Declaration of Jose Gelvez Albarracin I, Jose Gelvez Albarracin, declare under penalty of perjury of the laws of the United States of America, and the State of Alabama, that: 1. I am over 18 years of age, am of sound mind, and have no disabilities that would prevent me from providing the truthful facts based on my personal knowledge that are in this Declaration. I do not speak English fluently so I have provided this Declaration in Spanish, my native tongue, and I understand that it will be translated to English to be used in the federal District Court in the State of Alabama for a case against the Drummond Company for human rights violations committed in Colombia. 2. I make this truthful statement despite my knowledge that doing so is against my personal interest. I am confessing to participating in very serious crimes, including murder. Additionally, there is no doubt that through this Declaration, I am exposing myself to great risk by linking very powerful people to serous crimes. These people, in the context of Colombia, will not hesitate to use violence and threats against me and my family to silence me, or kill me. 3. I was a member of the Self-Defense Forces of Colombia (hereafter “AUC”) between 2003, until I demobilized in 2006 under the Justice and Peace Law. I served as political commander for the Bloque Resistencia Tayrona (Tayrona Resistance Front), operating within the Northern Block of the AUC under Jorge 40. I am currently being held in La Picota prison in Bogota, and am facing extradition to the United States for alleged drug trafficking. These charges are completely false, and I have even in the past collaborated with the DEA to help them gain information about drug traffickers. 4. Before I became a political commander of the AUC, I worked with the Intelligence Division of the Colombian Army in Cesar Department. In 1996, I was contacted by the Intelligence Battalion of the Colombian Army found in Santa Marta, Magdalena. The Colombian Army offered me a job in the coal mine operated by Prodeco S.A. in Calenturitas, Cesar. My job was to detect guerrillas and subversives in the area and within the union at the mine. I carried out this job with the active participation of the National Army’s intelligence forces. I stayed working with Prodeco during 1996 and 1997, until I returned to Santa Marta and took an administrative job at the Hospital of Fernando Troconis. 5. Around the same time I went to Cesar to work at Prodeco, I was aware of the formation of Convivir self defense groups in Magdalena and Cesar, which were formed by the Colombian government in order to give legitimacy to and revive the paramilitary groups who were fighting guerrillas in the region. The Convivir groups were groups organized and directed by the ranchers and landowners in the region, and AUC members were recruited as official

members of these Convivir groups. Uriel Mora was a retired military Sergeant who commanded the Convivirs in Magdalena. I know that the Convivir groups were fronts for the AUC because several members of my Front of the AUC, the Tayrona Resistance Front, had originally joined the AUC as members of the Convivirs. One of those AUC members who demobilized with me is Luis Ropero, alias Cambalache. 6. I came to work at Prodeco shortly before the mine had been bought by the foreigners from Glencore. Around this same time there were retired Colombian military officials, subofficials, and civilian attachments working together in the security team at Prodeco. We were trained in offensive and defensive techniques by foreign officials who worked for Glencore. Under the new Glencore management, new offices and living quarters were constructed, and geological projects were conducted to locate coal deposits. 7. I do not remember any of the foreigners’ names at this time, but I do remember Pedro Arce, Administrative Manager of the mine; Cesar, Purchasing Manager; Manuel Gutierrez, Security Chief for Prodeco; and Luis Ochoa, Security Manager of the mine. 8. In the headquarters of Prodeco in Santa Marta, Prodeco had offices inside a mall named Parado Plaza, in front of the Social Security building. I have been to these offices many times because as I worked in security I often had to bring foreigners who worked for Glencore back and forth from Santa Marta to the mine. 9. Shortly after I arrived at Prodeco, an intelligence office was set up where information collected by Prodeco and Drummond was combined. This office was run by a Sergeant from Barranquilla who had been awarded the Medal of Public Order. The Sergeant gave me a list of what he needed and Manuel Gutierrez (Prodeco’s Security Chief) supplied him with computers, desks, a motorcycle and all of the other office supplies that he would need. Drummond and Prodeco both paid a monthly fee to cover the operating costs of the office. My role was to turn over to this intelligence office run by the Colombian military any intelligence information on subversives and union activity that had been collected by both Drummond and Prodeco’s security teams. I received a monthly fee from the Rime 1 Battalion of the Army Intelligence to turn over this information, and receipts from these payments should still exist in the military’s records. 