No other sign may be erected without prior written approval of the BOT, with the exception of one security sign (i.e., alarm sign) front and rear of home. Sign in front of home shall be placed in flowerbed or attached to mailbox post. Sign in rear of home shall be placed in flowerbed. 6. Any of the aforementioned signs permitted on front lawns need to be removed on the day that lawn cutting transpires. Heatherwood’s Landscaping Company is not responsible for any damage that may occur to signs left out on lawns. L.

Vehicles /Parking – THIS RULE IS A PROTECTIVE COVENANT

All vehicles shall be parked in residents’ driveways or on the street. Owners and residents shall be responsible for damage caused to the Heatherwood common property areas through the negligent operation of their vehicle(s). 1. Owners of all vehicles shall adhere to all posted traffic signs. 2. No driveway, street, or common property area shall be used for the repair of automobiles or motor vehicles of any kind, except for emergencies. 3. No driveway, street, or common property shall be used for the parking, storage, and/or repair of boats and canoes, boat trailers, house trailers, and trucks that exceed 3/4 ton in weight, motor homes, campers or camper-type add-ons, or commercial vehicles. 4. Vehicles parked on driveways shall not block sidewalks or be parked on the lawn. 5. The following classes of vehicles may be parked in the driveway or in the street: a. b. c. d. e.

6. The following classes of vehicles may not be parked on or in front of any property: a. b. c. d. e. f. g.

Motor homes Trailers Campers or camper-type add-ons Boats School buses and the like Ambulances and the like Snowmobiles

7. No commercial vehicle shall be left parked on any street or driveway longer than is necessary to perform the business function of such vehicle in the area. Commercial vehicles include pickup trucks, tow trucks, vans, or any vehicle used in a business or trade other than passenger cars. 8. No inoperable, disabled, abandoned, or unregistered motor vehicle of any type shall be stored or parked on any street or any driveway unless within an enclosed garage. 9. No vehicle shall be parked in a manner that would obstruct any pedestrian walkway. 10. No commercial vehicle shall be parked in a driveway or on the street overnight. M.

Amendments

Amendments to Exhibit E – Rules and Regulations can be made by a twothirds (2/3) vote of the Board of Trustees following a hearing for which due notice has been provided to all members. All such amendments shall be placed in the Book of Resolutions and shall be binding upon all members, except when expressly provided otherwise in such rule. Refer to Article VI – Section 1E and Article VIII – Section 12. However, those rules in Exhibit E found also under the Protective Covenants require a voting approval of not less than sixty percent (60%) of the voting membership. These amendments must be recorded. Refer to Article XI – Section 2.

Rules in Exhibit E also found under Protective Covenants have been marked accordingly in this document.
