Preface According to the Article 42. of the Air Traffic Act (OG 69/09, 84/11, 54/13, 127/13 and 92 /14), Zagreb International Airport Jsc (hereinafter: MZLZ) is introducing the Regulated Airport Services Price List. Until final revision of the Ground Handling and Commercial parts, the existing “MZLZ Price List of Basic Services 2014” remains in force for any item which is not contrary to this new document. The Regulated Airport Services Price List has been approved on behalf of Croatian Civil Aviation Agency. The Regulated Airport Services Price List will apply unless the users are notified otherwise, in other words until revocation. Zagreb International Airport Jsc. reserves the right to review and adjust prices according to the conditions set by the Zagreb Airport Concession Agreement, signed between the Republic of Croatia and MEDUNARODNA ZRACNA LUKA ZAGREB d.d., on 2013 December 4th. Other Charges: a) Ground Handling (subject to separate price list): No aircraft is allowed to land, park on the apron and take-off in Zagreb International Airport, without Ground Handling assistance.

Ground Handling services (GH services) are provided by: MZLZ- Zemaljske usluge d.o.o. (hereinafter: MZLZ-Zu) DSM + Handling Request: ZAGAPXH, +385 1 456 2009 or [email protected] Ground handling services available at Zagreb International Airport are described into the “Ground Handling Services Price List” ([email protected]). Occasional and ad-hoc flights are handled through the Basic list of GH services, which has been approved between MZLZ and MZLZ-Zu. b) Commercial Services (subject to separate price list): Commercial services are provided by MZLZ Jsc. Commercial services available at Zagreb International Airport are described into the Commercial Services Price List ([email protected]).

1. General Conditions 1.1.

Every user requiring and using air traffic services is considered to accept all conditions of the Price List, on the principle of acceptance.

1.2.

The prices in the Price List are unique for services rendered in domestic and international air traffic.

1.3.

They are fully compliant with Directive 2009/12/EC and Article 11 of the Ordinance on Airport Charges.

1.4.

The air carriers, who do not have an agreement with Zagreb International Airport otherwise, shall pay for rendered services prior to take-off.

1.5.

Charge of services rendered to air carriers from item 1.4. shall be performed as follows:  in cash  American Express  Diners  Master Card  VISA  AIR ROUTING  Multiservice  cheques (Captain's, Traveler’s, Euro) 1.6. Value Added Tax (VAT) will be calculated in accordance with Value Added Tax Law (OG 73/2013) and Rulebook on Value Added Tax (OG 79/2013 and amended Rulebook OG 160/13).

1.7.

Calculation and charge of rendered services can be performed in any currency in the following way: The prices quoted in EUR are to be paid into EUR, HRK or USD in accordance with the official Middle Exchange Rate of the Croatian National Bank (Hrvatska narodna banka) on the date of the invoice issuance.

1.8.

For delayed payments, interest will be added to the debtor in accordance with the maximum interest rate prescribed by the Croatian law. Zagreb International Airport Jsc. may require payment security instrument from the user of services based on estimated turnover and risk analysis.

1.9.

In case of delay of payment exceeding 30 days over a 6 month continuing period on a rolling basis, prepayment of services will be required. Discount granted by Zagreb International Airport Jsc to air carriers - if any - would also be automatically cancelled. Back to normal postpayment situation and application of potential discount may be agreed in written by MZLZ, as soon as the air carriers give additional guarantees that are acceptable according to MZLZ standards.

1.10.

Changes and supplements of the Charge list are to be carried out in accordance with the Zagreb International Airport Jsc. business policies, the Zagreb Airport Concession Agreement

and according to Article 42. of the Air Traffic Act (OG 69/09 and 84/11 art. 42) and Ordinance on Aerodrome Charges (OG 50/12). 

Zagreb International Airport Jsc. is liable within frame of Chapter III, Article 17 of Montreal Convention and Directive 889/2002/EC.



All disputes between users and Zagreb International Airport Jsc. regarding the performing of airport services and use of this List are under jurisdiction of the Court in Zagreb, while Croatian Law shall be applicable.



It is to be considered, that after being published, the General Conditions and List of Airport Charges are accepted by every user requiring to operate and use Zagreb International Airport Jsc. services. .

