BACKGROUND INFORMATION A major responsibility of the Board of Education is to adopt formal policies for governing the educational practices and operations of the school district. To ensure that these policies are appropriately updated for compliance with required laws and regulations, the Board of Education has utilized the Board Policy Service offered by the Erie I BOCES.

EVALUATION /ANALYSIS Appropriate revised and new policies developed by the Board Policy Service are reviewed by district administration and forwarded to the Board of Education with a recommendation for adoption. A first reading approval of the policies was made at the February 8, 2016 meeting of the Board, which must be followed by a second reading approval and formal adoption at a subsequent meeting of the Board in order for the policies to become effective.

SUBJECT: SUBMISSION OF QUESTIONS AND PROPOSITIONS AT THE ANNUAL MEETING AND ELECTION AND SPECIAL DISTRICT MEETINGS Questions and Propositions at the Annual Meeting and Election The following rules and regulations shall apply to the submission of the questions or propositions at the annual meeting and election of this School District: a)

Questions or propositions shall be submitted by petition directed to the Clerk of the School District and shall be signed by twenty-five (25) qualified voters, or five percent (5%) of the registered voters ofthe District who voted in the previous annual election of Board members, whichever is greater.

b) A separate petition shall be required for each question or proposition. c)

Each petition shall be filed with the Clerk of the School District. Petitions relating to an Annual Election must be filed not later than sixty ( 60) days preceding the election at which the question or proposition is to be voted upon.

d) Questions or propositions submitted in accordance with these rules and accepted will be printed on the ballot for the voting machine. The School District, however, retains the right to reject petitions as permitted by law, including but not limited to instances where such petitions are advisory in nature or beyond the power of the voters. e) The Board of Education shall cause the rules and regulations set forth in this policy to be distributed within the District. f)

Nothing herein contained shall affect the nominations of candidates as set forth in the Annual District Election notice pursuant to Education Law Section 2018.

Questions or Propositions to be Submitted at Special District Meetings The procedure for requesting the Board of Education to call a Special District Meeting to vote on a question or proposition shall be in accordance with subdivisions 2 and 3 of Education Law Section 2008.

INSTRUCTION FOR ENGLISH LANGUAGE LEARNERS

The Board of Education recognizes its responsibility to ensure that students of foreign birth or ancestry who are identified as English Language Learners (ELLs) are provided with an appropriate bilingual education or English as a New Language (ENL) program. The District has developed a comprehensive plan to meet the educational needs of ELLs. The plan will be kept on file in the District and submitted to the Commissioner of Education prior to the start of each school year. The plan includes: a)

The District's philosophy regarding the education of ELLs;

b)

The District's administrative practices and procedures to screen, identify, and place ELLs in appropriate programs;

c)

The District's plan to provide parents and other persons in parental relation with information about all bilingual education and ENL programs available in the District and notices regarding program placement and the rights of parents or persons in parental relation in a language they best understand;

d)

The District's system to annually measure and track the academic progress and English language proficiency of ELLs and use of data to drive instruction;

e)

A description of the District's curricular and extracurricular services provided to ELLs;

f)

The District's administrative practices to annually evaluate ELLs;

g)

The District's procedure to identify support services for ELLs;

h)

The District's policies and procedures regarding ELLs who are students with disabilities;

i)

The District's procedures to exit ELLs including those students with inconsistent/interrupted formal education;

j)

The District's services to support former ELLs.

Additionally, the District will provide professional development to all teachers, level III teaching assistants, and administrators that specifically addresses the needs of ELLs. The Superintendent will ensure that all data, including plans, assurances, and reports as required by the Commissioner's regulations, is submitted to the State Education Department in a timely manner.

BACKGROUND INFORMATION Section 912 of the Education Law permits a school district to enter into a contract for the purpose of providing health and welfare services for children residing in a school district, and attending non-public schools located in a different school district. EVALUATION/ANALYSIS A review of district records indicates 1 student residing in the Mohonasen Central School District is receiving health and welfare services from North Greenbush Common School District. The cost ofthese services is $238.60 per student for the 2015-16 school year, at a total of $238.60. The district should now enter into a contract with North Greenbush Common School District, in the total amount of $238.60. RECOMMENDATION That the Board of Education approve a health and welfare contract with North Greenbush Common School District, in the total amount of $23 8.60 for the 2015-16 school year.

ENTITLEMENT TO ATTEND-- AGE AND RESIDENCY

Entitlement to Attend All persons residing within the District who are between the ages of five (5) years and twenty­ one (21) years and who have not obtained a high school diploma are entitled to enroll in the District. A student who becomes six (6) years of age on or before the first of December in any school year shall be required to attend full-time instruction from the first day that the District schools are in session in September of such school year, and a student who becomes six (6) years of age after the first of December in any school year shall be required to attend full-time instruction from the first day of session in the following September. Each student shall be required to remain in attendance until the last day of session in the school year in which the student becomes sixteen (16) years of age. Evidence of a prospective student's age and residency must be presented in such form as is permitted by state and federal law and regulation.

