WATER CONSERVATION AND IRRIGATION ADVISORY COMMITTEE ACT. Act No. 45, 1932. An Act to provide for the constitution of a Water Conservation and Irrigation Advisory Committee; to authorise that committee to make investigations in relation to the construction, control, and management of works of water conservation, irrigation and water supply, and the administration and management of irrigation areas, and to report thereon; to authorise the determination of certain amounts by the Governor; to amend the Irrigation Act, 1912-1931; and for ^purposes connected therewith. E it enacted b y t h e King's Most Excellent Majesty, b y a n d with t h e advice a n d consent of t h e Legis­ lative Council a n d Legislative Assembly of New South Wales in Parliament assembled, a n d b y t h e a u t h o r i t y of t h e same, as follows :— 1. (1) T h i s Act m a y be cited as the " W a t e r Con­ s e r v a t i o n a n d I r r i g a t i o n A d v i s o r y Committee Act, 1 9 3 2 . " (2) T h i s Act shall commence u p o n a d a t e to be a p p o i n t e d by the Governor a n d notified by p r o c l a m a t i o n published in the Gazette. 2 . I n this Act, unless the context or subject-matter o t h e r w i s e indicates or r e q u i r e s , — " Commission " m e a n s the W a t e r C o n s e r v a t i o n a n d I r r i g a t i o n Commission constituted u n d e r t h e I r r i g a t i o n Act, 1912-1931. " Commissioner " m e a n s a m e m b e r of the W a t e r Conservation a n d I r r i g a t i o n Commission con­ stituted u n d e r the I r r i g a t i o n Act, 1912-1931. Committee " m e a n s the w a t e r C o n s e r v a t i o n a n d I r r i g a t i o n A d v i s o r y Committee constituted u n d e r this Act. " I r r i g a t i o n a r e a " m e a n s i r r i g a t i o n a r e a constituted u n d e r the M u r r u m b i d g e e I r r i g a t i o n Act, 1910, or the I r r i g a t i o n Act, 1912-1931. " Member " m e a n s a member of the W a t e r Con­ s e r v a t i o n a n d I r r i g a t i o n A d v i s o r y Committee, a n d includes a p e r s o n a p p o i n t e d as d e p u t y of a m e m b e r of the committee. " P r e s c r i b e d " m e a n s p r e s c r i b e d by this Act or by regulations made thereunder. A reference in t h i s Act to a n y other Act shall be deemed to include a reference to all rules, regulations a n d by-laws for the time being in force t h e r e u n d e r . 3. (1) T h e r e shall be constituted a W a t e r Conserva­ tion a n d I r r i g a t i o n A d v i s o r y Committee which shall c a r r y into effect the objects a n d p u r p o s e s of this Act, a n d have a n d discharge the duties, powers a n d functions t h e r e b y conferred a n d imposed on the committee. (2)

(2) The committee shall consist of t h r e e m e m b e r s , who shall be a p p o i n t e d by the Governor, a n d one of t h e m e m b e r s shall be a p e r s o n for the time being holding office a s a commissioner u n d e r the I r r i g a t i o n Act, 19121931, other t h a n the c h a i r m a n of the Commission. (3) T h e Governor m a y a p p o i n t a p e r s o n , possessing the n e c e s s a r y qualifications, to fill a n y vacancy a r i s i n g on the committee. (4) T h e provisions of the Public Service Act, 1902, shall n o t a p p l y to the a p p o i n t m e n t of m e m b e r s of t h e committee. (5) E v e r y m e m b e r of the committee, except t h e commissioner a p p o i n t e d as member a n d a n y member w h o is a n officer of the Public Service, shall be paid such fees a s m a y be prescribed. (6) One of the m e m b e r s shall in and by the i n s t r u ­ m e n t by which he is a p p o i n t e d be the c h a i r m a n of the committee. (7) A n y two m e m b e r s of the committee, of which one shall be the c h a i r m a n or the d e p u t y - c h a i r m a n , shall form a q u o r u m for the p u r p o s e of t r a n s a c t i n g business of the committee. (8) If a t a n y m e e t i n g of the committee, a t which two m e m b e r s only a r e p r e s e n t , such m e m b e r s differ in opinion upon a n y m a t t e r , the d e t e r m i n a t i o n of such m a t t e r shall be p o s t p o n e d until t h r e e m e m b e r s a r e present. (9) I n the case of the illness, suspension or absence of the c h a i r m a n or a n y other m e m b e r of the committee, a d e p u t y m a y be a p p o i n t e d by the G o v e r n o r to act for such m e m b e r d u r i n g his illness, suspension or absence, a n d every such d e p u t y shall, d u r i n g the time he acts a s d e p u t y , have all the p o w e r s a n d a u t h o r i t y of such member. (10) No act or proceeding of the committee shall be i n v a l i d a t e d or p r e j u d i c e d by r e a s o n only of the fact t h a t a t the t i m e when such act or proceeding w a s done o r commenced t h e r e w a s a vacancy in the office of a n y o n e member. (11)

(11) U p o n the e x p i r a t i o n of twelve m o n t h s after the commencement of this Act, or upon the publication in the Gazette of a proclamation by the Governor declaring t h a t the duties and functions imposed by section four of this A c t h a v e been discharged, whichever is the earlier date, t h e committee shall be dissolved a n d the m e m b e r s of the committee shall cease to hold office as such members. 4. (1) The committee shall, as soon as practicable t e r the commencement of this Act, furnish to the Goveror a r e p o r t setting out the steps which they consider should be taken— (a) to make better provision for the construction, control and m a n a g e m e n t of works of w a t e r conservation, i r r i g a t i o n and w a t e r supply, a n d the a d m i n i s t r a t i o n and m a n a g e m e n t of i r r i g a ­ tion a r e a s ; (b) to effect an a d j u s t m e n t or t r a n s f e r of any powers, a u t h o r i t i e s , duties, functions or obliga­ tions exercised a n d d i s c h a r g e d by the Com­ mission where, by such a d j u s t m e n t or t r a n s f e r , such powers, a u t h o r i t i e s , duties, functions or obligations can be m o r e efficiently a n d econo­ mically c a r r i e d out by the D e p a r t m e n t of Public W o r k s , the D e p a r t m e n t of L a n d s , the D e p a r t ­ m e n t of A g r i c u l t u r e , the D e p a r t m e n t of Local Government, the D e p a r t m e n t of Mines, the R u r a l Bank, or o t h e r w i s e ; (c) to make such r e a d j u s t m e n t s or t r a n s f e r s of officers, s e r v a n t s , and employees employed by the Commission as will e n s u r e the observance of a p r o p e r s t a n d a r d of efficiency a n d economy for c a r r y i n g out the powers, a u t h o r i t i e s , duties, functions a n d obligations in t e r m s of the com­ mittee's r e c o m m e n d a t i o n ; (d) to provide, as f a r as is practicable, for the application of the provisions of the Public Service Act, 1902, as amended by subsequent Acts, to the officers, s e r v a n t s and employees employed by the C o m m i s s i o n ; (e)

(e) to m a k e such financial a r r a n g e m e n t s as m a y be n e c e s s a r y to c a r r y into effect the recommenda­ tions of t h e committee. • (2) T h e r e p o r t of the committee shall be accom­ p a n i e d by a d r a f t Bill or Bills for a n y legislation neces­ s a r y to give effect to the c o m m i t t e e ' s r e p o r t . (3) The P e r m a n e n t H e a d of each of the D e p a r t ­ m e n t s m e n t i o n e d in p a r a g r a p h (b) of subsection one of t h i s section a n d the Commissioners of the Government S a v i n g s B a n k of New S o u t h W a l e s shall, each, select a n officer to confer with a n d a s s i s t t h e committee when exercising the jurisdiction, functions a n d powers u n d e r t h i s Act. T h e services of the officers so selected shall be m a d e available to the committee for such duties as the com­ m i t t e e m a y direct. Such officers m a y , if the committee so elect, take p a r t in t h e proceedings a n d deliberations of the committee, b u t as assessors only a n d w i t h o u t vote. (4) T h e committee, or a n y m e m b e r or a n y p e r s o n a u t h o r i s e d b y the committee in w r i t i n g in t h a t behalf, e i t h e r generally or for a p a r t i c u l a r case or class of cases, m a y inspect all offices of the Commission a n d all books, p a p e r s , documents, accounts, places, p r o p e r t i e s , w o r k s a n d buildings u n d e r t h e control of the Commission. T h e committee m a y i n v e s t i g a t e the c h a r a c t e r of the w o r k p e r f o r m e d by the Commission a n d by the officers, s e r v a n t s a n d employees of the Commission, a n d t h e efficiency, economy a n d g e n e r a l w o r k i n g of the Commis­ sion a n d the officers, s e r v a n t s a n d employees thereof. (5) W h e r e the inspection a n d i n v e s t i g a t i o n is con­ ducted by the committee, the committee m a y examine such witnesses as m a y a p p e a r necessary. (6) The committee m a y , a t a n y time, and, from t i m e to time, r e q u i r e the Commission to furnish all such i n f o r m a t i o n as the committee m a y r e q u i r e . (7) F o r the p u r p o s e of conducting a n y inspection o r investigation u n d e r this Act, the committee shall h a v e t h e same p o w e r s a n d a u t h o r i t i e s to summon witnesses a n d receive evidence as a r e conferred by the R o y a l Com­ missions Act, 1923, on a Commission, a n d the c h a i r m a n shall

shall have t h e p o w e r s of a chairman, within t h e m e a n i n g of Division 1 of P a r t I I of the said A c t ; a n d the said A c t , section t h i r t e e n a n d Division 2 of P a r t I I excepted, shall a p p l y to witnesses so summoned a n d evidence so received and given, a s completely a n d effectually as if such wit­ nesses h a d been summoned a n d such evidence h a d been received or given by v i r t u e or u n d e r the a u t h o r i t y of t h e said Act. (8) T h e committee m a y for t h e p u r p o s e s of t h i s A c t m a k e u s e of t h e services of a n y officers, s e r v a n t s o r employees of the Commission. 5. (1) N o t w i t h s t a n d i n g a n y t h i n g contained i n this o r a n y o t h e r Act, t h e Governor, on the r e c o m m e n d a t i o n of the committee, on being satisfied t h a t it is in t h e i n t e r e s t s of t h e public so t o do, m a y from time to time b y proclama­ tion published i n t h e Gazette direct t h e Commission o r a n y officer, s e r v a n t o r p e r s o n in the employment of t h e Commission, u p o n whom a n y p o w e r s , duties, functions or obligations a r e conferred by t h e I r r i g a t i o n Act, 19121931, to do o r r e f r a i n from doing a n y act, m a t t e r o r t h i n g w h a t s o e v e r , a n d every such direction shall immediately be c a r r i e d into effect. A n y such direction m a y be g e n e r a l or limited to a p a r t i c u l a r case or class of cases. A n y such p r o c l a m a t i o n m a y from time to time, u p o n the r e c o m m e n d a t i o n of t h e committee, b e revoked o r varied b y t h e G o v e r n o r b y a like p r o c l a m a t i o n . (2) E v e r y p r o c l a m a t i o n made u n d e r this section shall take effect from the d a t e of the publication thereof in t h e Gazette or from a l a t e r d a t e t o be specified i n t h e proclamation, a n d e v e r y direction contained i n the p r o ­ clamation shall be c a r r i e d into effect forthwith. (3) E v e r y p r o c l a m a t i o n m a d e u n d e r t h i s section t o g e t h e r with t h e r e c o m m e n d a t i o n of the committee r e l a t i n g to a n y direction contained t h e r e i n shall be laid before both H o u s e s of P a r l i a m e n t within fourteen s i t t i n g d a y s a f t e r publication if P a r l i a m e n t is in session, a n d if not, t h e n within f o u r t e e n s i t t i n g d a y s after the commencement of the next session.

