INTRODUCTION Pell Frischmann has been commissioned by the P&R Williams partnership (Trading as Rural Retreats and Leisure) to undertake an Extended Phase 1 Habitat Survey at Polvellan Manor in Looe, Cornwall. Polvellan Manor has been vacant for many years and extensive restoration plans are proposed. Additional residential accommodation is proposed in two blocks on either side of the manor house (see proposed layout plan in Appendix C). There are extensive broadleaf woodlands around the house which have been neglected for many years. A restoration programme is proposed to ensure sufficient woodland regeneration to sustain the habitat and landscape. Sufficient ecological information is required to fully inform the site design and the proposed works. Reports will enable the project to satisfy all current UK and European legal wildlife requirements, as well as national and local planning regulations. All public bodies have statutory obligations under the Natural Environment and Rural Communities Act 2006 to conserve and enhance biodiversity. 1.1
SCOPE OF WORKS The impacts of the proposed works may be significant so it is important that all ecological indicators are identified and correctly assessed. Sufficient ecological information is required to fully inform the site design and the proposed works. The Extended Phase 1 Habitat Survey comprises the following elements:

SITE LOCATION The site is located on OS grid reference SX 250 537 which is shown in Figure 1 and extends to an area of approximately 1.3hectares. Page 1 Frischmann

A detailed survey was carried out of the trees within the area shown in Figure 2. Trees in adjoining properties which might be affected by the proposals were also considered.

NATIONAL POLICY AND LEGISLATION
2.1
NATIONAL LEGISLATION The Wildlife and Countryside Act (WCA) 1981 (as amended) is the principal mechanism for the legislative protection of wildlife in the UK and is divided into four parts, the first section of which details the protection of wildlife. This legislation protects wild animals listed in Schedule 5 and wild flowers which are listed in Schedule 8. All wild birds and their eggs and nests are protected, with special protection for birds listed in Schedule 1. Invasive plants listed in Schedule 9 must not be spread or propagated in any way. The Conservation of Habitats and Species Regulations 2010 protects animals listed on Schedule 2 and plants listed on Schedule 5, also known as European Protected Species. The Regulations allow the designation and protection of Special Areas of Conservation (SACs), Special Protection Areas (SPA’s) and RAMSAR sites. These are collectively known as Natura 2000 sites. A development which would have an adverse effect on the conservation interests for which a Natura 2000 area has been designated should only be permitted where:
there is no alternative solution; and
There are imperative reasons of over-riding public interest, including those of a social or economic nature.
Where a priority habitat or species (as defined in Article 1 of the Habitats Directive) would be affected, prior consultation with the European Commission is required unless the development is necessary for public health or safety reasons. These conditions also apply to any European protected species that may be present. The Protection of Badgers Act 1992 provides protection to Badgers and their setts from injury/fatality, damage and any form of disturbance however this does not extend to protection of other habitats Badgers may utilise. The Hedgerows Regulations 1997 controls the removal of important hedgerows in the countryside through a system of notification and covers all hedgerows except those which are ‘within or marking the boundary of the curtilage of a dwelling house’. The Natural Environment and Rural Communities (NERC) Act 2006 places an obligation on all Local Planning Authorities to conserve and protect biological diversity and the natural environment. Section 40 of the Act concerns biodiversity and states: ‘Every public authority must, in exercising its functions, have regard, so far as is consistent with the proper exercising of those functions, to the purpose of conserving biodiversity.’ The Act states that: ‘it is important that public authorities seek not only to protect important habitats and species, but actively

