Massachusetts Gaming Commission Gaming Regulations The Massachusetts Gaming Commission, acting with the regulatory authority provided under M.G.L. Chapter 194 of the Acts of 2011 “An Act Establishing Expanded Gaming in the Commonwealth” has adopted the following regulations with respect to expanded gaming, horse racing, harness horse racing, and greyhound racing in the Commonwealth of Massachusetts.

The following is a list of gaming regulations that apply to this manual. A complete list of the Massachusetts Gaming Commission regulations, 205 CMR, can be found on the Commission’s website, http://massgaming.com/regulations/gamingregulations/.

Section I: Procedures for Transporting Slot Machines To or From a Licensee Casino/Hotel Facility SCOPE: The procedures described in this section shall apply to any movements of slot machines into or out of the Commonwealth to a licensee’s casino/hotel facility. NOTICE: Responsibility of Person or Entity Shipping Machines Before any slot machines are shipped, the person or entity shipping the machines (i.e., manufacturer, distributor/representative or casino licensee) must provide 5 day prior notice in writing to the IEB or their designee assigned to the casino to which the machines are to be shipped. The IEB or their designee assigned to the casino to which the machines are to be shipped will verify receipt of this notice. The above notice must contain the following information. 1. The full name and address of the person or entity shipping or moving said machines; 2. The full name and address of the person who owns the machine, including the name of any new owner in the event ownership is being changed in conjunction with the shipment or movement; 3. The method of shipment or movement and the name of carrier(s); 4. The full name and address of the person or entity to whom the MASSACHUSETTS GAMING COMMISSION

machines are being sent and the destination of said machines if different from such address; 5. The quantity of machines being shipped, make and the serial number of each machine; 6. The expected date and time of delivery to or removal from any authorized location in the Commonwealth; 7. The port of entry or exit, if any, of said machines if the origin or destination of the machine is outside the continental United States; and 8. The reason for transporting the machine(s). MOVEMENT AND USE APPROVAL: The casino licensee will be responsible for contacting IEB to arrange for the inspection of the machines. Inspection of CCTV is required for movements of all slot machines, and will be reviewed and verified by the IEB or their designee. If inspection of the slot machines is required, the date and name of the individual(s) contacted along with the scheduled inspection date shall be recorded in the designated area on the Notification Log. The IEB shall be notified of the movement of slot machines 5 days in advance of such movement. The IEB or their designee shall be authorized to approve the use of the machines. See the appropriate sections for additional approvals necessary if the movement pertains to progressive machines (Section IX).

INSPECTION:

Once the slot machines have been received and placed in locations within the casino that have been approved by the IEB the casino licensee may request approval to use the machines from the IEB. NOTE:

It should be noted that in such cases the casino licensee will be responsible for ensuring the slot machines comply with the approved prototype. Any deficiencies uncovered by the IEB or their designee when the machine(s) are inspected may result in a formal complaint being filed against the casino licensee by the IEB.

The following inspection criteria will be also among those applied in the inspection process: 1. The operational blueprint shall be reviewed by the IEB or their designee to determine compliance with the MGC regulations as they pertain to zoning of machines within a casino. 2. Inspection of all ancillary equipment. 3. The IEB, MGC GTL and/or CITL will perform an inspection which will include, but not be limited to, an inspection of the program, the award glass, the reel strips, the payout percentages, ticket in ticket out (TITO), the denomination, all ancillary equipment and sealing of the EPROMS, disk drives and any other sensitive areas as needed. 4. The camera coverage of the slot areas will be certified by the licensee’s surveillance department. An IEB gaming agent or their designee will review and verify the CCTV coverage.

GAMING: Each slot machine will have an MGC Asset Tag affixed to it by an IEB gaming agent. This tag shall be located on either side and on the outside of the slot machine cabinet in an easily accessible location. MACHINE MOVEMENT LOG: A copy of the request with the attached slot control log shall be maintained by the slot department in a binder or in an approved electronic storage format which will serve as the Machine Movement Log. PAYOUT PERCENTAGE SHEET CODE LOG: Each casino licensee shall maintain a binder or an approved electronic storage file to be referred to as the "Payout Percentage Sheet Code Log." The binder or an approved electronic storage file shall contain all Payout Percentage Sheets relative to the slot machines on the casino floor. The casino licensee shall assign, as a code, a unique numeric or alpha-numeric number, in sequential order, to each Payout Percentage Sheet. The casino licensee shall indicate the applicable code on the Slot Control Log and the Payout Sheet. The casino licensee may use the manufacturer's program identification number and version in the Slot Control Log and Slot Master Listing in lieu of assigning its own Payout Percentage Sheet Code. The binder or approved electronic storage file shall also contain the relative information that determines the payout percentage for specialty machines (i.e., rules of the game for Video Blackjack, Keno and winning combinations for Video Draw Poker as approved by the Commission). The casino licensee shall indicate the applicable code on the Slot Control Log and the Payout Schedule Sheet. It is the responsibility of the casino licensee to maintain and update this log. Commission and Division staffs shall be given free and unfettered access to the Payout Percentage Sheet Code Log upon request.

