CITY OF NEW BRITAIN RFP FOR SERVICE LINE PROTECTION PLAN PROVIDER PUBLIC BID NO. 3425 A. INTRODUCTION AND GENERAL REQUIREMENTS The New Britain Board of Water Commissioners, and the City of New Britain Sewer Department, through the City's Purchasing Agent, is requesting proposals from qualified firms to provide a service line protection plan to be available to New Britain Water Department customers and to the New Britain Sewer Department customers. A three-year contract is anticipated, with an option to extend for two additional oneyear periods. The scope of services shall include matters related to development, marketing, management and administration of a service line protection plan to be made available to New Britain Water Department customers. For matters concerning drinking water service lines, The selected firm shall report to and be responsible to the New Britain Board of Water Commissioners through Gilbert Bligh, Director, its liaison in all aspects of the assignment. For matters concerning sewer service laterals, The selected firm shall report to and be responsible to the New Britain Sewer Department through Mark Moriarty, Director of Public Works, its liaison in all aspects of the assignment. There is no expressed or implied obligation for the City of New Britain to reimburse responding firms for any expense incurred in preparing proposals in response to this request. To be considered, sealed proposals must be submitted in triplicate to the City of New Britain, Purchasing Department, Room 401, City Hall, 27 West Main St., New Britain, CT 06051, by 11:00 a.m. on May 29, 2008. The envelope should be clearly marked on the outside "Proposal for Service Line Protection Plan" due at 11:00 a.m. on May 29, 2008, Public Bid No. 3425". The City of New Britain reserves the right to reject any or all proposals submitted. Proposals submitted will be evaluated by the New Britain Board of Water Commissioners, the New Britain Sewer Department and the Purchasing Agent. During the evaluation process, the City of New Britain reserves the right, where it may serve the City's best interest, to request additional information or clarifications from proposers. At the discretion of the City of New Britain, firms submitting proposals may be requested to make oral presentations as part of the evaluation process. The City of New Britain reserves the right to retain all proposals submitted and to use any ideas in a proposal regardless of whether that proposal is selected. Submission of a proposal indicates acceptance by the firm of the conditions contained in this request for proposals, unless clearly and specifically noted in the proposal submitted and confirmed in the contract between the City of New Britain and the firm selected. TERM OF ENGAGEMENT A three-year contract is contemplated, subject to the annual review and recommendation of the New Britain Board of Water Commissioners and the Sewer Department. After the third year, contract extension of two additional one-year periods may be made, or the City may license the service line protection plan s trademark and become the plan provider, contingent upon the satisfactory negotiation of terms. C. ADDENDA TO REQUEST FOR PROPOSALS If any addenda are issued on this request for proposals, a good faith attempt will be made to forward a copy to each of those firms who, according to the records of the Purchasing Department, have previously received a copy of this request. However, it shall be the sole responsibility of those offering proposals to contact the Office of the Purchasing Agent prior to submitting their proposals to determine whether any addenda have been issued. Addendas will also be posted on the City s and State of Connecticut s DAS websites under the Bid Number. It is also the responsibility of the firm submitting the proposals to check these websites regularly. D. SELECTION CRITERIA Selection of service provider will be based upon the following standards: 1. Responsiveness of the written proposal to the purpose and scope of the project and to the plan's value to New Britain Water and Sewers Dept. and its customers. Submissions are to include detailed provisions of the offered service line protection plan, including enrollment procedures and costs, termination and cancellation provisions, specific work to be covered, specific work not to be covered, response time and all other relevant plan information. Sample brochures should be included.

Experience with governmental entities in the management of similar programs 4. Revenue sharing plan offered.