10. By 1996 when I arrived at Prodeco, the AUC were already present in Cesar in the area around the Prodeco and Drummond coal mines. I later learned that Carlos Baena, a Corporal in the Rime 1 Battalion of the Army Intelligence, passed to the AUC all of the intelligence information that I turned into the intelligence office, so that the AUC could eliminate any subversives found in the region of La Loma and around the mines. I understand that Carlos Baena later retired from the military and still currently works in Calenturitas. I

noticed during my time at the Prodeco mine that many personnel from the military had close links with the AUC, in particular Manuel Gutierrez of Prodeco and Luis Carlos Rodriguez of Drummond. 11. In addition to intelligence information, Prodeco also financed and provided the AUC with supplies. On one occasion, under the instruction of Manuel Gutierrez, Luis Ochoa found out where the AUC base in the region was located. Manuel Gutierrez, Luis Ochoa, and I then drove in a pickup truck to a farm named La Ucrania, which was located approximately ten minutes from Pailitas, Cesar. There were palm trees on either side of the entrance to the farm. Once entering, we saw approximately 30 people dressed in camouflage who introduced us to the commander who went by the alias, “Lucho”. Manuel Gutierrez spoke on behalf of the company, Prodeco, about providing this group of the AUC with whatever support they might need. It was clear that there was a direct link between the company and the AUC. About two days after this meeting, the guerrillas attacked the La Ucrania farm, but the paramilitary group remained there. 12. I was also present at the meeting in which it was established that Prodeco would finance, arm, and equip a group of 200 men from the AUC, who were being transferred to the area of Silencio, near the Calenturitas mine. This meeting was attended by myself, Manuel Gutierrez, Luis Ochoa, and a high ranking AUC officer who was known as ‘El Profe’. El Profe arrived in a helicopter, and when El Profe was lowered to the ground Manuel gave him the money. 13. About 20 days after this meeting with El Profe, so this would have been in 1996 still, approximately 80 paramilitaries appeared in the region and established themselves in a farm in El Silencio. In the end only 80 paramilitaries arrived, instead of the 200 of which they had discussed. This relationship between the AUC and Prodeco was arranged directly between Manuel Gutierrez, Luis Ochoa, and the AUC Commander whose name I cannot recall. Prodeco paid the AUC commander approximately 40 million Colombian pesos monthly to cover the cost of the salaries and expenses for this group of AUC troops. 14. As part of my security job, I was required to monitor the entire area around the Prodeco mine, including the Silencio farm where the paramilitary base was established. It was common knowledge that the AUC base had been built up by Prodeco. Once when I was monitoring the area, a woman asked me “Why did Luis Ochoa put these people here?”. The reason was supposedly to eliminate the guerrilla from the area, but I know that the paramilitaries killed and displaced many innocent people. 15. Once Prodeco had made contact with the AUC, we contacted Drummond’s Department of Security, which was also staffed by retired Colombian military officials; including high ranking officers, majors, lieutenants, and low ranking