PRINTS AND REPORTS: As required by 205 CMR 145.01 the casino licensee shall be responsible for submitting to the IEB the updated Slot Master List every 30 days. NOTE:

If any movement of slot machines requires a modification to the authorization granted in the Certificate of Operation issued to the casino licensee, prior to the movement of any machine, a formal petition requesting that modification must be filed with and approved by the IEB.

Section II: Procedures for Transporting Slot Machines to or from the Casino Floor to or from Any Location Outside Of the Licensee Casino/Hotel Facility within the Commonwealth of Massachusetts SCOPE: The procedures described in this section shall apply to any movement of slot machines to or from the casino floor to any location outside the licensee casino/hotel facility but within the Commonwealth of Massachusetts. POSSESSION: It is to be emphasized that any shipment of slot machines can only be made to a person or entity who can legally possess slot machines in this Commonwealth. NOTICE: The casino licensee shall submit 5 days prior notice in writing a Notification Log to the IEB or their designee containing the following information: 1. The full name and address of the person or entity shipping said machines; 2. The method of shipment and the name of the carrier; 3. The reason for transporting the machines; 4. The full name and address of the person or entity to whom the machines are being sent and the destination of said machines if different from such address; 5. The quantity of machines being shipped and serial number of each machine; MASSACHUSETTS GAMING COMMISSION

6. The expected date and time of shipment of the machines from their point of origin; 7. The expected date and time of arrival of the machines at their destination; and 8. The full name of the owner of the slot machines, if different than in Item #1 above. For leased games, the licensee should be listed as the owner. A copy of the notification must accompany the slot machines during the shipment. INSPECTION: Prior to the removal of a machine(s) from the slot base the licensee shall verify and certify that the following has been completed: 1. The machine's slot cash box was removed and transported to the Count Room. 2. All meters have been read and recorded. 3. All Accounting and Security locks have been removed from the slot machine and returned to the appropriate department. STATE SEALS: In the case of machines being shipped within the commonwealth the MGC Asset Tags will remain intact. NOTE:

IEB will be responsible for breaking any evidence tape or seals if necessary

For those machines that will be placed in an approved storage area within the commonwealth and are subject to return to the casino floor at a later date, the following procedures shall take place prior to removal of same. 1. Gaming seals and/or MGC Asset Tags will remain on the slot machines; 2. An additional gaming seal shall be affixed by IEB staff personnel in a position between the lock side of the slot machine door and the side of the cabinet (evidence tape should also be applied over the gaming seal). The casino licensee may place clear packing tape over the evidence tape and seal to prevent seal breakage. The machine may be wrapped in packing tape; 3. To assure proper adhesion, the casino licensee shall clean the applicable area of the door and cabinet with a liquid cleaner such as acetone, alcohol, etc., before applying the seal; and 4. Each additional gaming seal affixed shall contain the following information: (a) name of casino/hotel complex; (b) serial number of slot machine; and (c) date seal was affixed. If the gaming seal(s) placed between the lock side of the slot machine door and the side of the cabinet are intact and not broken when the slot machine is returned to the floor an IEB inspection will not be necessary. MOVEMENT NOTIFICATION: In all cases where the IEB office is not available for immediate notification the IEB gaming agent on duty should be given the written movement notification. MGC - Chief Information Officer, IEB - Assistant Director Gaming Agents and Division Chief and IEB - Senior Supervising Gaming Agent should also be copied on the movement notification. MACHINE MOVEMENT LOG A copy of the Notification Log with an attached Slot Control Log shall be maintained by the slot department in a binder or in an approved electronic storage format which will serve as the Machine Movement Log which will serve as the Machine Movement Log. PRINTS AND REPORTS: As required by 205 CMR 145.01 the casino licensee shall be responsible for submitting to the IEB the updated Slot Master List. NOTE:

