Letter From Your President It is common knowledge throughout the building and remodeling industries that time stands still for no one. With that said, my year as Association President is quickly drawing to a close. Before long I will be passing the honor over to Tony Myers who will undoubtedly continue to lead the York Builders Association in a great direction. As acting President for 2012 I have been overjoyed with the opportunity to be more involved behind the scenes at some of our larger events such as the Home Show and Parade of Homes. It has been a Jeff real eye-opener to witness how much hard work pours into these events from every corner of the Association. However, these events are not the only time I have been able to see the York Builders Association “family” in action. The Board meetings, committee meetings, seminars and luncheons I have been a part of always proved to be informative and of utmost importance to the advancement of the York Builders Association. I’d like to take just a minute to express my gratitude to all of our board members, committee members and directors at each and every level. Your participation and willingness to contribute will never go unnoticed. Thank You!

As outgoing President I hope to see everyone’s involvement with the Association continue to grow for years to come. As a quick word of advice to Tony, make sure to have fun. Gates Project in York City In June of 2011, a group of our members joined in an initiative to prevent crime in the West End of York City, installing iron gates between houses. Over the last year and a half each of those member volunteers has made an impact on the Gates Project. As the project continues, the gifts of one volunteer will be sorely missed.

Joanne Borders passed away in September just 2 days after our last installation. In her honor the installation of much needed gates at Liberty Court is planned. Until then, the York County Community Foundation has pledged to provide gates to anyone in the West End grid of the city wanting a gate. Because of our member volunteers and many others, the successes of the more than 270 gates installed to date will impact our community for years to come. And now, without restriction, future families will be blessed with a gate.

Parade of Homes This year’s Parade of Homes ecoed what is happening in the building industry in York and around the country. 16 out of the 17 entries were remodeled homes. The first time in YBA history that remodels out numbered new homes.

People’s Choice Winner RF Hager LLC

Homeowners came out to see what’s new as well as to get ideas for their home. Each home averaged 75 buyer unit visits. We’re hearing from the builders who participated that the homeowners were looking to buy. We have heard reports from the participants of the appointments booked and contracts signed as a direct result of their participation in the Parade of Homes. A note to suppliers and specialty trades contractors for 2013...Garrety Glass co-sponsored the Landis Custom Cabinetry & Woodworking home. As a co-sponsor, Mike Landis invited them to help staff the project during the tour. Garrety Glass sold a specialty glass shower enclosure because their sales rep was in the home talking with the visitors. We’re anxious to hear about the additional sales they are going to reap from their investment. Start talking to the builders and remodeler you work with to select your entry in the 2013 Parade of Homes.

Chefs on Parade Favorite Kitchen Kruzson Remodeling

Sponsored by Columbia Gas, Chefs on Parade was new this year and kicked of the Parade of Homes weekend. Five of the Parade remodelers and builder teamed up with area chefs. Tickets were sold with a portion of the proceeds benefitting Our Daily Bread. Over 160 people visited the Chefs homes enjoying tasty tidbits while enjoying a private showing of the homes. Congratulations to Kruszon Remodeling as they were voted favorite kitchen of Chefs on Parade. There was a tie for Favorite Chef going to Blue Moon Restaurant and Victor’s Italian Restaurant. Chefs was well received by the public so plans are underway for the 2013 Chefs on Parade. Did you know the Parade of Homes is still going on? This year the Virtual Parade is rounding out the event. YBA E-Cycled Thank you very much to everyone who helped to make this event a success. With the help of Jeff Korkie of ReSource York, and Jim Stuart of PAZ Metals, the YBA was able to raise money that will go toward scholarships for High School Seniors of members. As of press time, we do not have a total amount that was raised. Those that were gracious enough to volunteer and help out were: John Stein, Barry Strine, Jeff Henry, Bob Myers, Kim Craley, Nick Sabold, Paul Deller and Sheldon & the Youth Development Center boys. Also, your wonderful staff helped out, so a big thanks to Leah Spangler and Jim Miller! We accepted old computers, monitors, TV's, cell phones, printers, and telephones to name a few items. We hope this was just the beginning of holding events of this type and look forward to making some tweaks and holding another E-cycle event with hopes of doubling and tripling our proceeds for scholarship. 2013 Slate of Leadership Candidates Presenting your 2013 slate of candidates as presented by the York Builders Association Board of Directors. Elections will be held at the November 7th Membership meeting. See page 6 for meeting details. PRESIDENT Tony Myers Kinsley Construction I am a long time employee of Kinsley Construction beginning in the mud and progressing to Manager of Lexington Builders, part of the Kinsley umbrella of companies. We are a custom new home builder and remodeler in both Maryland and Pennsylvania. Serving on our Board of Directors the past two years and as Secretary/Treasurer this year has been a truly rewarding experience for me both personally and professionally. Serving as a volunteer leader has given me more than I have given in return.

