CITY OF CENTERTON CITY COUNCIL MEETING JANUARY 12, 2016 The city council was called to order by Mayor, Bill Edwards. The Pledge of Allegiance was recited. The prayer was offered by Keith Higginbotham. Those Present and answering roll call were Mayor Bill Edwards, Keith Higginbotham, Josie Reed, Robin Reed, Misty Elam, Wayne Low and Skye Petty. Those present and not answering role call were Todd Wright, Pam Grant, Brian Rabal, Planning Director Lorene Burns, Water & Sewer Superintendent Frank Holzkamper, Street Superintendent Rick Hudson, Police Chief Cody Harper, Chief Building Inspector Robert Coffelt, Animal Control Supervisor Terry Sanchez and Fire Chief Delton Bush.

Public Hearing- Sewer Rate Adjustment- Mayor Edwards explained the need for this public hearing to discuss a sewer rate adjustment. Keith Higginbotham made a motion to open the public hearing with a 2nd from Skye Petty. Bob Anderson made a presentation to those in attendance. There were no public comments. Robin Reed made a motion to close the public hearing with a 2nd from Keith Higginbotham. All council members voted in favor and the motion carried.

(1) Council Minutes- Keith Higginbotham made a motion to approve the December 8th, 2015 city council minutes with a 2nd from Skye Petty. All council members voted in favor and the motion carried.

(2) Planning, Parks & Recreation and Water & Sewer Minutes- Robin Reed made a motion to acknowledge receipt of the November 19th, 2015 CWSD, November 24th, 2015 Planning and October 6th, 2015 Parks & Recreation meeting minutes with a 2nd from Josie Reed. All council members voted in favor and the motion carried.

(3) City and Court Financials- Mayor Edwards stated that 100% through the year we received 111% of our budgeted revenue. He stated that our expenditures were at 105%. Skye Petty made a motion to accept the December 2015 City and Court financials with a 2nd from Keith Higginbotham. All council members voted in favor and the motion carried.

(4) Ordinance 2016-01- AN ORDINANCE AMENDING CENTERTON MUNICIPAL CODE, SECTION 13.04.05 TITLED “COMPENSATION” FIXING THE SALARY FOR MEMBERS OF THE PLANNING COMMISSION, AND DECLARING AN EMERGENCY. Mayor Edwards addressed the council and explained the need for this ordinance to adjust the pay for the Planning Recorder for the Planning Commission. There was discussion. There was agreement to raise the Planning Recorder pay to $100 per meeting, with $100 for preparation of the planning meeting minutes. Keith Higginbotham made a motion to read the ordinance by title only with a 2nd from Misty Elam. All council members voted in favor and the motion carried. Brian Rabal read the ordinance by title only. Josie Reed made a motion to suspend the rule requiring the reading of the ordinance on 3 separate occasions with a 2nd from Wayne Low. All council members voted in favor and the motion carried. Keith Higginbotham made a motion to adopt the ordinance with a 2nd from Misty Elam. All council members voted in favor and the motion carried. Brian Rabal read the emergency clause. Josie Reed made a motion to adopt the emergency clause with a 2nd from Skye Petty. All council members voted in favor and the motion carried.

(5) Ordinance 2016-02- AN ORDINANCE AMENDING CENTERTON MUNICIPAL CODE, CHAPTER 10.12.05, ADJUSTING SEWER RATES; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. Mayor Edwards addressed the council and explained the need for this ordinance to adjust sewer rates. Skye Petty made a motion to read the ordinance by title only with a 2nd from Keith Higginbotham. All council members voted in favor and the motion carried. Brian Rabal read the ordinance by title only. Keith Higginbotham made a motion to suspend the rule requiring the reading of the ordinance on 3 separate occasions with a 2nd from Wayne Low. All council members voted in favor and the motion carried. Keith Higginbotham made a motion to adopt the ordinance with a 2nd from Wayne Low. All council members voted in favor and the motion carried. Brian Rabal read the emergency clause. Robin Reed made a motion to adopt the emergency clause with a 2nd from Skye Petty. All council members voted in favor and the motion carried.

