PACKAGE 30-RCP 01: SOSOK-TAYAN AND SP.TANJUNG-BATAS KOTA SANGGAU WEST KALIMANTAN PROVINCE

I.

PROJECT BACKGROUND

1. There are seven subproject roads for Regional Road Development Project (RRDP) in West Kalimantan, that two of the subproject links are in Sanggau District i.e. Sosok – Tayan and Sp.Tanjung – Batas Kota Sanggau will have resettlement impacts. The Sosok – Tayan and Sp.Tanjung – Sanggau link passes through five sub-districts: Tayan Hulu, Tayan Hilir, Balai, Parindu and Kapuas. Description of the subproject road in Sanggau District presented in the Table 1. 2. The road right-of-way (ROW) for the Sosok – Tayan Link and Sp. Tanjung – Sanggau is 20 meters which has been acquired since 1980s by the Kalimantan Road Project. This is supported by formal documents from the Sanggau District and by the landmark of ROW as shown along the subproject. The affected households were aware that their affected properties are within the ROW. Their main houses built on their own land which adjacent to the ROW, however there will be no impacts on their main houses. Table 1: Subproject Roads No. 1 2

PURPOSES OF REPORT

3. The report was prepared to find out how far action plan in the LARP document has implemented in the field, and also identify constraint and problems that faced during the implementation process.

III.

NUMBER OF AFFECTED PERSONS

4. The asset inventory carried out on 26 January to 9 February 2010 with additional survey carried out on 24 to 27 September 2011, and the inventory of losses done by the Land Acquisition Committee. The Corridor-of-Impact (COI) used for the project is 14 meters total. It was estimated within the COI that there are 219 households who have shops, secondary structures (fence, walls, kitchen, and foundation) while 161 households has trees. In addition, there are also 7 structures owned by the institutions. In total, there are 387 affected persons. 5. There are 30 of the 147 affected shops have to move back, while the remaining 117 shop structures do not require relocation. For shops it is estimated that business disruption Sanggau District

There is no compensation for land as the affected properties built on the ROW, whereas for affected buildings and other affected properties an estimate for compensation is given based on calculation using actual current market prices of materials and actual cost of labor for dismantling and rebuilding which were derived from Public Work Agency of Sanggau District 2009. These rates are used as basis for private businesses or construction suppliers to issue their market prices. At the time of LARP preparation in 2010, Sanggau has not issued 2010 rates thus additional assets identified in 2011 used 2009 rates for budget purposes. 7. Local people alongside both links (Sosok – Tayan and Sp. Tanjung – Sanggau) derived income from rubber plantation, while fruits products usually are for use for their own consumption and not for sale. Since information of the plant price issued by Plantation Agency of Sanggau District only mentions seed price, market prices were based on interviewed from the affected households. 8. There are 147 businesses that will be affected by project consist of 102 temporary shops which require to move back, while 30 shops will be partially affected but not require relocation. The remaining 15 structures are affected only loss of roof or terrace. In terms of disruption, the 102 temporary shops and 15 partially affected structures will only take two days to dismantle or move their shops while the 30 shops that will be partially affected will take at least 5 days to restore their structures. properties, such as easy access to get materials and labor, if needed. The project staff and external monitor will ensure that all of the vulnerable AHs will get all of information easily and receive all of their compensation prior to clearance of land. There will also be active participation of women from consultation to monitoring, representation of women during meetings. 10. For protecting ROW land, the prohibition sign for using acquired land will be installed in several strategic points alongside the road link. Estimated cost for one prohibition sign is about IDR 500,000 and will be installed ± 20 units. Total estimated cost is IDR 10,000,000. 11. In summary, cost estimates for resettlement is IDR 3,067,812,125 as shown in table below. It includes cost for engaging an external monitor, contingency and administration cost. 12. The establishment of the eligibility cut-off date is intended to prevent the influx of ineligible non-residents who might take advantage of Project entitlements. For this Project, official announcement on the cut-off date will be done following the completion of detailed design DGH, through the district and village office, by posting copies at the village offices or public places. Village meetings will also be carried out, minutes of meeting and attendance of participants will be prepared to confirm announcement of cut-off date by the local authorities. 13. The entitlements below are based on potential resettlement impacts and corresponding compensation and assistance to the APs, regardless of tenure status. Entitlements adopted are based on central and local decisions, and as per policy principles of ADB Safeguard Policy Statement.

