REVISED REGULATIONS OF SASKATCHEWAN SASKATCHEWAN REGULATIONS 55/2012 The Coroners Act, 1999 Section 64

Order in Council 457/2012, dated August 1, 2012 (Filed August 2, 2012) Title

These regulations may be cited as The Coroners Amendment Regulations, 2012.

R.R.S. c.C-38.01 Reg 1, section 4 amended

2(1) Section 4 of The Coroners Regulations, 2000 is amended in the manner set forth in this section. (2) Clause (2)(e) is repealed and the following substituted: “(e) $1,298.32, if the complete post-mortem examination was begun on or after April 1, 2012”. (3) Clause (3)(e) is repealed and the following substituted: “(e) $1,718.87, if the complete post-mortem examination was begun on or after April 1, 2012”. (4) Clause (4)(e) is repealed and the following substituted: “(e) $295.08, if the external post-mortem examination was begun on or after April 1, 2012”.

Coming into force

3 These regulations come into force on the day on which they are filed with the Registrar of Regulations.

SASKATCHEWAN REGULATIONS 56/2012 The Mortgage Brokerages and Mortgage Administrators Act Section 91

1 These regulations may be cited as The Mortgage Brokerages and Mortgage Administrators Amendment Regulations, 2012.

R.R.S. c.M-20.1 Reg 1 amended

2 The Mortgage Brokerages and Mortgage Administrators Regulations are amended in the manner set forth in these regulations.

Section 2 amended

3 Section 2 is amended: (a) by adding the following clause after clause (c): “(c.1) ‘initial licence year’ means the licence year in which the licence was issued to the holder of the licence”; and (b)

by adding the following clause after clause (f):

“(f.1) ‘licence year’ means the period commencing on July 1 in one year and ending on June 30 of the following year”. Section 4 amended

4(1)

Subsection 4(2) is amended:

(a) by repealing clause (d) and substituting the following: “(d) subject to section 4.1, has successfully completed an approved educational program within the three-year period preceding the date of the application”; and (b) in clause (e) by adding “subject to section 4.1,” before “has been licensed”. (2) Clause 4(3)(d) is repealed and the following substituted: “(d) subject to section 4.1, has successfully completed an approved educational program within the three-year period preceding the date of the application”. New section 4.1

5 The following section is added after section 4:

“Conditional exemption re out-of-province authorizing certificate 4.1(1) In this section: (a) ‘Agreement on Internal Trade’ means the Agreement on Internal Trade entered into on or about July 18, 1994 by the governments of Canada, the provinces and the territories;

(b) ‘authorizing certificate’ means a valid certificate, licence, registration, or other form of official recognition that: (i) is granted by an out-of-province regulatory authority to an individual; (ii) attests to the individual being qualified to practise an occupation that is substantially equivalent to that of broker or associate; and (iii) authorizes the individual to do either or both of the following: (A)

practise either occupation mentioned in subclause (ii);

(B) use a title or designation relating to either occupation mentioned in subclause (ii); (c) ‘occupation’ means a set of jobs which, with some variation, are similar in their main tasks or duties or in the type of work performed; (d) ‘out-of-province regulatory authority’ means a regulatory authority that is authorized to issue authorizing certificates pursuant to an Act of the Parliament of Canada or of a province, other than Saskatchewan, or territory of Canada that is a party to the Agreement on Internal Trade. (2) An individual is exempt from the requirements set out in clauses 4(2)(d) and (e) for a broker’s licence, or from the requirement set out in clause 4(3)(d) for an associate’s licence, if: (a) the individual holds an authorizing certificate in good standing; (b) the superintendent is satisfied that the authorizing certificate authorizes the individual to practise the occupation that is substantially equivalent to that of broker, or associate, as the case may be; and (c) if required by the superintendent, the individual demonstrates, in the manner required by the superintendent, knowledge of matters applicable to practising as a broker or associate, as the case may be, in Saskatchewan. (3) Notwithstanding subsection (2), if the individual’s authorizing certificate is subject to a condition relating to education requirements or, in the case of an applicant for a broker’s licence, education or experience requirements, the superintendent may: (a) impose an equivalent condition on the licence issued to the individual; or (b) if the superintendent is not satisfied that he or she can impose an equivalent condition on the licence, refuse to issue a licence to the individual”. Section 5 amended

Clauses 5(1)(b) and (c) are repealed.

New section 8.1

7 The following section is added after section 8:

“Continuing education requirements 8.1(1) In this section: (a) ‘approved continuing educational program’ means, with respect to a licensed broker or a licensed associate, a continuing educational program that is satisfactory to the superintendent; (b) ‘continuing education period’ means the period commencing on June 1 of an even numbered year and ending on May 31 two years later. (2) Every licensed broker and licensed associate must complete at least one approved continuing educational program in each continuing education period”. Section 43 amended

8 Subsection 43(1) is amended by adding “and section 44.1” after “In this section”.

New section 44.1

9 The following section is added after section 44:

“Exemption re statutory declaration 44.1(1) A licensed mortgage brokerage that did not hold an endorsement during the preceding fiscal year is exempt from the requirement in section 49 of the Act to provide the superintendent with a statutory declaration if that licensed mortgage brokerage included in the last annual return filed pursuant to section 48 of the Act a confirmation that the mortgage brokerage did not receive or handle trust property during the reporting period. (2) Notwithstanding subsection (1), if a licensed mortgage brokerage in its initial licence year would be required to file a statutory declaration before June 30, that licensed mortgage brokerage is exempt from the requirement in section 49 of the Act to provide the superintendent with a statutory declaration in that initial licence year”. Section 50 amended

10 Subsection 50(2) is amended: (a)

in subclause (a)(ii) by striking out “, as defined in section 5,”; and

(b) in subclause (b)(ii) by striking out “, as defined in section 5,”. Coming into force

R.R.S. c.T-19.1 Reg 1, section 3 amended

2 Clause 3(1)(r) of The Traffic Safety Court of Saskatchewan Regulations is repealed and the following substituted: “(r) $7,783 for the period commencing on April 1, 2011 and ending on March 31, 2012; “(s) $7,939 for the period commencing on April 1, 2012”.

Coming into force

3 These regulations come into force on the day on which they are filed with the Registrar of Regulations.

2 L’alinéa 3(1)r) du Règlement sur le Tribunal de la sécurité routière de la Saskatchewan est abrogé et remplacé par ce qui suit : « r) 7 783 $ pour la période allant du 1er avril 2011 au 31 mars 2012; « s)

7 939 $ pour la période commençant le 1er avril 2012 ».

Entrée en vigueur

3 Le présent règlement entre en vigueur le jour de son dépôt auprès du registraire des règlements.
