proper care of The Marq. Please review these procedures and provide a copy to your vendors or any other persons involved with the implementation of your event. We

realize each event is unique and you may have specific questions or need clarification during the planning process. Please present your Banquet Specialist with any

Standard Operating Procedures Purpose and Definitions

Intent of Non-Discrimination

The purpose of these Standard Operating Procedures is to provide guidance in developing a safe and successful event, activity or meeting at The Marq Southlake Legends Hall which includes the Traditions Ballroom, Legacy Meeting Rooms, Studio, Stage, Club Lounge, Boardroom, catering kitchen, gallery/lobby, outdoor Terrace and administrative offices. Outdoor amenities include Aria outdoor amphitheater, promenade, and the surrounding parking lot. For the purposes of these Standard Operating Procedures, Legends Hall and the outdoor amenities are referred to as “The Marq”. The Marq is owned and operated by the City of Southlake referred to as “City”.

The Marq does not discriminate against any person or persons because of their age, sex, race, religion, color, or natural origin, nor will the City permit individuals or organizations making the reservations to engage in such discrimination. In the event it is determined by The Marq, in their sole discretion, that this section is or will be violated, The Marq shall have the right to demand that Lessee immediately cease such activity. If the Lessee fails to comply with The Marq’s request, The Marq shall have the right to cancel or cease the event, without refunding the security deposit and other fees.

Section I: General Conditions Individuals, groups or organizations reserving space at The Marq are considered the Lessee.

Accessibility The Marq is committed to ensuring that our venue is as convenient, accessible and enjoyable as possible. While we make every effort to ensure accessibility of our facilities, should Lessee require additional assistance, reasonable accommodations will be made. The Marq is responsible for the permanent building access requirements such as, but not limited to, wheelchair ramps, restroom standards, and internal hallways and doors. Lessee is responsible for the provision of all auxiliary aids and services such as, but not limited to, seating accessibility, assistive listening devices, sign language interpreters and signage which may be required to accommodate Lessee’s guests.

A. The Marq office hours are Monday – Friday 9:00 a.m. – 6:00 p.m. and Saturday 9:00 a.m. – 3:00 p.m. The Marq is closed on Sundays unless the facility is booked for an event(s). The Marq office is closed on the following city designated holidays: New Year’s Day, Martin Luther King, Jr. Day, Good Friday, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, the Friday after Thanksgiving, Christmas Eve and Christmas Day. B. Reservations and tours may be scheduled during office hours and by appointment. Please call in advance to schedule your appointment. C. The Marq standard event hours are Monday – Thursday 7:00 a.m. – 11:00 p.m. and Fridays - Sundays 7:00 a.m. – 1:00 a.m. The Marq is closed on New Year’s Day, Easter Sunday, Thanksgiving Day, Christmas Eve and Christmas Day and not available for events. The Marq is available on Martin 3|P age

Luther King, Jr. Day, Good Friday, Valentine’s Day, Memorial Day, Independence Day and the prior day, city designated Independence Day holiday, Labor Day, the Friday after Thanksgiving and New Year’s Eve. Holiday rates will apply. D. Events are booked for The Marq on a first come, first served basis. The Marq cannot temporarily hold a date. Only a signed contract, and refundable security deposit can confirm a date. The security deposit is NOT payment towards the rental fee. The Marq accepts payments by credit card (MasterCard, Visa, and Discover), cash, cashier’s check, debit card, money order or check. All checks must be made payable to the City of Southlake. The Marq does not charge additional taxes or service fees. E. City sponsored special events and multiple day events shall have priority over any recurring reservations such as one day meetings, programs or activities. If possible, The Marq will accommodate the recurring reservation in another area comparable to the originally reserved area. Lessee shall pay quarterly for all recurring reservations requested for the quarter; however, recurring reservations will not be confirmed by The Marq until two months (60 days) prior to the reservation date. Any remaining balance will be applied to the following quarter. F. The security deposit will be refunded to the Lessee thirty (30) days after an event if the Lessee, including the participants and his/her vendors, has complied with all rules and regulations of The Marq. In the event a Lessee, vendor, or event participant fails to comply with The Marq Standard Operating Procedures, the security deposit may be used by The Marq to clean, repair, replace, or pay for any property of The Marq which is damaged or destroyed. The security deposit may be held at the discretion of The Marq for as long as necessary to determine the