officials. Directors and Heads of Security and Protection at Prodeco and Drummond financed the AUC in order to control the entry to the region, and the surrounding area. As Drummond was also run by foreigners, the goal of their Security Department was the same as Prodeco’s: to detect subversive and union sympathizers so that the AUC could eliminate them. 16. After we contacted Drummond, we held a joint-staff meeting of Prodeco and Drummond’s security teams at the casino within Drummond’s facilities. From Drummond’s security team the following people attended: Rafael Peña Ríos, a retired General; Luis Carlos Rodriguez, a retired Colonel; some retired officials named Carlos Sastre, Mario Otero, Cesar Agudelo, Néstor Rodriguez, Wilmer Aguerre and Orlando Ramirez. There was also an American present who was part of Drummond’s security team, Jim Adkins. From Prodeco´s security team the following people attended: Manuel Gutierrez; Luis Hernando Ochoa; Javier Recaman, a retired military official who currently works in the Calenturitas mine as Security Chief; and myself. At this meeting we discussed and we all agreed that we would support the AUC with money for arms and supplies. We also agreed that we would give the AUC a monthly payment to cover the salaries, food, and costs of the AUC troops. We also agreed to buy the AUC some vehicles and supply them with fuel. There was no objection to any of these agreements from anyone present. 17. At this meeting we also discussed and everyone agreed to create two military bases for internal security at the two mines: one for Drummond and the other for Prodeco. This occurred after our meeting. Drummond´s military base was run by a military commander with the last name Llorente and Prodeco´s military base was headed by a Sergeant whose name I cannot recall. We also agreed that the intelligence office (mentioned above), would have a suboffice at Prodeco. 18. At this meeting, we also all agreed that there would be free movement for the AUC within both the Prodeco and Drummond mines. We agreed to install a radio system so that we could easily communicate between the two mines. We also gave a radio to the commander of the AUC, so we could easily communicate with him and he with us. At first there was an AUC commander named “Jimmy” and later a commander named “Melchor”. The radio system was installed in the suboffice of the intelligence office at Prodeco. Through this system we were able to communicate directly with Drummond, the military, and the AUC. We took turns acting as radio operator but Nohora Delgadillo and Luz Dary, from the Colombian military, most frequently operated the radio out of that office. I believe that Luz Dary now works at Prodeco´s port in Santa Marta. 19. Besides receiving funding and other support from Drummond and Prodeco, the AUC also entered the Drummond mine freely. The AUC often entered through the back entrance of the Drummond mine, which was guarded by the Security company, Viginorte. The AUC filled the tanks of their cars within

the mine, with fuel that was rationed from Drummond for the AUC’s use. I observed this during my routine monitoring of the area which was part of my job. Because of my history as a military investigator it was easy to detect the AUC’s presence. 20. Although I have spoken about my activities with the AUC through Colombia’s Justice and Peace process, I have not spoken about the activities of Drummond and Prodeco until now. The AUC has demobilized so I can talk freely about what I did with the AUC, but these mining companies continue to operate in Colombia and still have a lot of power in this country. I know that in giving this declaration I am implicating many active military officers, intelligence officers, and powerful mining companies that to date have enjoyed impunity. It is not a secret that these people will not hesitate to eliminate me or my family for giving this information. Executed this 21st day of November, 2011, in the Picota prison, Bogota, Colombia.

Declaración de José Gelvez Albarracín Yo, José Gelvez Albarracín, declaro bajo pena de perjurio al tenor de las Leyes de los Estados Unidos y del Estado de Alabama: 1. Tengo más de 18 años de edad, me encuentro en mi sano juicio y no tengo incapacidad alguna que me impida proporcionar hechos ciertos basados en mi conocimiento personal, los mismos que están contenidos en esta Declaración. No hablo inglés con fluidez, razón por la cual me ha sido proporcionada esta Declaración en español que es mi lengua nativa, y comprendo que ésta Declaración será traducida al inglés para ser utilizada en la Corte de Distrito del Estado de Alabama en el caso que se lleva en contra de la compañía Drummond por violaciones a los derechos humanos cometidas en Colombia. 2. Realizo esta declaración auténtica aunque estoy conciente que hacerlo va en contra de mis intereses personales. Adicionalmente, no cabe duda que a través de esta Declaración me estoy exponiendo a un enorme riesgo por cuanto estoy vinculando a gente muy poderosa con la práctica de delitos serios. Esta gente, en el contexto de Colombia, no dudará en utilizar la violencia y amenazas en mi contra y de mi familia en aras de silenciarme o matarme. 