New Customer Application Form 2 of 3 Privacy Act Acknowledgement & Consent I/We acknowledge that the personal information collected about me/us is collected primarily for the purpose of considering my/ our application for retail credit, and also to collect overdue payments. I/We acknowledge that The Yoghurt Shop may disclose information about me/us including our credit worthiness or credit history to other credit providers to assess an application by me/us for credit, to notify them of any default by me/us and to inform other credit providers who allege I/We are in default with them. I/We acknowledge that The Yoghurt Shop may disclose a credit report that is or has been in its possession containing my/ our information or information derived from that report, to a person who is a guarantor or to a person for that purpose of that person considering whether to act as a guarantor in respect of: •

Credit given by The Yoghurt Shop to me/us; or

Credit for which I/We have applied to The Yoghurt Shop.

I/We acknowledge that The Yoghurt Shop may give a credit reporting agency certain information about me/us at any time after the making of this application. I/We acknowledge that if I/we apply for additional credit from time to time, this disclosure and consent statement applies to each application. I/We acknowledge that upon any time upon request I/we may gain access to the information that The Yoghurt Shop holds about me/us in accordance with the Privacy Act 1988 (Cth) and the National Privacy Principals (NPP’S).

Terms & Conditions Of Supply Of Goods Upon the supplier approving this application the applicant agrees: 1.

The Customer shall pay for all goods within seven (7) days from the end of the week in which the goods were purchased. In case of Payment Default the Company may charge an additional administration fee of 10% per month from statement amount owed until payment is made.

2.

That the supplier shall be at liberty to withdraw account facilities offered to the applicant at any time without prejudice to any right the supplier may have and without being liable for consequences.

3.

That the applicant shall be liable for all costs, charges, commission fees and disbursements incurred by the supplier in recovery of any unpaid account.

4.

To notify the supplier in writing no later than fourteen (14) days prior to any change of ownership of the intended change. Failure to do so could result in the applicant being responsible for future debts.

5.

A minimum order of $100.00 is required for free delivery. For orders under $100.00, a $10.00 delivery fee will be incurred.

6.

Orders must be placed before 11:00am for next day delivery, unless using a transport company for stock delivery, in which orders must be placed two days prior to delivery.

7.

For deliveries outside of the Adelaide Metropolitan area, the customer must organise and fund refrigerated transport. The Yoghurt Shop will deliver orders to the specified transport depot in the Adelaide Metropolitan area, after which point The Yoghurt Shop will not be held responsible for any costs or damages that may be incurred.

New Customer Application Form 3 of 3 Credit Account Terms & Conditions Please read fully these terms and conditions before signing this application. 1.

Trading terms are strictly within seven (7) days and payment is to be received within seven (7) days of the date we issue our invoice.

2.

Any amount not paid by the due date will, at our discretion, be subject to an interest charge of one (1) % per month calculated daily and compounded annually.

Personal Guarantee This personal guarantee must be signed by all directors, sole traders and business partners as a condition to our granting credit to your business. I, the undersigned have requested The Yoghurt Shop to grant credit to the business referred to on the reverse hereof. Should credit be provided then: 1.

I will be responsible for all outstanding moneys due at any time for goods supplied to us.

2.

My guarantee is a continuing security and you will not be effected by any bankruptcy or winding up of the business or any extension or other indulgence shown to my business.

3.

I will indemnify The Yoghurt Shop for any losses, costs, charges and expenses of any nature which might incur as a result of any default by my business or myself arising out of this agreement.

4.

This guarantee extends to any credit given by The Yoghurt Shop to my business and will not be withdrawn until all debts owed to The Yoghurt Shop by the business have been paid in full and thereafter will not expire until fourteen (14) days from the day at which I give written notice of my intention to withdraw this guarantee but nevertheless will remain in full force and effect until all debts incurred during the period of this guarantee have been fulfilled.
