WHEREAS, the Board of County Commissioners adopted an Annual Appropriation Resolution, No. 16-1048 on December 28, 2016 to provide for the current expenses and other expenditures of Medina County, and WHEREAS, the amounts to be appropriated are within the amounts available on the Certificate of Estimated Resources, and WHEREAS, changes in the annual appropriation resolution levels are now necessary. RESOLUTION NO. 17-0065 AUTHORIZING THE COUNTY AUDITOR TO TRANSFER FUNDS FROM THE COUNTY GENERAL FUND (0010) TO THE MEDINA COUNTY JOB AND FAMILY SERVICE CHILDREN SERVICES FUND (0055) FOR THE BOARD AND CARE OF COUNTY WARDS

WHEREAS, ORC 5705.14 (E) provides for the transfer of funds from the General Fund to any proper fund of a district authority, and WHEREAS, in accordance with O.R.C. 5101.144 which requires the county to deposit all funds a Public Children Services Agency (PCSA) receives for the purpose of providing children services into a single fund within the county treasury, and WHEREAS, in order to guarantee Medina County’s Maintenance of Effort (MOE) in the provision of children services, herein called Board and Care, the Board appropriated $1,149,183.00 in subsidies for calendar year 2017, and WHEREAS, the Board of County Commissioners has determined it necessary to transfer a portion of the funds from the county subsidies appropriation for calendar year 2017, and WHEREAS, the Board now finds it in the best interest of the County if such as transfer is made at this time. RESOLUTION NO. 17-0067 ACCEPTING AND AWARDING BIDS FOR A FUEL PURCHASE/MANAGEMENT SYSTEM FOR MEDINA COUNTY PUBLIC TRANSIT

WHEREAS, Medina County was authorized to solicit bids for a fleet management fuel card purchasing and reporting system which would provide to Medina County Public Transit a supply of fuel and fuel management reporting, and WHEREAS, on December 5, 2016, bids were received by the Medina County Board of Commissioners for a fuel card purchasing and reporting system as follows: Margin on Fuel in Excess of OPIS Pricing (excluding taxes)

BE IT FURTHER RESOLVED that the Medina County Board of Commissioners be authorized to enter into an agreement setting forth the details of this procurement.

AGREEMENT THIS AGREEMENT, made this 24th day of January, 2017, by and between the Medina County Commissioners, hereinafter called “OWNER”, and Town & Country Co-Op, doing business as a corporation, hereinafter called “VENDOR”. WITNESSETH: That for and in consideration of the payments and agreements hereinafter mentioned: 1.

The VENDOR will commence and provide a fleet management fuel card purchasing and reporting system providing for the supply of fuel and fuel management reporting to the Medina County Public Transit.

2.

The VENDOR through its card system will provide Unleaded Fuel and Diesel Fuel (ASTM Number 2D, low sulfur, summer and winter specifications as appropriate), which shall be made available for purchase at their retail locations as described by the Contract Documents

3.

The VENDOR will commence fuel supply and delivery required by the CONTRACT DOCUMENTS, as needed by the OWNER, on or about February 1, 2017 and will continue this service through January 31, 2020, with the Owner having the option to renew for an additional two (1) year periods ending January 31, 2022.

4.

The VENDOR agrees to perform all of the work described in the CONTRACT DOCUMENTS and comply with the terms therein at the proposed bid margin of $0.095 per gallon, inclusive of profit and freight, to be charged over and above the Rack Price cost per gallon and taxes.

5.

The VENDOR shall provide weekly motor fuel and maintenance reports which will contain the vehicle number performing transaction, date and time of transaction, location of transaction, driver number, odometer entered, quantity purchased, base price per gallon, applicable taxes charged per gallon, total amount of purchase, Daily OPIS average rack price per gallon for location.

RESOLUTION NO. 17-0068 APPROVING A MEMORUNDUM OF UNDERSTANDING BETWEEN THE SHERIFF’S DEPARTMENT AND THE MEDINA COUNTY COURT OF COMMON PLEAS, ADULT PROBATION DEPARTMENT TO PROVIDE COMPREHENSIVE AND COHESIVE SERVICES FOR FELONY 4 AND FELONY 5 INMATES INCARCERATED AT THE MEDINA COUNTY JAIL WHEREAS, on November 8, 2016 the Commissioners authorized the acceptance of an Ohio Department of Rehabilitation and Corrections Probation Improvement T-CAP Grant by approving resolution no. 16-0912, and WHEREAS, it is the desire of the Board of County Commissioners to authorize a Memorandum of Understanding between the Sheriff’s Department and Medina County Court of Common Pleas, Adult Probation Department for comprehensive and cohesive services for approximately Sixty-Three (63) Felony Four and Felony Five inmates incarcerated at the Medina County Jail commencing November 1, 2016 through June 30, 2017 at a rate of $60.00 per day, per inmate, and WHEREAS, should the grant recipients meet the goals of the grant successfully this MOU shall continue for an additional 12 month period, July 1, 2017 through June 30, 2018, with the intention of diverting a total of Ninety-Five (95) cases with the cost of services being $60.00 per day, per inmate. NOW, THEREFORE, BE IT RESOLVED by this Board of County Commissioners the Memorandum of Understanding between the Sheriff’s Department and Medina County Court of Common Pleas, Adult Probation Department, be approved.

