Subject: Resolution No. 35-16 approving the installation of a public artwork at the 312 23rd Street Development by the developer Park PB LLC. Ordinance/Resolution: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF WEST PALM BEACH, FLORIDA, APPROVING THE INSTALLATION OF A PUBLIC WORK OF ART AT THE 312 23RD STREET DEVELOPMENT IN COMPLIANCE WITH THE ART IN PUBLIC PLACES ORDINANCE; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. Staff Recommended Motion: Approve Resolution No. 35-16. Background: PROPOSED ART/LOCATION: The 312 23rd Street Development Project is a four (4) story residential rental development located on the south west corner of Ponce De Leon Avenue and 23rd Street in West Palm Beach. The proposed art is an integrated wall tile and sculpture works, shown in the attachments. The developer Park PB LLC, proposed the installation of an artwork titled Urban Reconnect by artist Lucy Keshavarz. Urban Reconnect" combines and integrates wall tiles with three (3) sculptures on the building façade facing Ponce De Leon Avenue. Using the classic materials of sculpted/glazed ceramic tiles, glass mosaic tiles, stone and metal, the artwork is a contemporary design visually connecting the building and street. The work will be seen by pedestrian and vehicular traffic along Ponce De Leon Avenue. The artwork is low maintenance and will be maintained by the developer. The value of all directly related costs of Urban Reconnect is $98,000, which equals the one percent of the development construction cost. Copies of the artist's resume, narrative, site plan, rendering of the artwork on site, maintenance plan, and art budget are attached. CODE REQUIREMENTS: Section 78-122 of the Code of Ordinances applies an art assessment of 1% of the vertical construction costs to new private development to fund the City's Art in Public Places Program or provide artwork(s) for the public City-wide. The art assessment is

applied to municipal, commercial, and multi-family residential projects with construction costs equal to, or greater than $500,000. Section 78-123 of the Code of Ordinances provides that in lieu of paying the art assessment, a developer may install a work of art for public view, or retain or install an element of historic or cultural significance, which art or elements must be appraised at the 1% value. AiPP COMMITTEE: The Code provides that the Art In Public Places (AIPP) advisory committee shall review the proposed artwork(s) or historical or cultural elements based on the standards established in Section 78-130 of the Code and shall recommend to the City Commission whether to approve, deny, or approve with conditions, the selection and location of the artwork or elements in accordance with the art in public places implementation guidelines and with sensitivity to the aesthetic and cultural traditions and the history of the city, along with the character of the surrounding neighborhood. At their regularly scheduled meeting held January 6, 2016 the AiPP Committee members voted unanimously to recommend the approval of Urban reconnect by Lucy Keshavarz, to be installed at 312 23rd Street by the development firm Park PB, LLC. CRITERIA: The AiPP Committee found that the proposed artwork met the following criteria established in Section 78-130 of the Code of Ordinances: 1. The proposed art conforms to the definition of art contained in this article and will be created by an artist as defined in this article; 2. The proposed art and/or element(s) meet or exceed the valuation requirements of this article. 3. The proposed art/element will be readily visible to the public and meet the location requirements of this article. 4. The proposed art/element is of exceptional quality and enduring value; 5. The proposed art/element is of appropriate scale to the development site; 6. The proposed art/element is compatible with the neighborhood; 7. The proposed art/element is not detrimental to the public welfare; 8. The proposed art/element will not constitute a safety hazard; 9. The proposed art/element will not require extraordinary maintenance. RESOLUTION NO. 35-16 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF WEST PALM BEACH, FLORIDA, MAKING FINDINGS AND APPROVING INSTALLATION OF A WORK OF ART AT 312 23rd STREET DEVELOPMENT IN COMPLIANCE WITH THE ART IN PUBLIC PLACES ORDINANCES; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. ********* WHEREAS, Section 78-122 of the Code of Ordinances applies an art assessment of 1% of the vertical construction costs of new private development to fund the City's Art in Public Places programs and provide art for the public City-wide. The art assessment is applied to municipal, commercial, and multi-family residential projects with construction costs equal to, or greater than $500,000; and WHEREAS, Section 78-123 of the Code of Ordinances provides that in lieu of paying the art assessment, a developer may install a work of art for public view, or retain or install an element of historic or cultural significance, which art or elements must be appraised at the 1% value; and WHEREAS, 312 23rd Street Development is a Residential Rental Project at the corner of Ponce de Leon and 23rd Street; and WHEREAS, the developer, Park PB LLC, proposes the incorporation of an artwork, titled Urban Reconnect, a mix of wall tile and sculptural artworks by Lucy Keshavarz, to be installed on the façade of the building facing Ponce de Leon, as their compliance with the Art In Public Places Ordinances; and WHERAS, one percent of the construction costs of the Park PB LLC development project is $98,000.00, which funds all facets of creating, fabricating and installing the sculptural artwork; and WHEREAS, the artwork is proposed to be installed on the building’s façade facing Ponce de Leon making the sculptural work highly visible and accessible to the general public during the day and night; and WHEREAS, Urban Reconnect shall by maintained by the developer, its successors and assigns; and WHEREAS, the Code provides that the Art In Public Places (AIPP) advisory board shall review the proposed artwork or historical or cultural elements based on the standards established in Section 78-130 of the Code and shall recommend to the City Commission whether to approve, deny, or approve with conditions, the selection and location of the artwork or elements in accordance with the art in public places implementation guidelines and with sensitivity to the aesthetic and cultural traditions and the history of the city, along with the character of the surrounding neighborhood; and