Section III: Slot Machines to Be Removed From the Casino Floor to an Approved Storage or Repair Area within the Casino/Hotel Facility SCOPE: The procedures described in this section shall apply to slot machines being removed from the casino floor to an approved storage or repair area within the casino/hotel facility. INSPECTION: Prior to the removal of a machine(s) from the slot base the casino licensee shall certify the following has been completed: 1. The machine’s slot cash box was removed and transported to the Count Room as required. 2. All meters have been read and recorded 3. All Accounting and Security locks have been removed from the slot machine(s) and returned to the Accounting and security Departments. COMMONWEALTH TAGS AND SEALS: For those slot machines that will be placed in storage and shall not be returned to the casino floor at a future date the IEB Asset Tags will removed by the licensee and returned to the IEB. The licensee will include documentation indicating the IEB Asset Tag number and game serial with the tag. NOTE:

Prior to removal, the IEB will be responsible for breaking any evidence tape.

For those machines that will be placed in an approved storage area and are subject to return to the casino floor at a later date, the following procedures shall take place prior to the removal of the same: 1. MGC Asset Tags will remain on the machines; 2. A gaming security seal shall be affixed by IEB staff personnel in a position between the lock side of the slot machine door and the side of the cabinet. The casino licensee may place clear packing tape over the evidence tape and seal to prevent seal breakage. The machine may be wrapped in packing tape 3. To assure proper adhesion, the casino licensee shall clean the applicable area of the door and cabinet with a liquid cleaner such as acetone, alcohol, etc., before applying the seal; and 4. Each additional gaming security seal affixed shall contain the following information: (a) name of the casino licensee (b) MGC Asset Tag Number (c) serial number of slot machine; and (d) date seal was affixed. 5. If the gaming seal(s) placed between the lock side of the slot machine door and the side of the cabinet are intact and not broken when the slot machine is returned to the floor an IEB inspection will not be necessary.

NOTIFICATION: The casino licensee will provide the IEB or their designee with written notification for the movement of the slot machine(s) 5 days in advance of the movement. The IEB or their designee shall sign and/or stamp the Notification Log acknowledging receipt of the notification. It will be the responsibility of the casino licensee to forward a copy of the Notification Log to the IEB. If the IEB designee signs and/or stamps the notification acknowledging receipt the designee should forward the notification to the IEB. MACHINE MOVEMENT LOG: A copy of the Notification Log with the attached Slot Control Log shall be maintained by the Slot Department in a binder or approved electronic storage format which will serve as the Machine Movement Log. PRINTS AND REPORTS: As required by 205 CMR 145.01 the casino licensee shall be responsible for submitting to the IEB the updated Slot Master List. NOTE:

If any movement of a slot machine requires a modification to the authorization granted in the Certificate of Operation issued to the casino licensee, prior to the movement of any machine, a formal petition requesting that modification must be filed with and approved by the IEB or its authorized designee.

Section IV: Slot Machines to Be Removed From an Approved Storage or Repair Area within the Casino/Hotel Facility to the Casino Floor SCOPE: The procedures described in this section shall apply to slot machines being removed from an approved storage or repair area within the casino/hotel facility to an already approved location on the casino floor. POSSESSIONS: By Licensee as described herewith. NOTICE: Prior to the removal of slot machines from an approved storage or repair area within the facility to an already approved location on the casino floor, the casino licensee shall provide written notification 5 days in advance of the movement to the IEB or their designee. The IEB, MGC GTL and/or the CITL responsible for floor testing should be copied on the Notification Log. If the machines were modified in any way while in storage or repair, the casino licensee will be responsible for contacting the IEB, MGC GTL and/or CITL to arrange for inspection of the machine(s) involved. The date and name of the individual(s) contacted along with the scheduled inspection date shall be recorded in the designated area of the Notification Log request. If the machine(s) were not previously on the casino floor, refer to Section I.

INSPECTION: If an inspection is required for those machine(s) returning to an approved location(s) on the casino floor from an approved repair area, the casino licensee will be responsible for contacting the IEB, MGC GTL and/or CITL as required to arrange for the inspection of the machines. The IEB shall be authorized to approve the use of the slot machines. NOTE:

It should be noted that in such cases the casino licensee will be responsible for ensuring the slot machines comply with the approved prototype. Any deficiencies uncovered by the IEB, MGC GTL or CITL representative when the machine(s) are inspected may result in a formal complaint being filed against the casino licensee by the IEB