If either H o u s e of P a r l i a m e n t p a s s e s a resolution of which notice h a s been given a t a n y time within fifteen sitting clays after the p r o c l a m a t i o n h a s been laid before such H o u s e disallowing a n y direction or p a r t thereof contained in the p r o c l a m a t i o n , such direction or p a r t shall t h e r e u p o n cease to have effect. 6. (1) N o t w i t h s t a n d i n g a n y t h i n g contained in the I r r i g a t i o n Act, 1912-1931, or a n y other Act, the p u r c h a s e m o n e y o r t h e r e n t a l p a y a b l e in respect of a n y a r e a of l a n d of t h e Crown in a n i r r i g a t i o n a r e a , a n d t h e value of t h e i m p r o v e m e n t s on such a r e a , a n d t h e r a t e or charge for w a t e r m a d e in respect of a n y land u n d e r the I r r i g a ­ tion Act, 1912-1931, m a y , a t a n y time, a n d from time t o time, while this A c t is in operation, be r e d e t e r m i n e d by t h e Governor. (2) Subject to this section a n y r e d e t e r m i n a t i o n of t h e Governor shall be final a n d conclusive. (3) T h e G o v e r n o r m a y , a t a n y time, a n d f r o m t i m e to time, while this Act is in operation remit either wholly or in p a r t the p a y m e n t of a n y moneys owing to the Crown or to t h e Commission by an occupier u n d e r a n d within the m e a n i n g of the I r r i g a t i o n Act, 1912-1931. (4) A n y r e d e t e r m i n a t i o n or remission u n d e r this section shall be notified in the Gazette, shall take effect from a date specified in t h e notification, a n d the notifica­ tion thereof shall be laid before both H o u s e s of P a r l i a ­ m e n t within fourteen s i t t i n g d a y s after the publication of t h e notification if P a r l i a m e n t is in session, a n d if n o t , t h e n within fourteen sitting d a y s after the commencement of the next session. If either H o u s e of P a r l i a m e n t p a s s e s a resolution of which notice h a s been given a t a n y time within fifteen s i t t i n g d a y s after the notification h a s been laid before such H o u s e disallowing a n y r e d e t e r m i n a t i o n or remis­ sion, such r e d e t e r m i n a t i o n or remission shall t h e r e u p o n cease to h a v e effect. 7. (1) T h e G o v e r n o r m a y m a k e r e g u l a t i o n s n o t incon­ sistent with this Act, p r e s c r i b i n g all m a t t e r s which a r e n e c e s s a r y or convenient to be prescribed, t o c a r r y t h i s Act into effect or to give effect t o a n y power, function, d u t y or a u t h o r i t y of the committee u n d e r t h i s Act. Without

W i t h o u t prejudice to the g e n e r a l i t y of the foregoing provision the regulations m a y provide for the constitu­ tion of local committees which shall exercise a n d dis­ c h a r g e such powers, functions, duties and a u t h o r i t i e s in r e l a t i o n to the execution of this Act as m a y be specified in the r e g u l a t i o n s . (2) T h e regulations shall— (a) be published in the G a z e t t e ; (b) take effect from the date of such publication or from a l a t e r d a t e to be specified in the regula­ tions ; (c) be laid before both H o u s e s of P a r l i a m e n t within fourteen sitting d a y s after publication if P a r l i a ­ ment is in session, a n d if not, then within four­ teen sitting d a y s after the commencement of the next session. If either H o u s e of P a r l i a m e n t p a s s e s a resolu­ tion of which notice h a s been given a t any time within fifteen sitting d a y s after the r e g u l a t i o n s have been laid before such H o u s e disallowing a n y regulation or p a r t thereof, such r e g u l a t i o n or p a r t shall t h e r e u p o n cease to h a v e effect. (3) A n y regulation m a y impose a p e n a l t y not ex­ ceeding twenty p o u n d s for any breach thereof. (4) A n y p e n a l t y imposed by the regulations m a y be recovered in a s u m m a r y m a n n e r before a s t i p e n d i a r y or police m a g i s t r a t e or a n y two justices. 8. T h e provisions of this A c t shall cease to h a v e effect twelve m o n t h s after the commencement thereof.