3. Fui miembro de las Autodefensas Unidas de Colombia (de aquí en adelante referidas como las "AUC") entre el 2003, hasta que me desmovilicé en el 2006 bajo la Ley de Justicia y Paz. Yo me desempeñé como comandante político del Bloque Resistencia Tayrona (Bloque Resistencia Tayrona), que operaba dentro del Bloque Norte de las AUC bajo el mando de Jorge 40. Me encuentro actualmente recluido en la cárcel La Picota en Bogotá y estoy enfrentando la posibilidad de ser extraditado a los Estados Unidos bajo cargos de tráfico de drogas. Estos cargos son completamente falsos; yo incluso he colaborado en el pasado con la DEA ayudándoles a obtener información sobre de traficantes de droga. 4. Antes de llegar a ser comandante político de las AUC, trabajé en el Departamento de Inteligencia del Ejército Colombiano en el Departamento del Cesar. En 1996 fui contactado por el Batallón de Inteligencia del Ejército Colombiano que se encontraba en Santa Marta, Magdalena. El Gobierno Colombiano me ofreció un trabajo en la mina de carbón operada por Prodeco S.A. en Calenturitas, Cesar. Mi trabajo consistía en detectar a las guerrillas y subversivos en el área y en el interior del sindicato en la mina. Yo realicé este trabajo con la participación activa de las fuerzas de inteligencia del Ejército Nacional. Me quedé trabajando en Prodeco durante 1996 y 1997, hasta que regresé a Santa Marta donde acepté un trabajo administrativo en el Hospital de Fernando Troconis. 5. Alrededor de la misma época en que fui a trabajar en Prodeco, tuve conocimiento de la formación de los grupos de autodefensa de Convivir en Magdalena y Cesar, lo cuales fueron formados por el gobierno Colombiano

para dar legitimidad y resucitar a los grupos paramilitares quienes estaban luchando contra las guerrilleras en la zona. Los grupos Convivir fueron organizados y gestionados por los ganaderos y dueños de tierra en la región, y miembros de las AUC fueron reclutados como miembros oficiales de esos grupos Convivir. Uriel Mora era un sargento retirado del ejército quien comandaba los Convivir en Magdalena. Yo sé que los grupos Convivir fueron fachadas para las AUC porque varios miembros de mi Frente de las AUC, el Bloque Resistencia Tayrona, se habían originalmente unido a las AUC como miembros de los Convivir. Uno de estos miembros de las AUC quien se desmovilizó conmigo es Luis Ropero, alias Cambalache. 6. Yo vine a trabajar en Prodeco poco antes de que la mina había sido comprada por extranjeros de Glencore. Alrededor de este tiempo habían oficiales y suboficiales del ejército colombiano y civil trabajando en conjunto en la seguridad de Prodeco. Fuimos entrenados en técnicas de ataque y de defensa por oficiales extranjeros que trabajaron para Glencore. Bajo la nueva administración de Glencore se construyeron nuevas oficinas y viviendas y se realizaron proyectos geológicos para localizar depósitos de carbón. 7. No recuerdo los nombres de ninguno de los extranjeros en estos momentos, pero si recuerdo a Pedro Arce quien era el gerente administrativo de la mina; a Cesar el gerente de compras; a Manuel Gutiérrez el jefe de seguridad de Prodeco; y a Luis Ochoa jefe de seguridad de la mina. 8. En el cuartel general de Prodeco en Santa Marta, Prodeco tenía oficinas dentro de un centro comercial llamado Parado Plaza, enfrente del edificio del Seguro Social. Yo he estado en estas oficinas muchas veces por cuanto yo trabajé en la seguridad y con frecuencia tenía que llevar a extranjeros quienes trabajaban para Glencore desde Santa Marta hacia la mina. 9. Poco después de mi llegada a Prodeco, fue establecida una oficina de inteligencia donde se recolectaba información por Prodeco y Drummond en forma conjunta. Esta oficina era administrada por un sargento de Barranquilla quien ha sido galardonado con la Medalla del Orden Público. Este sargento me dio una lista de lo que él necesitaba y Manuel Gutiérrez (Jefe de Seguridad de Prodeco) le proporciono de computadoras, escritorios, una motocicleta y de todos los insumos de oficina que él pudiera necesitar. Ambas, Drummond y Prodeco pagaban un costo mensual para cubrir las operaciones de la oficina. Mi función era entregar a esa oficina de inteligencia manejada por el ejército colombiano, cualquier información acerca de subversivos y actividades del sindicato que había sido recolectada por los equipos de seguridad de Drummond y Prodeco. Yo recibía un pago mensual del Batallón Rime 1 de la Inteligencia del Ejército por entregarle esta información, y los recibos por estos pagos deberían todavía existir en los registros militares. 10. Para 1996 cuando yo llegue a Prodeco las AUC ya estaban presentes en el cesar en el área alrededor de las minas de carbón de Prodeco y Drummond.

