Overview:

• This report is to obtain Council authorization to commence procurement for the Steeles Avenue Zum Improvements - Phase II from Winston Churchill Boulevard to Malta Avenue, in accordance with Purchasing By-law no. 35-2012. • Brampton Transit is scheduled to expand Phase II of its Bus Rapid Transit (BRT) service in 2015 with the launch of the Ziim Steeles Avenue service, from Winston Churchill Boulevard to Malta Avenue.

• The construction work includes, but is not limited to concrete bus bays, pedestrian bus pads, sidewalks, street lighting, traffic signals, extending storm sewers, street trees, station stop shelter installations and servicing. In addition, all remaining traffic signals within this corridor will be enhanced with transit signal priority and WiFi infrastructure. • The cost estimate for detailed design, fabrication and installation of the station

stop shelters is $3,500,000 including contingency and excluding taxes. Through Contract 2013-071, these works have been awarded to Enseicom Inc.

• The cost estimate for the road construction is $4,653,000 including contingency and excluding taxes.

• The total combined cost estimate for the station stop shelters and road construction is $8,153,000 including contingency and excluding taxes.

Recommendations: Based on the following report, it is recommended:

1. THAT the report from Klaus Stolch, P. Eng., Director, Capital Engineering and Construction, Maintenance & Operations Division, Planning & Infrastructure Services Department, dated January 10, 2014, to the Council Meeting of January 29, 2014, re: Request to Begin Procurement - Purchasing By-law Section 4.0 - Steeles Avenue Ziim Improvements - Phase II, From Winston Churchill Boulevard to Malta Avenue - Wards 4 and 6, be received; and

2. THAT the Purchasing Agent be authorized to commence the procurement for the Steeles Avenue Zum Improvements from Winston Churchill Boulevard to Malta Avenue.

Background:

The City of Brampton's Ziim Bus Rapid Transit (BRT) program began operation on September 20, 2010, with the introduction of the Queen Street service. The Zum BRT service is operated with distinctive, high quality vehicles with advanced intelligent transportation systems (ITS) providing real-time passenger information and service control. The BRT service operates on the City's key north-south and east-west arterial corridors, servicing station stops with clearly branded shelters, equipped with passenger amenities and real-time information displays. The introduction of the Zum BRT is separated into two phases. consisted of three segments:

Phase I works

• Queen Street East (Downtown to York University, 2010) • Main Street (Sandalwood to Mississauga City Centre, 2011) • Steeles Avenue (Main Street to Humber College, 2012) On November 26, 2012, Brampton Transit launched the Zum Steeles Avenue service. This new service was complemented by the concurrent opening of the Brampton Gateway Terminal at Steeles Avenue and Main Street. These events marked the closing of the first phase of BRT in Brampton.

Phase II works consists of three segments: • Bovaird Drive (Mount Pleasant GO Station to Goreway Drive and Queen Street via Humberwest Parkway, Fall 2014 launch - currently under construction) • Steeles Avenue (Winston Churchill Boulevard to Malta Avenue) (also referred to as "Steeles Avenue from Gateway Terminal to the Lisgar GO Station", Fall 2015 launch) • Queen Street West (Downtown Terminal to Mount Pleasant GO Station via Mississauga Road, Fall of 2016 launch)

Through Contract 2013-071, the Ziim Station Stop designer/fabricator/installer for the above mentioned segments was awarded to Enseicom Inc.

Council has approved funding through the 2014 budget process for the construction of Phase II Zum related improvements, including funds for the intersection improvements, station stops, and ITS systems along the Steeles Avenue corridor from Winston Churchill Boulevard to Malta Avenue.

Current Situation:

Capital Engineering and Construction is ready to begin procurement for the construction of the Steeles Avenue Zum Improvements between Winston Churchill Boulevard and Malta Avenue.

Hire of General Contractor

A prequalification of General Contractors will be conducted to ensure that the successful General Contractor has experience with projects of similar scope, size, complexity and value.

Following completion of design and preparation of bid documents, the prequalified contractors will be issued an invitation to bid for the construction of the Phase II Ziim

works along Steeles Avenue between Winston Churchill Boulevard and Malta Avenue.