extent of damages and the cost of repairs and/or replacement of property. If the cost of cleaning, repairs and/or damage exceeds the amount of the security deposit, the Lessee will be billed the additional balance. The additional balance is due and payable within thirty (30) days upon receipt of invoice, unless otherwise agreed to by The Marq in writing. Security deposits are non-refundable if an event is cancelled by the Lessee. Events with contracts exceeding $2,000 shall pay fifty percent (50%) of the contract balance within thirty (30) days of booking the event. The remaining fifty percent (50%) of the contract shall be paid fourteen (14) days prior to the event. Events with contracts UNDER $2,000 shall pay the full contract amount no less than fourteen (14) days prior to the event date. Any Lessee proposing to charge fees and/or sell a product or service must receive written approval in advance by The Marq. Duplication of services or products provided by the City shall not be sold by any Lessee. Lessee is responsible for the collection of sales tax. A copy of the vendor’s sales tax permit must be provided to The Marq prior to an event. The Marq reserves the right to audit the records of any vendor selling items at The Marq to ensure compliance with this section. Any vendor seeking to sell items at The Marq shall provide their contact information, as well as any other identifying information deemed necessary by The Marq. Lessee shall be a minimum age of 21 years old. Lessee agrees and gives permission for any photography taken during an event at The Marq to be utilized for promotional use by the City unless otherwise agreed in writing by The Marq.

M. Lessee must comply with the maximum occupant load requirements as assigned by the City. The Marq staff reserves the right to end a Lessee’s event should Lessee not comply with the maximum occupant load requirements. The rental includes the room(s) and common areas, neutral chairs, 72 inch round tables accommodating up to 12 guests, stage & dance floor in the ballroom; rectangular tables with business appropriate chairs in meeting rooms/studio; and state-of-the-art audio visual system, complimentary high speed wireless internet throughout the facility, white or black table linens, white or black napkins, staff for set up and take down of tables & chairs, as well as a Banquet Specialist to manage facility amenities and set-up/break-down of vendors. O. The ballroom and meeting rooms are equipped with state-of-the-art audio visual systems. Room rental includes built-in screens and monitors, house sound and one microphone. Additional equipment is available on a first come, first served basis for an additional fee and should be coordinated through the Banquet Specialist a minimum of fourteen (14) days prior to your event. Should Lessee add additional audio visual equipment to their contract but not use said equipment the day of the event, no refunds will be issued for prepaid, unused equipment. Lessee may provide their own equipment free of charge; however, equipment may not be

connected to the house audio system without prior approval of The Marq. The Marq is not responsible for the compatibility of the equipment. Aria rentals include the seating area, promenade, outdoor restroom facilities, house sound system, basic lighting and a Banquet Specialist to manage facility amenities and set-up/break-down of vendors. Tables and chairs are available for an additional fee. Copy services are available at The Marq office for an additional fee. Rental of The Marq does not entitle the Lessee to use of The Marq staff in connection with an event except for the basic set-up of the room rented by the Lessee, which includes the layout and placement of tables and chairs. In addition, The Marq staff will attend to any emergency situation. Lessee shall be solely responsible for employing a sufficient number of qualified personnel for the event to safely and successfully occur. Lessee agrees that all vendors employed by Lessee to provide services in The Marq be approved and authorized by The Marq and shall, at all times, maintain an appropriate appearance and conduct themselves in a polite and professional manner. Lessee agrees to replace any vendors failing to do so immediately upon request by The Marq. The City of Southlake Code of Ethics prohibits any of The Marq employees from accepting tips, gifts, gratuities or any other favors from Lessee doing business with The Marq. The rental of The Marq by a Lessee does not relinquish the right of The Marq staff to control the management and operation of The Marq and to enforce all rules and regulations. The Marq staff, City Department of Public Safety personnel, and designated City employees may enter the facility, including any or all rented areas, at any time and for any purpose arising out of or related to the operation of The Marq. 5|P age

