It gives me great pleasure to invite you to attend our fourth National Superannuation Conference to be held at the Crown Conference Centre in Melbourne on 25 and 26 August 2016. Now in its fourth year, the conference has emerged to become the premier event for tax specialists within the superannuation industry, uniquely dealing with the tax issues affecting both the large fund and self-managed superannuation fund (SMSF) sectors. Superannuation is a key component of the Australian economy. Superannuation assets have increased from $245billion in 1996 to over $2trillion today. In this light, it is not surprising that the industry figures prominently in almost every government consultation or report in relation to the economy, the financial system or tax reform. This year’s conference will take place shortly after the Federal election, with both major parties proposing significant changes to present taxation settings for superannuation. The conference will provide an ideal forum to discuss the practical implications of these and potential future changes for both large funds and SMSFs, as well as the broader tax issues affecting the industry. This program brings together regulators and leading practitioners from the legal, accounting, audit and financial advisory services fields of the superannuation industry for two full days to discuss tax and related challenges and the opportunities that these will bring. Speakers have been chosen because they are leading superannuation and tax experts with the essential blend of knowledge and experience in the practical application of the laws. A mixture of plenary sessions and two streams of breakout sessions are offered. Delegates can pick and choose breakout sessions from either stream. Session 12: US Tax Issues Affecting Australian Superannuation Fund Members with a US Connection Any member of an Australian superannuation fund who is a US citizen, or an Australian resident whose employment or other circumstances require them to file a US tax return, is likely to be subject to US income taxes on employer and employee contributions to the fund, accrued growth in the fund, and distributions made from the fund to the member.

