BUTLER COUNTY BOARD OF COMMISSIONERS Tuesday, November 24, 2015

CALL TO ORDER Commission Vice-Chairman Jeff Masterson called the Butler County Board of Commissioners to order at 9:00 a.m. Present were Commissioner Ed Myers, Commissioner Peggy Palmer, Commissioner Dan Woydziak, County Administrator Will Johnson, and Clerk Recorder Gayle Reiswig. Commission Chairman Mike Wheeler was absent. INVOCATION Eric Shaver, El Dorado Correctional Facility, presented the invocation. APPROVAL OF MINUTES Commissioner Myers motioned to approve the minutes of the Butler County Commission meeting of Tuesday, November 17, 2015, as written. Commissioner Woydziak seconded the motion. Motion carried 3-0. Commissioner Palmer abstained due to her absence from last week’s meeting and Commissioner Wheeler was absent. (00:02:30) PUBLIC COMMENTS Jessica Folk, Golden Living Nursing Facility District Sales, presented a $1,000 grant check to Butler County EMS as part of a community initiative support program. EMS personnel were present to receive the grant in appreciation of their support to the community and county. (00:05:10) ITEM #1 – CONSIDER APPROVAL OF A REQUEST FROM THE UNRUH FAMILY TRUST FOR A MORTGAGE LOT SPLIT WITH AN AGRICULTURE PRESERVATION OVERLAY (APO) David Alfaro, Director of Community Development, came before the Board for approval of a request from the Unruh Family Trust for an 8+/- acre Mortgage Lot Split with APO on 70 acres zoned AG-80. The Unruh Family Trust owns approximately 78 acres located at NW 130th, Whitewater, KS. This request will allow the sale of 8 acres for a single family residence construction by the buyer. Staff mailed notifications to all residents within 1,000’ of the property with no response. The Planning Commission approved the request with a 4-0 vote. Commissioner Myers motioned to approve the request for a Mortgage Lot Split and APO on property owned by the Unruh Family Revocable Trust located at NW 130th, Whitewater, and authorized the Chair to sign both agreements. Commissioner Palmer seconded the motion. Motion carried 4-0. (00:07:27) ITEM #2 – CONSIDER APPROVAL OF RECOMMENDATION REGARDING THE PURCHASE OF SNOW PLOW BLADES FOR THE PUBLIC WORKS DEPARTMENT Darryl Lutz, P.E., Director of Public Works, came before the Board for approval to purchase snow plow blades for the County. On November 17, 2015, the Commission opened the only Page 1 of 5

