Nestled at the base of the Blue Ridge Mountains and just a few miles west of Charlottesville, Old Trail Golf Club is the centerpiece of the spectacular Old Trail community. Old Trail offers multiple tees to provide a range of course lengths pleasurable for all players. Plus, the zoysia fairways offer a perfect lie and the bent grass greens are the purest putting surfaces available today. Old Trail is a truly unique golf experience. In addition to the wonderful design and immaculate conditioning of the course, our professional team is committed to providing our Members and daily fee golfers a superior level of customer service. Old Trail Golf Club operates as a semi private Club serving daily fee golfers from the greater Charlottesville area. In addition, a Membership program offering a number of categories of membership to fit various lifestyles is available for Old Trail homeowners and regular users of the facilities. The Old Trail Golf Club Membership program has been established as an annual program with dues payments on a monthly basis or for the year in advance. Each year Members will be renewing for the next 12 months. If a Member chooses to resign for any reason within the 12 months time frame, they may not rejoin the Club for 12 months from the date of resignation unless they pay a $1500 rejoining fee.

1. General Understanding. The undersigned understands the information included in this packet concerning Membership at Old Trail Golf Club and herby agrees to the Membership benefits, fee schedule and Rules and Regulations as posted at the Club. The undersigned further acknowledges that the golf course and other facilities are open to the public and host daily fee golfers, corporate and charity outings on a regular basis and that the golf course may not be available each time the undersigned chooses to play. 2. Payment of Membership Dues. The initial dues payment will be charged to your credit card with the submittal of this document. The Membership year is for 12 months from the date you join. All offerings, prices and dues are subject to change without prior notice. The Old Trail Golf Club Membership program has been established as an annual program with dues payments on a monthly basis or for the year in advance. Each year Members will be renewing for the next 12 months. If a Member chooses to resign for any reason within the 12 months time frame, they may not rejoin the Club for 12 months from the date of resignation unless they pay a $1500 rejoining fee. If at any time the Membership dues and/or other charges of the undersigned are 60 days past due, the undersigned understands his/her Membership privileges will be suspended until the account is paid. If Membership of the undersigned is terminated by self or Old Trail Golf Club, the undersigned agrees to honor all financial obligations owed by undersigned to the Club. 3. Charging of Membership Dues. Old Trail Members will be charged dues on a monthly basis or with yearly payment in advance and will be required to have a valid credit card on file. Monthly dues will be charged on the first day of each month and the dues will be for the month in which the charge occurs and agree that all disputes on my credit card account relating to the Club will be promptly brought to the Club's attention. The undersigned understands that he/she is obligated to keep a valid approved credit card on file with the Club at all times for membership dues only and that the undersigned is responsible for any amounts that are not paid by the credit card company. 4. Delinquent Memberships. If the club account of any member is delinquent, the Club may at its option take whatever action it deems necessary to effect collection, including without limitation, suspension or termination of a membership or legal action. If the Club commences any legal action to collect any amount owed by any member or to enforce any other liability of any member to the Club, and if judgment is obtained by the Club, the member shall also be liable for all costs and expenses of such legal action and reasonable attorneys' fees, including any fees required in connection with appellate proceedings. 5. Immediate Family Members. If selecting the family privileges above, please specify below the names of each unmarried child of either the primary member or spouse who is under the age of twenty-three and either living in the primary member’s household or attending school on a full-time basis that will have use privileges at the Club Facilities.

Receipt of Membership Plan and Information. The undersigned hereby acknowledges receipt of The Old Trail Golf Club Membership Information and these exclusions and limitations and have read and understand them, and agree to be bound by the terms and conditions thereof as the same may be amended from time to time by the Club. The undersigned further acknowledges that he/she is not relying on any oral representations in acquiring a membership in the Club. 8. Membership Privileges. The undersigned understands that Members of the Club are allowed to use the facilities provided at Old Trail Golf Club. By obtaining a membership at Old Trail Club, Members obtain a nonexclusive revocable license to use the facilities in accordance with the classification of membership selected by the Member. Members do not obtain any equity or ownership interest in the Club or the facilities provided at Old Trail Golf Club, do not have and do not acquire any property rights or other interest in any property of the Club, do not have any rights to become involved in the management or operation of the Club or the facilities provided at Old Trail Golf Club and are not subject to any assessments for operating deficits incurred in the operation of the facilities provided at Old Trail Golf Club or any assessments for capital improvements to the Club Facilities. 9. Modification and Termination of the Membership Plan. The undersigned understands that the Club may discontinue operation of any or all of the Club Facilities, to change the Club Facilities available for use by Club Members, to terminate this Membership Plan, to terminate all memberships at Old Trail Golf Club with or without cause, to terminate any particular membership (selectively, if so desired by the Club) at Old Trail Golf Club with or without cause, and to sell, lease or otherwise dispose of the Club Facilities, in whole or in part to any other third party. In addition, the Club further reserves the right to amend and modify this Membership program in any manner it deems appropriate, in its sole discretion. All Club Members agree to be bound by any changes to this Membership. 10. Indemnification and Assumption of Risk. By executing the Application for Membership Privileges and the Membership Agreement, Applicant hereby agrees to indemnify, defend and hold Old Trail Golf Club and its affiliated entities (and their respective owners, directors, partners, officers, operators, employees and other agents) harmless from and against any and all liabilities, costs (including reasonable attorney’s fees), claims, demands or damages incident to or arising out of or relating to the acts or omissions of Applicant, their Family or guest(s), and their respective use or occupancy of the Facilities. In addition, by executing this Agreement, Applicant hereby voluntarily assumes all risks of accident or damage to Applicant’s person or property, and the person or property of Applicant’s Family and guests, arising out of or relating to the use or occupancy of the Facilities including but not limited to errant golf balls, operation of a golf cart, and adverse weather conditions including lightening.