Scope of the Project: Steeles Avenue Zum Improvements

This contract will include the intersection improvements required for implementation of the Zum service along the Steeles Avenue corridor between Winston Churchill Boulevard and Malta Avenue. The following Zum transit stops are being constructed as part of this project segment: Malta Avenue / McMurchy Avenue South

McLaughlin Road

Chinguacousy Road

Mississauga Road

Hereford Street

Heritage Road

Winston Churchill Boulevard

The improvements at these locations include construction of concrete bus bays, pedestrian bus pads, sidewalks, street lighting, traffic signals, extending storm sewers, street trees, and the station stop shelter installations. Station stop servicing (hydro and communication ducts) are included in the project scope. In addition, all remaining traffic signals within this corridor will be enhanced with transit signal priority and WiFi infrastructure.

Zum Station Stop Detailed Desiqn/Fabrication/lnstallations

This contract will include the design, fabrication and installation of the Phase II Station Stop shelters and related passenger amenities including heaters, benches, garbage and recycling bins, display cases, ad cases, emergency panels, a CCTV system, and real time information displays. The estimated road construction cost for the Steeles Avenue Zum intersection

improvements from Winston Churchill Boulevard to Malta Avenue is $4,653,000

(including contingency and excluding taxes), and the estimated cost for the station stop shelters is $3,500,000 (including contingency and excluding taxes), as shown in the breakdown below:

Corporate Implications:

The schedule as presented in this report meets the criteria proposed by the Federal Government for Canadian Strategic Infrastructure Funding. In January 2012, the City of Brampton received confirmation from the Government of Canada of a federal "approval­ in-principle" for the funding of Phase II of the Zum project to a maximum contribution of $42 million. This specific funding will be for one-third of eligible construction costs (Station Stops, roadway intersection, transit signal priority, etc.) and must be expended prior to April of 2018.

To date, the Zum BRT initiative has provided the residents of Brampton with a high quality transit service, resulting in an overwhelming positive response which has been clearly demonstrated with a significant increase in ridership. With the continued support 4

from all three levels of government, it is expected that Ziim Phase II will continue to help move the residents of Brampton.

Purchasing Comments Pregualification of General Contractors

A prequalification of general contractors shall be publicly advertised. Prequalification submissions shall be evaluated in accordance with the published criteria and weighted points within the Bid Document. The successful contractors that have prequalified shall be issued the invitation to bid for construction. Hire of the General Contractor

Request for Formal Sealed Tenders shall be issued to the prequalified contractors. The Bid Document shall include the specifications and drawings for the required works. The method of obtaining pricing shall be a sealed bid process and the lowest compliant bid is eligible for the award of contract. Purchase approval will be obtained in accordance with the Purchasing By-law.

Performance Security

The successful bidder shall be required to provide a Performance and Maintenance Bond and a Labour and Material Payment Bond. Liquidated Damages

The Contractor shall pay the City as liquidated damages and not as a penalty for each and every calendar day that any portion of the Work is incomplete after the required completion date. Contractor Evaluation

The Contractor's performance will be evaluated in accordance with the City's Vendor Performance Evaluation Process as set out in the Vendor Performance Standard

Operating Procedure. The performance evaluation will be used to provide feedback to the Contractor; to provide the contractor with the opportunity to implement performance improvements during the duration of the contract; and to justify an award or non-award of future contracts by the City in accordance with the terms of the Vendor Disqualification Purchasing Protocol. Communication During Procurement All communications with Bidders involved in the procurement must occur formally, through the contact person identified in the Bid Document. This shall commence when the bid call is solicited and ends when the Purchase order is issued.

Funding for the construction cost estimate of $4,653,000

(pre-tax,

including

contingency) for the installation of Zum Infrastructure on Steeles Avenue will be funded

from AcceleRide capital project activity 124800-001 (Roadway Intersections). Funding for the detailed design, fabrication and installation at the cost of $3,500,000 (pre-tax, including contingency) of the Steeles Avenue Station Stops will be funded from AcceleRide project activity 124800-002 (Station Stops). Although there is currently insufficient funding available in the project activity 124800-001 and 124800-002, there is sufficient funding available in the overall project 124800 to approve the shortfall. There is currently adequate funding approved and available to carry out the project work at the estimated combined cost of $8,153,000 (pre-tax, including contingency) as identified in this report. Conclusion:
