Fair Woods Homeowners Association Parking Rules & Regulations The Board of Tnistees has recently entered into a Parking Management Contract with Henry's Wrecker Service to enforce the Fair Woods Homeowners Association's Parking Rules and Regulations as adopted by the Board

of Trustees and set forth in the Association's rules. Signs indicating that parking in the community is restricted and towing is enforced have been placed at the entrance to each street. Henry's has been provided a list of assigned parking spaces for every home and is now authorized to tow vehiclesthat violate the parking rules listed below.

Homeowners should make every effort to locate vehicle owners and have the offending vehicle moved before the towing company is called.

Parking In Assigned Spaces All homes in Fair Woods are assigned TWO spaces. These spaces are comprised of one of the following three

1. Two numbered spaces off-street parking 2. Garage and driveway only, no off-street parking 3. Garage and one numbered off-street parking space It is the responsibility of all homeowners to instruct their guests not to park in other homeowner's spaces,

driveways, or in front of someone's garage. If someone should park in a homeowner's assigned parking space, the homeowner can have that vehicle towed from that space by calling Henry's Wrecker Service.

Double Parking When a homeowner is ináonveniencedby apersoñ double párkiiig their vehicle and blocking the homeowner's entrance to or exit from their assigned space, garage, or driveway, the homeowner can have that vehicle removed by calling Henry's Wrecker Service. In situations where residents allow vehicles to be parkedbehind their assigned parking spaces or garages which creates a nuisance or danger to other vehicles traveling on that road, homeowners are advised to call the Fair Oaks Police immediately on 691-2131.

Residents Parking in Visitors Spaces Visitors Spaces are intended for use by ALL homeowners' guests to the community. Homeowners are not to use these spaces as erna parking spaces. If a homeowner, on a regular basis, uses avisitor space for an extra vehicle to that residence, to the detriment of neighbors, homeowners are asked to make such complaints to the Board of Trustees in writing, % Capitol Management Corporation. The Board will issue a letter of complaint to the property owner, and, if a second complaint is received, initiate towing the vehicle lithe violation is

Parking on the Fire Lanes

Complaints of Fire Lane violations should be made directly to the Fair Oak Police at 691-2131, Neither the Board nor the Fire Department handles these complaints.

Homeowners can contact Henrys on 698-8900 for towing or to find out if your vehicle has been towed.

All vehicles are towed at the vehicle owner's cost and risk. The Fair Woods Homeowners Association is not responsible for any damage to property towed by Henry's Wrecker Service as a result of these

X. PARKflG A.

GENERAL: Overnight parking of any conunercial vehicles

within the community is not permitted. Recreational vehicles an related equipment, other that on a temporary (generally 24 hours) and non—recurring basis, shall be in garages or screened enclosures approved by the PBB.

designated firelanes, and never in another residence's numbered space without their permission. Homeowners are responsible for where their guests park. or which meet the Fairfax County Code definition of "abandoned" will be reported to the County, who will tow the vehicle to the vehicle owner's expense.

D. FIRELANES: Resident parking is permitted in non—firelan street space, as long as it does not impede the flow of traffic, pose a safety hazard, obstruct driveways, garages, or designated head-in resident parking spaces, or violate other rules and regulations promulgated by the Board of Trustees. Firelanes are marked with yellow curbing.

2. NOTICE: The Board, Managing Agent, or the Board's designees shall place a written notice on any vehicle in violation of the Rules and Regulations requiring that the vehicle be removed or the violation rectified within 24 hours or sooner, the circumstances warrant expedited action. Subsequent violations of the same rule may result in the immediate towing of the offending vehicle without further notice. For the purposes of towing, this notice provision shall supersede the enforcement procedure contained in Article V.

F. ASSESSMENT OF CHARGES: In addition to towing and any other remedies available to the Association, the Board of Trustees will have the power to assess monetary charges of up to $50.00 per violation and up to $10.00 per day for violations of a continuing nature pursuant to Section 55—513(2) of the Code of Virginia, as amended. 8efore any such charge is assessed, the owner of the lot associated with the violation win be notified, by certified mail, of a hearing in front of the Board of Trustees. The owner of the vehicle which is the subject of the violation may also be notified.

XI. SPEED LIXITS

The speed limit for the two major toads in the community (Alder Woods Drive and Burning Bush Drive) is 25 MPH. For an other side streets the limit is 15 MPH.

III. PETS A. As provided in the Supplementary Declaration of Covenants

and Restrictions, generally recognized house or yard pets may be kept and maintained on a Lot or in a Living Unit, provided that such pets are not kept or maintained for commercial purposes.