For those machines returning to an approved location(s) on the casino floor from an approved storage area, no inspection is necessary if the additional gaming seal/evidence tape is intact; however, if the seal is missing or broken, inspection by the IEB or designee will be required. MOVEMENT AND USE APPROVAL: The casino licensee will provide written Notification Log 5 da y s in advance of the slot machine movement to the IEB or their designee. The MGC - Chief Information Officer, IEB - Assistant Director Gaming Agents and Division Chief and IEB - Senior Supervising Gaming Agent should be copied on the notification. If the machines being placed on the casino floor require inspection(s), it will be the casino licensee’s responsibility to contact the IEB, MGC GTL or CITL as required to arrange for the inspection of the machines. The date and name of the individual(s) contacted along with the scheduled inspection date shall be recorded in the designated area of the Notification Log. CCTV inspection will be completed and certified by the licensee’s Director of Surveillance or their designee. The IEB or their designee will review and verify the CCTV coverage. It should be noted that the IEB will decide if a CCTV inspection is MASSACHUSETTS GAMING COMMISSION

necessary. The IEB shall be authorized to approve use of the slot machines. NOTE:

Section V: Approval of the Progressive Slot Machines Submission SCOPE: The procedures described in this section shall apply to the approval of progressive slot submissions. (Thirty day review period.) Elements of a submission should include the following: 1. Current PC Sheets; 2. Proposed PC Sheets; and 3. Cover letter summarizing the requested change. NOTICE: Prior to establishing or modifying progressive slot machines or making changes to a previously approved Notification Log, progressive slot machine submission, the casino licensee shall submit a written request Notification Log to the IEB. CCTV inspection coverage will be certified by the licensee’s surveillance department. CCTV coverage will be reviewed and verified by the IEB or their designee. Attached to the Notification Log must be the new or revised request reflecting the new locations, the number of machines being added/deleted from an existing progressive link or any modification to an existing progressive unit. The filing of a Notification Log shall be required for the following: 1.

Installing a progressive machine or link unit.

2.

Transferring a progressive jackpot.

3.

Increasing the probability of winning the jackpot.

4.

Changing the reset amount.

5.

Changing the progressive controller/controller program (any change/upgrade or servicing).

6.

Decreasing/increasing the denomination of the slot machine

NOTE:

When decreasing the denomination of an existing progressive, the required wager to win the progressive jackpot cannot be increased, i.e., existing $.25 denomination progressive requires 3 coins ($.75) to win progressive jackpot, if changing denomination to a $.05, then number of coins required to win progressive cannot exceed 15 coins ($.75).

7.

Replacing the slot machine program with a program having the same probability.

8.

Relocating a progressive controller.

9.

Increasing or decreasing the number of machines in a link progressive unit.

10. Installing or removing a common progressive display unit. 11. Rate of Progression Changes. 12. Placing, changing or establishing a payout limit.

NOTICE:

Items #8, #9, #10 and #11.

A formal approval letter will not be required on changes to a progressive slot machine submission for Items #8, #9, #10 and #11. The casino licensee will submit the appropriate paperwork detailing the change to the IEB for review. The casino licensee will be responsible to arrange for inspection of the equipment and machines as necessary. NOTICE:

Item #12.

A formal approval letter from the IEB will be required on changes outlined in Item #12. It requires the posting of a notice of not less than thirty days in advance of the proposed changes. Prior to modifying the machines, the appropriate procedures described elsewhere in this manual shall be followed. See the appropriate sections for the Movement/Reduction/Increase of progressive slot machines on the casino floor (Section IX) or removing progressive slot machines from the casino floor once the progressive jackpot has been awarded (Section X). The approval letter from the IEB shall be attached to the request for the modification if applicable INSPECTION: If any of the proposed changes require a modification to the authorization granted in the Certificate of Operation issued to the casino licensee, a formal petition requesting that modification must be filed with and approved by the MGC or its authorized designee prior to implementation. MULTI-CASINO PROGRESSIVE LINK UNIT OR PROGRESSIVE LINK WITH MACHINES OF DIFFERENT DENOMINATIONS OR THAT REQUIRE DIFFERENT MAXIMUM WAGERS TO HIT THE PROGRESSIVE JACKPOT