POLVELLAN MANOR EXTENDED PHASE 1 HABITAT SURVEY R73015V002/A seek opportunities to enhance biodiversity through development proposals, where appropriate.’ This legislation also details those species for each country that are of Principal Importance for Conservation of Biological Diversity. UK Biodiversity Action Plans (UK BAP) do not provide any legal protection for the habitats or species listed but highlights those that are of conservation concern, details why they are of concern and the actions required to prevent further declines and to encourage habitat/population expansion. Three types of Action Plan (Species Action Plans (SAPs), Habitat Action Plans (HAPs) and Local Biodiversity Action Plans (LBAPs)) have been developed by the UK Biodiversity Action Plan steering group which set priorities for nationally and locally important habitats and wildlife. It is this BAP framework that forms the basis of the habitat and, to a certain extent, the species surveys for this scheme. The statutory basis for species and habitats listed in BAPs is provided by Section 41 of the Natural Environment and Rural Communities (NERC) Act 2006. The UK and the Cornwall Biodiversity Action Plans are relevant to the area surveyed. Species of principal importance for the conservation of biodiversity in England (as identified under the Countryside and Rights of Way Act, 2000 (CROW Act, 2000)) should be protected from adverse impacts of development. To ensure that the habitats of these species are not adversely impacted upon, the planning authority may impose planning conditions or obligations. 2.2
PLANNING POLICY The National Planning Policy Framework (NPPF 2012) sets out the Government’s policies on protection of biodiversity through the planning system. These policies are expected to be incorporated into development planning documents at regional and local scales, and are also of material worth in considering individual planning applications. The NPPF states the “The planning system should contribute to and enhance the natural and local environment by minimising the impacts on biodiversity and providing net gains in biodiversity where possible, contributing to the Government’s commitment to halt the overall decline in biodiversity, including the establishment of coherent ecological networks that are more resilient to current and future pressures”.

ASSESSMENT METHODOLOGY This assessment follows the methodology of an Extended Phase 1 Habitat Survey, which aims to identify habitat features of particular value to different plant and animal groups. The methodology used for this survey implements those detailed by the Institute of Environmental Assessment (IEA) (1995) and the Joint Nature Conservation Committee (JNCC) (2007). A site visit was completed in order to map general habitats present in the area. The survey also aimed to record any evidence of the species groups outlined below, including habitat features with the potential to support them:
Plant species of significant value, particularly European Protected Species;
Nesting birds, particularly specially protected species;
Animal species protected under UK legislation and European legislation;
Invasive species, particularly Japanese Knotweed and Giant Hogweed which are listed under UK legislation.
An assessment was made of the suitability of the site to support roosting bats. An internal and external survey of all buildings was undertaken. A survey was also undertaken to determine the presence of Barn Owls within any of the structures or trees. This information allowed the requirement for more detailed species surveys to be evaluated.

DESKTOP STUDY This desktop study utilises a range of information sources, including the Multi Agency Geographic Information for the Countryside (MAGIC) to ascertain potential impacts of the scheme. Records have been made available by the Environmental Records Centre for Cornwall and the Isles of Scilly (ERCCIS). These records are presented in within Appendix A.
4.1
DESIGNATED SITES The MAGIC interactive maps (www.magic.gov.uk) and English Nature’s Nature on the Map (http://www.natureonthemap.naturalengland.org.uk) were used to identify designated nature conservation sites located in close proximity to the scheme, with additional information supplied by ERCCIS.
4.1.1
Statutory Designated Sites The proposed scheme is not located within a statutory designated area. There are no Sites of Scientific Interest (SSSI) located within 2 km of Polvellan. Kilminorth Local Nature Reserve is located 200m to the west of Polvellan. There is a narrow yet continuous woodland link between the two. This site is unlikely to be affected by any aspect of the proposed development.
4.1.2
Non-statutory Designated Sites Information provided by ERCCIS indicates that there are several non statutory designated sites within 1 km of the application site. These include Three County Wildlife Sites CN 1.3 St Martins to Cleeve Wood CN 1.6 East Looe River West Bank (Trenant to Tregarland Wood) CN 12.1 West Looe River to Watergate Polvellan is also within 1 km of the Woodland Trust Reserve at Trenant. County Wildlife Sites (CWS) are the most significant areas for wildlife in Cornwall outside Sites of Special Scientific Interest (SSSIs) and Special Areas of Conservation (SACs). County Wildlife Sites contain features that are of substantive nature conservation value at a county level of significance. None of these sites are likely to be affected by the proposed development at Polvellan.

