CALL TO ORDER 1. Vice-Chair Laura Blackburn officially called the meeting to order at 2:04 p.m. 2. Vice-Chair Laura Blackburn welcomed all people in attendance. 3. Approval of the August 29, 2013 meeting summary was approved with no amendments. AGENCY REPORTS 1. EPA Update – Carl Young a. Designations for the Sulfur Dioxide (SO2) Air Quality Standard www.epa.gov/so2designations/regs.html On August 5, 2013 EPA published in the Federal Register the initial round of SO2 nonattainment designations. EPA designated 29 areas in 16 states as nonattainment. EPA is not yet prepared to issue designations for all other areas and intends to address these areas in future actions. More information is available at: www.epa.gov/so2designations/regs.html b. EPA Proposals on the Houston Area State Implementation Plans (SIPs) for the 1997 Ozone Air Quality Standards The proposed approvals for the Houston area attainment demonstration and reasonable further progress SIPs were published in the Federal Register on September 9. These SIPs are for the 1997 ozone standard of 84 parts per billion (ppb). The current ozone standard is 75 ppb. The comment period closes October 9. Page 1 of 6

c. EPA regulation of power plant Greenhouse Gas (GHG) emissions (future plants, modified and reconstructed plants and existing plants) www2.epa.gov/carbon-pollution-standards On September 20 EPA announced a proposal to regulate GHG emissions from future power plants. Under the proposal: • New large natural gas-fired turbines would need to meet a limit of 1,000 pounds of carbon dioxide (CO2) per megawatt-hour • New small natural gas-fired turbines would need to meet a limit of 1,100 pounds of CO2 per megawatthour • New coal-fired units would need to meet a limit of 1,100 pounds of CO2 per megawatt-hour • New coal-fired units would have the option to meet a somewhat tighter limit if they choose to average emissions over multiple years Publication of the proposal will start a 60 day comment period. More information on the proposal, including a pre-publication copy and a fact sheet, is available at: www2.epa.gov/carbon-pollution-standards (look under regulatory actions). In a similar manner, EPA will be developing carbon emission standards for modified and reconstructed power plants. EPA plans to propose emission standards for modified and reconstructed power plants in June 2014 and finalize the standards in June 2015. EPA will also be addressing carbon emission standards for existing power plants under Clean Air Act section 111(d). Under the section 111(d) process: • EPA would propose emission guidelines in June 2014 • EPA would finalize the guidelines in June 2015 • State plans for existing plants would be due in June 2016 On November 7 EPA will have a listening session in Dallas on what the agency should be considering in drafting the proposed standards for existing power plants. The meeting will be from 10 to 3 in the 1st Floor Auditorium at the J. Erik Jonsson Central Library, 1515 Young Street, in Downtown Dallas. Process for Determining if Air Quality Monitoring Data has been Influenced by Exceptional Events www.epa.gov/ttn/analysis/exevents.htm Exceptional events are unusual or naturally occurring events that can affect air quality but are not reasonably controllable. The normal Clean Air Act regulatory process is not appropriate for exceptional events. Air quality monitoring data that has been influenced by exceptional events can be excluded in determining whether an air quality standard has been exceeded or violated. In 2007 EPA finalized an Exceptional Events Rule establishing the process for determining if air quality monitoring data has been influenced by exceptional events (March 22, 2007 Federal Register, 72 FR 13560). Under the process: • The State notifies EPA of its intent to exclude a measured exceedance of an air quality standard due to an exceptional event Page 2 of 6

