Terms and Conditions The Rebate Scheme applies to scheduled passenger flights only. This is relevant to this scheme as well. The application for the Rebate Scheme must be done in writing by the airline prior to the commencement of the new route. Airlines must have reached agreement with Jönköping Airport to operate a new route, have discussed and agreed a 3 year business plan for the route and received confirmation from the airport that the slots are available and agreed the terms of a Standard Ground Handling Agreement at the airport prior to applying for the Rebate Scheme. Any flights for which an application is made to the Rebate Scheme must be intended for operation for at least 1 year as a non stop service and it must be confirmed in writing by the airline that it intends to operate such flights for at least 1 year in the letter of application. The rebate will not be paid to the airline in the case that the airline has not followed the payment obligations detailed in the Jönköping Airport Price List and Regulations. The airline must be fully compliant with the terms and conditions published at Jönköping Airport to qualify for the rebate. Rebates will be applied and paid retrospectively on a quarterly basis. For the sake of clarity, a rebate of 1,000,000 SEK allowable in a year will be applied quarter i.e 250,000 SEK will be rebated to airlines meeting the criteria and the minimum operating rotations in the respective quarter and paid at the end of the quarter. All amounts due to Jönköping Airport AB or its affiliates must be paid in order for any rebate to become due and payable. For the avoidance of doubt, the application of the rebate scheme will under no circumstances result in rebates, in aggregate, being in excess of the charges and fees payable to Jönköping Airport AB or its affiliates in terms of Take Off Fees, Passenger Fees, Passenger Handling Charges and Ramp Handling Charges. In respect of the same time period, the airline shall pay a minimum charge of 1 SEK per passenger such that the rebate scheme never exceeds 100% of the charges in terms of Take Off Fees, Passenger Fees, Passenger Handling Charges and Ramp Handling Charges. In the event that Jönköping Airport AB is of the opinion that an airline is manipulating its flight programme either independently or jointly with other airline(s) in order to qualify for the Rebate Scheme, the airline will be disqualified from receiving any rebates under the Rebate Scheme until further notice.

  5

If an airline does not operate the minimum weekly rotations for 12 consecutive months, Jönköping Airport will have the right to request a repayment of any rebate amount paid by Jönköping Airport to the airline on the basis that the airline did not fulfil the terms and conditions of the Rebate Scheme, in which case, and upon the receipt of which request such repayment shall become immediately due and payable. The new destination may be launched with fewer than 2 weekly flights, but must have reached a minimum of 2 weekly year round flights within one year from the start to the same destination. An airline proposing to launch a new destination shall not have operated to that destination in the previous 6 months, in which case such airline will not be eligible for the Rebate Scheme. The 6 month period does not apply in the case that an airline decides to operate a route which another airline has (recently) ceased to operate. If an airline contracts with another airline, either as a franchise, operating company or as a (full) lease operation, this will be considered as one Airline Company operating the route. If another airline provides services on the same route during the existing incentive period, that airline may also be entitled to the same discount. The incentive period ceases when the entitlement is no longer valid for the first airline. Jönköping Airport reserves the right to review and modify the terms and conditions of the Rebate Scheme at any time and may also in its absolute discretion determine to withdraw the Rebate Scheme. Any such decision by Jönköping Airport will however not have retrospective effect. Jönköping Airport reserves the right to refuse or disregard any application to the Rebate Scheme which does not meet the terms and conditions mentioned above. Such decision of Jönköping Airport is final. Jönköping Airport shall not be liable for any costs, expenses or damages in relation to or resulting from the Rebate Scheme. This Rebate Scheme is subject to and may be modified or terminated in accordance with all applicable laws or other decisions decrees or judgements of competent authorities. The Jönköping Airport Rebate Scheme is valid as of 1st June 2010 until the Rebate Scheme is revised by Jönköping Airport in which case such revision will be disclosed on the web page of Jönköping Airport (www.jonkopingairport.se). Jönköping Airport will accept retrospective applications from airlines meeting the scheme terms and conditions from 1st January 2010 to 31st May 2010 if applications are made by 30th June 2010 and the airlines meet the terms and conditions of the scheme for the whole period.   6
