(4) US & CANADA: COMMENTARY Much as the UK and Ireland have traditionally been amalgamated for box-office purposes, so figures collected for ‘North America’ combine the US and Canada. This is not to say that there are no Canadian distributors; Cinando lists 67, with many active in VOD, but also a number of theatrical distributors, and not just in French-speaking Quebec. But no separate data is recorded. And there is no doubt that the US dominates the North American market, just as it used to dominate the international film distribution business. Such figures as are available show the break as being 90/10 in terms of population: 96/4 for admissions; 93/7 for numbers of screens; and 95/5 for box office. The US has always tended to be the holy grail for production companies and national film institutes – the market by which the success or failure of an international film is judged. If a movie doesn’t make some impact in America, it hasn’t really travelled. This is a problematic situation for producers of European movies made in a language other than English, since the US is a market with a strong degree of resistance to foreign-language titles, particularly subtitled ones. The debate about whether US audiences will accept subtitles has intensified of late, with Indiewire recently reporting that audiences for subtitled movies had declined by 61% over the five years covered by this Report. The US is an extremely parochial market, with the proviso that it is the largest parish in the filmmaking world. Thus a small proportion of the US filmgoing public – averaging out at 1.3 billion a year between 2010 and 2014, with the US’s per capita attendance rate of 3.8 bested only by tiny Iceland – is still a significant amount. The market, however, is changing, with admissions declining (down 10% - with some fluctuations - over the five-year period surveyed) even as box office, thanks to increasing ticket prices, continues to grow. Certainly, regular moviegoing is part of US culture, but the home-entertainment opportunities offered by digital distribution are beginning to make an impact.

VOD has arrived in the US. Distributors now routinely acquire VOD rights along with theatrical ones just as they used to acquire DVD or TV rights. As a result, VOD is now an integral part of the distribution landscape in the US, with platforms offering one of three distribution models: a pre-theatrical teaser release on VOD to build awareness of a difficult or controversial title, as was done with Lars von Trier’s NYMPHOMANIAC by Magnolia; a simultaneous theatrical, VOD and DVD release – a system used for both genre and arthouse titles; and a VOD release after the film has disappeared from theatres (generally around three months for major films). The pattern of delivery (as suggested in (3) above) is also somewhat different from the rest of the world. SVOD platforms like Netflix, where a subscription brings access to a library of titles, are certainly prospering, but are heavily reliant on original product like HOUSE OF CARDS and ORANGE IS THE NEW BLACK to maintain their profile and audience share. On the TVOD market, meanwhile, where payment is per title purchased, smaller distributors sell product direct to the public (with the physical shipment of DVDs still forming a significant part of their business) but also make them available on bigger platforms such as Amazon, i-Tunes and Hulu. The net result is that individuals using VOD need to know what they are looking for, generally in terms of a specific title, with the option of browsing, for instance, ‘French movies’ or ‘German movies’ rarely available. This means that the VOD market for arthouse and foreign-language films is currently almost entirely driven by the theatrical one in terms of title recognition. Thus, while VOD offers substantial benefits to cinéphiles who do not live within driving distance of an arthouse theatre and want to watch a specific title, it offers limited scope for broadening the market.

(5) GERMAN FILMS IN THE US AND CANADA As the charts below indicate, US audiences prefer English-language films, and do so in a more determined fashion than in most of the territories surveyed in this Report. Of the eight German films that took over $1 million at the US box office (basically entry-level for a commercial release) between 2010 and 2014, seven were essentially German-produced American films (the eighth was Wim Wenders’ PINA). Put another way, 90% of revenue for German films over the period surveyed was accounted for by the English-language category. The news is not all that bad: although an average market share of 0.04% may not be anything to celebrate, it has to be put in the perspective of a market where nine-and-a-half tickets out of 10 are sold to American films. Within the very small US foreign-language market, Germany has carved out a tiny but meaningful niche, as the breakdown in the VOD chart shows. German is the third most frequently acquired nationality of film – after the UK and France, and well ahead of Spain and Italy. German mainstream movies like DAS LETZTE SCHWEIGEN have a small corner of the market, but for most North American moviegoers, a European movie is by definition an arthouse movie, and the performances in that category, averaging $362,563 at the box office between 2010 and 2014, clearly outperform the ‘German stories’, which average $148,748 over the same period.

One notable absence from the list is children’s films – just one, DAS MERKWÜRDIGE KÄTZCHEN, with a box-office total of under $6,000 in the 2010-2014 period. Clearly, local fare – Disney and Pixar – more than meet that market need. Four arthouse distributors – three long-established (Kino Lorber, First Run Features and Strand Releasing) and one relative newcomer (Music Box Films, founded in 2007) – account for almost half the German films released, and Strand’s VOD line-up of German titles is notable for the presence of a number of gay movies, in which the distributor has long specialised. The following charts show numbers of releases and box office revenue for the key groups identified in the introduction to this Report.