• The State, after notice and opportunity for public comment, submits to EPA a request to exclude the data and an exceptional events demonstration, along with any comments it received • If EPA is satisfied with the demonstration, EPA does not include the data in determinations of exceedances or violations of the air quality standards There is a general deadline for when the exceptional events demonstration and public comments must be submitted to EPA. It is the lesser of: • 3 years following the end of the calendar quarter in which the measurement was recorded, or • 12 months prior to the date that a regulatory decision must be made by EPA For initial area designations of the 2012 PM2.5 air quality standard there is a separate deadline for submitting the exceptional events demonstration and public comments: • 2010 and 2011 data – due to EPA December 12, 2013 • 2012 data – due to EPA December 12, 2013 (Carl incorrectly stated 2014) • 2013 data – due to EPA August 1, 2014 There is no deadline in the rule for when EPA must complete its review of the exceptional events demonstration. EPA received a PM2.5 exceptional events demonstration from Texas for 2010. EPA has not completed review of the demonstration. In May EPA issued interim guidance to help state, local and tribal governments as they develop exceptional event demonstrations. EPA also announced its intention to propose and finalize revisions to the 2007 Exceptional Events Rule, which will incorporate into regulation important aspects of the Interim Guidance. 2. TCEQ Update – Lola Brown a. Public Hearings: Inspection and Maintenance (I/M) Rulemaking and State Implementation Plan (SIP) Revision http://www.tceq.texas.gov/rules http://www.tceq.texas.gov/airquality/sip/Hottop.html Public hearings will be offered in various areas of the state, including a hearing at the Houston-Galveston Area Council (H-GAC) on October 29, 2013 at 2:00 p.m. for the proposed I/M rulemaking (Rule Project No. 2013035-114-AI) and SIP revisions (Non-rule Project No. 2013-041-SIP-NR) implementing House Bill 2305. The comment period will close on November 4, 2013. Documents are available on the Rule Proposals web page and the SIP Hot Topics web page. Clean Air Interstate Rule Program (CAIR) http://www.tceq.texas.gov/airquality/banking/Air_Banking_CAIR.html The preliminary 2013 New Unit Pool Allocations and the 2017 General Pool Allocations for nitrogen oxides are available for public review and comment until September 30, 2013. Highly-Reactive Volatile Organic Compound (HRVOC) Emissions Cap and Trade (HECT) Program http://www.tceq.texas.gov/airquality/banking/hrvoc_ept_prog.html A 10% reduction from the existing HRVOC emission cap of 3,451.5 tons will begin with the 2014 calendaryear control period. The HRVOC emission cap will then be reduced in 5% increments at the start of each calendar-year control period for 2015, 2016, and 2017 for an overall 25% reduction. The final HRVOC emission cap is set at 2,588.6 tons for 2017 and all subsequent control periods. The preliminary HRVOC Page 3 of 6

allowance allocations for the 2014 and beyond control periods for eligible sites are available for public review and comment until October 18, 2013. Regional Ozone Update – Kevin McLeod a. TCEQ Region 12 Ambient Air Monitoring Report During the month of September, there was one 8-hour ozone exceedances at a non-regulatory monitor in the HGB region.

PRESENTATIONS 1. CLIMATE CHANGE ADAPTATION STUDY FOR THE BAYPORT TERMINAL – Lily Wells • Ms. Lily Wells with Port of Houston Authority delivered a presentation regarding the Climate Change Adaptation Study for the Bayport Terminal. The presentation covered an introduction, overview, the US DOT Gulf Coast Study, the Bayport Terminal Climate Change Study, Conclusions and Recommendations, and Questions and Answers. INFORMATION ITEMS 1. PM2.5 Task Force Update – Adrian Shelley a. Mr. Adrian Shelley briefed the committee regarding the PM Taskforce meetings on September 12 & 19, 2013. The update included the following: • September 12, 2013 The PM Taskforce and TCEQ discussed the schedule for TERP rule making following SB1727. Mr. Steve Dayton with TCEQ laid out the schedule for the various rule makings and guidance that will be issued around the new TERP. H-GAC has informally provided information about drayage trucks around the Port of Houston of use to TCEQ in the rule making. • September 19, 2013 TCEQ’s Mr. Jim Price with Mr. David Brymer delivered a presentation about the PM2.5 data and report; questions and answers followed. Ms. Carrie Paige with EPA encouraged the taskforce to begin their path forward document for submittal to EPA. The taskforce requested individual contributors for present and possible future projects. b. The next PM Taskforce Meeting is scheduled for November 12th, 2013. 2. H-GAC Update – Shelley Whitworth a. General • H-GAC submitted data to TCEQ relating to the Corporate Research Study indicating drayage truck activity; movement and inventory makeup. • H-GAC received a final work scope from Environ; currently, it’s in the H-GAC internal audit review process. Following this review, the project contract will be drafted, signed, reviewed and executed. b. H-GAC Board • H-GAC Board approved agreements with recommended entities for 19 Clean Vehicle Trucks; amount not to exceed $10 million. • H-GAC Board ratified the new RAQPAC Bylaws and Name Change. • H-GAC Board approved entering an agreement for an additional year with Edelman summing $192,500 for public outreach awareness campaigns. • H-GAC Board approved opening new Implementation Local Planning funding agreement with TxDOT for Clean Cities Program, Clean Vehicles Program, and Commute Solutions Program. 3. Clean Cities Coalition Status Report– Allison Carr a. The Clean Cities Coalition recently received grants from the Department of Energy (DOE). • Clean Cities Education Project is in the process of developing a GIS base map that will provide connections between fleets, alternative fuel infrastructure, and infrastructure providers. • Funding of $65,000 - $70,000 is available for local fleets to purchase Smith Electric Vehicles which are box trucks and step vans. Ideally, the grant will cover the incremental cost of the vehicle. The total project entails 30 truck purchases. ANNOUNCEMENTS a.