1.11.

Definitions of Terms



Zagreb International Airport means the International Zagreb Airport according to the Croatian Registry Court.



Domestic air traffic means every flight taking off and landing at the airports within the borders of the Republic of Croatia.



International air traffic means a flight that takes - off in one country and lands in another.



Terms as "passenger", "baggage", "cargo", and "mail", used in conditions and charge lists shall include all those persons and goods that are to be transported in the carrier's aircraft.



Returning flight means the flight of an aircraft that returned after departure, before reaching its destination or alternation, due to a special reason, beyond normal control. It is to be considered as technical flight.



Trial flight means the flight of an aircraft, performed to test either engine, instrument or frame. It is to be considered as technical flight.



Training flights means flights for training and recertification purposes, according to the CCAA FTO-ATO Certificate for students, registered in training log book (according to Article 5 OG 49/06) or Technical Log Book in case of certification flight, under the supervision of a flight instructor with single engine aircrafts not above 5 700 kg MTOW.



Medical flight means the flight transporting sick, wounded persons or human organs for transplantation, which have already been given medical attention.



Technical landing means the landing for other than commercial reasons, where no physical change of useful load occurs between the landing and subsequent take - off.



Emergency landing is a landing in the case of emergency event (illness or death of passenger, technical defect on aircraft, etc.) or the threat of violence.



Air carrier is a company with valid AOC.



Maximum take - off weight of an aircraft (MTOW), as stated in the aircraft Airworthiness Certificate. If this document is not presented the highest MTOW for particular aircraft type shall be taken. No refunds will be possible. Each started ton is to be considered as the whole one.

Price list



Security check is procedures which serve to prevent prohibited or dangerous device on board the aircraft.



Crew members are persons being on-board the aircraft for their duty to perform the flight.



A passenger is any person embarked, not being a crew member.



Transit passenger is passenger arriving at the airport on a through-flight and leaving it with the same flight number on the same aircraft, without getting outside the airside area.



Transfer passenger is a passenger arriving and departing from the airport under a different flight numbers and with purpose of continuing his trip.



Airport user means any physic or legal person responsible for the carriage of passengers, mail and/or freight by air from, or to the airport.



General aviation means all activities done with aircraft belonging to companies with an airtaxi or air work license, or to an individual, a flying club or a company whose main objective is not to provide revenue passenger, freight or mail transport. A passenger aircraft is to be considered as “general aviation aircraft” if its MTOW does not exceed 5,7 tons.



Business aviation means all aircrafts for which flights the carriers don't sell air tickets.



Commercial flight – any flight undertaken for money or other kind of compensation, which is accessible to the public, or, if not accessible to the public, performed as agreed/contracted between air carrier and service user, where the user has no control over the carrier.



Schedule flights - represents series of flights between two airports in accordance with flight schedule made in advance.



During the Concession Period, the Regulated Charges may be adjusted for inflation/deflation, according to MUICP (the Monetary Union Index of Consumer Prices, as defined in Council Regulation (EC) No 2494/95 of 23 October 1995). At least ninety (90) days prior to the date upon which the inflation/deflation adjusted Regulated Charges are scheduled to take effect; the Concessionaire (MZLZ) shall submit it to the Concession Grantor, the Airport User Committee and the CCAA.



Airport means an aerodrome especially adopted for air services.

2. Landing and Take - off Charges will be collected for use of the landing infrastructure and installations (including lighting). 2.1.

Description of Service  Use of runway for landing and take - off,  Use of taxiways between the runway and the apron,  The use of built-in facilities and installations for lighting of runway, taxiways and intersections, as per CAT II/IIIb ICAO standards,  The claim to this charge shall arise at the moment the aircraft touches the ground of Zagreb International Airport.

2.2.

Unit of Measure MTOW – maximum take-off weight, in accordance with Certificate of Airworthiness, expressed in metric tons. Every part of started ton is to be calculated as a whole ton.

2.3.

Price of Service The price of service is indivisible and includes landing and take - off.

