title insurance - a new way of thinking

Title insurance has traditionally been obtained to resolve a title problem when all other avenues have been exhausted. Solicitors are increasingly realising the benefits of using title insurance earlier in conveyancing transactions, as title issues can be resolved more rapidly than by using conventional methods.

More Than Just Title Insurance Title insurance protects owners, their successors in title and their lenders against losses associated with a defect in the title. Our coverage can encompass:

Defective Title Cover is available for specific identified defects such as lack of access and services easements, inadequate or inaccurate descriptions, missing consents or other links in title issues.

Insolvency Cover against the risk of loss for lenders and successors in title in transactions that are at undervalue or for no value, such as transfers between spouses.

Covenants Cover for transactions where there has been or will be a breach of covenants in the title.

Cover can also be customised for other title-related problems.

Title Insurance and The CML Lenders’ Handbook The Council of Mortgage Lenders (CML) Lenders’ Handbook for Northern Ireland regulates the procedures and due diligence required by lenders in Scotland. Section 9 of Part 1 of the Handbook requires solicitors acting for lenders to arrange “… an indemnity insurance policy whenever the Lenders’ Handbook identifies that this is a course required by or acceptable to us to ensure that the property has a good and marketable title at settlement.”

Simplify Your Re-mortgage Transactions The processing of re-mortgages either in bulk or on an individual basis is a competitive area of legal practice. Stewart Title offers a range of policies for such cases to help complete re-mortgages with ease: At its most basic, a Stewart Title policy allows re-mortgages to complete without obtaining a reply to the usual form of property certificate from the local council, the Department of the Environment, the Northern Ireland Housing Executive, and the Statutory Charges Register. The policy protects the lender against loss in respect of an adverse entry that should or could have been disclosed on a Property Certificate had the search been done. Cover includes questions normally asked on a property certificate, and can also include questions about water and drainage, as well as mining searches. The policy can also be extended to cover a range of title and other off-title risks.
