Outings with less than 72 players Monday through Thursday and Friday through Sunday will be modified or straight tee times. The outing coordinator is responsible for full payment to Five Ponds G. C.: By cash, check, or credit card (MasterCard, Visa, American Express, or Discover) We cannot accept payment from individual participants. Payment in full for the balance our your event is due the day of the event unless other arrangements have been made in advance. As required by P. L. C. B. & B. C. D. H., all food, drink & alcohol MUST BE purchased from Five Ponds Golf Club. Donations of alcohol are not permitted. All participants should arrive at the club at least 45 minutes prior to their starting time, ready to play golf. Only outing participants and a previously agreed upon number of volunteers will be permitted on the Golf Course. For your event to be played as a “SHOTGUN” you must have a minimum of 72 players for Monday, 90 players for Tuesday thru Thursday, or a minimum of 124 players for Friday, Saturday, or Sunday (1:00 PM Start). NO EXCEPTIONS General Information One golfer per cart will be required to sign a golf cart rental agreement and waiver. No Person under the age of eighteen (18) years of age may operate a powered Golf Cart. Please make sure if anyone is expecting to drive a cart and an age question arises, photo identification must be provided. No Exceptions. If a person is found in violation, they may be removed from the course with no refund.
Rain Policy Unless Warminster’s Five Ponds Golf Club Management deems the course to be unfit for play, all events will take place, If during the course of play weather becomes an issue, such as long delays or course closure, a determination will be made in reference to refunds for golf only. If we cancel your event and cannot find a mutually agreeable make-up date, then golf and golf shop credits will be issued. In any event where food has been ordered, the food will be served the day of the event. Indemnification To the fullest extent permitted by law, the Applicant and their employees, officials, volunteers, agents and representatives agree to defend, indemnify, pay on behalf of, and save harmless Five Ponds Golf Club and its employees against any and all claims, liability, demands, suits or loss, including attorneys’ fees and all other costs connected therewith, arising out of or connected to the Applicant’s use or occupancy of the premises, including, but not limited to the golf course, driving range, clubhouse and pro shop, parking lot, and walkways. Waiver of Subrogation To the fullest extent permitted by law, the Applicant and their employees, officials, volunteers, agents and representatives waive any right of recovery against Five Ponds Golf Club and it’s employees for any and all claims, liability, loss, damage, costs or expense (including attorney’s fees) arising out of the Applicant’s use or occupancy of the premises. Such waiver shall apply regardless of the cause of origin of the loss or damage, including the negligence of Five Ponds Golf Club and its employees. Damage to Property of the Applicant and its Invitees The Applicant and their employees, officials, volunteers, agents and representatives shall be solely responsible for any loss or damage to the property of the Five Ponds Golf Club or its employees while such property is on, at or adjacent to Five Ponds Golf Club. Miscellaneous This document constitutes the entire agreement between the parties. Any amendment hereto shall be in writing and signed by all parties. If any provision contained in this Agreement is held unconstitutional, invalid, or unenforceable, the remainder of this Agreement shall be deemed severable, shall not be affected, and shall remain in full force and effect. This Agreement shall be governed in all respects and be interpreted by and under the laws of the Commonwealth of Pennsylvania, except to the extent that such law may be preempted by applicable federal law.