RESOLUTION NO. 35-16 WHEREAS, on January 6, 2016, the AIPP Committee found that the proposed artwork met the criteria established in Sec. 78-130 of the Code of Ordinances and voted unanimously to recommend approval of the sculptural artwork Urban Reconnect by Lucy Keshavarz, to be installed at 312 23rd Street by the development company Park PB, LLC; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WEST PALM, FLORIDA, that: SECTION 1:

The City Commission hereby finds that the sculptural artwork by Lucy Keshavarz, titled Urban Reconnect, to be installed at 312 23rd Street meets the following criteria established in Section 78-130 of the Code of Ordinances: 1. The artwork conforms to the definition of art and will be created by an artist as defined in the Code; 2. The artwork meets or exceeds the valuation requirements of the Code. 3. The artwork will be readily visible to the public and meets the location requirements of the Code. 4. The artwork is of exceptional quality and enduring value. 5. Urban Reconnect, three large scale sculptural works integrated and complimented by wall tiles by Lucy Keshavarz, as shown in Exhibit A, when installed at 312 23rd Street, is hereby determined to meet the requirements of the Art in Public Places Ordinances. This Resolution shall take effect in accordance with law.

Construction has begun and is expected to be complete by the end of July 2016. This development is subject to the City’s Art in Public Places (AIPP) code. The AIPP budget is $98,000. The developer has contracted with artist Lucy Keshavarz to commission public art specifically for this project. The proposed public art combines and integrates wall tiles with sculpture at three locations on the building façade facing Ponce De Leon Avenue. Using the classic materials of sculpted/glazed ceramic tiles, glass mosaic tiles, stone and metal, the artwork is a contemporary design that brings a much needed connection between the building and street. The work will easily be seen by both vehicular and pedestrian traffic along Ponce De Leon Avenue.

The public art uses the classic materials of stone, metal, clay and glass with a contemporary aesthetic to create a timeless artwork for the public.



The artist creates a “Tree of Life” with hand sculpted and glazed tiles, giving both texture and relief to the tree trunk, braches & leaves. Five-eights inch glass mosaic tile are installed in the remaining portion of the space representing earth, water, air and clouds.



Natural Florida stone (Coquina and/or Florida Cap Rock) are placed asymmetrically at the base and sides of the wall mosaic. Continuing the idea of connective life cycles, powder coated aluminum ring sculptures ungulate from wall to rock boulder and back again. The sculpture at each location is unique to it’s place while at the same time is influenced and responds to the other mosaics and sculptures.



Wall mosaic is 12’ high x 9’ wide at locations A & B, and 13’ high x 9’ wide at location C.



The combination of materials, shapes and sizes both compliment and contrast with the project architecture and landscape design.