Tree Preservation Orders All of the trees on site are protected under the Polvellan Tree Protection Order reference E2/07/TPO/00075. The site is also within the Looe Conservation Area, so no tree work can be undertaken without prior consultation.
4.2
SPECIES RECORDS
4.2.1
Environmental Records Centre for Cornwall and the Isles of Scilly Records of protected and notable species which have been identified within a 1 kilometre of the site have been procured from the Environmental Records Centre for Cornwall and the Isles of Scilly (ERCCIS). Designation maps and details of notable species can be found in Appendix A. There are a large number of bird and botanical records for the Looe area, which have been reviewed but not included in this report. Full details of all local records are available on request. A summary of the records for notable species have been included within this section. This summarises those European Protected Species (Habitat Regulations) and UK Statutory Protected Species (Wildlife and Countryside Act (WCA). Bats There are recent records for two bat species only. In view of the quality of habitat available bats would appear to be under recorded. Bat species recorded include:
Lesser Horseshoe Bat (Rhinolophus hipposideros)
Barbastelle Bat (Barbastella barbastellus)
Otters (Lutra lutra) There is a single local record for Otter from 1990 but there are no recent sightings within 1km. Barn Owl (Tyto alba) There are 5 barn owl records within 1km of the application site, which suggests there is a healthy local population and good foraging habitat (Tawny Owl has also been recorded). Badgers (Meles meles) There are 9 local records for badgers within a 1km radius.

POLVELLAN MANOR EXTENDED PHASE 1 HABITAT SURVEY R73015V002/A Dormouse (Muscardinus avellanarius) There are recent records for dormice within 1km. Other Notable Species with national levels of protection There are extensive bird records for the Looe area which include a wide range of waders and migrant species which visit the estuaries. Protected species include Kingfisher, Greylag Goose, Garganey, Greater Scaup, Purple Sandpiper, Long tailed Duck, Cirl Bunting, Peregrine, Little Gull, Black tailed Godwit, Common Scooter, Storm Petrel, Wimbrel, Ruff, Black Redstart, Slavonian Grebe, Black necked Grebe, Pied Avocet, Green Sandpiper, Redwing, Fieldfare, Barn Owl, and Hoopoe have also been recorded. Killarney fern (Trichomanes speciosum) is a European protected species and is present within Kilminorth Woods. There are no recent records for otters or common reptiles. These records are indicative of a wide range of high value habitats within a short distance of the house and grounds. The proximity of extensive ancient woodland, parkland, two river corridors and coastal habitats will influence the biodiversity of the Polvellan site, and increase the likelihood of protected species being present.
5.
SITE SURVEY FINDINGS AND POTENTIAL IMPACTS An ecological walkover survey was undertaken on 21st January 2013 by a suitably qualified ecologist. The weather was fine with good visibility. The findings of the survey are detailed in the following sections. A Phase 1 Habitat Plan is presented within Appendix B. The survey included an inspection of all buildings to determine their suitability to support bats. A survey was also undertaken to determine the likelihood of Barn Owls nesting on site.
5.1
HABITAT TYPES A range of habitat types were identified on site which have been classified using the Joint Nature Conservation Committee (JNCC) phase 1 code. Polvellan Manor is located on a north facing slope adjacent to the old mill pool (currently a car parking area). The property extends over a length of 340m and is dominated by mature broadleaf woodland.
5.1.1
Pell
Broadleaf Plantation Woodland (A1.3.2) Approximately 70% (0.92ha) of the total site area is broadleaf woodland plantation dominated by beech trees. Sweet chestnut and pedunculate oak are also Page 8 Frischmann

(see Polvellan Arboricultural report Pell Frischmann R73015V001/A March 2013 Most of the mature trees are even aged and suggest planting in the period 1860 1875. There is little natural regeneration and much of the shrub layer is dominated by Rhododendron ponticum. Other tree species present include:

There are indications that bluebells (Endymion non-scriptus) and Ramsons (Allium ursinum) are frequent, with male fern (Dryopteris felix-mas) soft shield fern (Polystichum setiferum), hart’s tongue (Phylitis scolopendrium) and ivy (Hedera helix). The ground flora is restricted by widespread the presence of Rhododendron ponticum. The woodland is not registered as ‘ancient semi natural woodland’ by Natural England.

