UTAH STATE UNIVERSITY ATHLETICS Athletics Department Guidelines As a student athlete at Utah State University, you become highly visible and recognizable among the student population, giving up a portion of your privacy in exchange for the opportunity to compete for USU nationwide and achieve a level of fame. Whether you are on or off campus, in your hometown, in the game, in the stands, in class or socializing, you always represent yourself, your community, your team and your university. Your language and actions have an effect on the athletics department—not just yourself. If you remember and apply this principle, you will be very successful at USU. All student athletes at Utah State University, including you, are held to standards set in the Code of Policy and Procedures for students at Utah State University. Included are specific policies and procedures concerning academic honesty, discipline and grievance/appeals processes. You are students first and athletes second. You are responsible for compliance to the university, conference and NCAA rules and regulations and must follow department and team regulations. A student at Utah State University is a member of two communities—civil and educational. Regulations of both communities are applicable to you, the student athlete.

Conduct and Behavior USU athletes must remember at all times to conduct themselves both on and off campus in a manner that brings respect and high regard to the University.

Discipline and Procedure All student athletes are expected to conduct themselves with the dignity of a Utah State Aggie. However, in order to address a problem when it arises, the following recommendations have been adopted: UTAH STATE UNIVERSITY ATHLETICS A. Serious Crimes Policy It shall be the policy of Utah State University Department of Athletics, (hereinafter “Athletics Department”) that upon notification that a student athlete has been arrested for a State or Federal law or is arrested for a DUI offense as defined by Utah law, said student athlete shall be immediately suspended from athletic competition. The student athlete is required to notify his/her head coach of the felony arrest as soon as possible. In turn, the head coach must notify the Sport Administrator, who will then forward the information to the Director of Athletics. B. Misdemeanors Discipline for misdemeanor offenses other than DUI offenses described in Section A herein shall be the responsibility of the Head Coach in the sport in which the student athlete participates, except asset forth in Section C hereafter. The Head Coach may impose such conditions, limitations or discipline, if any, as he or she deems proportionate to the facts of the individual case, except as set forth in Section C hereafter. However, if the student athlete is arrested, the Head Coach should notify the Sport Administrator immediately and further disciplinary actions may be taken, subject to a review of the circumstances. Further it should be understood that the Comprehensive Action Committee may find it necessary to convene on Misdemeanor offenses and implement further disciplinary action. C. Other extreme acts of behavior detrimental to the tradition of college athletics at Utah State University. The Athletics Department recognizes that there may be certain misdemeanor offenses or other activity by the student athletes, including repetitive offenses and/or acts, so serious that the conduct warrants immediate suspension from athletic competition by the Head Coach of the sport in which the student athlete participates. Then, in that event, the Head Coach shall immediately notify the Sport Administrator, who will convene the Comprehensive Action Committee will review the circumstances of the situation and forward a recommendation to the Director of Athletics. UTAH STATE UNIVERSITY ATHLETICS D. Notification Policy A student athlete arrested for any crime shall report such arrest to the Head Coach, or an Assistant Coach, of the sport in which the student athlete participates. Upon notification from any source of the arrest of a student athlete for any crime, the Head Coach of the sport in which the student athlete participates has the institutional responsibility to report such arrest immediately the Sport Administrator of that sport after it becomes known to the Head Coach in order that appropriate notice of such situation can be forwarded to the Director of Athletics and the President of the University. Consistent with this notification policy, all Assistant Coaches and other team staff members of the Utah State Department of Athletics have an institutional responsibility to report the arrest of a student athlete to the Head Coach and/or Sport Administrator of the sport in which the student athlete participates immediately after notice of such an arrest becomes know.

Sexual Assault/Misconduct One of the most important areas of growth experienced by a university student is in his or her friendships, especially intimate social relationships. Although it may be unfair to consider this of public interest, it can become a public issue, especially if circumstances or misunderstandings arise that lead to claims of physical or sexual injury to another.

Student-athletes, just as every other citizen, must remember that any form of physical or sexual conduct carried out upon a person, against that person’s will, is a crime. Physical assaults, whether sexual or not, are among the ugliest and most devastating crimes. You must be very careful whenever the issue of sexual intercourse, or any other form of physical intimacy enters your relationship plans. Be very clear about your partner’s limits and wishes. You must clearly understand any physical or sexual contact that is accomplished against the will of another person may lead to suspension or dismissal from your team, from the University, or may even result in criminal charges, even if you think permission has in some way been implied. Be very careful prior to engaging in any sexual activity to clearly discuss your intentions with your partner and leave nothing to doubt as to your partner’s willingness to participate in the activity, even to the point of asking specific permission if you are at all uncertain. Also, please remember that anyone who has or had been drinking alcohol is not going to be able to give valid permission for anything, including sex, and having sex with an intoxicated individual may later be interpreted as rape. This common sense advice will help you continue to represent USU athletics to the campus and larger community in a positive, winning manner.

