SUPPLEMENTARY NOTE RE OJEU NOTICE Note dated 20 August 2010

We have amended some of the text at Section II.1.5 of our two Gallowgate and Conisborough Road OJEU Notices. In the original Notices, the text stated that we have appointed a design team to develop the scheme design to RIBA Plan of Work Stage D. and that if you are invited to tender, you will need to further develop the design to RIBA Plan of Work Stage E as part of your tender submission. This text has now been changed to say that we have appointed a design team to develop the scheme design to RIBA Plan of Work Stage D; that this will form the basis of Employer’s Requirements which will be set out in the invitation to tender; and that if you are invited to tender, you will be required to develop Contractor’s Proposals which satisfy these requirements and to submit them with your tender. I anticipate that the amended Notice will be published soon.

The development is likely to include a mix of 2 storey houses and flats. We have appointed a design team to develop the scheme design to RIBA Plan of Work Stage D. If you are invited to tender, you will need to further develop the design to RIBA Plan of Work Stage E as part of your tender submission. Lodging of appeals Precise information on deadline(s) for lodging appeals: The contracting authority will incorporate a minimum 10- calendar-day standstill period at the point information on the award of the contract(s) is (are) communicated to tenderers. If an appeal regarding the award of a contract has not been successfully resolved, the Public Contracts (Scotland) regulations 2006 provide for aggrieved parties who have been harmed or who are at risk from harm by breach of the rules to take action in the Sherriff Court or Court of Session. Any such action must be brought promptly and within three months. Where a contract has not been entered into in accordance with the Regulations the court may award the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the court may render it ineffective and set it aside or award damages (the purpose of the standstill period referred to above is to allow parties to apply to the court before the contract is entered into).