It is estimated that 117 shops may require 2 days to move/rebuild shop while 30 shops may need 5 days to repair their partially affected shops. Average net income of shop per day is IDR 60,000 multiplied by the number of days of disruption (i.e., 2 to 5 days) Trees and crops will be based on replacement cost which is equivalent to age, type, and productive value. Households will be given timely notice in order for them to harvest their crops.

Restoration of land will do immediately after use.  Non-land assets within the residual area of the ROW will be replaced through in-kind support while those outside of the ROW that are adversely impacted by construction activities will be compensated in-kind or cash at replacement cost by the civil works contractor.

V.

IMPLEMENTATION PROGRESS REPORT

a.

Establishment of Land Acquisition Committee

14. In order to arrange land acquisition and resettlement for National and Provincial Road in Sanggau District, the Land Acquisition Committee for Development of National Road, Sosok – Tayan and Tanjung – Batas Kota Sanggau have been established on December 2010, through Bupati Sanggau Decree No. 432. 15. The Team is leading by Regional Secretary of Sanggau District and the members are including any institution in Sanggau District related with land acquisition and resettlement such as Legal Bureau, the District National Land Agency, Head of District Public Work and Head of District Agriculture, Fishery and Husbandry Agency. The Land Acquisition Committee has responsibility to carried land acquisition process from socialization with Affected People regarding the project plan and the impacts in each village up to the delivering compensation payment. 16. In order to assist the LAC in carry out inventory of loss asset, socialization and arrange administration task, The Task Force and Secretariat Staff of LAC was established by the Decree of Head of the LAC No: 580-29-PPT-2011, issued on 1 September 2011. b. Establishment of Land Appraisal Team 17. Since no Independent Appraisal for appraise affected land, Bupati Sanggau was established A Land Appraisal Team for Development of National Road, Sosok – Tayan and Sp. Tanjung – Batas Kota Sanggau has been established through Bupati Decree No. 310, December 2011. This Appraisal Team responsible to determine amount of compensation for affected land to be used by the LAC as basis of negotiation with APs. The Team was chaired by Head of District Tax Office, with member from any related institution such as District Land Agency, District Public Work Agency, and Public Notary etc. c. Socialization 18. Socialization to the APs has been done for several times, informally as well as formally. Informally socialization was conducted when staked out border of the acquired land, initial survey of LARP and when consultant conducted detailed survey on 11- 25 February 2010 and additional survey on 17- 22 February 2011. 19. During the survey and consultation with households along Sosok – Tayan and Sp. Tanjung – Sanggau in September 2011, it was noted that the people have been waiting for the road improvement. According to the people, the existing corridor is too narrow and has been so many accidents due to the inter-state buses passing through their villages. 20. The unit costs for structures are calculated based on determination of the appraisal team and negotiation with the affected households on August 2012. The LAC had deducted depreciation of age of structure when calculated the compensation. This practice is not consistent with the ADB policy that requires payment of compensation for acquired assets at full replacement cost. Total compensation that has delivered in 2012 is IDR 270,624,795; however the deduction of building depreciation has been paid to the AHs on 5 – 10 December 2013 with amount IDR 79,548,055 to comply with the project resettlement. b. Compensation of affected trees/crops 21. Compensation of affected trees/crops was given to 9 kinds of trees owned by 11 affected persons; the trees consist of 26 large or productive trees, and 2 medium trees. Compensation payment for structures is calculated based on determination of the appraisal team and negotiation with the affected households on August 2012, though with deduction of depreciation on structure age when calculating the compensation. Payment of compensation for affected trees/crops was given to 10 affected households, who have 5 kinds of trees which consist of 17 productive trees and 10 medium trees/non productive trees. In addition, there are 45 m2 of crops with total compensation IDR 7,673,000. The following table is detail payment of trees and crops.