The initial review and approval for a multi-casino progressive link unit or a progressive link with machines of different denominations or that require different maximum wagers as well as changes to such existing links will be reviewed and approved by the IEB in conjunction with the MGC. The casino licensee will submit to the IEB a Notification Log outlining the proposed change for review and approval. Review by the IEB will not be necessary for Items #8, #9, #10 and #11 listed above. The MGC - Chief Information Officer, IEB - Assistant Director Gaming Agents and Division Chief and IEB - Senior Supervising Gaming Agent, will be copied on the Notification Log. The casino licensee shall submit the Notification Log to the IEB and MGC for review. The changes outlined in Items #1 through #11 may be instituted at any time after approval has been received from the IEB and the requisite inspections have been obtained. The changes outlined in Item #12 requires the posting of a notice of not less than 30 days on each of the progressive machines location(s) involved. Upon the expiration of the time period, the approved changes must be made unless the IEB is notified in writing prior to the expiration of the time period that the changes will not occur. Any future request involving this machine will require a new Notification Log. Nothing in this section shall preclude the casino licensee from removing progressive slot machines from the casino floor in accordance with Section X of the manual. Prior to implementing any progressive slot machine changes as detailed in this section, the casino licensee shall contact the IEB, MGC GTL and/or CITL for related inspections as required. The appropriate procedures described in Section IX of this manual shall be followed. See the appropriate sections of this manual for Movement/Reduction/ Increase of progressive slot machines on the casino floor (Section IX) or removing progressive slot machines from the casino floor once the progressive jackpot has been awarded (Section X). NOTE:

DEFINITIONS: AUTOMATIC RESET - The slot machine which hit the jackpot must be reset by the key switch located on the side of the slot machine in order for the link progressive unit to be reset. Only the slot machine involved in the jackpot locks up. No other keys are necessary. EXTERNAL RESET - External reset systems utilize a key switch which are externally mounted on the slot stand to reset the link progressive unit. Every slot machine in the link locks up when the jackpot occurs. In addition, the slot machine which hit the jackpot must be reset by the key switch located on the side of the slot machine. Section VI: Slot Machines Being Relocated From One Approved Location to another Approved Location on the Casino Floor Excluding Progressive Slot Machines SCOPE: The procedures described in this section apply to all slot machines being relocated from one approved location on the casino floor to another approved location on the casino floor, excluding progressive slot machines. POSSESSION: By licensee as described herewith. NOTICE: Prior to the movement of slot machines from one approved location on the casino floor to another approved location on the casino floor, the casino licensee must provide 5 day prior notice in writing via Notification Log to the IEB or their designee. If the movement involves progressive slot machines, from one approved location to another approved location, refer to Section IX. If the movement of the progressive slot machines involves any additional changes and/or modifications, (i.e., reduce link, change display meter, etc.) refer to Section V. Section VII: Denomination and Percentage Modifications of Slot Machines SCOPE: The procedures described in this section shall apply to denomination and percentage modifications of slot machines. NOTICE: For denomination and percentage modifications the casino licensee shall submit a written request Notification Log to the IEB. If the modifications pertain to progressive slot machines, also refer to Section V. MODIFICATION AND USE APPROVAL: Denomination modifications are restricted to already approved denominations within the Commonwealth only. If a denomination and/or percentage modification requires a RAM clear and that the slot machine’s options must be reset an IEB gaming agent must be notified prior to utilizing the machines for gaming. For denomination modifications that do not require a RAM clear or game option changes the casino licensee can assume approval to use. The IEB will retain the right to inspect the machines at a later date. Any deficiencies uncovered by the IEB’s inspection may result in a formal complaint. The casino licensee will be responsible for contacting the IEB, MGC GTL and/or the CITL to arrange for an inspection of the machines. The date and name of the individual contacted along with the scheduled inspection date shall be recorded in the designated area of Notification Log. Section VIII: Other Modifications of Slot Machines SCOPE: The procedures described in this section apply to other modifications not addressed in this manual. Examples of other modifications would be physical and operational modifications. NOTICE: The casino licensee shall submit a written request Notification Log to the MGC and