The Ohio Manufacturers' Association ("OMA")

is a statewide association of

approximately 1,500 manufacturing companies in Ohio. Manufacturers employ roughly 600,000 men and women in the State of Ohio, and the OMA's members have a vital interest in ensuring that Ohio remains a desirable place to do business. The laws establishing the scope of a business' potential liability are the backdrop against which businesses must structure and conduct their affairs. The many businesses whose interests the OMA represents depend on certainty and clarity in those laws, and rulings that significantly change the landscape of the potential liability are of great interest and concern to them. The OMA urged this Court to accept jurisdiction over this case and to reverse the decision of the Fifth Appellate District which significantly altered Ohio law with respect to two important issues: ( 1) piercing the corporate veil doctrine; and (2) liability under Ohio's Pattern of Corrupt Activity statute ("POCA"). OMA filed a merit brief in favor of Appellants' Propositions of Law Nos. 1, 2, 3 and 6. Based upon all of the briefs filed on these and other propositions of law, it remains clear that this appeal involves matters that are of public or great concern, particularly to Ohio's business community. The OMA therefore respectfully urges this Court to deny the motion of Appellee to dismiss the appeal. Respectfully submitted,
