On Saturday, September 6th Local 28 proudly marched in the 2014 NYC Labor Day Parade. Once again, our efforts and involvement were a highlight of the event. Over 500 Local 28 brothers, sisters, family and friends stood tall and represented our Local with dignity and respect. The float, a scale model of our NYC Skyline was hand fabricated in stainless, copper, brass and galvanized. It was the focal point and envy of all. This masterpiece was fabricated at our Training Center under the direction of the late Nicholas Maldarelli. This year’s parade was dedicated to the memory of Nick. He was a true gentleman and craftsman. His mentorship and dedication will be missed. Special thanks to everyone who attended and made this year’s celebration a success. ANNUITY FUND Effective February 1, 2012, the Sheet Metal Workers Local Union No. 28 I. A. Annuity Fund converted from a Money Purchase Plan to a Profit-Sharing Plan. This change allowed for the Annuity Fund to add Hardship Withdrawals to the benefits already in place. The Profit-Sharing account consist of the contributions made on your behalf as of February 1, 2012. Contributions prior to that date are not considered for this benefit. You are allowed two (2) Hardship Withdrawals in a calendar year. The amount requested cannot exceed 50% of the Profit-Sharing portion of your account. The amount payable cannot exceed the amount necessary to satisfy the financial hardship as indicated on your supporting documents. There are only six (6) reasons under which a Hardship Withdrawal can be taken: 1. To Purchase A New Home: You must have a purchase or sales agreement listing the address of the property, the seller, the total amount and the amount needed for the down payment. Please note this is not to rent a new house or apartment but to purchase your principal residence. Refinancing your mortgage is not eligible. 2. Medical Bills: You must submit copies of medical, hospital or dental bills for yourself or eligible dependent, with the date of service, patient’s name, place of service and the balance owed after the insurance payment or denial of payment because of loss of coverage. Bills cannot be more than six (6) months old. 3. College Tuition: You must submit a bill for tuition from the financial office of the college, university or trade school that you or your eligible dependent are or will be attending. This also covers all educational expenses such as books, school fees and any other items that may be required. The repaying of students Loans is not eligible for a distribution. 4. To Avoid Eviction or Foreclosure: You must have an eviction or foreclosure notice that is signed and dated from the owner/ landlord or mortgage company that references your address, the amount owed and the date due to avoid the eviction or foreclosure proceedings. Evictions or foreclosures that have already occurred are not eligible. 5. To Pay For Funeral Expenses: You must submit a bill from the Funeral Home or Mortuary for your parent, spouse and eligible dependents. Documents cannot be more than six (6) months old 6. To Pay For Repairs To Your Home: You must supply a copy or copies of repair bills that indicate the work that is needed due to a fire, storm or natural disaster. Bills must reference your name and address as the place the work is being done. Local No. 28 Retirees Club

Greetings to all. A new season is upon us, with it comes a nip in the air and hopefully a better future for Local 28. Once again I am urging those retired members that haven't done so, to join the Local 28 Retirees Club. Why not start the Halloween season off with a “Treat”? We invite you to come to our next scheduled monthly meeting, which will be held at 11:00 AM on October 22nd, 2014 at VFW Post #5253, located at 155 Searingtown Road, Albertson, NY 11507. Come early for coffee, cake and a chance to socialize with sister and brother members. Stay after the meeting and have a sandwich. Pop out a double sawbuck (twenty dollars) for annual dues, and you're good to go! We also have some special events coming up which you might like to participate in. Our Annual Holiday Party is fast approaching. Don't miss out on a chance to dance with your honey!! It is to be held on Tuesday, December 2nd, 2014. Also, our annual Super Bowl raffle allows a $500.00 scholarship award to a child or grandchild of a Retiree Club member. They Shall Be Missed... Message from the Financial Secretary-Treasurer/Recording Secretary For the past 6 years I have had the honor of serving Local 28 as your Organizer. On July 1, 2014 I was appointed to the position of Financial Secretary-Treasurer/Recording Secretary pro tem. I understand the controversy regarding such appointments and humbly accept the responsibility and critique. As your new Financial Secretary-Treasurer/Recording Secretary, I will strive to ensure that this office provides better communication and service to you, the membership.

This local is larger than any one person or issue. Working together we will prevail and prosper. Starting on October 1, 2014 Local 28 will be accepting credit cards for payment of dues and merchandise. This simple convenience is long overdue. JOINT LABOR MANAGEMENT NEWS You will now see on the website a link for JLM (Joint Labor Management) which will track information with a list of TARGETED PROJECTS. Members will be able to see the number of projects required to be targeted either through target money or a mixed use of Building Trades Journeypersons and Light Commercial workers. These projects would have gone non-union if we did not make concessions. We will give monthly updates on jobs that get approved and awarded through JLM so members will know if they are on a targeted job.

LOCAL 28’S COMMITMENT TO EQUAL WORK OPPORTUNITIES

Dear Brothers and Sisters: Local 28 is committed to ensuring equal work opportunities for all its members. Toward that end, we write to remind you of the nondiscrimination provision contained in Article XV, Section 8 of our collective bargaining agreement, which reads: “The Employer and the Union mutually agree there shall be no discrimination of any member of the Union in connection with union activities, race, nationality, religion, gender, age or marital status by any person in the employ of the employer.” Due to concerns about allegations of racial and national origin discrimination, Local 28 has instituted some specific mechanisms for identifying and addressing allegations of such discrimination. Local 28 has established an Office of Court Compliance (“OCC”) to address these issues and appointed Anthony Guerrero to lead that effort. Among other things, the OCC is evaluating work hours and hiring data in order to identify and investigate contractors that appear to have significant work hours or work force disparities between white and nonwhite journeypersons. In addition, we want to know about any concerns of discrimination that you may have so that we can work to remedy them. We have established a confidential Hotline (1-800-366-4814) and secure email address [email protected] to handle complaints of discrimination or retaliation. If you believe that any contractor or member of Local 28 has engaged in discrimination on the basis of race or national origin, we urge you to let us know. To report an incident of discrimination or discriminatory retaliation, please call the Hotline, use the secure email address, or contact the OCC, Local 28's Counsel Riccardo Iaccarino, or one of Local 28's Business Agents, by certified mail, fax, or electronic mail. In addition, you can make your concerns known to the plaintiffs in the discrimination court case by leaving a message on a toll-free hotline maintained by the plaintiffs (866-748-5968).