VICE PRESIDENT Barry Strine Strine Heating & A/C I was born and raised in York, PA. I attended Central York High School and graduated with a BS Degree in Business Management from York College. Married Kathryn May 26, 1973 and have 3 children, Christopher, Mary Kate and Patrick. Joined my father, Paul Strine, in his new business, Strine's Service, in February 1974. Strine's moved their business to Sprigettsbury Township in January 1985 and incorporated in January 1986 as Strine's Heating and Air Conditioning, Inc.. Barry became president of Strine's after Paul's retirement in 1992. His son Christopher and nephew Eric Deardorff have joined Barry at Strine's. I have been active with the association as a member and chair of the Home Show Committee, a trustee of the YBA Insurance Trust, Chair of the Associates Committee, Associate Vice President of YBA, member of the Remodelers Council, and very active in YBA activities, most recently the YBA Membership Campaign and The City of York Safe Gates Project. The York Builders Association has been an asset to my company and to me as an individual. My affiliation with the association has been a tremendous learning experience. I would very much like to build upon these 10

experiences as a line officer. My previous chairperson positions, my Associate Vice Presidency and company ownership in the building industry gives me a unique perspective of the leadership requirements necessary to successfully fulfill this position.. I wish to return the favor, in time and dedication as a line officer, to an association that has been so instrumental in the success of my company and personal life. SECRETARY/TEASURER OPEN ASSOCIATE VICE PRESIDENT Bob Myers III John H Myers & Son, Inc. Bob is formerly the 4th generation owner of JOHN H. MYERS & SON, Inc., and now VP of Business Development for JOHN H. MYERS & SON, a US LBM company. Began career here in 1972 while still in high school. Went to Penn State University and received a B.A. Degree in Journalism. 2012 will be my 40th year in the building industry, all with JOHN H. MYERS & SON. I am active in numerous builder associations including the YBA, HBA, and HBAM, where I serve on several boards and committees. I encourage our associates at JOHN H. MYERS & SON to get involved as well. I also serve on the boards at York Habitat for Humanity and Penn State York. I am honored to serve on the YBA Board of Directors to help direct our association in all it’s efforts to achieve our mission statement which is: “To advocate for the building industry by promoting standards of ethics, education and services to members and the community”. Membership in the YBA for me has many benefits. It provides endless networking opportunities along with cost-saving benefits with many local and national companies. But the most important benefits for me, are the relationships and friendships I have developed over the years, which will last a lifetime.

BUILDER DIRECTORS 2-YEAR TERM ELECT (3) Sid Kohr Dorgan & Zuck Construction I grew up in Hanover, Pa. Graduated from Thiel College with a B.A in Economics in 1975. Married that same year to Ellen Bolton who has a Pa. teaching degree. Due to the somewhat similar economic times as we currently have; my wife and I took jobs not in line with our degrees. She in child care and I in the factory that I worked at growing up, my father being the Superintendent. I then moved on to manual labor in a construction company. I became a carpenter and helped build several hundred homes in all stages, including the one I still live in. In the early 80’s the economy was still stalled and I moved on to construction and manufacturing sales and service for a company. and stayed in that till, I moved back into construction in 2002. I am currently the V.P. of Dorgan & Zuck Construction. My responsibilities include sales, business development, project management and assisting in estimating .We have two children; one who works for Head Start in York and one who is a Physical Therapist in Hanover, Pa. My daughter gave birth to our first grandchild in July. I hope to see an huge economic turnaround soon and can spend more time with my wife and family and travel. Sid stands for his second (2) year term. Greg Hess Keystone Restorations & Builders, Inc. I Graduated from York Vo-Tech in 1985 with three years concentrated in Cabinetmaking. My Career started in the residential field from cabinetmaking, custom kitchen/bath installs, to commercial carpentry. After 19 years in the field I formed Keystone Restorations & Builders Inc. in June 2004. The company was founded on the business principles to present a complete, fair and reasonable estimate. Set Reasonable Customer Expectations

Begin the New Year on the New Website

Now is the time to place your advertisement on the YBA website.

