To South of Scotland Electricity Board.

(hereinafter called "the Owner") being the Owner of the property situate in the Parish(es) of

which property or part thereof is shown on the plan annexed and signed as relative hereto IN CONSIDERATION of the rent after specified HEREBY CONSENT to the South of Scotland Electricity Board (hereinafter called " the Board ") placing the electric lines and works specified in the First Schedule hereto (hereinafter referred to as " the electric lines ") across the said property upon the following ·terms and conditions, namely :l. The Board shall, during the time the electric lines are placed across the said property, pay to the Owner a yearly rent in accordance with the Second Schedule hereto the said rent to be payable on the E...~-..e.\fi!.~~ day of ~" ~.-.·y~L~ in each year the first payment being apportioned from the date of commencing the erection of the electric lines. 2. The expression "the placing of the electric lines" includes the laying, placing or erection, use, existence, maintenance, repair, renewal, inspection, retention and removal of the electric lines and access thereto for all reasonable purposes. 3. The Board may carry out the placing of the electric lines as nearly as may be along the route or routes shown on the said plan subject to such reasonable additions to, or deviations from, the said route or routes as may be necessary or desirable ; but the Owner shall be informed of any such additions or deviations. The Board may reasonably lop any branch which is obstructing or interfering with or is likely to obstruct or interfere with the placing of the electric lines, and may also on giving not less than fourteen days' notice (or in the case of emergency without notice) to the Owner, a.:nd to the owner of the tree aftermentioned, fell any tree which obstructs or interferes with or which will obstruct or interfere with the working of the electric lines and +'· Board shall pay to the owner thereof compensation for any tree so felled, such compensat' be determined in the absence of agreement by arbitration in accordance with Clause f- ...... The electric lines described in the First Schedule shall remain the property of the BoCJ The placing of the electric lines shall be executed by the Board in accordance with th regulations applicable thereto and for the time being in force. ~----------~~~~

In addition to paying the yearly rent the Board shall:(a) pay compensation for, and free and relieve the Owner of any claims made against him by occupiers of the said property in respect of damage caused by the placing of the electric lines, to crops, grass, trees, hedges, stock or property of the Owner or occupiers of the said property; or, at the option of the Board, make good such damage to the reasonable satisfaction of the Owner or occupiers ; and

(b) free and relieve the Owner against all actions, claims, costs and expenses which may be made against him by reason of the placing of the electric lines, and indemnify him against his own personal injury or death (including personal injury or death arising from an Act of God) which would not have occurred in the absence of the placing of the electric lines ;

Provided that the Board shall not be liable, nor pay compensation nor indemnify the Owner, in respect of any damage, injury or death which may be caused directly or indirectly through the default or negligence of the Owner or occupiers of the said property, including default or negligence in the use of the electric lines by them or any of them. 6. The Board upon giving to the Owner not less than seven days' previous notice in writing may remove the electric lines or any part thereof and upon such removal or the expiration of twelve calendar months from the service of such notice (whichever shall be the later) payment of the said rent shall cease in respect of the electric lines or such part thereof as may be removed. 7. This consent may be terminated at any time by the Owner giving to the Board twelve calendar months' previous notice in writing but without prejudice to the rights of the Board under Section 22 of the Electricity (Supply) Act, 1919, Section ll of the Electricity (Supply) Act, 1922, or Section 9 of the Electricity Act, 1947, all as amended. 8. When completed, this consent will be retained by the Board ; but a true copy thereof, including a copy of the said plan, will be furnished by the Board to the Owner free of expense. 9. Any dispute or difference arising under this consent shall be referred to a single arbiter to be mutually appointed, and, failing agreement, to be appointed in the manner provided by the Arbitration (Scotland) Act, 1894, or any statutory modification thereof.

FIRST SCHEDULE. The electric lines and works to which the foregoing consent relates are those specified in Part...}i>:' ............ . below. PART I-UNDERGROUND LINES. Underground lines consisting of cables, pipes, ducts, protective boards or tiles, and other works in connection therewith, and....................................manholes.

No poles or supports for carrying the said conductors and (if any) the earth wire will be erected on the property which is subject to the foregoing consent.

COMMUTATION OF ANNUAL PAYMENT. Where both parties are willing to commute the annual payment provided for in the foregoing Consent on the basis of

years' purchase, the

following Supplementary Agreement should be completed by the Owner.

IJWe in respect of within designed acknowledge receipt of the sum of the commutation of the annual payment agreed to be paid to mejus in the foregoing consent : in consideration of the said sum Ijwe agree that the foregoing consent shall apply and continue in force in favour of the South of Scotland Electricity Board in all time coming and shall be irrevocable : and notwithstanding the provisions of Clause Seven of the conditions of the foregoing consent Ijwe agree that this Agreement and the foregoing consent shall be binding upon myjour heirs, executors and representatives whomsoever in all time coming, and Ijwe oblige myself/ourselves and myjour heirs, executors and representatives whomsoever to take myfour or their successors in th~ lands over which the foregoing consent is granted bound to observe and fulfil this Agreement and the fq/egoing consent in like manner : and without prejudice to the foregoing obligations Ijwe further agree that in the event of the foregoing consent terminating for any reason other than the Board's own act within the next years Ijwe and myjour foresaids shall repay to the South of Scotland Electricity Board the said sum now paid to mejus under deduction of the annual payments which would have been receivable by mejus or myjour foresaids if these had not been commuted: In Witness on the Whereof, ljwe have subscribed these presents at Nineteen hundred and day of before the witnesses subscribing.