U. The Lobby and Gallery are considered common areas and may not be leased independently for event use. The Lobby and Gallery may be used for pedestrian traffic, registration, ticket sales, or food and beverage service connected with the event. All other event activities must be held within the contracted space. Exhibits set in the Lobby and Gallery must be approved by The Marq in advance. The Lobby shall not be used for move-in or move-out purposes. Lessee is responsible for removal of bulk trash in the Lobby and Gallery space and will be responsible for costs associated with the removal of such excess. V. Registration areas in the Lobby and Gallery are provided on a complimentary basis. Registration telecommunication and data equipment and utility services are not available in the Lobby and Gallery. Registration areas in all public spaces must be approved by The Marq in advance. In order to provide safe and attractive access to the facility, registration areas, entrance units and other event specific displays may only be installed in public areas during times when it does not conflict with the activity of other events. W. The Marq reserves the right to book more than one event in The Marq at a time. Consideration will be given to avoid conflicts due to noise or traffic concerns. The Lessee may elect to rent the entire facility if sharing the facility is not desired. No more than one wedding will be booked simultaneously. X. Rental times will begin and end at the exact times agreed upon in the contract. Additional hours are not available the day of the event, and should be scheduled a minimum of fourteen (14) days prior to event date. Failure to vacate any part of the property by prior contracted time will cause Lessee to incur additional lease time which will be charged the prevailing extended rental rate to the security deposit on file. All events must conclude no less than one

hour prior to The Marq’s posted closing time. Y. Proof of residency is required when requesting resident rates for individuals and businesses. A current water bill shall serve as proof of residency. A resident is a citizen who lives within the city limits of Southlake. A resident business is a business with its physical address within the city limits of Southlake. Those requesting resident non-profit organization rates must be exempt from Federal income taxes under Section 501(c) 3 of the Internal Revenue Code and will be required to provide proof of tax-exempt status and the organization’s physical address. Section II: Rehearsals A. If the ceremonial fee is added to the wedding package, a one hour rehearsal is included complimentary. Rehearsal time and space is not guaranteed until two months prior to the event, and is subject to availability. Lessee may call eight (8) weeks prior to the event to schedule the rehearsal with the Banquet Specialist.

Section III: Cancellations A. If the Lessee chooses to cancel the event, the deposit is non-refundable and non-transferrable. All cancellations must be submitted in writing. If the Lessee cancels with ninety (90) or more days’ notice, fifty percent (50%) of the rental fee will be assessed to the Lessee. The Lessee will be held responsible for the entire contract value should Lessee cancel the event with less than a ninety (90) days’ notice. If Lessee opts to reschedule their event, a fifteen (15%) rescheduling fee will be added to the contract, the deposit is forfeited, and a new event date must be selected within one hundred eighty (180) days of the original event date. 6|P age

B. The Marq offers a grace period for cancellations resulting in full refund of deposit. Lessee shall have five (5) days from the date of the signed contract to notify The Marq of cancellation. Notifications of cancellations must be in the form of a written and signed letter. C. If (a) The Marq or any portion thereof is destroyed or damaged by fire or other calamity so as to prevent the use of the rented facilities for the purposes and during the periods specified in the agreement, or (b) if the use of the rented facilities by Lessee is prevented by an act of God, civil riot, flood or any other cause beyond the control of The Marq, then the agreement will terminate. The Marq shall not be liable or responsible to Lessee for any damages caused thereby and Lessee waives any claim against The Marq and or City for damages by reason of such termination except that any unearned portion of the fees due shall abate, or if previously paid, shall be refunded by The Marq to Lessee within thirty (30) days of cancellation.

Section IV: Lessee’s Indemnification

Liability

and

A. Lessee holds sole responsibility for all persons on property associated with their event. If any person is injured on the property during or pertaining to their event, the Lessee holds The Marq harmless from any liability for such injury, and hereby indemnifies the Marq and the City for any damages or expenses caused thereby. The word “Persons” is defined as the Lessee, their guests, vendors or employees. The word “property” is defined as the facility, buildings, structures, and contents thereof, all grounds, landscape, statuaries, and facades of The Marq. B. Lessee holds sole responsibility for damage, theft, or loss of personal property during the use of The Marq or the use of any property on The Marq.