Determination of Student Residency "Residence," for purposes of this policy, is established by a child's physical presence as an inhabitant within the District and his/her intent to reside in the District. A child's residence is presumed to be that of his/her parents or legal guardians. Where a child's parents live apart, the child can have only one legal residence. In cases where parents have joint custody, the child's time is essentially divided between two (2) households, and both parents assume responsibility for the child, the decision regarding the child's residency lies ultimately with the family. Where parents claim joint custody, but do not produce proof of the child's time being divided between both households, residency will be determined on the basis of the child's physical presence and intent to remain within the District. The presumption that a child resides with his/her parents or legal guardians may be rebutted upon demonstration that custody of such child has been totally and permanently transferred to another individual. The District will not acknowledge living arrangements with persons other than a child's parents or legal guardians which are made for the sole purpose of taking advantage of the District's schools. The presumption that a child resides with his/her parents or legal guardians may also be rebutted upon demonstration that such child is an emancipated minor. To establish emancipation, a minor may submit documentation of his/her means of support, proof of residency, and an explanation of the circumstances surrounding the student's emancipation, including a description of the student's relationship with his/her parents or persons in parental relation.

Notwithstanding the foregoing, all determinations of student residency will be made consistent with applicable state and federal laws and regulations.

Undocumented Children The District is mindful that undocumented children are entitled to attend the District's schools, provided they meet the age and residency requirements established by state law. Consequently, the District will not request or require on any enrollment or registration form, in any meeting, or in any other form of communication, any documentation and/or information regarding or tending to reveal the immigration status of a child, a child's parent(s) or the person(s) in parental relation. In the event the District is required to collect such information, the District will do so after the child has been enrolled. In no instance will such information be required as a condition of enrollment or continued attendance.

Children of Activated Reserve Military Personnel Students temporarily residing outside the boundaries of the District, due to relocation necessitated by the call to active military duty of the student's parent or person in parental relation, will be allowed to attend the public school that they attended prior to the relocation. However, the District is not required to provide transportation between a temporary residence located outside the District and the school the child attends.

Homeless Children Determinations regarding whether a child is entitled to attend the District's schools as a homeless child or youth will be made in accordance with Section 100.2(x) of the Commissioner's Regulations, as well as applicable District policy and regulation.

ADMISSION OF NON-RESIDENT STUDENTS

The Board of Education affirms that its primary responsibility is to provide the best possible educational opportunities for the children who are legal District residents and who are of legal age to attend school. If a student qualifies to attend the District schools as a non-resident based upon the criteria below, all rules and regulations in effect for District students will be applicable to non-district students.

A non-resident student may be admitted to District schools for academic reasons tuition-free under the following circumstances: Placement Non-resident students placed in a family home by a social service district or a state department or agency shall be allowed to attend District schools. Under said circumstances, the cost of instruction shall be paid by the district in which the student resided at the time the agency assumed responsibility for the student's support. Appropriate transportation will be provided. Children of Regularly Scheduled Employees Children ofregularly scheduled employees, with "regularly scheduled" being defined as 6.5 hours per day, not less than one hundred eighty (180) days per school year, who are not residents of the Rotterdam-Mohonasen Central School District, may attend District schools tuition free. Under said circumstances, application must be made annually to the Superintendent in the form of a written letter. Approval is not automatic. A non-resident student shall not be approved if acceptance of that student's admission will create the need to employ additional staff or cause class size to increase beyond what is desirable, will create stress on the use of facilities in the District, or is currently serving a period of suspension or expulsion from the home district. The non-resident student shall meet all academic and behavioral standards of the District. The parents shall assume full responsibility for the transportation of the student. Homeless and Runaway Students A homeless child, as defined by the McKinney-Vento Federal Regulation, may attend the school district in his/her current location, the school district of origin, or a school district participating in a regional placement plan, without payment of tuition, and with transportation provided. Emancipated Minors An eligible student providing proof of emancipation and resident is entitled to a tuition-free education.

Future Residents (Intent to Reside Permanently) Children of families who have signed a contract to buy or build a residence in the school District may be enrolled within five (5) weeks of that date. The parents shall assume full responsibility for transportation.

Former Residents Resident students who move outside of the District, who have attended school through the Friday prior to April break, may complete only that school year tuition-free. If the student is a Junior who has consistently attended school from September through April break, he/she may complete the remainder ofthe Junior year and Senior year tuition free. It is the expectation that the student remain in good academic and disciplinary standing for the duration ofthe year. The parents shall assume full responsibility for transportation. Permission must be requested in writing to the Superintendent and approved by the Superintendent.

Foreign Exchange Students A Foreign student participating in a Student Exchange Program may submit a request to attend District schools through the District office. If the request is approved, the student will be eligible to attend District schools without payment of tuition.