5.1.3
Ephemeral / short perennial (J 1.3) An area of former hard standing and car parking (approximately 0.07ha) which has become overgrown with a range of ruderal species including Hypericum hirsutum, Rumex obtusifolius, Scrophularia nodosa, Rubus fruiticosus agg., Poa pratensis and occasional Carex pendula. Buddleja davidii, Salix caprea and Betula pubescens are colonising the edges of this habitat. This area may have the potential to support common reptile species such as slow worm, common lizard and grass snake.

5.1.4
Buildings (J 3) Polvellan Manor was originally constructed in the eighteenth century and extended during both the nineteenth and twentieth century’s. The buildings occupy and area of approximately 0.2 hectares) The slate roof structure is complex with several valleys, skylights and a belfry structure. The house has been disused for several years and many windows are missing or partly sealed over. Lead has been removed from the roof creating potential access points for bats.

5.1.5
Walls (J2.3.5) There is a large stone retaining wall to the east of the manor house. This is well pointed with limited ivy growth and is generally of low ecological value. There are lengths of dry slate wall alongside the front driveway and along the south side of the lower woodland track. These walls support a range of fern and bryophyte species. Earth Bank (J2.3.8) There is a length of north facing earth and rock bank to the west of the manor house. This has been colonised with bryophytes, bramble, polypody fern and navelwort.
5.1.7
Bare Ground (J4) Asphalt and hard standing areas cover approximately 0.11 hectares of the site. The hard standing area to the west of the manor house (see plate 8) supports a range of moss and early successional plants. TARGET NOTES Target notes provide supplementary information on sites of interest, and information on sites which are too small or difficult to map. They may also highlight sites which require additional survey effort. Target Note 1 A single large sweet chestnut tree (Castanea sativa) was recorded close to the front entrance. This veteran tree is likely to be more than 200yrs old. Parts of the main trunk are dead and the tree is likely to support a wide range of invertebrate species. It also has high potential to support roosting bats. Plate 9: Target note 1 veteran sweet chestnut tree
Target Note 2 Throughout the woodland there are large mature trees which have the potential to support roosting bat species. These tend to be oaks which support more ivy than the mature beech trees, and retain more dead wood in their crowns and higher branches. These trees tend to be at the western end of the site away from the manor house.

Target Note 3 Rhododendron ponticum was recorded through large sections of the woodland area forming a dense or scattered shrub layer. Rhododendron ponticum is an invasive species which shades out native flora. It is also an important host plant for Sudden Oak Death Disease (Phytophthora ramorum) which can in turn lead to the rapid death of species such as beech and sweet chestnut. A careful search was undertaken to identify any setts or latrines within the woodland but none were recorded. Plate 12: Badger ‘up and over’ track into western woodland
Target Note 5 There is a small area of Japanese Knotweed (Fallopia japonica) growing alongside the road opposite to the car park entrance. Japanese Knotweed is invasive and the infestation currently covers an area of approximately 10 m².
5.3
PROTECTED SPECIES
5.3.1
Breeding Birds No nesting sites were identified during the survey but there were a significant number of suitable nesting habitat areas within the woodland areas. The woods may also provide temporary shelter for waders and other species which forage on the estuary mud flats and saltmarsh.
5.3.2
Bats An internal and external survey of all the manor house was undertaken to identify potential roosting features and entrances to the roof space.