C. Lessee holds The Marq and the City harmless and indemnifies The Marq and the City for any damages and expenses resulting from any law suits in regards to Lessee’s event at The Marq. This includes, but is not limited to, any liability, damages and expenses arising due to any injuries resulting from the sale and/or ingestion of alcoholic beverages served to guests, liability due to injuries, and any other accidents. D. To the fullest extent permitted under the Constitution and the laws of the State of Texas, Lessee shall indemnify, hold harmless, and defend, and hereby agrees to indemnify, hold harmless and defend, The Marq and City, and their affiliates, agents, officers, elected officials and employees, from and against all claims, demands, costs or expenses for loss, damage, or injury, including attorney’s fees, whether incurred during the investigation or defense of a claim, or for bodily or personal injury, sickness, disease, death, or injury to or destruction of personal property, including the loss of use, in whole or in part, which arises out of or is related to the Lessee’s use of The Marq, the performance of the Lessee, and Lessee’s activities at The Marq, whether caused by Lessee’s negligence, gross negligence, intentional acts, or omissions, or by the negligence, gross negligence, intentional acts, or omissions of any person who is directly or indirectly employed by or working at the direction of the Lessee, participating in an event of the Lessee or acting in concert with the Lessee. Such acts include, but are not limited to: (1) a failure of the Lessee, or any of its employees, participants, or agents, to perform in accordance with these Standard Operating Procedures; (2) any injury, loss or damage, whether to person or property, occurring as a result of, or arising out of, the Lessee’s event; (3) a failure of the Lessee, or its employees, participants, or agents to comply with any law(s) of any 7|P age

governmental authority; (4) any third party agreement(s) or contract(s) to provide goods or services for the direct or indirect benefit of the Lessee or a customer of the Lessee; or (5) any other circumstance or condition that does not arise out of or result from the gross negligence and/or willful misconduct of The Marq or City, or their agents, elected officials, servants or employees.

Section V: Food and Beverage A. The Marq does not provide on-site catering. B. Any food served at The Marq event rentals must be provided from a licensed caterer or restaurant. Serving potluck or homemade items at event rentals is prohibited at The Marq, either by Lessee, guests, representatives or its sub-contractors. C. Lessee may select a caterer from the Preferred Caterers List provided by The Marq. Please contact each individual caterer for menu options and pricing. Any caterer not on the preferred list must provide proof they have met insurance requirements and hold current Tarrant County health permits. D. Catering Fees: If Lessee’s catering contract exceeds $2,000 and/or event requires the use of the on-site catering kitchen, Lessee’s event will be subject to The Marq’s catering fee of ten percent (10%) of the total pre-tax gross of food and beverage sales for preferred caterers. If Lessee chooses to use a caterer not on the Preferred Caterers List, the Lessee’s caterer must agree to pay The Marq a catering fee of fifteen percent (15%) of the total pre-tax gross of food and beverage sales and the Lessee shall pay a $250 catering access fee. Exception: The ten (10) and fifteen (15) percent catering fee shall be waived for any food truck caterer not utilizing The Marq catering kitchen or other indoor facilities.

E. The Preferred Caterers List is for informational purposes only and should not be considered a recommendation or endorsement by The Marq. Those listed have met all health requirements and The Marq standards. Please confirm directly with the selected caterer that he/she has sufficient qualifications and equipment to serve the anticipated number of guests and in conformity with the expected quality. In addition, please feel free to contact the caterer’s references for additional information. F. All catering contracts must be submitted to The Marq fourteen (14) days prior to event date. Catering fees shall be submitted by caterer along with a copy of the Lessee invoice within fourteen (14) days following the contracted event date to The Marq. If catering fees are not paid to The Marq within fourteen (14) days following the contracted event date, The Marq may apply the balance due to the Lessee’s security deposit. The Marq reserves the right to prohibit use of The Marq by caterer for any future events, and shall not be responsible for any fees or loss of revenue related to said action. G. Chocolate fountains are strictly prohibited. H. Table coverings are required on all tables used for serving, drinking and/or eating. I. Lessee may provide Caterer with alcohol to serve provided it is purchased from a state licensed liquor retailer. If alcohol is provided by the Lessee, alcohol sales or cash bars are prohibited. If alcohol is provided by a bar service provider, alcohol sales or cash bars are allowed. All alcohol served must be served by a licensed Texas Alcoholic Beverage Commission (TABC) bartender(s). The number of TABC bartenders required is at the sole discretion of The Marq. J. Portable bars and set-up are available for an additional fee. K. The Lessee or Lessee’s bar service provider must provide The Marq with a 8|P age