received sealed bid from Foley Equipment for a partial order. A second bid for the entire order was received from Welborn Sales by fax. The fax time stamp for the Welborn bid was 9:52 a.m. on Tuesday, November, 17, 2015. Mr. Lutz reported that the amount received from Welborn denotes a competitive and honest bid. State contract pricing was not available. Vendor Tungsten Carbide Blade Cost cost/foot Foley Equipment $72.83 Partial order cost = $20,830.01 Welborn Sales $51.79 Entire order cost = $15,706.69 Commissioner Woydziak motioned to approve the purchase of snow blades for the Department of Public Works from Welborn Sales, Salina, KS, in the low bid amount of $15,706.69. Commissioner Myers seconded the motion. Motion carried 4-0. (00:16:37) ITEM #3 – RECEIVE AND OPEN SEALED BIDS FOR THE PURCHASE OF (4) TANDEM AXLE DUMP TRUCKS FOR THE PUBLIC WORKS DEPARTMENT Darryl Lutz, P.E., Director of Public Works, came before the Board for the receiving and opening of sealed bids for the purchase of (4) tandem axle dump trucks for the Public Works Department. In April 2015, staff received authorization from the Commission to obtain bids for several pieces of equipment including (4) tandem axle dump trucks which will replace (4) existing trucks in the County’s fleet. Following delivery of the new trucks, the (4) older ones will be sold on public auction. An amount of $520,000 is budgeted in the CIP for this expense. * Verified price with the Public Works Department. (00:24:10) NON AGENDA ITEM – CONSIDER APPROVAL FOR A UTILITY AGREEMENT RELATED TO THE DRY CREEK BRIDGE REPLACEMENT PROJECT ON SW PRAIRIE CREEK RD Darryl Lutz, P.E., Director of Public Works, came before the Board for approval of a utility agreement related to the Dry Creek Bridge replacement project on SW Prairie Creek Rd. located one mile north and one mile east of Andover. To accommodate construction of the Dry Creek Bridge, Butler Rural Water District #5 will need to relocate a waterline on a private easement. Actual cost of the relocation will be brought before the Commission prior to starting work. Commissioner Masterson motioned to approve a utility agreement with Butler Rural Water District #5 related to the KDOT Project #8 C-4655-01, the Dry Creek Bridge replacement project on SW Prairie Creek Rd. located north and east of Andover and authorized the Chair to sign the agreement. Commissioner Woydziak seconded the motion. Motion carried 4-0. Mr. Lutz updated the Commission stating that the flashing light at SW 120th St. and SW Butler Rd. will be installed on Tuesday, November 24, 2015. Also, the County shoulder work on Butler Rd. remains in progress. (00:36:43) ITEM #4 – WORK SESSION – 2016 ELECTED OFFICIAL PAY Will Johnson, County Administrator, presented salary comparisons for elected officials, Kansas county compensation surveys, and new Kansas Association of Counties (KAC) salary information for elected officials to the Board. Ruth Fechter, County Treasurer, approached the Board to discuss the increase in the General Fund portion of the Treasurer’s salary causing it to be equal to other Butler County elected officials with similar levels of responsibility as in the County Clerk. Elected Official Yearly Salary Attorney $93,952 Sheriff $77,225 Clerk $67,784 Treasurer $62,889 (Includes $11,000 for MV duties) Register of Deeds $58,569 County Commissioner $28,633 Mrs. Fechter noted that her additional years of service to the County should also be taken into effect when considering the increase. Responsibilities between the Treasurer and the Clerk are comparable but the pay is not. Commissioner Myers noted that when comparing the two, there is a plausible argument as to which has more responsibility. There was discussion about treasurer salary comparisons to similar sized counties; Butler County was in the middle of the list when viewing the lowest and highest salaries. Commissioner Masterson suggested the idea of decreasing the Clerk’s salary by $3,000 and increasing the Treasurer’s salary by $3,000. Commissioner Palmer was not in favor of reducing the Clerk’s salary but considered incrementally increasing the Treasurer’s salary over the next few years. Commissioner Woydziak noted that the increase in the Treasurer’s salary should have already been done incrementally over the past years. Commissioner Masterson was in favor of a $5,000 increase to the Treasurer’s salary making it equal to the Clerk’s salary, thus making all Butler County elected official salaries within 3% of elected officials in counties of similar size. Myers was agreeable to the number. This topic will be readdressed as an action item in the December 8, 2015, Commission meeting. No action was taken. Administrator Johnson reported that Commissioner Wheeler had been involved in an automobile accident. He is recovering at home with surgery scheduled next week. (01:31:51) RECESS Vice-Chairman Commissioner Masterson recessed the Board meeting at 10:32 a.m. for 5 minutes. RECONVENE Vice-Chairman Commissioner Masterson reconvened the Board meeting at 10:37 a.m. (01:32:00) One bid was overlooked in the receiving and opening of sealed bids for Item #3, the purchase of (4) tandem axle dump trucks for the Public Works Department. * Verified price with the Public Works Department. Vendor Truck Type Total Bid for 4 Tandem Axle Location Dump Trucks Summit Truck Group 2017 Mack $569,553.92* Wichita, KS Commissioner Woydziak motioned to accept the bid that was overlooked earlier in the meeting from Summit Truck Group, Wichita, KS, and to include it in the packet of original bids received early in the meeting for Item #3, the purchase of (4) tandem axle dump trucks. Commissioner Myers seconded the motion. Motion carried 4-0. (01:33:30) ITEM #5 – CONSIDER APPROVAL OF THE BUTLER COUNTY HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT (HIPAA) MEDICAL PRIVACY POLICIES AND PROCEDURES AS REQUIRED FOR THE BUTLER COUNTY HEALTH INSURANCE PROGRAM Will Johnson, County Administrator, presented the Butler County HIPAA policies to the Board for approval. With the County’s transition from fully-insured to self-insured, there is a requirement for an internal HIPAA policy. The Hinkle Law Firm has developed the HIPAA document on the County’s behalf at a cost of $650. Rene Bender has been designated as the HIPAA Compliance Officer for the County. HIPPA does not change any current policies. Commissioner Woydziak motioned to approve the Butler County HIPAA policies as required for the Butler County Health Insurance Program and appointed Rene Bender as the HIPAA Compliance Officer. Commissioner Masterson seconded the motion. Motion carried 4-0. (01:36:18) ITEM #6 – RECESS TO EXECUTIVE SESSION TO DISCUSS MATTERS OF NONELECTED PERSONNEL (COUNTY ADMINISTRATOR ANNUAL REVIEW) Page 4 of 5

Commissioner Woydziak motioned to table this item until December 8, 2015. Commissioner Myers seconded the motion. Motion carried 4-0. (01:36:57) VOUCHERS There was discussion about car mounted deer alerts in reference of a voucher expense for damage to a sheriff’s car. Commissioner Woydziak motioned to approve vouchers for November 24, 2015, in the amount of $503,753.56. Commissioner Myers seconded the motion. Motion carried 4-0. COMMISSION ADDS & ABATES Commissioner Myers motioned to approve Adds & Abates #2581 dated November 24, 2015; Adds in the amount of $3,661.16 and Abates in the amount of $5,071.10. Commissioner Woydziak seconded the motion. Motion carried 4-0. (01:41:37) OTHER ITEMS OF BUSINESS TO COME BEFORE THE BOARD OF COUNTY COMMISSIONERS Commissioner Palmer noted that our Country is currently on high alert. She asked that everyone be aware and stay safe. Commissioner Woydziak reminded everyone that Friday, November 27, 2015, is “Wear Red Day” in support of the troops. A meet and greet for Sedgwick County Manager Mike Scholes is scheduled for Tuesday, December 1, 2015, at 4:00 p.m., at the National Center for Aviation Training. The Commissioners will be attending a luncheon at the Benton Senior Center on Tuesday, December 8, 2015. A new chair sample for the seating area in the Commission meeting room was available for review. The cost for this item is $45/each. It was noted that the current chairs are approximately 15 years in age. The Commissioners wished everyone a happy Thanksgiving. The Commissioners adjourned to attend a luncheon at the Whitewater Senior Center.