Here are two commonly used sales phrases: "Set reasonable consumer expectations." "Under-promise and over-deliver." Both are important whether we are Associates Members or Builders Members. It is important to sell potential clients on the appeal of our offerings, but equally important to cover less glamorous aspects. Setting reasonable expectations on the front side and throughout the transaction will prevent or reduce the severity of disputes later.

Beginning in January, the YBA’s largest event geared toward homeowners, Home Show, will begin advertising. That advertising will direct homeowners to the YBA website where your advertisement can be waiting for them.

Offer achievable lead times for product and service delivery. Set sensible schedules that allow for the possibility of product, information and permit delays. If we know our services create messes, set expectations about how frequently we clean up and to what degree. Set expectations for replying to phone calls, texts or emails, then meet expectations. When questions arise and we don't have an immediate answer, give a practical lead time for our response.

The YBA website has been totally redesigned with the homeowner in mind. Vibrant, colorful site skins have been developed with the goal of attracting the female homeowner. The site is being populated with glamour shots of homes, before and after projects, and new product information. All to encourage the visitor to dream...plan...build...enjoy. Your ad would easily link to your website for someone to make their dreams come true.

If we talk about a warranty on our product, we should provide warranty papers. The same applies to maintenance instructions for products. If we are putting new product next to an old product, address in advance that the colors, textures or other physical attributes will not be a 100% match. Set expectations regarding acceptable tolerances for our workmanship. YBA offers a valuable program to its members and consumers. Our Consumer Assurance Program (CAP)establishes acceptable tolerances that create reasonable expectations for customers. CAP includes an Industry Standards Manual, which addresses the most commonly cited issues arising in new construction and remodeling. This program was created by our peers at YBA and reviewed by legal counsel. CAP even won an award from NAHB. Stop by YBA to review the Industry Standards Manual. Pick up some CAP brochures to hand out to potential clients at the beginning of the sales process. Even if the end user is not your customer, review the Industry Standards Manual to see what is expected of your trade or product.

Attorney George McDonald The Pennsylvania Mechanic’s Lien Law continues to provide a statutory method for a contractor or subcontractor to file and enforce a lien against the real property for which labor or materials are provided. You must follow the statutory notices and procedures, AND you must not have otherwise “waived” your mechanics lien rights. For residential construction, mechanics lien rights can be waived in advance of construction if the owner and general contractor enter into a stand-alone “Non-Lien Agreement” or “Stipulation Against Liens.” Mechanics lien rights can also be waived by agreeing to mechanics lien waiver language that is included in the terms and conditions of a written construction or remodeling contract. Recent changes to the Pennsylvania Mechanics Lien Law restrict the use of such mechanics lien waivers for commercial and industrial construction. The only mechanics lien waivers now permitted for non-residential construction are separate lien waiver documents that are signed at the time of, and in exchange for, payments made to the contractor/subcontractor. Assuming you have not otherwise “waived” your right to file a mechanics lien, you must strictly observe the notice and filing procedures established by the Pennsylvania Mechanics Lien Law. A description of those procedures is beyond the scope of this answer, but a key element of those procedures involves time limitations. To be enforceable, all mechanics lien notices must be given, and all mechanics lien claims must be properly filed, within 6 months from the date the last labor or materials were provided to the job site. Enlightenments from the EO government controls Fannie and Freddie. To expand HARP to include non-Fannie or nonFreddie loans would require congressional action. In February, the Obama administration urged Congress to take action, saying: "For responsible borrowers, there will be no more barriers and no more excuses." Romney adopted a skeptical tone about government-sponsored refinances in October 2011 when he told the Las Vegas ReviewJournal: "I think the idea of helping people refinance homes to stay in them is one that's worth further consideration, but I'm not signing on until I find out who's gonna pay and who's gonna get bailed out. And that's not something which we know all the answers to yet."

Jim Miller The Language that Effects Homebuilding I was fortunate enough to catch up with both Presidential candidates a few weeks ago and asked them some questions about their policies on housing. Both were on a tight sched ule but felt that having the ability to speak directly to the business owners of the Homebuilding Industry was important, so they took the time for us. What should the government do about housing? Romney's policy on foreclosure prevention has changed over the last year, from hands-off to something vaguely hands-on. On Oct. 17, 2011, Romney said: "Don't try to stop the foreclosure process. Let it run its course and hit the bottom, allow investors to buy homes, put renters in them, fix the homes up and let it turn around and come back up." On Sept. 21, the Romney campaign said: "A Romney-Ryan administration will make it easier for homeowners to get alternatives to foreclosure, such as short sales, deed-in-lieuof-foreclosure and shared appreciation."