Reduction of Charges Charges for use of runway shall be reduced by 25 % in cases of:  return flight,  trial flight,  technical landing. Training Flights For aircrafts with MTOW less than 5.7 tons:  Organizations registered in Croatian CAA for pilot’s training in accordance to ATO-FTO certificates, may request contract for group of training flights, which will determine all services, limitations and charges for such activities at MZLZ. For others:  Landing Charges shall be reduced by 75 %  If the training flights are performed in time period after last landing of commercial aircraft in the evening, or before first commercial aircraft take off in the morning, and performing such flight request runway and approach lighting, these services will be charged 50 € per final approach.  Training flight must be announced in advance and approved by Zagreb International Airport Jsc. before operating in order to be considered as is.

2.6.

Noise and Air pollution related Charges According to:  The Air Traffic Act, Article 126 (Republic of Croatia)  Concession Agreement

A set of rules should be implemented at Zagreb International Airport, in order to discourage noisy aircraft operations and to monitor the noise and pollution levels.

3. Aircraft Parking 3.1.

Aircraft parking is charged per ton of MTOW. The calculation of parking charge starts from the first hour. Nevertheless, an aircraft parking for less than 4 hours is not invoiced (franchise). o Period of time between 10:00 pm and 06:00 am is free of charge. o aircraft parking for more than 2 days enjoys a daily flat-fee, as from the third full day. The calculation period starts from the beginning of the actual on block time and finishes on the actual off block time.

4. Passenger Service 4.1.

Description of Service Passenger service includes use of all non-commercial facilities in Passenger Building.

4.2.

Unit of Measure The basis of calculation of passenger service charge is the number of departing passengers per flight.

Passenger Service charges are paid by all passengers of general and business aviation. 4.4.5. Passenger Service Charges are due, from the Air Carrier.

5. Air Traffic Security Security services are performed in accordance with the Article 120 of Air Traffic Act (OG 69/09, 84/11, 54/13, 127/13 and 92/14). 5.1.

Description of Services Zagreb International Airport Jsc. as the civil airport operator performs all security measures and procedures in compliance with the National Civil Aviation Security Programme of the Republic of Croatia, as well as the emergency measures determined by authorities of the Republic of Croatia.

5.2.

Unit of Measure The basis for calculation of air traffic security charges is the total number of departing passengers per flight, including the number of transfer passengers and or, total weight of cargo and shipments.

6. Passenger with Reduced Mobility (PRM) 6.1.

General According to the Regulation (EC) no. 1107/2006 of the European Parliament and of the Council of 5 July 2006 concerning the rights of disabled persons and persons with reduced mobility when travelling by air, Zagreb International Airport Jsc. is responsible for the assistance to such passengers. The assistance shall be given to a passenger declaring his/her disability and whose mobility when using transport is reduced due to any physical disability (sensory or locomotor, permanent or temporary), intellectual disability or impairment, or any other cause of disability, or age, and whose situation needs appropriate attention and the adaptation to his or her particular needs of the service made available to all passengers; The responsible carrier shall notify Zagreb International Airport Jsc. about the need for assistance at least 24 hours before the published departure for the flight. In case of later notification Zagreb International Airport Jsc. could not guarantee the assistance according to published standards. The timely notification shall be the responsibility of the carrier. Zagreb International Airport Jsc. is responsible for organizing and making available PRM assistance, under the international standards of service, for any PRM passenger announced in due time. PRM service provision can be sub-contracted to a third party but under close supervision of Zagreb International Airport Jsc.

6.2.

Unit of Measure The assessment basis for the PRM charges is the number of departing passengers (local and transferring) and shall be collected in connection with the passenger service charges.

7. Centralized Infrastructure 7.1.

General Zagreb International Airport Jsc. as the managing body of the airport manages the centralized infrastructure used for the supply of ground handling services in accordance with Articles 10 and 17 of the Ordinance on Provision of Ground Handling Service, (OG 38/13) and collects the related charges in accordance with this official Price list.

7. 2.

Description of Service 7.2.1.

