RESPONSE Section 1 of the Freedom of Information Act 2000 (FOIA) places two duties on public authorities. Unless exemptions apply, the first duty at Section 1(1)(a) is to confirm or deny whether the information specified in a request is held. The second duty at Section 1(1)(b) is to disclose information that has been confirmed as being held. Where exemptions are relied upon Section 17 of the FOIA requires that we provide the applicant with a notice which: a) states that fact b) specifies the exemption(s) in question and c) states (if that would not otherwise be apparent) why the exemption applies. In relation to the details of all of British Transport Police’s current recycling and waste support and maintenance contracts, the following exemption applies: Section 12 - Exemption where cost of compliance exceeds appropriate limit Section 12 of the FOIA provides an exemption from a public authority’s obligation to comply with a request for information where the cost of compliance is estimated to exceed the appropriate limit. In relation to your request for the full details for all relevant contracts, the information you have requested cannot be easily retrieved. Due to the complexity of the British Transport Police estate and the fact that BTP is a national force, there are 140 sites that may have different contract arrangements. In order to provide the answer to this question we would need to collate the information for all 140 sites. It is estimated that it would take approximately 20 minutes per site to identify the information requested. Therefore, we estimate that it would take approximately 46 hours to comply with your request. It is estimated that the cost of providing you with the information is above the amount to which we are legally required to respond i.e. the cost of locating and retrieving the information exceeds the “appropriate level” as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004. In the case of the police service, the appropriate limit is £450 which has been calculated to equate to a total of 18 hours of

work. If any part of the request exceeds the fees limit then Section 12 applies to the whole request. This letter acts as a refusal notice under section 17(5) of the Freedom of Information Act 2000. Although excess cost removes the force’s obligations under the Freedom of Information Act, as a gesture of goodwill, I have supplied information, relative to your request, retrieved or available before it was realised that the fees limit would be exceeded. I trust this is helpful, but it does not affect our legal right to rely on the fees regulations for the remainder of your request. British Transport Police has 3 national Waste Management contracts. The details of these are provided below: CONTRACT 1 Contract Name Provision for the Destruction and Disposal of Protectively Marked Waste Contract Type Recycling collection service Supplier Shred-It Limited Annual Average / Estimated Annual spend £75,000.00 approx Brief Description of Contract 1. Shred-It Ltd to supply a sufficient number of document containers to be used by the customer (BTP) for the storage of documents awaiting destruction 2. On a regular basis, as agreed from time to time with the customer, Shred-It Ltd to collect and empty such document containers as contain documents awaiting destruction 3. Shred-It Ltd to destroy all documents contained in the document containers using a cross-cut shredding machine. 4. Shred-It Ltd to recycle all newly shredded documents. 5. Shred-It Ltd to provide a Certificate of Destruction in the form annexed at Schedule 1 upon the destruction of such documents. Contract Duration   
