Eksport Kredit Fonden (EKF) hereby invites to tender for two partial Framework Agreements (lots) for Reinsurance Brokerage. The scope of the assignment and service is for 1 or 2 awarded Reinsurance Broker(s) to assist EKF with upcoming tenders and negotiations on reinsurance of EKF's guarantee portfolio and the daily administration of such reinsurances. Furthermore, to support EKF's monitoring of the portfolio risk as well as risk transfer operations. As a result, this tender is divided into 2 lots of: 1) Brokerage on Treaty reinsurance (the Treaty Framework Agreement — estimated value of 20 000 000 DKK 25 000 000 DKK), and 2) Brokerage on Facultative reinsurance (the Facultative Framework Agreement — estimated value of 15 000 000 DKK - 20 000 000 DKK). Description of the procurement: The awarded Broker on the Treaty Framework Agreement (Reinsurance Broker on Treaty reinsurance) shall assist EKF on matters relating to EKF's treaty reinsurance, including but not limited to assisting on the structuring of a tender on treaty reinsurance, which is expected to be facilitated in late 2016 (and then again the following years) and to act as intermediary between EKF and the reinsurers, with the negotiation of terms on this matter and to act as an intermediary between EKF and the reinsurers during the term of reinsurance agreement.

Description of the procurement: The awarded Broker on the Facultative Framework Agreement (Reinsurance Broker on on facultative reinsurance) shall assist EKF on matters relating to EKF's facultative reinsurance, including but not limited to assisting on the structuring of tenders on facultative reinsurance (single transactions), which is expected to be facilitated in late 2016. Furthermore, to act as intermediary between EKF and the reinsurers, with the negotiation of terms before the signing of an agreement and to act as an intermediary between EKF and the reinsurer during the term of reinsurance agreement. EKF expects that the upcoming tender on facultative reinsurance will be established as a framework agreement with ongoing ‘mini tenders’ (reopening of the award procedure for each single transaction).

List and brief description of conditions: The tenderer must have a capacity to maintain a stable contractual period of the Assignment with EKF. The tenderer must demonstrate this by filling the ESPD. The Reinsurance Broker(s) shall be well-established and well-reputed as reinsurance broker in the relevant line of business. The tender shall include: — a short and general presentation of the Reinsurance Broker and details of the professional qualifications and experiences of the Reinsurance Broker as company (see below regarding references and technical capabilities); — evidence that the Reinsurance Broker is authorized to conduct reinsurance business for EKF being a Danish Independent Public Company; — evidence that the Reinsurance Broker has a professional insurance policy with adequate liability coverage. If the tender is submitted by a consortium, the abovementioned shall be filled for each and all participants as to the relevant part of the Services to be provided by the entities in the consortium. If the Tenderer wishes to use subcontractors for whole or parts of the Services this shall be advised in the tender and the abovementioned shall be filled for each subcontractor as to the relevant part of the Services to be provided by the subcontractor. The tender shall furthermore specify the names of the subcontractors in question, and the work, which shall be subcontracted. III.1.2)

Technical and professional ability List and brief description of selection criteria: An important skill for EKF is that the Broker(s) has/have experience from the market for quite some time and have positive experience on transactions in the market similar to the requirements for reinsurance of EKF as specified above regarding the Services. Such experience shall be presented to EKF by the general description mentioned above in section III.1.1) together with up to ten relevant references per lot/framework agreement. If a Tenderer (only) submits a tender for either the Treaty Framework Agreement or the Facultative Agreement the Tenderer may include up to 10 references. If a Tenderer submits a tender for both the Treaty Framework Agreement and the Facultative Framework Agreement the Tenderer may include up to twenty (20) references. If a Tenderer includes more references than mentioned EKF will only include the first 10 or 20 respectively. Please pay close attention to the minimum requirements described below. Minimum level(s) of standards possibly required: Consequently, the following shall be attached to the tender: — details of minimum 1 example of assignments of reinsurance on portfolio basis for medium/long credit term reinsurance cover for commercial and political risks with debtors in different countries (the Treaty Framework Agreeement only). Any Tenderer can attach up to 10 references. — details of minimum 1 example of assignments of reinsurance on single transaction basis for medium/ long credit term reinsurance cover for commercial and political risks with debtors in different countries (the Facultative Framework Agreement only). Any Tenderer can attach up to 10 references.

Review procedure Precise information on deadline(s) for review procedures: Precise information on deadline(s) for review procedures: Pursuant to the Danish Act on the Complaints Board for Public Procurement (Act 492 as of 12.5.2010), the following deadlines apply to lodging of appeals: Section 7(2), clause 3: Appeals against tendering procedures must be lodged with the Complaints Board for Public Procurement within 6 months after the tenderer has entered into a framework agreement calculated from the day following the date when the contracting entity has notified applicants and tenderers cf. 171(4) of the Danish Public Procurement Act. No later than at the same time as lodging an appeal with the Complaints Board for Public Procurement, the appellant must provide written notice to the contracting entity about its intention to lodge an appeal with the Complaints Board for Public Procurement and whether said appeal has been lodged in the stand-still period. In the event that the appeal is not lodged in the stand-still period, the appellant must also state whether a stay of proceedings (suspensory effect) is requested.