copy of the TABC License or the name of the TABC licensed bartender no later than fourteen (14) days prior to the date of the event. All alcohol service must cease by midnight (12:00 a.m.). Per TABC regulations, alcohol may only be served to individuals twenty-one (21) years of age or older. Minors may not be served or consume alcoholic beverages. The staff and management of The Marq have the right to refuse service of alcohol to any guest who appears to have symptoms of intoxication or is under the age of 21. The Marq reserves the right to end bar service of alcoholic beverages during any event in which Lessee is not in compliance. If anyone attending Lessee’s event is found in possession of unauthorized alcoholic beverages and/or other illegal substances, Lessee shall forfeit their security deposit and The Marq may immediately end the event and require Lessee and guests to vacate the property. Lessee must comply with all federal and state laws regarding the distribution of alcoholic beverages at all times while on site. Food service MUST accompany ANY alcohol service. Alcohol only events are prohibited. An off-duty police officer(s) must be hired for ALL events that serve alcoholic beverages. All off-duty police officers used in the facility shall be acquired through the City of Southlake Police Department and shall be the responsibility of the Lessee. The number of off-duty police officers required is at the sole discretion of The Marq and City of Southlake Police Department. At minimum, one officer is required for events with less than fifty (50) guests and two officers are required for events with fifty (50) or more guests. Off-duty police officer(s) must be present a minimum of thirty (30) minutes

prior to alcohol service beginning until thirty (30) minutes after the event ends. R. Alcoholic beverages shall only be consumed in the area(s) rented to Lessee as stated in the rental agreement. Alcohol may not be taken into or consumed in restrooms, cars, parking lots of The Marq or the surrounding park. S. All persons must dispose of their alcoholic beverages before leaving the designated rented area(s). Lessee or caterer may remove open alcoholic containers only if transporting them in compliance with applicable law.

Section VI: Vendor Requirements A. It shall be the responsibility of the Lessee to submit to The Marq, no later than a minimum of fourteen (14) days prior to the event, a written list of the vendors the Lessee intends to use. All vendors must be properly licensed and permitted. A vendor’s certificate of insurance must be on file with The Marq. B. All DJs, bands and entertainers should contact The Marq regarding staging needs, audio visual requirements and entry procedures. The Marq cannot guarantee compatibility of their equipment or adequate power supply; therefore it is recommended that Lessee’s preferred entertainment provider contact The Marq prior to booking. C. DJs, bands and other entertainers are required to restrict sound to 55 dBA during nighttime and Sundays and 60 dBA during daytime in accordance with the City Ordinance No. 778. The Marq has the sole discretion to determine what is considered excessive during events. If Lessee’s entertainment provider does not stay in compliance, Lessee understands and agrees that The Marq management may decide to terminate the event and guests will be required to immediately vacate the 9|P age

facility. Music is prohibited in the parking lot or any part of the grounds other than Aria, the promenade and terrace unless previously approved in writing by The Marq. D. All music fees and licenses are the responsibility of the Lessee. E. All audio visual equipment and programs must have a final run through no later than one day prior to the Lessee’s event. Failure to do so removes any responsibility from The Marq. Section VII: Equipment Move In and Move Out A. Lessee may bring in additional furniture and equipment for their event. However, all items must be delivered during Lessee’s rental hours, and removed at the conclusion of their event. Special arrangements to deliver rentals early or leave rentals overnight may be available in certain circumstances and may be subject to an additional fee. Lessee may not store equipment of any kind in or on the grounds without written permission from The Marq. B. Carts are not provided by The Marq for move-in, display, move-out and/or movement of any materials. Carts may be rented from an outside contractor or brought onsite by the Lessee or their vendors. Carts may only be rolled on protected areas. C. Equipment shall not be transported through the Lobby. All equipment shall be transported through the mechanical yard or other Marq designated loading areas. D. Any item(s) left at The Marq for thirty (30) days or more after the event date becomes the property of The Marq.

