Introduction to OHSE Management System 1.0 Scope This Occupational Health, Safety and Environment Management Plan (OHSE Plan) applies to all sites and offices of Ceglar Excavation Pty Ltd and any other sites or projects under management by the Company. This manual sets out recommendations and procedures for promoting an environmentally committed, healthy and safe workplace and of a safe and effective return to work if an injury or illness does occur. Occupational Health and Safety legislation requires employers to manage risks to health and safety. This means that we must find the hazards in our workplace (identify), decide how hazardous they are (assess), do something about them (eliminate or control), and keep working on and reviewing controls (monitor). We must also involve our Team Members in identifying hazards (consultation).

1.1 Purpose The purpose of this Occupational Health, Safety and Environment Management Plan is to establish and maintain an effective OHS management system. Ceglar Excavation Pty Ltd has implemented an OHS management system (OHSMS) so that they can achieve a consistently high standard in relation to the environment, health and safety performance. In addition, it will serve to ensure Ceglar Excavation Pty Ltd meets the obligations of its internal OHS policy and the relevant legislation. The relevant state OHS Acts aim to protect the health, safety and welfare of all people in every place of work. Under each Act employers, Team Members and the self-employed are required to meet certain standards of health, safety and welfare. Employers must: • Provide or maintain plant, equipment and systems of work that are safe and without risks to health. • Ensure that substances (chemicals) are used, stored and transported safely and without risks to health • Provide information, instruction, training and supervision. • Maintain the workplace in a safe condition, including entrances and exits. • Ensure the health and safety of contractors and visitors to the workplace. Team Members must: • Co-operate with their employers in their effort to maintain the required level of health and safety. • Take reasonable care of the health and safety of themselves and others.

1.2 Review Ceglar Excavation Pty Ltd will review this manual every two years and when legislative or operational changes require it. Management will undertake the review and Team Members will be consulted during and then notified of any final changes.

1.3 Document Control This Occupational Health, Safety and Environment Management Plan will be released as a controlled document. The controlling authority shall be David Ceglar. Non-controlled copies of the plan are not authorised for distribution or use within Ceglar Excavation Pty Ltd or to outside parties.

Occupational Health and Safety Ceglar Excavation Pty Ltd has developed and implemented a policy on Occupational Health and Safety. Every Team Member shall be aware of this policy and it shall be displayed in relevant locations. 2.0 OHS Policy Ceglar Excavation Pty Ltd has been established to provide Excavation works including sewers, pipe laying and manhole construction. Ceglar Excavation Pty Ltd accepts the responsibilities to provide a safe and healthy work environment for Team Members, contractors, visitors and client’s staff, where they are involved with Ceglar Excavation Pty Ltd. Objectives Ceglar Excavation Pty Ltd’s policy is to: • Comply with relevant OHS Acts and other legislative requirements. • Provide suitable, well maintained and safe plant and equipment • Provide written safety procedures and instructions to ensure the planned systems of work are implemented and continually followed. • Provide regular information, instruction, training and supervision to Team Members and contractors to safeguard their health and safety. • Provide support for injured Team Members during rehabilitation. • Monitor Team Member health and wellbeing. Responsibilities Ceglar Excavation Pty Ltd accepts responsibility to provide a healthy and safe workplace and encourages all Team Members to contribute to the company policy and objectives. Everyone is responsible for supporting this policy within their workgroup. Roles and responsibilities are defined in the OHSE Plan and include: • Establishing and supporting an effective mechanism for consultation and issue resolution between management and Team Members. • Actively promoting OHS and related policies and procedures. • Providing the resources needed to ensure a healthy and safe workplace. • Actively monitoring and reviewing to verify that procedures and instructions are implemented and that policy’s are amended as appropriate. Ceglar Excavation Pty Ltd is committed to a healthy and safe workplace and continued improvement to performance. This policy will be reviewed at least every two years or as changes require.

2.1 Assigning Responsibilities for OHS The Company To ensure the health, safety and welfare of their Team Members whilst at work, Ceglar Excavation Pty Ltd shall comply with the NSW and Victorian Occupational Health and Safety Acts (2000 and 2004 respectively), as well as all other relevant legislation. The Director Responsible for: • Ensuring the OHSE Plan is developed and implemented. • Ensuring that the OHSE Plan is included in the planning phase of any new project. • Monitoring the effectiveness of the OHSE Plan. • Promoting the commitment of Ceglar Excavation Pty Ltd to improving OHS performance. • Reviewing all investigations comprehensively to ensure their accurate completion and corrective actions. The Management Team (Supervisors) Responsible for: • Implementing the OHS and injury management system including policies, procedures and manual. • Ensuring compliance by all Team Members, contractors and visitors with regard to both the manual and policy. • Monitoring the effectiveness of the OHSE Management Plan. Team Members Responsible for: • Ensuring compliance with the OHSE Plan and all safe work practices. • Ensuring the health and safety of themselves and others in the workplace. • Immediately reporting any hazards, unsafe condition, dangerous occurrence or injury / illness to their supervisor. • Ensuring they are able to competently and safely perform their work.

Consultants/Contractors Responsible for: • Adhering to the safe work practices and any other health and safety requirements of Ceglar Excavation Pty Ltd. • Ensuring compliance with all relevant OHS legislation and standards. • The immediate provision of information regarding any hazard or incident they become aware of during their assignment to Ceglar Excavation Pty Ltd.

2.2 Management Liaison Representatives In matters relating to OHS, the Director of Ceglar Excavation Pty Ltd is the nominated and authorised officer to speak to external bodies on behalf of the company.

2.3 OHS Legislation Ceglar Excavation Pty Ltd shall ensure a safe and healthy working environment by adhering to the requirements of relevant state legislation and regulations relevant to OHS and Injury Management. In Victoria the current legislation is the OHS Act 2004 and OHS Regulation 2007. In NSW the current legislation is the OHS Act 2000 and OHS Regulation 2001.