Centralized Infrastructures, Traffic Handling Centralized infrastructures, traffic handling, necessary for the provision of passenger handling comprise the following:      

baggage conveying system including weighing equipment telephone connection computer network connection CUTE infrastructure necessary space for passenger (1,5 m2 in front of check‐in counter) inscription above the counter

The price of Centralized Infrastructure does not include costs of booking systems, communication and other depending costs. Depending cost - Refers to the costs of installing new systems for check-in and balancing, costs of upgrading or replacement of existing systems used by carriers, and the damages that occurred due to system failure, interruption of communication lines due to force majeure or negligence of third parties. 7.2.2 Centralized infrastructures ‐ Passenger and Cargo aircraft ramp handling Centralized Infrastructure, Ramp Handling, necessary for the provision of ramp handling comprises the following:       

space, equipment and services in departure and arrival baggage sorting area equipment and services for baggage transportation between sorting areas and aircraft and vv. equipment for the marshaling the aircraft fire‐fighting and rescue equipment equipment and system for toilet waste disposal including sewerage equipment and system for fresh water including waterworks equipment and system for waste disposal space, installations and equipment for storage and application of aircraft de‐icing and drainage system for waste de-icing fluid

8. Incentive Program In order to develop the Zagreb International Airport’s attractiveness and the range of destinations served to/from Zagreb, Zagreb International Airport Jsc. (MZLZ) has developed an Incentive Program giving discounts on Regulated Charges. This program is intended to boost new international activities and is subject to conditions. It has been introduced to the Airport User Committee and approved by the CCAA. It is described in annex of this document.

9. Miscellaneous Services 9.1 Access to the Security restricted area Identified employees of the Airport’s stake holders are allowed to enter the restricted area (i.e. ramp side, boarding lounges, CIP lounges, Baggage claim area, General Aviation Area, Cargo Terminal, etc…), unescorted and on a permanent basis, provided they hold a visible and valid permanent pass. Employee can also enter the ramp area, along with allowed car or equipment. 9.2 Access to some buildings or parts of building Identified employees of the Airport’s stake holders are allowed to enter and move into some specific facilities which are under security surveillance. 10. Payment Exemptions The following shall be exempt from airport charges: a) Aircraft involved in search and rescue operations, b) Aircraft used for humanitarian assistance in case of a natural disaster or state of emergency, c) Aircraft in distress, d) State aircraft which provides emergency medical aid, e) State aircraft which performs firefighting protection, f) State aircraft which performs special activity flights, g) Croatian military aircraft when flying for military purposes and Republic of Croatia Red Cross aircraft.

Annex 1 Incentive Program

Purpose This Incentive Program aims to establish rules and conditions for the traffic growth incentive program (Incentive Program) at Zagreb International Airport (ZAG) by Zagreb International Airport Jsc. (MZLZ) with its capacity as the airport operator (“Airport Operator”), which is subject to the tariff system in effect. For the purposes of this program the following terms shall have the following meaning: I.

New Scheduled Destination: a nonstop scheduled air service to a new airport that has not been served from ZAG by scheduled flights during the last twelve months starting from the start date of the Incentive Program in question. Frequency Increase on Existing Destination: increase in the number of its total departures on an existing destination during the last twelve months in relation to the twelve months immediately prior to the last twelve months starting from the start date of the Incentive Program in question. Multi-Airport System: A Multi-Airport System is the set of airports that serve the airline traffic of a metropolitan area.

Beneficiaries The Incentive Program is aimed at all passenger airlines that operate or intend to operate at ZAG and which fulfill all the requirements and criteria set forth in this program.

General Conditions Airlines that intend to benefit from the Incentive Program should submit an operating plan that includes a minimum of twelve (12) and a maximum of thirty-six (36) calendar months. 1. The Incentive Program will be in effect starting from Winter 2014 IATA season. 2. The applicants cannot submit an application corresponding to its operations carried out prior to the submission of the application. 3. The Incentive Program is available for scheduled international traffic only. 4. The incentives to be granted under this Incentive Program shall not be implemented prior to the satisfaction of the conditions set out in section “Special Conditions” of this Program. 5. An airline may qualify for only one incentive model per each route at a time.

6. The Operation Plan is the document that supports the entire application process, in particular for the purposes of monitoring the airline and number of frequencies operated during the period during which the Incentive Program is implemented.

Incentive Programs 1.

New Scheduled Destination Incentive Program (Incentive Model I) : 

Airlines applying for the New Destination Incentive Program (Incentive Model I) shall ensure that the proposed route will be operated nonstop at least three (3) times in a week for a period of a minimum of twelve (12) months uninterrupted on a scheduled basis.