Section VIII: Decorations and Care of the Facility A. All decorations must be approved in advance by the Banquet Specialist. B. For your safety, exit doors may not be obstructed, locked, or blocked, except by an approved device that is permanently installed on the doors by the City. Items may not be placed within fifteen feet (15’) of a means of ingress or egress doorway. Exit signs may not be obstructed from view. C. The Lessee, service vendors and exhibitors must comply with all federal, state and municipal fire codes that apply to a place of public assembly, as well as Occupational Safety and Health Association (OSHA) regulations. Fire and emergency equipment may not be blocked or obstructed under any circumstance. All fire hose connections, extinguisher cabinets, fire alarm pull stations and any audible/visual devices must be visible at all times. Chains or locks may not be placed on any facility door. All curtains, drapes, decorations and decorative or construction materials are to be non-combustible or flame retardant. D. All decorator or service vendors must wear a company shirt or visibly displayed ID badge. E. Flowers are to be arranged before delivery to The Marq. Flower arrangements shall arrive finished and ready to be placed on tables. Flowers shall NOT be constructed in the building. F. Lessee may not damage the structure of the building (i.e. hang, attach or suspend anything from any part of the building via staples, tacks, nails, tape etc. drill, or punch holes in the building). All forms of glue, duct tape and other high residue tape are strictly prohibited. All floors and carpets must be protected from any moveable equipment during set up and break down. G. Open flames are strictly prohibited, unless used for a ceremonial or religious 10 | P a g e

purpose by a method pre-approved in writing by the City Fire Marshal. All candles must be securely supported on substantial noncombustible bases with glass or metal vessels and the candle flames protected by a container that exceeds the height of the flame. Candle(s) shall not be placed where individuals stand or in a walkway or exit. The use, display or storage of compressed gasses, flammable liquids, or dangerous chemicals is prohibited. Specific decorations, such as glitter, rice, bird seed, streamer poppers, loose sequins, artificial snow, faux rose petals and confetti are prohibited for décor purposes or wedding exits. Real or live Christmas trees and straw/hay bales are prohibited within the indoor facilities. Notwithstanding the above, The Marq reserves the right to prohibit or remove any item not set forth herein if, in The Marq’s discretion, the item may cause damage to the facility or create a hazard. If a Lessee has any questions about whether a particular item is permitted, please speak with the Banquet Specialist prior to Lessee’s scheduled event. The Marq is not liable for the cost of an item or decoration that was purchased for an event and is prohibited from use. Rose petals may be used for guest table décor. White rose petals may be used for wedding exits, as well as bubbles, glow sticks/wands, no mess streamers, and ribbon wands. All surfaces and flooring must be cleared and swept of any items used. Sparklers and fog/cloud machines are prohibited. Only firework demonstrations that are managed by a state licensed pyrotechnician are allowed and shall be approved in writing a minimum of fourteen (14) days in advance by City Fire Marshal. Furnishings of The Marq shall not be moved, taken outside, or removed from the building. ONLY The Marq personnel shall be permitted to set up, break down or rearrange The Marq property.

N. Only The Marq staff may operate the moveable walls in the facility. O. All equipment and connections, regardless of power source, must comply with federal, state, and local safety codes. All extension cords must be three (3) wires grounded. P. Extension cords must be plugged directly into an electrical outlet or a power strip and must not be piggybacked. Cords subjected to foot or equipment traffic shall be within cord covers or low residue carpet tape such as Venture Tape 576-2” or Polyken 105C-2” to prevent trip hazards or cord damage. Q. Animals (except service animals) are prohibited at all times within The Marq facility. Service animals must be harnessed, leashed, or tethered unless these devices interfere with the service animal's work or the individual's disability prevents the use of these devices. In that case, the individual must maintain control of the animal through voice, signal, or other effective controls. R. Animals may be allowed at Aria in accordance with City Ordinance No. 1069 with prior written approval from The Marq. Lessee assumes full responsibility for any approved animal at Aria and must provide clean up and proper disposal of waste and other related items. S. Outside exhibits and/or decorations are considered on a case by case basis and will be based on other rental activities in the facility and/or type of exhibit. The Lessee may not place exhibits outside the facility without prior written approval from The Marq. T. Any tent or other membrane structure shall be considered a “tent”. All tents require written prior authorization from The Marq and compliance with the following guidelines: • Tents must be free-standing. Outdoor tents shall be securely anchored by approved methods regulated by tent manufacturer. All 11 | P a g e

anchoring devices must be approved a minimum of fourteen (14) days in advance by The Marq. • A permit from the City of Southlake Building Inspections is required for tents having an area in excess of four hundred (400) square feet. • Tents shall comply with the currently City adopted version of the International Fire Code and require an inspection by the City Fire Marshal prior to the event. U. Lighting options are available from The Marq for an additional fee. Up-lighting may not be provided by any outside vendor for use at The Marq without prior approval of The Marq.