B. The Fairfax County leash law will be enforced in Fair Woods. Under the law, animals (NOTE: This does not mean only dogs. This includes all "pets," including cats.) may not run at large on public property or the private property of others. They must be restrained by a dependable leash and controlled by a responsible person when off the property of the owner. Animals running loose in Fair Woods may be impounded by the Fairfax County Animal Warden. C. Residents shall not "curb" their pets on the private property of other residents of Fair Woods. Residents shall use a "pooper scooper" or other disposal method in the Fair Woods community, in accordance with the b'airf ax County Law #41—2—6, "Animals Causing Unsanitary Conditions." Penalties for violations of this law are up to $250. XISCEI.LMWOUS.

XV.

A. Use of common areas:

1. Any resident using the common areas shall, at the time he or she leaves the common area, remove all articles he or she brought into the area and shall

promptly clean up the common area. 2. No resident shall in any manner mark or deface common

property. Any violation of this rule shall subject the violating party to an assessment for the cost of repair and/or restoration. Residents are responsible for the actions of their family members, guests, and pets.

3. Garage/Yard sales are only permitted as a community— sponsored function, semi—annually (Spring and Fall). The Board of Trustees and each resident must be notified in advance. The sale will be held in the common area, either Alder Woods Drive near Acorn Ridge Road, or Burning Bush Drive, and advertising and signs will be placed and removed by individuals involved with the sale. No individual home or block sales are allowed. The fine for violation of this rule will be a minimum of $100 per participant. CUC

8. Trash shall not be put out more than 24 hours prior to trash collection, and trash receptacles and recycling bins shall

be

removed within 24 hours following trash collection.

t. please note that special collections (for large items or move in/move out debris) may be arranged through the trash removal service. 2. RecycLing is mandated by Fairfax Co'mty Law Chapter 109. Items to be recycled are specified by the trasi removal service and include, but are not limited to, newspapers, cardboard, aluminum, glass, plastic, metal toad containers, grass clippings, and Christmas trees. Care should be take to ensure that items are secured for collection and are not disturbed by winds or rain. Recycling bins are provided tree to each household, and a $10 fee will be charged for replacement.

3. All trash is to be placed in securely sealed plastic bags or cans.

A. Residents shall nake a good faith attempt to resolve problems with other residents and to correct violations of these rules by dealing directly with the person giving rise to the complaint. B. The complaint shall specify the problem, violation or action that is the subject of the complaint, identify the person being accused of the wrongful action, describe the efforts made to resolve the problem, and be signedby the complaining resident. Complaints that are not in this form may be ignored by the

Upon consideration of the complaint, response and evidence, the Committee shall report the complaint, along with any recommended action, to the Board of Trustees. The Board shall then act on the Committee's recommendation in accordance with the Board's rules and procedures. The Board of Trustees wi].1 be alerted to all complaints, even if said complaints are ultimately not processed by

the Committee.

E. The Board of Trustees reserves the right to suspend, modify, or dispense with these procedures if, in the opinion of the Board of Trustees, the circumstances require immediate enforcement action. However, the Board of Trustees may not assess monetary charges against an owner unless the owner has been afforded an opportunity to be heard pursuant to Section 55— 513(B) of the Code of Virginia, as amended.

FAIR WOODS HOMEOWNERS ASSOCIATION RESOLUTION PARKING SPACE MAINTENANCE WHEREAS, Article III, Section 3(b) of the Declaration of Covenants and Restrictions provides that the Board of Trustees shall have all powers for the conduct of the affairs of the Association which are enabled by law or the Founding Documents and that are not specifically reserved to the t'lembers or the Developer by said Documents; and

WHEREAS, the Board of Trustees is empowered by Article XII, Section 3(c)(2) to establish rules and regulations for the use of the property and common areas within Fair Woods; and WHEREAS, Article IV of the Supplementary Declaration of Covenants and Restrictions for each neighborhood specifically provides that the Association shall promulgate rules and regulations as needed to regulate the use of any parking area that may be constructed or authorized for the benefit of all Owners; and WHEREAS, the Board of Trustees feels that it is in the best interest of the Members of the Association to promulgate a resolution specifying the required maintenance of the assigned parking spaces within Fair Woods; and NOW, THEREFORE, The Board of Trustees hereby adopts the following guidelines for the use and maintenance of all common area parking spaces within Fair Woods: 1.

All Members shall keep the parking spaces assigned to such Member in good order and repair, and shall keep such space(s) free of debris and excessive dirt, rocks or mud. 2. Members shall be responsible for any and all damages to the asphalt or curbing and shall not allow any substances to stain or otherwise unreasonably alter the physical condition or appearance of the asphalt or concrete curbing. 3.

The parking spaces shall only be used for the parking of operable vehicles and shall not be used to perform repairs to vehicles. 4.

The Board of Trustees or the Architectural Review Board will notify the Member that is assigned the parking space of any violation of this Resolution and will request that the Member(s) restore the parking space to an acceptable condition. Thereafter, should the Member fail to perform the required restoration, the Board of Trustees shall

take steps to maintain the parking space and the Member and Owner shall be responsible for the cost incurred by the Association to repair or maintain that parking space. -