Más tarde llegue a conocer que Carlos Baena, un cabo primero del Batallón Rime 1 de la Inteligencia del Ejército, le transmitía a las AUC toda la información de inteligencia que yo le entregaba a la oficina, de tal manera que las AUC pudieran eliminar a cualquier subversivo que se encontrara en la región de La Loma y alrededor de las minas. Tengo entendido que Carlos Baena luego se retiró del ejército y todavía trabaja en la actualidad en Calenturitas. Yo me percaté durante mi tiempo en la mina de Prodeco que muchos miembros del personal militar tenían vínculos cercanos con las AUC en particular Manuel Gutiérrez de Prodeco y Luis Carlos Rodríguez de Drummond. 11. Además de proporcionarles información de inteligencia, Prodeco también financió y proporcionó insumos a las AUC. En una ocasión bajo la instrucción de Manuel Gutiérrez, Luis Ochoa determinó la localización de la base de las AUC en la región. Manuel Gutiérrez, Luis Ochoa y yo manejamos en una camioneta hacia una finca llamada la Ucrania, la cual estaba localizada aproximadamente a 10 minutos de Pailitas, Cesar. Habían tres palmeras en cada lado de la entrada a la finca. Una vez que entramos, nosotros vimos aproximadamente a 30 personas vestidas de camuflaje quienes nos presentaron al comandante que se hacia llamar Alias "Lucho". Manuel Gutiérrez habló en representación de la compañía Prodeco acerca de proporcionar a este grupo de las AUC, cualquier ayuda que estos pudiesen necesitar. Estaba claro que existía un vínculo directo entre la compañía y las AUC. Aproximadamente dos días después de esta reunión, la guerrilla atacó la finca La Ucrania, pero el grupo paramilitar siguió ahí. 12. Yo también estuve presente en la reunión en la cual se estableció que Prodeco financiaría, proporcionaría armamento y equiparía a un grupo de 200 hombres de las AUC, quienes fueron transferidos al área de Silencio cerca de la mina de Calenturitas. A esta reunión asistimos yo, Manuel Gutiérrez, Luis Ochoa, y un oficial de alto rango de las AUC conocido como "El Prof". El Profe llegó en un helicóptero y cuando aterrizó Manuel le dio el dinero. 13. Cerca de 20 días después de esta reunión con El Profe, por lo tanto esto sería todavía en 1996, aproximadamente 80 paramilitares aparecieron en la región y se establecieron en la finca El Silencio. Al final llegaron 80 paramilitares en vez de los 200 de los que habían hablado. Esta relación entre las AUC y Prodeco fue arreglada directamente entre Manuel Gutiérrez, Luis Ochoa y el comandante de la AUC cuyo nombre no recuerdo. Prodeco le pago al comandante de las AUC aproximadamente 40 millones de pesos colombianos mensuales para cubrir salarios y costos de este grupo de las tropas de las AUC. 14. Como parte de mi trabajo de seguridad yo tenía que monitorear el área entera alrededor de la mina de Prodeco incluyendo la finca El Silencio donde la base de los paramilitares había sido establecida. Era de conocimiento común que la base de las AUC había sido construida por Prodeco. Toda vez que yo me

encontraba monitoreando el área, una mujer me preguntó "por qué Luis Ochoa puso estas personas aquí?". La razón supuestamente era eliminar a la guerrilla del área, pero yo sé que los paramilitares asesinaron y desplazaron a muchas gentes inocentes. 15. Una vez que Prodeco hizo contacto con las AUC, contactamos al departamento de seguridad de Drummond, el cual estaba también compuesto por oficiales retirados del ejército colombiano; incluyendo oficiales de alto rango mayores, Tenientes, y oficiales de bajo rango. Los directores y los jefes de seguridad de Prodeco y Drummond financiaron a las AUC en aras de controlar su entrada en la región y las áreas alrededor. Por cuanto Drummond era administrado por extranjeros el objetivo de su departamento de seguridad era el mismo que el de Prodeco: Detectar subversivos y simpatizantes del sindicato de manera que las AUC pudieran eliminarlos. 