Long-haul flights (with a flight time of 6,5 hours or more) are entitled to benefit the Incentive Model I, in case the route is operated nonstop at least twenty-six (26) times in any given 6 months period on a scheduled basis.



The destination in consideration should not have been served nonstop on a scheduled basis in the last twelve (12) months immediately prior.



The Promotional Period, for the purposes of this Incentive Model I, shall be maximum thirtysix (36) months for the new destination.



The incentives granted shall be calculated in accordance with the following table:

Airline will continue to make regular payments during the incentivized period. If the Airline fulfills the requirements of Incentive Model I, Airport Operator will calculate the discount amount and transfer it to the airline’s bank account within thirty (30) days after every twelve (12) months.

2.

Incentive Program for Frequency Increase on Existing Destinations (Incentive Model II) : 

Airlines applying for Incentive Program for the Frequency Increase on Existing Destinations shall ensure that the proposed route will be operated with at least two additional frequencies per week for a period of minimum twelve (12) months uninterrupted on a scheduled basis.



Long-haul flights (with a flight time of 6,5 hours or more) are entitled to benefit the Incentive Model II, in case the route is operated with at least thirteen (13) additional flights in any given 6 months period on a scheduled basis.



The Promotional Period, for the purposes of this Incentive Model II, shall be maximum twentyfour (24) months for the incremental flights.



The incentive granted is related only to the charges associated with the operations of the incremental flights.



The applicant airline should maintain its existing flight services and frequencies (within the last 12 months) from/to ZAG (if any).



The incentives granted shall be calculated in accordance with the following table:

Airline will continue to make regular payments during the incentivized period. If the Airline fulfills the requirements of Incentive Model II, Airport Operator will calculate the discount amount and transfer it to the airline’s bank account within thirty (30) days after every twelve (12) months.

Submission of Applications 1.

Airlines shall apply to the Airport Operator for the Incentive Program, with a minimum notice period of forty-five (45) calendar days prior to the date set for the first operation.

Applicant airline shall submit the Operation Plan of which the sample form is attached as Appendix-I hereto, where it shall lay out the proposed operating plan, including a detailed description of service to be introduced, if applicable, such as: a. b. c. d. e.

Number and timetable of respective flights Destination Days of operation Type of aircraft and number of seats Start and end date of operations

Final Incentive Decision The final decision regarding the eligibility of an applicant airline for this Incentive Program is the exclusive right of the Airport Operator, which reserves the right to reject or suspend an incentive for reasons of public interest, particularly under the following circumstances: 

When the applicant airline is subject to an acquisition, merger or sale, unless the airline can demonstrate that the number of seats offered as part of all operations serving ZAG will not be affected.



If the airline does not operate at least 90% of the submitted schedule.



If the airline cannot ensure the prompt payment of any outstanding invoices at ZAG.



If the airport capacity is restricted. Currently the capacity is limited for departures between 08:00-09:15 and 14:00-15:30 local time (peak period), and none of the Incentive Models will be valid for flights scheduled to depart in this period. Zagreb International Airport reserves its right to update the peak period times by publishing sixty (60) days prior notice in its official web site.

Final Decision 

Applicant airlines will be notified regarding the final decisions of their applications within a period of fifteen (15) working days from the receipt date of their application



Airport Operator’s decision shall be final and cannot be subject to objection.

Special Conditions 1. The applicants for the Incentive Program should be approved by the Airport Operator by entering into a signed agreement that governs the specific conditions for the Incentive Program, which shall include, including but not limited to, the following information: a. Operating Plan; b. Duration of the Incentive Program; c. Method and deadline for awarding the incentives; 2. Changes in the incentive program and/or peak period times will not have effect on flights which already have a signed agreement in effect and benefit the incentives. 3. Multi-Airport Systems listed in Appendix 2 are considered as one destination (i.e. a new flight between Stansted and Zagreb cannot benefit new destination incentive, if there is -or was in the last 12 months- a direct scheduled flight between ZAG and any other airport in the same system (Heathrow, Gatwick etc.)).

Sanctions Any airline that manipulates its flight program each IATA Season, with or without cooperation with other airlines in order to qualify for the Incentive Program will be disqualified.