Section IX: Signage A. The Marq manages the messages displayed on The Marq owned electronic signage. Lessee shall submit event information for approval and display fourteen (14) days prior to the event. B. Electronic signage is not available for purposes of private advertising unless approved in advance by The Marq. C. Plans for all directional and informational signs, as well as plans for banners, special graphics or decorations in public areas, shall be submitted for approval fourteen (14) days prior to the event. D. The Marq does not provide eventrelated directional signage. E. The use of window clings or carpet adhesive graphics are prohibited.

contained within one parking space, must park in overflow parking lots. Vehicles are prohibited from parking or driving on grass areas, sidewalks and Terrace. Parking is prohibited under the porta cache. This area is used only for dropoff, pick-up and emergency service vehicles. This area must be kept clear for its intended use. The Terrace, promenade, and parking lots at The Marq or Bicentennial Park may not be used for commercial exhibits, displays, or promotions without the express written consent of The Marq. If permission is granted, the Lessee may not drill, bore or punch any type of hole or paint/mark on the surface of the parking lot. At the conclusion of an event, Lessee shall leave the parking lot in the same condition it was provided with all trash removed to the appropriate dumpster(s). Any damage to landscaping on The Marq property caused during or arising out of an event sponsored by the Lessee shall be replaced at the sole cost of the Lessee. The loading and unloading of vehicles must be from the parking lot or other designated loading areas as approved by The Marq. Vehicles left unattended in fire lanes or loading areas will be towed at owner’s expense. Vehicles shall be locked after parking. The Marq is not responsible for damaged, stolen or lost possessions.

Section XI: Cleaning & Trash Removal Section X: Parking A. Complimentary parking is provided onsite adjacent to The Marq. Overflow parking is available within adjacent Bicentennial Park parking lots. B. All vans, buses, trailers and/or other vehicles and equipment that cannot be

A. The Marq provides normal custodial services including set up and break down for each event. The Marq staff will stock and clean restrooms. B. Lessee agrees to leave the premises in the same clean condition in which it was found, including cleaning any tables of any debris or food. Trash bags will be furnished by The Marq. Lessee will be charged a clean-up fee for actual costs 12 | P a g e

incurred if any trash, debris or personal items are left on property. Trash cleanup is the sole responsibility of the Lessee. All trash must be bagged and placed in the appropriate receptacles in the outdoor mechanical yard. C. Property damages, unacceptable conditions and/or fees assessed after the event, shall be deducted from the deposit if necessary.

Section XII: Lost & Found A. Reasonable effort is made to ensure property found and given to The Marq is managed in a manner which provides the best possible opportunity for return to its owner. All items given to The Marq will remain at the customer service desk until the end of the event. Any item unclaimed for thirty (30) days will be disposed of in accordance with City policies. However, the Marq shall not be liable for any lost or stolen property.

Section XIII: Safety and Security A. All security used in the facility shall be an off-duty police officer acquired through the City of Southlake Police Department and shall be the responsibility of the Lessee. Procedures for hiring off-duty police officers will be provided by The Marq to the Lessee. B. The Marq and City of Southlake Police Department shall have sole discretion on determining whether or not an offduty police officer is needed for an event. If deemed necessary, the off-duty officer must be present at The Marq property a minimum of thirty (30) minutes before an event starts until thirty (30) minutes after the event ends. The hourly fee for the off-duty police officer(s) providing security is determined by the City of Southlake Police Department.

C. Security cameras are for the monitoring of facility security needs only and may not be used for event security. Security cameras may not be moved or covered at any time. D. Any large event, with the majority of guests being ages 12 to 18 years old, is required to have security provided by a Southlake Police Department off-duty police officer, as well as one adult chaperone per every 20 guests. If Lessee fails to comply with security and chaperone requirements, the event may be terminated and Lessee shall forfeit security deposit and rental fees. E. Cartons, packages or other containers brought in or removed from The Marq may be subject to random inspection by The Marq staff. F. Children must be accompanied by a parent or responsible adult at all times. G. The Marq does not assume responsibility of damage or loss of any merchandise or articles. H. The Marq has a zero tolerance policy for workplace violence, drug and alcohol abuse, unprofessional and discourteous conduct, and sexual harassment. These policies extend to any employee, vendor, subcontractor and guest affiliated with an event. The Marq will take prompt action to investigate any situation and take corrective steps where necessary. The cooperation of everyone is appreciated so that The Marq Southlake workplace is safe, friendly and professional. I. Abusive language, threats, assault, vandalism, theft and other conduct detrimental to the successful staging of an event will result in The Marq staff summoning law enforcement. J. If a fire alarm sounds, emergency personnel will respond. The Marq will be evacuated until emergency personnel determine that it is safe to reenter the building.