16. Después de que contactamos a Drummond, tuvimos una reunión conjunta de personal con los equipos de seguridad de Prodeco y Drummond en el casino que está dentro de las instalaciones de Drummond. En representación del equipo del seguridad de Drummond las siguientes personas asistieron: Rafael Peña Ríos, quien era un general retirado; Luis Carlos Rodríguez que era un coronel retirado, algunos oficiales retirados entre quienes estaban Carlos Sastre, Mario Otero, Cesar Agudelo, Néstor Rodríguez, Wilmer Aguerre y Orlando Ramírez. Estuvo también presente un norteamericano, Jim Adkins. En representación del equipo de seguridad de Prodeco las siguientes personas asistieron: Manuel Gutiérrez; Luis Hernando Ochoa; Javier Recaman, un oficial retirado quien actualmente trabaja en la mina Calenturitas como jefe de seguridad; y mi persona. En esta reunión discutimos y todos estuvimos de acuerdo en apoyar a las AUC con dinero para armas y suministros. También acordamos que proporcionaríamos a las AUC de un pago mensual para cubrir salarios, comida, y costos de las tropas de las AUC. También acordamos comprar vehículos para las AUC y proporcionarles de combustible. No hubo objeción en contra de ninguno de estos acuerdos de parte de ninguno de los presentes. 17. En esta reunión también discutimos y todos estuvimos de acuerdo en la creación de dos bases militares para seguridad interna en las dos minas: Una para Drummond y otra para Prodeco. Esto se concretó después de la reunión. La base militar de Drummond era manejada por un comandante militar cuyo apellido era Llórente y la base militar de Prodeco estaba dirigida por un sargento cuyo nombre no recuerdo. También acordarnos que la oficina de inteligencia (mencionada antes) tendría una sub-ofícina localizada en Prodeco. 18. En esta reunión también acordamos que habría libertad de movimiento para las AUC dentro de ambas minas, la de Prodeco y la de Drummond. También acordamos en instalar un sistema de radio que comunicara fácilmente ambas minas. También le dimos un radio al comandante de las AUC, de tal manera que pudiéramos comunicarnos con él y el con nosotros. Al principio había un

comandante de las AUC que se llamaba "Jimmy" y después había un comandante que se llamaba '"Melchor". El sistema de radio estaba instalado en la sub-ofícina de inteligencia que estaba en Prodeco. A través de este sistema teníamos la posibilidad de comunicarnos directamente con Drummond, el ejército y las AUC. Nos turnábamos en el trabajo de operadores de radio pero Nohora Delgadillo y Luz Dary que eran del ejército colombiano eran quienes con más frecuencia operaban el radio en esa oficina. Creo que Luz Dary trabaja actualmente en el puerto de Prodeco en Santa Marta. 19. Además de recibir financiamiento y ayuda de Drummond y Prodeco, las AUC también ingresaban a la mina de Drummond Libremente. Las AUC con frecuencia entraban por la puerta de atrás de la mina de Drummond la cual era vigilada por la compañía de seguridad que se llamaba Viginorte. Las AUC llenaban los tanques de sus carros dentro de la mina con combustible que había sido separado por Drummond para el uso de las AUC. Yo observe esto durante mi rutina de monitoreo del área lo cual era parte de mi trabajo. Debido a mi historial como investigador militar era para mi fácil detectar la presencia de las AUC. 20. Aunque he hablado sobre mis actividades con las AUC por medio del proceso de Justicia y Paz, no he hablado sobre las actividades de Drummond y Prodeco hasta ahora. Las AUC se desmovilizaron así que puedo hablar abiertamente sobre lo que hice con las AUC, pero esas compañías mineras siguen operando en Colombia y aún tienen mucho poder en este país. Se que al dar esta declaración estoy implicando a muchos oficiales activos del ejército, a oficiales de inteligencia y a compañías mineras poderosas quienes hasta el momento se encuentran impunes. No es un secreto que estas personas no dudarán en eliminarme a mí o a mi familia debido a que estoy dando esta declaración.