IEB for approval. If the modification has received approval through a manufacturer’s request, the approval letter must be attached to the request. The request for other modifications shall detail the proposed modifications and be accompanied by a print, schematic, block diagram or machine analysis as needed. MODIFICATION AND USE APPROVAL: The casino licensee shall be responsible for contacting the IEB, MGC GTL and/or CITL to arrange for an inspection of the machines. The date and name of the individual contacted along with the scheduled inspection date shall be recorded in the designated area of the Notification Log. The casino licensee must submit the completed request Notification Log to the IEB 5 days prior to the scheduled inspection date. The IEB in consultation with the MGC GTL and/or CITL shall be authorized to approve the modification upon receipt of the completed request. Section IX: Procedures for Progressive Slot Machines and Stand-Alones Being Relocated From One Approved Location to another Approved Location on the Casino Floor and/or the Reduction/Increase of Machines in a Progressive Link SCOPE: The procedures described in this section apply to progressive slot machines being relocated from one approved location to another approved location on the casino floor and/or the reduction/increase of slot machines in a progressive link unit and the movement of stand-alone progressive slot machines. NOTICE: Prior to the movement of progressive slot machines from one approved location to another approved location or the reduction/increase of slot machines in a progressive link unit the casino licensee must provide 5 day prior notice in writing Notification Log to the IEB or their designee. CCTV inspections will be completed and certified by the casino’s surveillance department. The IEB will review and verify the CCTV coverage. Attached to the Notification Log must be a revised sheet reflecting the new locations and/or the reduction/increase in the number of machines. If the movement of progressive slot machines involves any additional changes and/or modifications (i.e., change program EPROM, reducing/increasing link, change display), also reference Section V. All meters will be taken as required and the Progressive Jackpot amount will be recorded on a progressive reset slip prior to the movement of the slot machine and given to the IEB or their designee for verification. MOVEMENT AND USE: The casino licensee will be responsible for contacting the IEB or their designee to arrange for the inspection of the machines. The date and name of the individual(s) contacted along with the scheduled inspection date(s) shall be recorded in the designated area(s) of the Notification Log. If CCTV inspection is not required, a notation indicating “CCTV inspection not required” shall be made on the Notification Log. It should be noted that the IEB or their designee must review and verify that CCTV inspection is not required and indicate the results of such verification on the Notification Log. The casino licensee must submit a copy of the Notification Log to the IEB or their designee prior to the scheduled inspection date(s), if applicable. The IEB or their designee shall be authorized to approve the movement of the progressive slot machines and/or the reduction/increase in the number of progressive slot machines in a progressive link unit upon receipt of the completed notification. Once the IEB or their designee, if required, has signed off on the Notification Log, the IEB or their designee shall authorize the use of the machines. It should be noted that approval to use a machine will not be given until any and all deficiencies uncovered in the inspection(s) of the machine and CCTV inspection are corrected. Section X: Progressive Slot Machines Being Removed From the Casino Floor SCOPE: The procedures described in this section shall apply to progressive slot machines being removed from the casino floor once the progressive jackpot amount has been awarded to a winning patron. NOTICE: Twenty-four hours prior to removing progressive slot machines from the casino floor, the casino licensee shall submit written Notification Log to the IEB or their designee. The casino licensee shall also submit an approved Notification Log which provides for either an entire link lockout at the time of the progressive jackpot hit or the return of the progressive jackpot meter(s) to a static jackpot amount with a zero progression rate. If the link must be modified to provide an entire link lockout, the procedures described in Section XI should be followed. If the static jackpot is selected, another Notification Log which approves the removal of the progressive feature(s) (pay glass, etc.) from the link must also be submitted. In lieu of the entire link lockout or the use of a static jackpot amount a transfer of the progressive liability may take. INSPECTION: Prior to the removal of a machine(s) from the slot base the casino licensee shall verify and certify that the following has been completed: 1 The machine's slot cash box was removed and transported to the Count Room. 2 All meters have been read and recorded. 3 All Accounting and Security locks have been removed from the slot machine and returned to the appropriate department.

