DISTRIBUTIONS 



The Trustee shall not make any distributions to beneficiaries without first obtaining authorization from the attorney for the following: o Basic shelter-related expenses, which include:  Room;  Rent;  Mortgage payments;  Real property;  Taxes; and  Utilities o Food  Attorney should consider only if funds are to be used for dining out occasionally or to have special foods periodically delivered. o Clothing, even if an item could be subjectively construed as a "luxury" item  Attorney should consider whether the article of clothing is "extra" but is more desirable to the beneficiary because the item is newer or more stylish. o Cash, checks, or money orders for any purpose  Attorney should only consider small, irregular amounts of personal spending money, which includes "reasonable" funds for the occasional purchase of gifts for family and friends or for donations to charities or churches. The Trustee may make distributions for the expenditures listed below. o Please note: When a distribution is made for one of these purposes, the funds cannot be transferred to the beneficiary in any form including cash, checks, or money orders. The Trustee must issue the distribution to the store, vendor, or provider directly. Otherwise, the distribution is likely to be deemed "income" to the beneficiary.  Acupuncture/Acupressure;  Appliances for private use by the beneficiary, such as:  Telephones;  Cable Television;  Televisions;  Radios and other sound equipment;  Cameras; o Film o Recorder and tapes o Development of film  VCR/DVD player;  Microwave;  Bottled water or water service;  Memberships in clubs;  Book clubs  Health clubs 5

 CD or DVD clubs  Zoo membership  Advocacy groups  Museum membership Subscriptions to magazines or newspapers; Computer hardware, software, programs, and Internet service; Courses or classes (academic or recreational) and necessary supplies;  Including paying for time and expense of a personal assistant necessary to enable the beneficiary to access or receive supplemental services Reimbursement for attendance at or participation in conferences, meetings, seminars, or training sessions;  Including paying for time and expense of a personal assistant necessary to enable the beneficiary to access or receive supplemental services Reimbursement for attendance at or participation in recreational or cultural events;  Including paying for time and expense of a personal assistant necessary to enable the beneficiary to access or receive supplemental services Travel and vacations;  Including paying for time and expense of a personal assistant necessary to enable the beneficiary to access or receive supplemental services Tickets to concerts or sporting events;  Including paying for the ticket of an accompanying companion Dental work not covered by Medicaid; Over-the-counter medications;  Includes vitamins, herbal remedies, etc. Pet and pet's supplies, veterinary services; Exercise equipment or special medical equipment if not covered by Medicaid; Cost differential between a shared room and a private room (for beneficiaries placed at nursing homes); Massage; Dry cleaning and/or laundry services; Burial expenses; Haircuts/salon services; Holiday decorations, parties, dinner dances, holiday cards; Legal fees/advocacy; Linens and towels; Musical instruments, including lessons and music; Snow removal, landscaping, & lawn service; Stationary, stamps, cards, etc.; 6

Visiting friends, companionship; Services of a Representative Payee, Conservator, Guardian, or other protective services; Counseling & guidance not provided by Medicaid; For someone outside of the agency to visit periodically and monitor the services the beneficiary receives; Items that Medicaid or other governmental programs do not cover or has denied payment or reimbursement, even if those items include basic necessities  Examples: nicer wheelchair, communication devices Therapy services not covered by Medicaid (including physical, occupational, and speech); and Participation in hobbies, sports, or other activities.