Maintenance:  It is important that surrounding plantings are never allowed to grow into or over sculptural tiles, glass mosaic tiles or powder coated aluminum sculptures.  A distance of 2 feet at minimum must be maintained between plantings and the tile wall to prevent damage during plant maintenance.  Drip irrigation is recommended around artwork to prevent water spraying on any part of the art.  The proposed public art has low maintenance requirements.  Tiles and powder coated metal sculptures can be brushed with a non-abrasive soft brush or broom as needed. If more cleaning is required, a mild bio-degradable cleaner mixed with warm water can be used with a non-abrasive brush or broom to remove anything that cannot be removed by dry brushing. Rinse with low pressure water.  Never use medium to high pressure and/or chorine or any abrasive chemical substance on any element of the artwork.  Do a visual check of artwork every six months and clean as needed (as described above).

Artist Statement …creating the connection between the Arts and Communities.

As the tag line for my company suggests, creating connections is the focus of the artwork I create for public places and gallery exhibitions. My work in the public realm reconnects viewers to the wonders that surround us. While many of our great innovations in this country make life more convenient and efficient, I have observed that in our day to day existence we are losing our understanding of and fascination with our amazing natural and built environments. In order to best bring these seemingly opposite worlds together, I create public art that is well researched, site specific, functional and touchable. The site and community's needs determine the materials for every project. In addition to emphasizing our natural and built environments, I use various materials, forms and colors that bring depth and complexity to each composition.

Integrated Public Artwork – Emerging Mangrove

Casa Del Mar Boynton Beach, FL K Hovnanian Homes AIPP budget $77,756

Sculpture 13’high x 31’wide x 2’deep integrated into wall along US 1 at the front of Casa Del Mar development. Materials are sculpted cast stone for mangrove canopy; sculpted roots made of powder coated aluminum ; and hand sculpted glazed tiles for leaves and waves combined with glass mosaic tiles. With very little room available for public art, the artist integrated sculpture into the privacy wall at the front of the development. The sculpture speaks to the water and mangrove restoration that will take place along the intracoastal water way on the east side of development and also acts as needed way finding for the narrow frontage on US1. Emerging Mangrove was approved by the Boynton Beach Arts commission in July 2015. Project completion expected Spring 2016.

By artist Lucy Keshavarz in collaboration with Linda Emerson, interpretive designer. A site specific integrated public art and interpretive design project creates eight locations within the park using coquina rock, pilings, decking, sculpted/ glazed tile and HDL panels. The project speaks to the history of Boynton Beach and the important connection between coastal municipalities, healthy estuaries, near shore ecosystems and the Gulfstream. The aesthetic and materials were inspired by the local fishing industry and the “ole timers” culture of making due with what they had on hand. Funded by a grant from F.I.N.D. & City of Boynton Beach

Ecological Art –Babbling Brook

Babbling Brook is a stormwater EcoArt project lead by artist Lucy Keshavarz that creates an aesthetically pleasing and bio diverse dry detention area that increases stormwater quality by circulating water from the Central Lake across the street through the brook. The remaining portion of the dry detention area is landscaped with over 70 species of native Florida plant species that provide food and shelter for migrating birds and the opportunity for hands-on science (citizen scientist) for community members.

Recycled concrete slabs taken during sewer renovations in another area of the CRA were used as sculptural pieces to line both sides of the brook channel and create the retaining wall at the head of the brook. Artist Lucy Keshavarz created the water feature at the head of the brook by exposing and using the stormwater infrastructure

Babbling Brook received “Urban Oasis Designation” from Audubon of Florida and Keshavarz & Associates, Inc., won the Distinguished Engineering Project Achievement Award in 2014 from The Engineers’ Council. Babbling Brook will be featured in Catherine Zimmerman’s documentary film, “Hometown Habitat” outlining Dr. Doug Tallamy’s research which documents the need to restore and connect our native plant habitats, including in our urban areas. The film is due for completion in early 2017.

2010 - Jaycee Park Interpretive Public Art Markers, City of Boynton Beach, FL – integrated public art and interpretive design at eight locations within the park using coquina rock, pilings, decking, sculpted/ glazed tile and HDL panels. The project speaks to the history of Boynton Beach and the important connection between coastal municipalities, healthy estuaries, near shore ecosystems and the Gulfstream. 2003 - Mirage: A Columned Courtyard, Laser & Surgery Center of the Palm Beaches, Kyoto Drive, Palm Beach Gardens, FL site specific and functional work of art that references Florida’s natural flora & fauna, in collaboration with clay artist Tracy RosofPetersen.