PRESENTER PROFILES An overview of our experts

Chris Balalovski, CTA, is Executive Director of Private Client Services at EY in Sydney. Chris has extensive experience in providing integrated solutions to the needs of high net wealth individuals and business owners in respect to superannuation (including SMSFs), estate planning, asset protection and taxation. His expertise also includes income tax, GST, FBT, stamp duty, land tax and international tax. Particular industry specialisations include financial services, medical, legal and property development. Chris is also the Chairman of the Self-managed Independent Superannuation Funds Association and is a member of The Tax Institute’s Estate Planning Committee. Roy Berg JD, LLM, is Director, US Tax Law, and Barrister and Solicitor of Moodys Gartner Tax Law LLP and has more than 23 years of experience in cross-border tax matters, IRS controversy, estate planning and finance. He has been admitted to the Bar associations of the US Tax Court, California, Washington, and Alberta, Canada. Roy is a fellow with the American College of Trust and Estate Counsel (ACTEC) and a member of the US and Canadian Society of Trust and Estate Practitioners (STEP) and American Bar Association tax sections. He is a frequent writer and speaker on the Foreign Account Tax Compliance Act (FATCA), IRS tax controversy, regulation, cross-border tax and estate planning issues. Roy received his LLM (US Taxation) from the New York University School of Law, a JD cum laude jointly from New York University School of Law and Willamette University, and a BA in Economics from the University of California, Berkeley. Peter Bobbin, CTA, of Argyle Lawyers is in his 30th year of superannuation, taxation and estate planning solutions. Many clients, large and small, have business and family wealth succession plans that are operating today, which were first developed 25 years ago under Peter’s guidance. He is a former lecturer in the Masters of Taxation, Laws and Financial Planning degrees at the University of Western Sydney, and has presented to the ATO, ASIC and a variety of other acronym organisations. In 2015, Peter was awarded SME Tax Adviser of the Year by The Tax Institute. Phil Broderick, CTA, is a Principal, and heads the superannuation team at Sladen Legal. He provides advice to SMEs and high net worth individuals in relation to superannuation, SMSFs, estate planning, trusts, business structuring, duty and tax. Phil is a member of The Tax Institute’s Superannuation Committee, National Superannuation Convention Committee and the Victorian Superannuation Education Sub-committee. He is also the chair of the Technical Committee for the Self-managed Independent Superannuation Funds Association (SISFA) and a regular attendee at the meetings of the ATO’s Superannuation Industry Relationship Network (SIRN). Phil is a regular speaker and author of numerous articles. He has also lectured on superannuation for The Tax Institute’s Applied Tax course. Richard Buchanan, CTA, is a partner at EY and specialises in the tax aspects of major transactions, including mergers and acquisitions, infrastructure and property projects. He regularly provides advice through the life cycle of the transaction, including funding, structuring, due diligence, documentation negotiation and post-acquisition integration. Richard’s role in infrastructure transactions can vary from advising bidding consortiums, representing lending syndicates, advising vendors and representing equity in a consortium. Daniel Butler, CTA, is one of Australia’s leading SMSF lawyers and has worked predominantly in the SMSF, tax and related fields for over 30 years. Dan presents on the subject Taxation of Superannuation at the University of Melbourne’s Master of Laws/Tax program. Dan is also a CTA and a Specialist SMSF Advisor. Stephen Callahan is Lead Director of KPMG’s Tax Management consulting practice in Australia. Stephen has over 25 years experience working in tax at KPMG, including five years spent in KPMG Lisbon heading up their tax risk management division and over 20 years in the UK. Stephen has a wealth of experience in assisting both large and small multinationals create sustainable improvements in global tax processes. Stephen has a strong and diverse network of contacts having led tax governance and tax performance improvement projects all over the world, not only for businesses but also for the European Commission and the governments of Bahrain, Armenia, Macau and the People’s Republic of China. Stephen is a Fellow of the Association of Chartered Certified Accountants in the UK. Shayne has been closely involved in structuring publicly offered superannuation and related financial products throughout his career. He has prepared many papers on superannuation and lectures on the Taxation and Regulation of Superannuation at the University of Sydney. Jeremy Cooper is the Chairman of Retirement Income at Challenger Limited, a full-time executive role involving aspects of research, product development and public advocacy of Challenger’s philosophies in a range of areas. Jeremy is a lawyer by training with experience across a broad range of financial services disciplines. Prior to joining Challenger, Jeremy was appointed by the Australian Government to chair a wide-ranging review of Australia’s superannuation system, now known as the “Cooper Review”. Before his review role, Jeremy was deputy chairman of ASIC for five years from mid-2004. He was awarded the 2011 Libby Slater Award by the International Pension & Employee Benefits Lawyers Association in Berlin for his contribution to the Australian superannuation system. Marsha–Laine F Dungog JD, LLM, is a senior US tax lawyer at Moodys Gartner Tax Law LLP specialising in cross-border tax planning and tax compliance services for high net worth individuals and entrepreneurs. She has over 15 years of experience providing international tax consulting services to clients seeking to infuse tax sensibility in cross-border acquisitions and sales, capital funding and expansion, manufacturing, supply and distribution, film production and licensing, real estate investments and philanthropic ventures. Mark Edmonds is a Partner at PwC, with Australian and international tax experience in the infrastructure, property, private equity and financial services industries. Mark rejoined PwC in 2012, following nearly five years with Australian listed company Challenger Limited, as Director of Structuring & Solutions. John Edstein is a consulting lawyer and company director with over 35 years’ experience in superannuation, trusts, tax and financial services laws. He currently holds Director level positions with REST Superannuation, Macquarie Investment Management Limited, Perpetual Equity Investment and is an Independent member of the Australian Defence Force Financial Services Consumer Centre and acts as Special Counsel with Carroll & O’Dea Lawyers consulting principally in wealth and estate structuring for high net worth individuals, senior executives and professional persons. John was Chairman and a Director of The Trust Company (Superannuation) Limited until 1 September 2014, when the company was sold by the Perpetual Group and for 23 years, was a partner in the Sydney office of King & Wood Mallesons where he was National Practice Team Leader of the Tax and Superannuation Group for several years. For many years, John was an author and co-editor of Australian Superannuation Law & Practice (a loose leaf text now published by Thomsons). He has contributed to professional and industry journals and has been a regular presenter for industry bodies and universities. John was a parttime lecturer for the post graduate Diploma of Taxation course at the University of Western Sydney for many years and now lectures in the Master of Laws course for the University of Sydney. Marco Feltrin is a Partner and leads the national superannuation tax practice for PwC. He has over 20 years experience and specialises in providing tax services to large superannuation funds and the funds management industry. Marco has advised many clients on the tax aspects of their investments, both domestic and international. In addition, Marco has provided tax advice on many other matters impacting the superannuation and funds management industry and is heavily involved with government in relation to tax reforms impacting the industry. Marco is a member of the ASFA Tax Standing Advisory Panel.