Victims of Sexual Assault If you are a victim of sexual assault, seek help – the earlier the better. You can contact any of the following organizations to report an incident or seek advice: ♦ USU Student Wellness Center – 797-RAPE (7273) ♦ USU Counseling Center – 797-1012 ♦ USU Women’s Center – 797-1728 ♦ Logan Police Department – 716-9400 ♦ CAPSA (Community Abuse Prevention Services Agency) – 753-2500 Prohibited conduct - general The following misconduct is subject to disciplinary action: 1. All forms of academic dishonesty, including cheating,fabrication, facilitating academic dishonesty and plagiarism. 2. Violating the terms of any disciplinary measure imposed. 3. Knowingly furnishing false information (including false identification) to the university or to any university employee or agent, including campus or community law enforcement or security officers acting in good faith and in the performance of their duties. 4. Forgery of or unauthorized alteration of or access to any university document, record or instrument of identification, including electronic hardware, software and records. 5. Knowingly possessing stolen property. 6. Destroying, damaging, misappropriating or gaining unauthorized access to university property. 7. Theft, destruction or damage to the property of others. 8. Violation of university rules governing alcohol consumption, unauthorized sale or possession of alcoholic beverages. 9. Engaging in, supporting, promoting, or sponsoring hazing or violating university rules governing hazing. 10. Engaging in harassment or unlawful discriminatory activities on the basis of age, ethnicity, gender, handicapping condition, national origin, race, religion, sexual orientation or veteran status or violating university rules governing harassment or discrimination. 11. Interfering with any university investigation, including but not limited to tampering with physical evidence or inducing a witness to testify falsely or to withhold testimony. 12. Conduct involving sale or distribution of illegal drugs, physical assault battery or violence, which may present a clear and present danger to the safety of the university or to the members of the university community. Possessing, using, selling, manufacturing, or distributing any hallucinatory, narcotic, illegal or controlled substance as defined by federal or state laws, except as expressly permitted by such laws. (See: Drug and Alcohol-Free Workplace pamphlet for summaries of these laws.) 13. Use of computers/computing facilities to store, access or distribute obscene or pornographic materials.

14. Remedial Guidelines for Alcohol-Related Misbehavior: Any student misbehavior resulting from the use or abuse of alcohol, except as described in Section A herein, may result in discipline ranging from probationary status, temporary suspension, or loss of scholarship after taking into consideration all of the facts surrounding the misbehavior, the age of the student, the facts and circumstances surrounding the student’s academic performance at USU, and any prior adverse, behavioral or disciplinary history of the student athlete.

While the moderate use of alcohol containing beverages is not prohibited for persons 21 years of age or older, any misuse of alcohol, including violations of the law while intoxicated, may result in corrective actions. A student athlete who receives a legal citation from a law enforcement officer for an alcohol violation, including, but not limited to: ♦ Driving under the influence of drugs or alcohol ♦ Public intoxication by drugs or alcohol ♦ Drinking alcohol under the legal age limit will be subject to the Guidelines for Drug Offenses in the Utah State Department of Athletics Drug Testing, Education and Counseling Policy. A student athlete who is observed in the act of drug or alcohol use, or is observed demonstrating the effects of drug or alcohol use, by an athletics department staff member, university employee (e.g. resident hall staff) or law enforcement officer will be subject to the Guidelines for Drug Offenses detailed in policy 15. More than five (5) unexcused absences from class (per signed financial aid agreement). 16. Other conduct that is not included in the list above but is contrary to the athletics department and university standards of what is considered to be a good citizen as a Utah State student athlete. Any attempt to commit an act of misconduct prohibited by these rules shall be subject to consequences to the same extent as completed acts. Myspace/Facebook policy THINGS TO DO: Set privacy settings to “Approve comments before posting” - From home menu, click “edit profile” - Click “account settings” - Click “change settings” icon next to “privacy settings” - Last, click box titled “comments-approve before posting” You are responsible for monitoring your page because there will be penalties for individuals who do not keep their pages in the Green Zone addressed below. Green Zone -No offensive or foul language. -No images that are revealing or consist of individuals in compromised positions. -Contains no racial/gender discrimination. -No display of alcohol or firearms. Generally: Does not consist of images that are damaging to the individual or Utah States reputation. Red Zone Consists of… -Adult content (sexually explicit behavior). -Offensive and foul language. -Inappropriate behavior (drinking, smoking, committing sexual acts, display of firearms, etc…). Represent yourself in a positive manor Images of sexual content, intoxication or endorsing drug and alcohol use on your page will not be allowed! Why Bother? Utah State University is completely dependent on its reputation of success and the success of its student-athletes. As student-athletes we represent more than ourselves. We are looked upon as representatives of this institution, city, and state. Therefore, we have a duty to conduct ourselves in a manor that will please not only this institution, but our families and the children who call us their hero’s. Those student athletes who are caught in the Red Zone will receive the following punishment: 1. Meet with the Director of Athletics and Head Coach 2. Community Service