POLVELLAN MANOR EXTENDED PHASE 1 HABITAT SURVEY R73015V002/A The buildings were assessed as having medium to high suitability to support roosting bats. The manor grounds and surrounding area provide excellent habitat for roosting and foraging bats. Two bat species have been recorded within 1km of the site. No bats were recorded during the survey. One small area of old droppings was found in the main roof space, which appeared to be Brown Long-Eared Bat (Plecotus auritus). Further surveys were not possible at this time of year. 5.3.3
Barn Owls All buildings, sheds and mature trees were checked for possible barn owl nesting sites. No nesting sites were recorded. No owl pellets or feathers were identified.
5.3.4
Badgers There are 3 possible badger runs entering Polvellan woods from the western end of Pollean Lane. Runs appear to pass through the woods and out to the Millpool car park. Searches failed to locate any latrines or setts within the site. No activity was identified within 100m of the proposed construction area.
5.3.5
Dormice Dormice are known to occur in Kilminorth woods, but full surveys of the adjoining Pollean light industrial site in 2011 found no dormice (Pers. comm.). This is the site between Polvellan and Kilminorth Local Nature Reserve, and nest boxes were located within 30m of Polvellan woods in similar habitat. Hazel is very scarce at Polvellan so the presence of dormice is thought unlikely.
5.3.6
Otters There are no close records for otters but their presence in the river is likely. No suitable otter habitat was recorded at Polvellan.
5.3.7
Reptiles Suitable habitat conditions exist for Common Reptile Species e.g. Slow Worms, Grass Snake and Common Lizard on the hard standing area to the west of the manor house. No signs of reptiles were recorded during the survey, but this area may be affected by the proposed development.

Other species No other protected species were identified during the survey.

INVASIVE WEEDS A small area of Japanese Knotweed was identified alongside the road (Target Note 5) during the survey. It is an offence to cause the spread of Japanese Knotweed in the wild under the Wildlife and Countryside Act 1981 and all waste containing Japanese knotweed comes under the control of Part II of the Environmental Protection Act 1990.
6.
POTENTIAL IMPACTS AND REQUIREMENT FOR FURTHER SURVEYS The layout for the proposed new buildings and demolition area is shown in the Polvellan Proposal Block Plan which is shown in Appendix C. Besides restoration and conversion of the manor house buildings, additional residential blocks are proposed for construction on the level ground to the east and west. Likely impacts will include:
Extensive repairs and alterations are proposed to the existing Manor House. Some signs of bat activity have been recorded within the roof space and parts of the roof were difficult to access and unsafe to survey. Bats are European protected species and the presence or absence of bats needs to be ascertained. An emergence bat survey is recommended to determine whether bats are currently making use of the buildings.
The construction works will impact on a proportion of the bare ground area to the west of the Manor House and the ephemeral short perennial vegetation to the east. These areas have the potential to support common reptiles that are at risk of disturbance and direct harm. Common reptiles are protected under the Wildlife and Countryside Act. A survey to determine their presence or absence is recommended. If reptiles are present, habitat mitigation will be required within the newly landscaped areas.
The construction work at the western end of the site will result in the permanent loss of approximately 250 m ² of broadleaf plantation woodland. In view of the overall size of this habitat this is a minor adverse impact at the local scale.
The construction work at the western end of the site will impact on surrounding trees and shrubs which are likely to be used as nesting sites by birds. Any tree or shrub removal should not be undertaken during the bird breeding season (March to September). If trees need to be removed during

If nesting birds are found to be present, no clearance work can be undertaken until it can be demonstrated that all fledglings have left.
The western development may impact on an area of earth bank. It is likely that this impact will only be temporary and the bank will be re-cut allowing recolonisation over time.
Impacts on dormice are unlikely.
The proposed construction area is unlikely to impact on badgers.
Further surveys for barn owls, badgers, dormice or breeding birds are not required
7.
MITIGATION AND ENHANCEMENT MEASURES
7.1
BROADLEAF PLANTATION The construction works will result in the permanent loss of 250 m ² of broadleaf plantation woodland. This equates to less than 3% of the total plantation habitat. Issues relating to wildlife connectivity will not be affected by the current proposals. Woodland plantation to the north and south of the proposed buildings will not be impacted. New tree planting is proposed in woodland areas recently damaged by storms. The new planting will sustain the woodland habitat and result in an overall minor enhancement of the site. Extensive additional woodland habitat improvements are proposed in section 8.
7.2
NESTING BIRDS Vegetation clearance and tree work should be avoided between March and September which is recognised as the bird nesting season. If vegetation clearance has to take place during this period an ecological watching brief will be required, however delays could be encountered if nesting birds are found. Vegetation clearance and construction work will not be able to take place within 5 metres of any nesting sites. Due to the removal of trees, there will be a temporary loss of bird breeding habitat until the replacement landscaping works mature. Alternative nest sites should be provided in the form of nest boxes. These should be located in areas where trees and scrub are retained, and a minimum of six boxes should be erected in suitable locations.

