Legal Graduate Employment and Summer Clerkship Guidelines FOR RECRUITMENT ACTIVITIES IN 2016 (d) Firms can withdraw their participation at any stage by providing written notice to the Law Society of New South Wales to the Contact details appearing at the end of these Guidelines.

1. Objective

To provide a structured process for graduate and summer clerk recruitment to allow students to simultaneously consider offers received and select a firm most appropriate to their needs.

(e) There are no penalties for not following the Guidelines.

2. Participation (a) Participation in the Guidelines is voluntary and law firms have the option to choose to participate in respect of either summer clerkship recruitment or graduate employment recruitment or both by completing and submitting the Firm Participation Form and paying the annual fee to the Law Society of New South Wales. (b) Firms who choose to participate in the Guidelines will abide by the principles set out in the Guidelines including the Key Recruitment Dates (Schedule A) for summer clerkship recruitment or graduate employment recruitment or both, as the case may be, and the Law Society of New South Wales Legal Graduate Employment and Summer Clerkship Guidelines Review Statement. (c) Set out in Schedule B is the name of each firm which has chosen to participate in these Guidelines and whether that firm’s participation is in respect of either summer clerkship recruitment or graduate employment recruitment or both.

(f) The Guidelines are not compulsory.

3. Key Recruitment Dates

Schedule A sets out the dates for the opening and closing of applications for summer clerkships and graduate positions and the making and accepting of summer clerk and graduate employment offers.

4. Key Recruitment Principles (a) Participating firms i. Firms will follow the Guidelines when making summer clerk and/or graduate offers (as the case may be) to: • Current Staff (including staff employed on a casual basis); • Applicants who have completed a summer clerkship with the firm (for graduate offers); and • Applicants who have no relationship with the firm. ii. It is desirable, although not a requirement, that firms should only be recruiting students in their penultimate year of obtaining a law degree for summer clerkships.

The Law Society of New South Wales acknowledges these Guidelines are a reproduction/adaptation of the Queensland Law Society Guideline produced with the assistance of various law practices participating in the Queensland scheme.

Legal Graduate Employment and Summer Clerkship Guidelines iii. It is desirable, although not a requirement, that firms should only be recruiting students in their final year of obtaining a law degree for graduate placements.

iii. Candidates can accept or decline an offer of graduate employment at any time prior to 5.00 PM the day identified in Schedule ‘A’ as the day on which offers for graduate positions must be accepted.

iv. Firms should refer the Guidelines (including the acceptance dates) to candidates both during the recruitment process and when offers of employment are made.

(2.) Summer Clerkships i. A participating firm may make an offer of a Summer Clerkship to a candidate at any time during the offer period identified in Schedule ‘A’

v. Participating firms cannot require a student to accept or decline an offer, nor require a student to give an indication about whether or not an offer may be accepted or declined, before the date by which offers must be accepted or declined.

ii. An offer of a Summer Clerkship made within the offer period will remain open for acceptance until 5.00 PM on the day identified in Schedule ‘A’ as the day on which an offer for a Summer Clerkship must be accepted.

vi. An offer of a summer clerkship shall not be made conditional upon acceptance of an offer of graduate employment

iii. A candidate must not retain more than two (2) open offers at any time during the period commencing at 12 noon on the penultimate day of the offer period and concluding at 5.00 PM on the day identified in Schedule ‘A’ as the day on which offers of Summer Clerkships must be accepted, and must, notwithstanding clause (5)(2)(ii) decline on a rolling basis excess offers as necessary to comply with this clause.

(b) Candidates i. There is an expectation that candidates will be straightforward, honest and sincere in their dealings with firms. ii. It is desirable, although not a requirement, that students applying for a summer clerkship should be in their penultimate year of obtaining a law degree iii.It is desirable, although not a requirement, that students applying for graduate employment should be in their final year of obtaining a law degree iv. There is an expectation that candidates will be clear and transparent with firms with regard to their intentions, e.g. to apply for Judge’s Associateship position or further study

5. Offer and Acceptance (1.) Graduate Employment i. On the day identified in Schedule ‘A’ as the day on which offers for graduate employment positions can be made, firms may make offers at any time throughout the day ii. Candidates must accept or decline an offer of graduate employment by 5.00 PM on the day identified in Schedule ‘A’ as the day on which offers for graduate positions must be accepted or declined.

6. Review

These Guidelines will be reviewed (including Key Recruitment Dates) annually by a Working Group established by the Law Society of New South Wales comprised of a representative of the Law Society of New South Wales, a representative of each of the firms named in Schedule B and a representative of each of the legal education providers named in Schedule C in accordance with the Law Society of New South Wales Legal Graduate Employment and Summer Clerkship Guidelines Review Statement.