3. Possible loss of scholarship and/or stipend 4. Loss of privilege to be on intercollegiate athletic team at Utah State

Appeals/Grievance Procedures Utah State University has in place several appeal/grievance procedures through which students including student athletes, may voice complaints against fellow students, instructors, other university employees, etc. One appeal procedure is specific to student athletes and addresses issues relating to financial aid (student athletes’ financial aid issues, cancellation or non-renewal of financial aid, and transfer issues) and is composed of faculty and staff appointed by the president. The NCAA requires a student athlete specific grievance/appeal procedure designed to address only student athlete concerns. Utah State Student Athlete Complaint Resolution Process Another process is an internal and confidential process intended to be available for a student athlete to address complaints/issues relating to any student athlete’s conflict with other student athletes, coaches, Athletics Department employees, and other athletically related complaints. This process is not to address any issues of an academic nature or those relating to financial aid and transfer issues since other university committees have authority in these areas. The process is as follows: 1. The initial step is for the student athlete to bring the complaint to the attention of sports administrator for his/her sport who is responsible for keeping all proceeds confidential and for mediating the dispute between all parties involved. Following completion of the initial mediation step, should the complainant feel that the issue has not been resolved then he/she may appeal the mediation ruling via petition to a review committee composed of the Senior Woman Administrator, Senior Associate Athletics Director for Athletic Training, and Faculty Athletics Representative. The petitioner may appear in person before the Review Committee as well as the individual against whom the complaint has been filed. The Review Committee shall submit its findings to the Athletic Director for final review and a formal Athletic Department decision on the matter. 3. Should the complaint not be resolved by the reviews or the internal decision of the Athletics Director, the Faculty Athletics Representative, after conferring with the Athletics Director, may have the options of forwarding the complaint to the Intercollegiate Athletics Council, a body external to the Athletics Department or informing the complainant that all options internal to the Athletics Department have been exhausted and he/she has the option of entering other grievance and mediation processes offered all students through the Utah State University Dispute Resolution Program administered by the Office of Legal Affairs, student conflicts through the Student Judiciary, or academic issues through the Vice President for Student Affairs.

Academic Dishonesty An instructor has full autonomy to evaluate a student’s academic performance in a course. If a student violates the Honor System (Section V-3.B., USU Student Code), the instructor may sanction the student in accordance with the procedure in Section VI-5.A.1.,as part of the course evaluation. Such sanctions may include: 1) verbally warning the student; 2) giving the student a written reprimand; 3) requiring the student to rewrite a paper/assignment or to retake a test/examination; 4) adjusting the student’s grade –for either an assignment/test or the course, or 5) giving the student a failing grade for the course. A sanction by the instructor is not a disciplinary penalty. If the instructor believes that, in addition to any sanction, the student should be disciplined and a penalty imposed, the instructor shall refer the student for disciplinary proceedings. (See: Section VI-5.A.2.) The penalties, which the University may impose on a student for an honor system violation, are: ♦ Probation: continued participation in an academic program predicated upon the student satisfying certain requirements as specified in a written notice of probation. Probation is for a designated period of time and includes the probability of more severe disciplinary penalties if the student does not comply with the specified requirements or is found to be violating the honor system during the probationary period. The student must request termination of the probation in writing. ♦ Suspension: temporary dismissal from an academic program or from the University for a specified time, after which student is eligible to continue the program or return to the University. Conditions for continuance or readmission may be specified. ♦ Expulsion: permanent dismissal either from an academic program or from the University.

♦ Assigning a designation with a course grade indicating an honor system violation involving academic dishonesty. Conditions fro removal may be specified, but the designation remains on the student’s transcript for a minimum of one year; provided, however, that once the student’s degree is posted to the transcript, the designation may not be removed thereafter. ♦ Denial or revocation of degrees.