BATS Bat mitigation measures may be required if the buildings due for renovation are found to contain roosting bats. A bat emergence survey will confirm their presence or absence. If bats are present a licence from Natural England may be required before roof repair works can be undertaken, and additional mitigation measures may be required. If bats are present, care will also need to be taken to ensure that external lighting does not lead to impacts on foraging or migrating bats.
7.4
REPTILES A presence / absence survey is required across the western bare ground and the ephemeral/short perennial vegetation areas. This can be undertaken during the spring using suitable reptile hibernacula traps. If reptiles are present, further surveys will be required during the summer in order to estimate reptile numbers. A suitable mitigation plan can subsequently be drawn up to allow for on-site protection or translocation to a more suitable site during the construction phase. Mitigation will ensure that the development complies with current legislation
7.5
DORMICE Recent surveys undertaken nearby would suggest that the presence of dormice is unlikely. As a precautionary measure it is recommended that clearance work takes place during May when dormice are active and can move away from the disturbance. As birds may be nesting at this time it is also recommended that trees and shrubs are removed before hand during the winter before the breeding season starts in mid March. Removing the trees during the winter will not impact on any hibernating dormice
7.6
INVASIVE SPECIES The small area of Japanese Knotweed is close to the proposed construction area. Control with suitable herbicide is recommended prior to building commencement.
8.
ECOLOGICAL ENHANCEMENT The following recommendations have been made in order to further enhance the ecological value of the application site in line the current Planning Policy Framework (2012). A woodland management plan is proposed to be developed as part of an England Woodland Grant Scheme Application (EWGS) in conjunction with the Forestry Commission.

To maintain Polvellan Woods as an important landscape and wildlife feature
To encourage woodland regeneration to ensure both habitat and landscape features are sustained.
To protect key habitat features such as veteran trees and trees with bat roost potential.
To remove invasive species which threaten the health and biodiversity of the woodland.
To encourage a wider age structure of trees and more diverse shrub and ground flora layers.
An initial 5 year plan will concentrate on tree safety and rhododendron control, with measures to encourage natural regeneration and replanting. Further felling and re-stocking will take place over the following 20 years.

CONCLUSIONS The site is located close to a range of designated ecological sites including a local nature reserve and a range of non statutory sites. The proposed development will have no impacts on the protected sites. The site itself is subject to a Tree Preservation Order and is within Looe Conservation Area. Habitat types recorded on site include broadleaf plantation woodland, bare ground, buildings, walls, earth banks, amenity grassland and ephemeral/short vegetation. A number of target note features were also recorded. The proposed development at Polvellan is likely to impact on existing buildings, broadleaf plantation woodland, bare ground, earth banks and ephemeral/short vegetation. Surveys were undertaken to determine the presence of protected species including bats and barn owls. Suitable habitat to support breeding birds was identified. Dormice have been recorded in Kilminorth Local Nature Reserve but recent dormice surveys of the adjoining land at Pollean found none. As the proposed building works will have an impact on a small area of woodland plantation, further precautionary mitigation measures have been recommended. The buildings due for demolition were inspected for the presence of bats. Some historical bat activity was recorded. An emergence bat survey of buildings due for demolition has been recommended. Small areas of potentially suitable habitats were also identified that may support common reptiles on abandoned parking areas. Prior to any construction works, presence /absence surveys should be undertaken. Suitable protection and mitigation measures cannot be determined until these have been completed. The building development is likely to result in the permanent loss of 250 m² of broadleaf plantation woodland. The provision of six bird boxes will be required to provide temporary nesting sites until the new landscape planting matures. No other protected species were recorded. Options for ecological mitigation and enhancement are outlined. Further details will be determined once the additional bat and reptile surveys have been completed.

This work pertains specifically to the identification of protected species on the proposed site. Information provided to Pell Frischmann by Biodiversity Records Centres and other statutory information sources has been accepted as being accurate and valid.