The compensation payment for affected structure in Sebara Village has been delivered, though depreciation of structure when calculating at the time of compensation payment. This is not consistent with the ADB policy that requires payment of compensation for acquired assets at full replacement cost. Reimbursement of deducted amount IDR 76,267,921 should be paid to the AHs to make resettlement in Sebara comply with the project resettlement. a. Compensation payment for Affected Asset 27. Compensation payment for structures is calculated based on determination of the appraisal team and negotiation with the affected households on August 2012, though with deduction of depreciation on structure age when calculating the compensation. This is not consistent with the ADB policy that requires payment of compensation at full replacement cost. The reimbursement of building depreciation has been paid to the AHs on 5 – 10 December 2013 with amount IDR 86,715,547 to make resettlement in Pusat Damai village comply with the project resettlement. There is no affected asset in Sukagerundi village; the compensation was only paid to affected trees/crops. The compensation payment to affected households in Balai sub-district was summarized on the above table that describes of IDR 1,563,491,990 replacement cost for five villages has been paid IDR 1,253,274,520 to project affected persons. Therefore IDR 310,217,470 that already paid on December 2013, to comply with the project entitlement. 34. The compensation payment due to the deprecation has been paid to 14 villages on December 2013, through the amendment budget of West Kalimantan Province. 35. Aside compensation for replacement assets, there are 147 owners of entirely affected shops are entitled to get IDR 60,000 per day for about 2 – 5 days. It is estimated that 117 shops may require 2 days to move/rebuild shop, while 30 shops may need 5 days to repair their partially affected shops. Sanggau Government has made payments of compensation to the owner of the kiosk who lost income and compensation for the transition period in years 2013. 36. At the time, payment of allowance for income loss of 147 affected kiosk and empowerment programs for vulnerable groups have been accomplished by integrating to the Program Nasional Pemberdayaan Masyarakat (PNPM) in 2013 and 2014.

Grievance and Complaints

37. Grievance mechanism and complaints redress have been informed to the AHs during socialization, and described detail in the Project Information Pamphlet that has distributed to affected households. There no grievance and complaints received by the LAC or Project, which means no grievance and complaint regarding land acquisition process or amount of compensation or any complaints. g. Internal Monitoring 38. As the Project Internal Monitoring body, PMU will prepare quarterly reports and submits to DGH starting from the commencement of LARP finalization. This report is part of the quarterly report which includes update on resettlement in its regular progress reports to ADB. h. External Monitoring Team 39. The scope of work of the external monitoring is to provide an independent periodic review and assessment of (i) the achievement of settlement purposes; (ii) changes in income, livelihoods and standards of living; (iii) restoration and / or improvement of the economic and social base of the affected communities; (iv) the effectiveness and sustainability of rights; and (v) the need for further mitigation measures. The activity External monitoring and evaluation activities for LARP in Sanggau District has been done in 2013 and uploaded on the ADB website. In 2014 being carried out by consultants hired by the Directorate General of Highways as the Executing Agency. 40. The scope of works of external monitoring is to provide an independent periodic review and assessment of (i) achievement of resettlement objectives; (ii) changes in income, living standards and livelihoods; (iii) restoration and/or improvement of the economic and social base of the affected people; (iv) effectiveness and sustainability of entitlements; and (v) the need for further mitigation measures. 41. Relative to compliance monitoring during resettlement implementation, the main activities of the external monitor will revolve around the following: (i) review existing baseline data and gather additional socio-economic information, as necessary, on sample affected households; (ii) monitor preparation and implementation of the LARP; (iii) identify any discrepancy between policy requirements and actual implementation of resettlement; (iv) monitor the resolution of complaints and grievances of affected households; (v) provide recommendations for improving resettlement preparation and implementation; and (vi) review compliance with regard to use funds for land acquisition and resettlement.
