RESOLUTION TO FLEX STBG FUNDING FOR THE CITY OF ASHEVILLE TRANSIT VEHICLES PROJECT TO FTA 5307 FUNDING CATEGORY WHEREAS, the French Broad River MPO Board is responsible for approving the programming of Federal Highway Administration (FHWA) STBG transportation funds for projects and studies for the Asheville Urbanized Area; and WHEREAS, the City of Asheville requested from the FBRMPO Board to provide STBG funds in the Fiscal Year 2018 for the purchase of transit vehicles; and WHEREAS, the 2018-2027 TIP currently programs $1,115,000 to purchase transit vehicles with $892,000 in STBG funds and with a local match from the City of Asheville equaling $223,000 (TIP Project ID number TA-6702); and WHEREAS, the City of Asheville is requesting the flexing of $892,000 in STBG transportation funds to (FTA) Section 5307 urban transit funds to facilitate administration of this project; NOW, THEREFORE, BE IT RESOLVED that the French Broad River MPO Board agrees to modify the Fiscal Year 2018-2027 TIP to flex $892,000 in STBG funds to FTA Section 5307 funds to pay the federal share for the purchase of City of Asheville Transit Vehicles. ADOPTED: This the 22nd day of March, 2018.

RESOLUTION CERTIFYING THE FRENCH BROAD RIVER METROPOLITAN PLANNING ORGANIZATION’S TRANSPORTATION PLANNING PROCESS WHEREAS, the French Broad River Metropolitan Planning Organization is the regional transportation planning organization for the Asheville Urban Area; and WHEREAS, the French Broad River Metropolitan Planning Organization Board has found that the Metropolitan Planning Organization is conducting transportation planning in a continuous, cooperative, and comprehensive manner in accordance with 23 U.S.C. 134 and 49 U.S.C. 1607; and WHEREAS, the French Broad River Metropolitan Planning Organization Board has found the Transportation Planning Process to be in full compliance with Title VI of the Civil Rights Act of 1964 and the Title VI Assurance executed by each State under 23 U.S.C. 324 and 29 U.S.C. 794; and WHEREAS, the French Broad River Metropolitan Planning Organization Board has considered how the Transportation Planning Process will affect the involvement of Disadvantaged Business Enterprises in the FHWA and the FTA funded planning projects (Section 1003(b) of ISTEA of 1991 (Pub. L. 102-240), Sec. 105(f), Pub. L. 97424, 96 Stat. 2100, 49 CFR part 23); and WHEREAS, the French Broad River Metropolitan Planning Organization Board has considered how the Transportation Planning Process will affect the elderly and the disabled per the provision of the Americans With Disabilities Act of 1990 (Pub. L. 101-336, 104 Stat. 327, as amended) and the U.S. DOT implementing regulations (49 CFR parts 27, 37, and 38); and WHEREAS, the Metropolitan Transportation Plan has a planning horizon year of 2040 and meets the requirements for an adequate Transportation Plan. NOW, THEREFORE, BE IT RESOLVED that the Board of the French Broad River Metropolitan Planning Organization certifies the transportation planning process for the French Broad River Metropolitan Planning Organization on this 22nd day of March, 2018

DRAFT February 16, 2018 Performance Management Agreement between [insert MPO name], [insert provider(s) of public transportation], and the North Carolina Department of Transportation (NCDOT) [*add SCDOT and RFATS here for the Charlotte CMAQ agreement] WHEREAS, the United States Department of Transportation promulgated transportation planning regulations in 23 CFR 450.314, and WHEREAS, MPO(s), State(s), and providers of public transportation are required by 23 CFR 450.314 to cooperatively determine their mutual responsibilities in carrying out the performance-based planning and programming requirements established by federal law, and WHEREAS, the 23 CFR 450.314(h) requires that MPO(s), State(s), and providers of public transportation shall jointly agree upon and develop specific written procedures for cooperatively developing and sharing information related to transportation performance data, the selection of performance targets, the reporting of performance targets, the reporting of performance to be used in tracking progress toward achievement of critical outcomes for the region of the MPO, and the collection of data for the State asset management plan for the National Highway System (NHS). NOW, THEREFORE, BE IT RESOLVED, that the parties do hereby agree to adhere to the following protocols for coordination to meet performance-based planning and programming requirements in accordance with 23 CFR 450 and established federal guidance. 1. Transportation performance data a. NCDOT will collect and provide the MPO and the transit providers, with data used in developing statewide targets for all applicable measures. b. If the MPO chooses to develop its own target for any measure. (A non TMA MPO selecting to create their own transit targets cannot be in the NCDOT’s Tier II transit group plan.) (i) The MPO will collect and provide NCDOT with any supplemental data used in association with the MPO target setting process, if applicable.