RESOLUTION NO. 17-0070 AUTHORIZING AN EMPLOYEE ASSISTANCE PROGRAM AGREEMENT EXTENSION WITH REACH EAP & WORKPLACE SOLUTIONS WHEREAS, the Medina County Board of Commissioners maintains and administers an employee assistance program for the benefit of all staff members within the organization, and WHEREAS, in an effort to stabilize costs associated with the provision of this benefit during future years, quotes have been received from various employee assistance programs, and WHEREAS, REACH EAP & Workplace Solutions original agreement which commended February 1, 2015 through January 31, 2017 with the option for an extension of two years, and WHEREAS, REACH EAP quoted funding rates for employee assistance program per employee per month of $1.71 for an eight session model with unlimited one-hour seminars for employee and wellness education, personal health and wellness coaching, on-site service for traumatic incident and grief and bereavement support, and WHEREAS, Board of County Commissioners has determined that it is in the best interest of the County that the employee assistance program be extended under the current contract with REACH EAP and Workplace Solutions for a continuing coverage period commencing February 1, 2017 through January 31, 2019. NOW, THEREFORE, BE IT RESOLVED by this Board of County Commissioners that an agreement for the employee assistance program be approved with REACH EAP and Workplace Solutions, effective February 1, 2017, and that the President of the Board be authorized to execute all necessary agreements for this plan.

RESOLUTION NO. 17-0071 AWARDING THE 2016 HOME SEWAGE SYSTEM REPLACEMENT PROJECT

WHEREAS, the Medina County Sanitary Engineer was directed by the Board of Commissioners to work with the Medina County Health Department for the purpose of implementing the household sewage treatment systems (HSTS) replacement/repair program for Medina County targeting the replacement/repair of 20 to 25 HSTS’s for an estimated total cost of approximately $300,000.00 per Resolution No. 15-0735; and WHEREAS, on Thursday, January 12, 2017, sealed bids were opened and read aloud for the 2016 Home Sewage Treatment System Replacement Project consisting of Contracts A through E for replacement/repair of 27 HSTS’s with the bid results attached as Exhibit “A”; and WHEREAS, the Medina County Sanitary Engineer and the Medina County Health Department have reviewed said bids and provided this Board with their recommendation for contract award. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Medina County, Ohio that: 1.

The bids for Contract A in the amount of $66,086.00, Contract C in the amount of $60,487.50 and Contract D in the amount of $54,654.50, for a grand total of $181,228.00, are awarded to Vasel Brothers, Inc., 1576 Marks Road, Valley City, Ohio.

RESOLUTION NO. 17-0072 DECLARING THE NECESSITY OF REHABILITATING THE WESTFIELD-HIGH AND WESTFIELD-LOW WATER TANKS LOCATED ON VIRGINIA DRIVE IN WESTFIELD CENTER VILLAGE AND AUTHORIZING THE SANITARY ENGINEER TO ENTER INTO AN AGREEMENT WITH DIXON ENGINEERING, INC. TO PROVIDE PROFESSIONAL ENGINEERING AND CONSTRUCTION PROJECT MANAGEMENT SERVICES FOR THE REHABILITATION PROJECT AND TO COMMENCE ADVERTISING FOR TANK REHABILITATION BIDS

WHEREAS, the Board of Medina County Commissioners has previously established the Medina County Sewer District; and WHEREAS, the Sanitary Engineer has conducted inspections on the Westfield-High (200,000 gallon spheroid water storage tank) and the Westfield-Low (250,000 gallon toro ellipse water storage tank) and based on the results of said inspections recommends that the tanks be rehabilitated, to include repairs, welding and painting; and WHEREAS, the Sanitary Engineer has determined that it is advantageous to enter into a Professional Engineering and Construction Project Management Agreement with Dixon Engineering, Inc., to prepare the technical specifications, and to provide project administration and inspection services, to ensure the water tower rehabilitation work is completed in a timely manner in accordance with the contract plans and specifications, and to immediately address any problems or questions which arise during construction per the Dixon Engineering, Inc. proposal in the attached 'Exhibit A'; and WHEREAS, the Ohio Revised Code Section 307.86 provides for entering into an agreement for the services of a Professional Engineer/Construction Project Manager in excess of fifty thousand dollars as an exception to the competitive bidding process. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Medina County Ohio, that: 1. It is hereby found, determined and declared to be necessary to rehabilitate the Westfield-High and Westfield-Low Water Tanks located on Virginia Drive in Westfield Center Village. 2. The proposal for Professional Engineering and Construction Management Services for the Rehabilitation Project from Dixon Engineering, Inc. be entered into as shown in Exhibit "A". 3. The Sanitary Engineer is hereby authorized to act as the agent for the Board of Medina County Commissioners in matters associated with Dixon Engineering, Inc. 4. The Sanitary Engineer is hereby authorized to commence advertising for bids to perform the Westfield-High and Westfield-Low Water Tank Rehabilitation Project.