STATE SEALS: In the case of machines being shipped within the commonwealth the MGC Asset Tags will remain intact. NOTE:

IEB will be responsible for breaking any evidence tape or seals if necessary.

For those machines that will be placed in an approved storage area within the commonwealth and are subject to return to the casino floor at a later date, the following procedures shall take place prior to removal of same. 1. Gaming seals and/or MGC Asset Tags will remain on the slot machines; 2. An additional gaming seal shall be affixed by IEB staff personnel in a position between the lock side of the slot machine door and the side of the cabinet (evidence tape should also be applied over the gaming seal). The casino licensee may place clear packing tape over the evidence tape and seal to prevent seal breakage. The machine may be wrapped in packing tape; 3. To assure proper adhesion, the casino licensee shall clean the applicable area of the door and cabinet with a liquid cleaner such as acetone, alcohol, etc., before applying the seal; and 4. Each additional gaming seal affixed shall contain the following information: (a) name of casino/hotel complex; (b) serial number of slot machine; and (c) date seal was affixed. 5. If the gaming seal(s) placed between the lock side of the slot machine door and the side of the cabinet are intact and not broken when the slot machine is returned to the floor an IEB inspection will not be necessary. APPROVAL: The IEB or their designee’s approval shall be indicated by his/her signature and the date on the original Notification Log. It shall be the responsibility of the casino licensee to forward a copy of the approved Notification Log to the MGC - Chief Information Officer, IEB - Assistant Director Gaming Agents, Division Chief and IEB Senior Supervising Gaming Agent, within 24-hours after the removal of the progressive slot machines from the casino floor. If the IEB or their designee receives the notification, the designee shall forward the approved notification to MGC - Chief Information Officer, IEB - Assistant Director Gaming Agents and Division Chief and IEB - Senior Supervising Gaming Agent. MACHINE MOVEMENT LOG: A copy of the Notification Log with the attached Slot Control Log shall be maintained by the slot department in a binder or in an approved electronic storage format which will serve as the Machine Movement Log which will serve as the Machine Movement Log. Section XI: Slot Machine Prototype Approval SCOPE: The procedures described in this section shall apply to slot machine prototype approval. NOTICE: The manufacturer or distributor shall submit a letter to the MGC and IEB of its intent to submit a slot machine for prototype to the MGC GTL and/or CITL for approval. It should be noted that the manufacturer must apply for licensure prior to submitting any product. A copy of the request shall also be submitted to the IEB, MGC - Chief Information Officer, IEB - Assistant Director Gaming Agents and Division Chief and IEB - Senior Supervising Gaming Agent, for formal approval prior to the shipment of any prototype product into the Commonwealth to the MGC GTL and/or CITL for testing. The IEB or their designee shall advise the manufacturer/distributor when to submit a notice of shipment. The MGC GTL and/or CITL shall acknowledge receipt of the prototype shipment. Each manufacturer’s/distributors initial request for prototype approval must be accompanied by a $500 permitting fee. The notice of shipment shall be forwarded by the manufacturer/distributor in advance to the MGC - Chief Information Officer, IEB - Assistant Director Gaming Agents and Division Chief and IEB - Senior Supervising Gaming Agent. Prior to transporting any slot machines into the Commonwealth, the manufacturer, distributor, seller, or other person shipping such machines shall notify the IEB in writing, of such shipment giving the following information: 1. The full name and address of the person or entity shipping said machines; 2. The full name and address of the owner of the machines if different than 1 above; MASSACHUSETTS GAMING COMMISSION

3. The method of shipment and the name of the carrier or carriers; 4. The full name and address of the person or entity to whom the machines are being sent and the destination of said machines if different from such address; 5. The quantity of machines being shipped, make and serial number of each machine; 6. The expected date and time of shipment of the machines from their point of origin; 7. The expected date and time of arrival of the slot machines at their destination within this state; and 8. The port of entry, if any, of said machines. Unless otherwise directed, these slot machines will be transported directly to the IEB, MGC GTL and/or CITL as required. Along with the shipment, a set of the prints, schematics, block diagram, circuit analysis, payout percentage sheet, award glass facsimile and a comprehensive and technically accurate description and explanation in both technical and lay language of the manner in which the device operates and the payout percentage is achieved. This description is to be signed under penalty of perjury.

Section XII: Destruction of Slot Machines SCOPE: The procedures described in this section shall apply to any slot machine being destroyed in the Commonwealth. NOTICE: Prior to the destruction of any slot machine(s), the person or entity destroying the machine(s) (i.e., manufacturer, distributor/representative or casino licensee) must send a notice of destruction to the MGC - Chief Information Officer, IEB - Assistant Director Gaming Agents and Division Chief and IEB - Senior Supervising Gaming Agent. The above notice must contain the following information: 1. The full name and address of the person or entity destroying the machines; 2. The place of destruction; 3. The method of destruction; 4. The quantity of machines being destroyed, the serial number of each machine and the MGC Asset Tag number for each machine; and 5. The expected date and time of destruction of the machines. The notice should be mailed sufficiently in advance of the destruction so that it will be received by the MGC - Chief Information Officer, IEB - Assistant Director Gaming Agents, Division Chief and IEB - Senior Supervising Gaming Agent. above at least MASSACHUSETTS GAMING COMMISSION

five working days prior to the actual destruction of the machines. The IEB or their designee will assign a gaming agent to monitor the actual destruction of the machine(s). Immediately prior to the destruction of the slot machine(s), the metal identification tag containing the slot machine serial number, the MGC Asset Tag and any gaming seals will be removed and turned over to the IEB staff personnel witnessing the destruction.