(ii) The MPO will provide NCDOT with an opportunity to comment on the use of any supplemental data sources. (iii) The MPO will provide NCDOT and/or the transit provider the opportunity to comment on MPO targets 30 days prior to MPO adoption of the targets 2. Selection of transportation performance targets a. NCDOT, the MPO, and the transit provider(s) will set performance targets in coordination with each other. (i) Coordination will include as many of the following opportunities as deemed appropriate for the measure: in-person meetings, webinars, conference calls, and email/written communication. (ii) The MPO and transit providers, as applicable, shall be given an opportunity to provide comments on NCDOT statewide targets 30-days prior to NCDOT’s establishment of statewide targets. (iii) If the MPO chooses to set its own target, the MPO will develop the target in coordination with NCDOT and/or the transit provider. b. The NCDOT will set statewide performance targets to meet the federal performance management requirements. (i) The NCDOT will provide written notice to the MPO when NCDOT sets a target. This notice will provide the targets and the date NCDOT set the target, which will begin the 180-day time-period in which the MPO must set performance targets. (ii) If the MPO chooses to support the statewide or transit provider targets, the MPO will provide documentation in the form of a support resolution to NCDOT and/or the transit provider that the MPO agrees to plan and program projects that will contribute toward the achievement of the statewide and/or transit targets. (iii) If the MPO chooses to set its own target, the MPO will provide NCDOT and/or the transit provider documentation that includes the target and when the MPO sets its target. c. The Tier 1 transit providers will set performance targets to meet the federal performance management requirements for transit asset management and transit safety (pending final rule).

(i) The transit provider will provide written notice to the MPO when the transit provider sets target(s). This notice will provide the targets and the date the target was set. The date the targets were set will begin the 180day time-period within which the MPO must set performance targets. d. If the MPO chooses to support the statewide or transit provider target, the MPO will provide documentation in the form of a support resolution to NCDOT and/or the transit provider that the MPO agrees to plan and program MPO projects so that they contribute toward achievement of the statewide or transit target. e. . 3. Reporting of performance targets a. Reporting of targets and performance will be done as specified in 23 CFR 490, 49 CFR 625, and 49 CFR 673. b. NCDOT will report all targets to FHWA and FTA as applicable. NCDOT will provide written notice of these reported targets to the MPO within ten business days of reporting targets. c. The MPOs will report any MPO targets to NCDOT within XX days/weeks after adoption. d. NCDOT will include information outlined in 23 CFR 450.216(f) in any statewide transportation plan amended or adopted after May 27, 2018, and information outlined in 23 CFR 450.218(q) in any statewide transportation improvement program amended or adopted after May 27, 2018. e. The MPO will include information outlined in 23 CFR 450.324(g)(3‐4) in any MTP amended or adopted after May 27, 2018, and information outlined in 23 CFR 450.326(d) in any TIP amended or adopted after May 27, 2018. 4. Reporting of performance to be used in tracking progress toward achievement of critical outcomes for the region of the MPO. a. Where available and practicable, NCDOT will provide the MPO with the statewide performance data used in developing statewide targets. All updates of this data will include prior performance data. b. If MPO sets a different target than the statewide target the MPO will provide NCDOT with MPO-wide performance data used to develop the target. All updates of performance data by the MPO will include prior performance data. c. Where applicable, the MPO will provide data to NCDOT for the CMAQ on-road emissions measure. 3

d. Where applicable, the MPO will provide NCDOT and the transit provider with a copy of the CMAQ Performance Plan xx days/weeks prior to October 1, 2022 per 23 CFR 490, subpart A, E, F, G & H. 5. The collection of data for the State asset management plans for the NHS a. NCDOT will be responsible for collecting bridge and pavement condition data for the State asset management plan for the NHS. This includes NHS roads are that are not on a State highway system but instead are under the ownership of local jurisdictions, if such roads exist. 6. All parties agree that email communications shall be considered written notice for all portions of this agreement.