E. INSURANCE REQUIREMENTS AND INDEMNIFICATION Service provider and all sub-contractors of service provider shall agree to maintain in force at all times during which services are to be performed the following coverages placed with company(ies) licensed by the State of Connecticut which have at least an "A-" VIII policyholders' rating according to BEST Publication's latest edition Key Rating Guide: Commercial General Liability:

"The City of New Britain, New Britain Water Department and Consolidated School District are to be named as "Additional Insured". Original, completed certificate of insurance must be presented to the Purchasing Agent prior to a purchase order or contract issuance. Service provider is responsible for collecting insurance documents from sub-contractors and submittal to the Purchasing Agent prior to performance of sub-contracted services. HOLD HARMLESS AGREEMENT:--The service provider, its agents and assigns shall indemnify and hold harmless the City of New Britain, including but not limited to, its elected officials, its officers, and agents, ("the City") from any and all claims made against the City, including but not limited to, damages, awards, costs and reasonable attorneys fees, to the extent any such claim directly and proximately results from the wrongful willful or negligent performance of services by the service provider during the service provider's performance of this Agreement or any other Agreements of the service provider entered into by reason thereof. The City agrees to give the service provider prompt notice of any such claim and absent a conflict of interest, an opportunity to control the defense thereof.

F. PROJECT BACKGROUND-WATER SERVICES The City of New Britain Water Department serves approximately a population of approximately 72,000 of its own customers in New Britain, Berlin, Newington, Farmington and Plainville. The City is currently engaged in a contract that provides water service insurance and protection for its residents. That insurance provides for repair or replacement of leaking water service lines and related work. Related work may include excavation, loaming and seeding of lawn as required in the area of replacement. This project constitutes a rebid of that contract. G. PROJECT OBJECTIVE

WATER SERVICES

The residential service line protection plan will be available for one through six family residential dwellings located in the New Britain Water service territory with a service line size up to and including three inches in diameter. The City of New Britain Water Department anticipates entering into a contract with a service line protection plan provider, general responsibilities include: Management Services Provider (MSP): 1.

Manage all aspects of marketing, development of SLPP brochures/applications, mailings, data processing, customer billing, and the transfer of customer SLPP participation to New Britain Water Department for data entry.

2.

Provide a toll-free telephone number to New Britain Water Department's customers for information and questions pertaining to the SLPP program.

3.

Arrange for and coordinate SLPP repairs with excavation/repair contractors (local contractors will be invited to bid repair work). Payment for contractor work will be made directly by MSP.

4.

Compensate New Britain Water Department services personnel for work related to on-site SLPP issues.

5.

Provide New Britain Water Department key designated employees with an overview of the SLPP program and protocol procedures for facilitating data input into the customer database; provide local customer and field service training related to SLPP procedures, provide SLPP database software that is fully compatible with the New Britain Water Department customer database.

6.

Administer all phases of the renewal processes.

New Britain Water Department:

1. Assist MSP with the marketing brochure development, including use of the City of New Britain seal in the partnership campaign. 2. Endorse the program in its customer communication and through local media contacts; include SLPP information in its quarterly customer billing. 3. Assist MSP personnel (as may be required) in its review of applications for compliance with the SLPP program's minimum requirements. 4. Enter customer SLPP participation into data base; forward customer inquiries to MSP SLPP's personnel. 5. Assist MSP in identifying quality, proven local excavating and repair contractors; field personnel to investigate leaks and contact contractors for SLPP-related repairs.

Describe in detail the qualifications of your company and individuals specifically assigned, and supply a list of current clients for references with names, addresses, telephone numbers, and contact persons who can be contacted by the City for discussion of your services to those clients. In addition, please provide the names of at least two clients with whom you have done business in the past, but who are no longer your clients. Submit a detailed proposed sample service plan, which includes terms and conditions and a description of services made available under the plan. Revenue sharing features of the plan, as well as responsibilities of the New Britain Water Department under the plan, should be completely described. Successful proposer shall be expected to execute the City's standard contract (copy attached), to which proposal and any other negotiated terms will be added as an exhibit. No other agreements/contracts will be signed, unless submitted with proposal and approved by the City's legal department.