Richard Friend, CTA, spent most of the first 23 years of his professional career in Brisbane in the tax practice of Andersen and then Ernst & Young. Since 2006, he has operated a tax consulting business through Balena Tassa Pty Ltd. Richard has developed particular expertise in all aspects of structuring for tax, investment planning, superannuation and estate planning for SME and high net worth clients. Most of this work is done by way of consulting to, and providing training for, accountants and lawyers who operate in these areas. Jocelyn Furlan of Furlan Consulting is the former Chairperson of the Superannuation Complaints Tribunal. She held this role for in excess of seven years from September 2007 to March 2015. Prior to being Chair she was the Deputy Chairperson from March 2006. In 1991 she started her own tax practice and took up a contract at a major Victorian public sector superannuation fund where she worked as Secretary to the Board and part of the executive management team for eight years. She became the inaugural Company Secretary of VicSuper in 1999 before joining legalsuper as Compliance Manager in 2003. Jocelyn is currently a director of First State Super and Strathcona Baptist Girls’ Grammar School. Brad Ivens, ATI is an Executive Director in EY’s Financial Services tax practice, who works with Melbourne and Sydney-based clients across the financial services industry. In particular, Brad has over 18 years’ experience in providing tax compliance and advisory services for the superannuation industry, covering matters such as investment due diligence, capital gains tax planning, unit pricing / crediting rate reviews, custodian tax reporting, fund administration, tax effect accounting and ATO reviews / audits. His clients have ranged from some of Australia’s largest industry and employer sponsored funds, through to public sector and self-managed funds. Brad’s qualifications include Bachelor of Commerce / Laws and Master of Tax degrees. Zaf Kardaras joined Northern Trust in May 2012. Prior to joining Northern Trust, he was a Tax Director at PricewaterhouseCoopers specialising in the taxation of superannuation funds and the managed funds industry. Stuart Forsyth, CTA, is a Director of McPherson Super Consulting Pty Ltd, a company which specialises in providing technical advice on superannuation matters to the accounting, legal and financial planning industries. Stuart is the former Assistant Deputy Commissioner for Superannuation at the ATO where his responsibilities included active compliance and risk and intelligence for all superannuation subject areas. He was also closely involved in the ATO’s Stronger Super project to implement the Cooper Review recommendations and drafting the ATO ruling on limited recourse borrowing arrangements for SMSFs. With over 30 years experience, Stuart also has a strong income

Kasey Macfarlane is the ATO’s Assistant Commissioner responsible for Self-Managed Superannuation Funds. Prior to joining the ATO in 1999, Kasey worked as a Chartered Accountant in one of the Big 4 accounting firms, as well as a second-tier accounting firm. During her time at the ATO, prior to joining the ATO’s superannuation business line, Kasey had undertaken various technical leadership roles and her responsibilities across various tax products have included technical leadership and input into policy and law development; leading the development of ATO public rulings and guidance products; and leading the management and resolution of tax-related strategic litigation matters.

In her role she is actively involved in reviewing and interpreting new legislation and participating in a number of industry forums. Kylie has spent most of her career in the funds management industry either in senior tax or fund accounting management roles.

Megan McBain is a Manager within the Investment team at First State Super providing tax advice on new and existing investments both domestically and offshore. Prior to joining First State Super, Megan was at KPMG for over 13 years within Corporate Tax advising a wide range of clients in the financial services sector, including superannuation funds, managed funds and custodians.

Chris Richardson is a Director of Deloitte Access Economics and is one of Australia’s best-known economists. Chris heads Deloitte Access Economics’ forecasting and modelling unit. He is the author of three regular publications: Business Outlook, Employment Forecasts and Budget Monitor. His comments on trends in the economy and their effect on business regularly appear in daily media coverage.

Gina Maio, is the Transaction Tax Manager at AustralianSuper. Prior to joining AustralianSuper Gina spent 10 years at KPMG, specialising in the provision of corporate and M&A tax advisory services including acquisition and divestment structuring, due diligence reviews and DDC reporting, corporate actions and initial public offerings.