(6) Ordinance 2016-03- AN ORDINANCE AMENDING CENTERTON MUNIPAL CODE 13.05 TITLED PLANNING FEE SCHEDULE; AMENDING SECTIONS 14.04.07, 14.04.08, 15.08.08 AND 16.04.05 PERTAINING TO SAID FEES; AND DECLARING AN EMERGENCY. Mayor Edwards addressed the council and explained the need for this ordinance to adjust some of the planning fees. Mayor Edwards detailed those changes. There was discussion. Keith Higginbotham made a motion to read the ordinance by title only with a 2nd from Josie Reed. All council members voted in favor and the motion carried. Brian Rabal read the ordinance by title only. Keith Higginbotham

made a motion to suspend the rule requiring the reading of the ordinance on 3 separate occasions with a 2nd from Skye Petty. All council members voted in favor and the motion carried. Josie Reed made a motion to adopt the ordinance with a 2nd from Misty Elam. All council members voted in favor and the motion carried. Brian Rabal read the emergency clause. Keith Higginbotham made a motion to adopt the emergency clause with a 2nd from Skye Petty. All council members voted in favor and the motion carried.

(7) Ordinance 2016-04- AN ORDINANCE ACCEPTING THE FINAL PLAT OF CREEKSIDE SUBDIVISION, CENTERTON, BENTON COUNTY, ARKANSAS, AND DECLARING AN EMERGENCY. Mayor Edwards addressed the council and explained the need to correct this ordinance to accept the final plat for the Creekside subdivision. Robin Reed made a motion to read the ordinance by title only with a 2nd from Josie Reed. All council members voted in favor and the motion carried. Brian Rabal read the ordinance by title only. Wayne Low made a motion to suspend the rule requiring the reading of the ordinance on 3 separate occasions with a 2nd from Keith Higginbotham. All council members voted in favor and the motion carried. Robin Reed made a motion to adopt the ordinance with a 2nd from Wayne Low. All council members voted in favor and the motion carried. (8) Resolution 2016-01- A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK, AS REPRESENTATIVES OF THE CITY OF CENTERTON, ARKANSAS, TO ENTER INTO AN AGREEMENT WITH SOURCE GAS ROGERS, ARKANSAS, FOR UTILITY RELOCATION ON GAMBLE ROAD. Mayor Edwards addressed the council and explained the need for this resolution to move a gas line on Gamble Road, at a cost to the city of $7431.26. Robin Reed made a motion to read the resolution by title only with a 2nd from Skye Petty. All council members voted in favor and the motion carried. Brian Rabal read the resolution by title only. Keith Higginbotham made a motion to adopt the resolution with a 2nd from Josie Reed. All council members voted in favor and the motion carried.

(9) Resolution 2016-02-A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK, AS REPRESENTATIVES OF THE CITY OF CENTERTON, ARKANSAS, TO ENTER INTO AN AGREEMENT WITH MHC KENWORTH/VOLVO, SPRINGDALE, ARKANSAS FOR THE PURCHASE OF A 2017 KENWORTH T370 DUMP TRUCK . Mayor

Edwards addressed the council and explained the need for this resolution to accept a bid for a dump truck for $89,125.00. Wayne Low made a motion to read the resolution by title only with a 2nd from Keith Higginbotham. All council members voted in favor and the motion carried. Brian Rabal read the resolution by title only. Keith Higginbotham made a motion to adopt the resolution with a 2nd from Josie Reed. All council members voted in favor and the motion carried.