Section XIII: Procedures for Slot Machine Payouts of Merchandise SCOPE: The procedures described in this section shall apply to the approval of merchandise jackpot submissions. (All references to merchandise jackpots also refers to anything of value.) NOTICE: The filing of a Notification Log shall be required for the following: 1. Installing a slot machine offering a merchandise jackpot; 2. Increasing the probability of winning the merchandise jackpot (requires prior IEB approval); 3. Establishing a time limit for: a. Decreasing the probability of winning the merchandise jackpot. b. Increasing the denomination of the slot machine. c. Changing the terms of the merchandise offering; The following can be accomplished through modification paperwork: 4. Replacing the slot machine program with a program having the same probability (requires prior IEB approval); and 5. Decreasing the denomination of the slot machine. The casino licensee shall submit the Notification Log to the IEB along with blueprints identifying the location and specifications of signs or displays (pay glass) as required for approval. If a sign or the actual merchandise is displayed, the following must also MASSACHUSETTS GAMING COMMISSION

be submitted as necessary: a Certification from the Director of Surveillance, an Architectural and Engineering Certification concerning the structural integrity of the suspension system(s) and a Sight-Line Analysis if required by the MGC. The casino licensee must submit procedures which address the awarding of merchandise to a patron. At a minimum, these procedures shall include the documentation given to the patron at the time of the jackpot supporting the winning of the merchandise. The receipt shall be a two-part form, at a minimum, one copy shall be issued to the patron and one copy shall be agreed to the triplicate copy of the Payout Slip or stored data as required. A new slot machine offering a merchandise jackpot may be instituted at any time after approval has been received from the IEB and the requisite inspections have been obtained. The changes outlined in Item #3 a bov e requires the posting of a notice of not less than 30 days in advance of the proposed changes. Upon expiration of the time period, the approved changes must be made unless the IEB or their designee is notified in writing prior to the expiration of the time period that the changes will not occur. Any future request involving this machine will require a new Notification Log. The Items in #4 and #5 above can be accomplished through modification paperwork and the required inspections. INSPECTIONS: The casino licensee will be responsible for contacting the IEB to arrange for the inspection of the slot machine(s) and/or review and verification of CCTV coverage, if required. The date and names of the individuals contacted along with the scheduled inspection dates shall be recorded in the designated areas of Notification Log. If a slot machine inspection and/or CCTV inspection is not required, a notation indicating “Slot machine inspection not required” and/or “CCTV inspection not required” shall be made on the IEB contact line Notification Log. Is should be noted that the IEB or their designee must indicate that a CCTV inspection is not required on Notification Log.

APPROVAL: The approval letter from the IEB shall be attached to the Notification Log and forwarded to the MGC - Chief Information Officer, the IEB - Assistant Director Gaming Agents - Division Chief and the IEB - Senior Supervising Gaming Agent.Once the IEB has signed off on Notification Log (if required), the IEB or their designee shall be authorized to approve the opening of the slot machines and the use of the merchandise jackpots. In conjunction with Notification Log, the casino licensee must submit procedures which address the awarding of merchandise to a patron. At a minimum, these procedures shall include the documentation given to the patron at the time of the jackpot supporting the winning of the merchandise. The receipt shall be a two-part form, at a minimum, one copy shall be issued to the patron and one copy shall be agreed to the triplicate copy of the Payout Slip or stored data as required. A new slot machine offering a merchandise jackpot may be instituted at any time after approval has been received from the IEB and the requisite inspections have been obtained. The changes outlined in Item #3 a bov e requires the posting of a notice of not less than 30 days in advance of the proposed changes. Upon expiration of the time period, the approved changes must be made unless the IEB or their designee is notified in writing prior to the expiration of the time period that the changes will not occur. Any future request involving this machine will require a new Notification Log. The Items in #4 and #5 above can be accomplished through modification paperwork and the required inspections.

Slot Machine Control Log Guidelines – Casino Licensee

SCOPE: The guidelines described in this section shall apply to the required slot machine control logs.

NOTICE: The Massachusetts Gaming Commission requires that a slot control log be included with all required slot machine submission documents, slot machine activity requests and MGC approvals. It is the responsibility of each casino licensee to comply with the Massachusetts Gaming Commission requirements to provide current and accurate slot machine and CMS information. The information provided on the slot control log will be used to populate and continuously update the MGC CMS slot file. This will ensure that the CSM slot file is accurate and up to date and the reliability of communication between the all slot machines and the MGC CMS.

PROCESS: Each slot control log will be made up of a series of columns that contain specific information needed to populate the MGC CMS slot file. These columns must be arranged in a specific order so that each of the data fields align with the import requirements for the CMS. Each row must contain all the required information that makes up the individual slot machine record within the CMS slot file. All fields which make up the individual slot records on the slot control log are required and must be complete unless otherwise noted.