Jemma Sanderson, CTA, is a Director at Cooper Partners Financial Services, heading up their SMSF specialist services. Jemma provides strategic advice on SMSFs, estate planning and wealth management to clients, as well as technical support to accounting, legal and financial planning groups. Jemma has over 15 years experience in developing complex strategies for high net worth clients. Jemma is a regular presenter on superannuation and SMSFs for The Tax Institute and other professional bodies across Australia. Jemma is the author of the popular SMSF Guide published by The Tax Institute, currently in its 7th edition, and is the author and convenor of The Tax Institute’s Graduate Diploma of Applied Tax Law Advanced Superannuation unit.

James O’Halloran, Deputy Commissioner, Superannuation, Australian Taxation Office. James has national responsibility for the ATO’s role in the regulation of APRA funds and Self-Managed Superannuation Funds. In this role he works closely with the Superannuation industry, advisors and other regulatory agencies. Prior to this role, James was Deputy Commissioner, Indirect Tax with responsibility the Goods and Services Tax and Excise. He has also served as Deputy Commissioner, Tax Practitioner and Lodgement Strategy with accountabilities for the ATO’s services and relationship with tax practitioners. James joined the Australian Taxation Office in 1999. Prior to joining the ATO James held senior management positions in the State Revenue Office (Victoria) and other Victorian agencies. James has a Bachelor of Arts (Criminal Justice Administration), a Master of Corporate Law and is a Fellow of the Australian Institute of Management. Peter O’Reilly, Assistant Commissioner, Public Groups and International (PG&I). Peter is the National PG&I Insurance and Superannuation Strategy Leader, he leads PG& I Compliance Operations at Parramatta and Newcastle, and is the Site Leader for PG&I at Parramatta. Peter is responsible for life insurance, general insurance and large superannuation funds income tax compliance including strategy and operations. He has also had extensive involvement in dealing with issues in the Managed investment trust industry and has represented the ATO on several Board of Taxation Reviews relevant to the financial services industry. His responsibilities for Compliance Operations at the Parramatta and Newcastle sites covers the full spectrum of public group issues, multinational and domestic tax risks, compliance, client engagement, assurance and relationship management. Kylie Quinn, is the Senior Tax Manager at Mercer specialising in superannuation and unit trust taxation of funds both in Australia and New Zealand. She manages the taxation compliance and obligations of the funds which includes the review and management of distributions, tax provisions and tax policies. A significant part of her responsibility and speciality is the management of unit pricing tax provisions which includes the management of deferred tax assets, effective tax rates and tax alignments. Ross Stephens, CTA, is a Director at KPMG and one of the most recognised tax advisers to the superannuation industry in Australia, with key clientele including many of the largest industry, corporate, public sector and retail funds. He has assisted ASFA with many industry submissions to government, Treasury and the ATO on taxrelated matters, most recently in respect of draft ruling TD 2014/D22 on funds’ foreign income tax offset entitlements. Anthony Versace, is a Partner in KPMG’s national Indirect Tax practice. Anthony is based in Melbourne and has more than 18 years of experience in providing practical and commercial GST advice to KPMG’s financial services clients, with a specific focus on clients in the superannuation, funds management and insurance industries. Anthony counts amongst his client base many of Australia’s largest superannuation funds, to which he provides a full range of GST advisory services including in relation to compliance obligations, GST technical advice on all aspects of fund’s activities and managing ATO interactions. Thilini Wickramasuriya, FTI, is a Tax Counsel at The Tax Institute and is responsible for coordinating the technical activities of the Tax Policy and Advocacy Team. Thilini regularly engages with Treasury, the ATO, the Board of Taxation and the Inspector-General of Taxation. Prior to joining the Institute, Thilini practised as a solicitor, acting in significant tax disputes on behalf of both taxpayers and the Commissioner in the High Court, Federal Court and Administrative Appeals Tribunal. Prior to this, Thilini worked in a Big 4 accounting firm advising multinational clients on international tax issues. Philip Witherow, CTA, is the General Manager Taxation at Cbus where he is responsible for the taxation affairs for Cbus and the Cbus Property entities. Prior to Cbus, Philip was a Principal in the Tax and Legal section at PricewaterhouseCoopers specialising in financial services and in particular large superannuation funds. He has been involved in the taxation industry for more than 20 years.