(10) Department Reports- Building Inspection- Robert Coffelt addressed the council and detailed his report in the council’s Dropbox packets. He also gave details on the new High School. Planning- Lorene Burns addressed the council and detailed the Planning Project Status Report in the council’s Dropbox packet. Lorene asked for the council’s permission to surplus the HP Plotter. Robin Reed made a motion to surplus the HP Plotter with a 2nd from Keith Higginbotham. All council members voted in favor and the motion carried. Police- Cody Harper addressed the council and pointed out the stats for the previous month. He stated that Patrick Stewart and Kenneth Sherman are our new officers. Streets / Parks & Rec- Rick Hudson addressed the council and detailed his reports in the Council’s Dropbox packets. Rick also gave an update on the city parks. Rick asked for the council’s permission to surplus a hydraulic post driver. Keith Higginbotham made a motion for Rick to surplus the hydraulic post driver with a 2nd from Josie Reed. All council members voted in favor and the motion carried. Fire- Delton Bush addressed the council and stated that there have been 32 runs. He said he has 29 firefighters at this time. He stated that we had 922 calls for 2015, which was a 23% increase over 2014’s calls. Delton stated that he has 3 candidates from within the department that have applied for the open full-time position. Delton gave an update on training. Water- Frank Holzkamper addressed the council and stated that there were about 10 water lines washed out in the recent heavy rains, but none were broken. Frank also gave an update on the Decatur Project, stating that the punch list should be complete this week, but that they are not going to be able to handle 100% of our flow at this time and gave some details. He stated that they are hoping to get to where they can send 80% fairly soon, with a goal of 100% by this time next year. Animal Control- Terry Sanchez addressed the council and stated that everything was going well at the shelter. He presented the council with a chart representing all of 2015. Terry stated that the citizen wanting to donate her house to the Shelter had rescinded that offer. He said there are 4 dogs currently at the Shelter. Administration- Pam stated that our Intern is leaving us next week and stated that she has been great help. Mayor- Mayor Edwards addressed the council and stated that we were moving Anthony to the Street Department to work under Rick as the Code Enforcement/MS4 Officer. He stated that they are looking to add 1-2 restrooms to the Concession Stand at the City Park. Mayor Edwards stated that we did not receive the grant for the Splash Pad.

(11) Acknowledge Receipt of 2014 Audit- Mayor Edwards stated that all of the council members should have received a copy of the 2014 Audit and asked the council to acknowledge receipt. Skye Petty made a motion to acknowledge the receipt of the 2014 Audit with a 2nd from Robin Reed. All council members voted in favor and the motion carried.

(12) Discuss Trash Bidding Procedures and Dates- Mayor Edwards- Mayor Edwards stated that our current waste collection agreement with Waste Management ends March 31st, 2016 and will need to be put out for bid. He stated that we will post the opening in Sunday’s paper to take bids by February 2nd, 2016, to have time to review and approve at the February 9th, 2016 City Council meeting.

(13) Accept Resignation of Joey Ingle and John Box from Parks and Recreation Advisory Board- Mayor Edwards stated that Joey Ingle and John Box sent him letters of resignation from the Parks and Recreation Advisory Board. Robin Reed made a motion to accept the resignation of Joey Ingle and John Box from the Parks and Recreation Advisory Board with a 2nd from Wayne Low. All council members voted in favor and the motion carried.

(14) Appoint Joshua Nicholson and Amber Beale to the Parks and Recreation Advisory Board- Mayor Edwards stated that Joshua Nicholson and Amber Beale had applied to the open positions on the Parks and Recreation Advisory Board. Robin Reed made a motion to appoint Joshua Nicholson and Amber Beale to Parks and Recreation Advisory Board with a 2nd from Josie Reed. All council members voted in favor and the motion carried. Mayor Edwards stated that Craig Overton will serve as Chairman and Amber Beale will serve as Secretary.

(15) Announcements- Mayor Edwards stated that Coffee with the Mayor will be this Saturday 1/16/16 at 9:00 a.m.

(16) Other Business- Melvin Haring of 960 Buckhorn Flats Road addressed the council in regard to flooding on his property that he feels is caused by the

build-up of the road by the city. There was discussion. Mayor Edwards stated that he and Rick Hudson will get together with Mr. Haring will get together in the next 24-48 hours to help find a solution for the problem.

Skye Petty made a motion to adjourn with a 2nd from Wayne Low. All council members voted in favor and the motion carried.