What about Fannie Mae and Freddie Mac? Fannie Mae and Freddie Mac are stockholderowned companies that buy mortgages from lenders, package them as mortgage-backed securities and guarantee the securities when they are sold to investors. Because the companies had implicit government backing, executives took risks. The result: multibilliondollar losses that taxpayers are on the hook for. Fannie and Freddie now operate under conservatorship of the federal government. The question is what to do about the companies. It will take years and specific plans to reform or eliminate Fannie and Freddie. Both candidates offer bromides instead of proposals. "Mitt Romney will reform these governmentsponsored companies to protect taxpayers from additional risk in the future by ensuring taxpayer dollars in the housing market are replaced with private dollars," according to the campaign website. As for the president, "The Obama administration is committed to proceeding with great care as we work toward the objective of ensuring that government support is withdrawn at a responsible pace that does not undermine the economic recovery," according to a U.S. Department of the Treasury news release from February 2011.

The Obama administration released on Feb. 1 a "plan to help responsible homeowners and heal the housing market." It touted "12 months of forbearance to unemployed borrowers" and "increasing incentives for modifications that help borrowers rebuild equity as well as introducing legislation to aid veterans."

The news release suggests requiring minimum down payments of 10 percent, reducing mortgage loan maximum amounts and "ending unfair capital advantages" that Fannie and Freddie enjoyed.

What help should be given to underwater mortgages?

Obama signed the Dodd-Frank financial reform law that created the Consumer Financial Protection Bureau, which regulates mortgage lenders and servicers. Mortgage servicers handle monthly payments and perform foreclosures and loan modifications.

The Obama administration responded by starting the Home Affordable Refinance Program, allowing homeowners to refinance mortgages guaranteed by Fannie Mae or Freddie Mac. HARP didn't require congressional approval because the

After the 2012 State of the Union, the administration released a "plan to help

responsible homeowners and heal the housing market" that promoted a "fair set of rules" that would "allow lenders to be transparent about options and allow borrowers to meet their responsibilities to understand the terms of their commitments." It lists "core principals," including developing "a simple mortgage disclosure form to be used in all home loans" and minimizing conflicts of interest between mortgage servicers and investors. Over the summer, the CFPB proposed national servicing standards governing billing, mortgage modifications, foreclosures and short sales.

In September, the Romney campaign issued a policy paper on housing issues that said: Mitt Romney will put in place smarter regulations to restore a functioning marketplace that holds banks accountable and restart lending to creditworthy borrowers. Where the candidates stand on housing tax breaks? Where Romney has talked of eliminating a tax break on mortgages for second homes for high earners, Obama has proposed reducing a tax break on mortgages for primary and secondary homes for high earners. In April, NBC News reporter Garrett Haake overheard Romney as he spoke at a closeddoor fundraiser in Palm Beach, Fla. Haake quoted Romney as saying, "I'm going to probably eliminate, for high-income people, the second-home mortgage deduction." Romney added that he likely would eliminate deductions for state income taxes and property taxes, too. "By virtue of doing that, we'll get the same tax revenue, but we'll have lower rates." Obama has proposed limiting the mortgage interest tax deduction for households that earn more than $250,000 per year. OK, in the interests of full disclosure I did not actually speak with the candidates. Rather a Google search and some time on each candidate's website provided the answers above. But, if I had actually spoken with both of them........................ Remember, VOTE on November 6, your voice matters. Live Local! Build Local!

Hello Remodelors, It has been my pleasure to be your RC Chairperson for 2012. We accomplished a lot over the past year, and I am grateful for all the support and participation. In my opinion, the best thing we did this past year was to refocus the Remodelors’ Council with a new mission statement. Defining who we are and why we exist is the best first step towards a successful future, and I do believe the R.C. has a bright future. The other accomplishment I would like to hi-light was on our September Remodelors’ Council meeting. At that meeting we gained a lot of information on what is working, and what has not been working when it comes to our RC meetings. We also heard loud and clear the need to increase the value of being a member of the York Builders Association, and the Remodelors’ Council, by getting more knowledge of who the members are out to the general public. The task moving forward is to educate the public on why they should always use a member of the YBA, and not just some “Chuck in a Truck”! Lastly, I want to let you know another reason the Remodelors’ Council has a bright 2013 to look forward to: your incoming Chairperson Dave “Smitty” Smith. Smitty is dedicated to seeing the Association as a whole and the Remodelors’ Council succeed. Fueled with the knowledge of the industry he has, the suggestions of the September meeting, and the conference he recently attended, I believe Smitty will do a great job as our Chairperson.