Section XIV: Dangerous, Illegal and Indecent Activities A. At any time during a rental if any laws are being broken, the City of Southlake Police Department will be called and the rental will be terminated immediately. Lessee will incur the loss of security deposit and all other fees. B. No activity, performance, exhibition, or entertainment shall occur on The Marq property which is potentially dangerous to the public, is illegal or could be considered indecent, obscene, lewd, immoral or offensive to a person of ordinary sensibilities. In the event it is determined by The Marq, in their sole discretion, that this section is or will be violated, The Marq shall have the right to demand that Lessee immediately omit such attractions. If the Lessee fails to comply with The Marq’s request, The Marq shall have the right to cancel or cease the event, without refunding the security deposit and other fees.

Section XV: Smoking & Tobacco A. In accordance with City Ordinance No. 907, The Marq is a smoke-free facility. Smokers are required to use the designated outdoor area located in the parking lot to the west of the entry doors only. Additionally, the use of all tobacco products is prohibited in the facility including but not limited to chew, cigarette, cigars, cigarillos, little cigars, e-cigarettes, vapor cigarettes, pipe, smokeless tobacco and dip. B. Smoking or using tobacco in The Marq will result in a forfeiture of the security deposit.

Section XVI: Firearms/Weapons A. Definitions: Firearm means: (a) gun, pistol, rifle, or device designed, made, adapted, or readily convertible to use explosive

energy generated by an explosion or burning substance to expel a projectile through a barrel; or (b) an air gun. Demo/Simulated Firearm means: Simulated rifle, shotgun, pistol or revolver that has been manufactured to resemble actual firearms modified by the manufacturer to be incapable of firing or discharge. Dangerous Weapon means: Gas, liquid, solid, edged weapons, or instrument which, in the manner used, is calculated or likely to produce death or great bodily harm or injury. Illegal knife means: (a) knife with a blade over five and one-half inches; (b) hand instrument designed to cut or stab another by being thrown; (c) dagger, including but not limited to a dirk, stiletto, and poniard; (d) bowie knife; (e) sword; or (f) spear. B. All event requests to possess, show or display any firearms, ammunition, simulated firearms, simulated ammunition or dangerous weapons on The Marq premises must be made in writing to The Marq at the time of booking which shall be a minimum of ninety (90) days prior to the first contracted date. The request must include the following information: i. Person making the request, including contact information. ii. Any organization, public or private, represented. iii. Type and number of firearms, ammunition or weapons to be displayed. iv. Purpose or intent of the possession, show or display. v. Any additional background requested by The Marq or City of Southlake Police Department. vi. Any supporting material for consideration.

The Marq will ensure each request is reviewed and approved by The Marq as deemed appropriate. If approved, the requestor will be notified of such and a pre-event meeting may be scheduled with The Marq or City of Southlake Police Department. C. ALCOHOL IS PROHIBITED DURING A GUN SHOW OR OTHER EVENT WHERE FIREARMS, WEAPONS OR ILLEGAL KNIVES ARE POSSESSED, SHOWN OR DISPLAYED.

Section XVII: Guarantees and Finalizing Event Details A. Fourteen (14) days prior to the event date, The Marq will require the following details be completed and submitted to the Banquet Specialist: Room layout; vendors’ names, contact information and arrival times; catering contract; time line; signage requests; confirmation of security (if required); audiovisual needs and review of special requests. B. Changes may be made to the set-up, without charge, only if the Lessee notifies The Marq prior to the room being set up. Any changes after the room has been set up will result in additional charges billed to the Lessee.

Section XVIII: Residual Matters The Marq reserves the right to alter and/or amend its Standard Operating Procedures as deemed necessary. The City of Southlake Director of Community Services or his/her designee shall determine any matters not expressly covered by said procedures.
