Property Description/Findings of Fact: The subject property is a 21,413 ± sq. ft. parcel that is developed with a single-family home. The property includes a 1,100 sq. ft. dock that contains a single boat slip located along the Mackenzie Canal. The property has frontage and access from SE 24th Avenue (a local road) and has a combined water frontage of approximately 315 feet along the Mackenzie Canal (115 feet wide) and the Bronte Canal (75 feet wide). The surrounding area consists of single-family residences and undeveloped lots in all directions. A site visit was conducted on August 10, 2015. Project Description: The applicant is requesting a 35 sq. ft. deviation to LUDR, Section 3.16 that restricts a marine improvement to a maximum of 1,100 sq. ft., in order to allow a marine improvement that is 1,235 sq. ft.

LUDR, Section 3.16.2.D.1 states, “For parcels with more than 40 feet of water frontage, the maximum deck surface area coverage shall be calculated as follows: the linear feet of water frontage of the parcel minus 20 feet times one-half times the linear feet of the maximum projection into the waterway (25% of the calculated width of the waterway or 30 feet, whichever is less). However, the maximum deck surface area allowed under this section shall not exceed 1,200 square feet for marine improvements which project from parcels utilized for single-family residential dwelling units in R-1, RD, RE, and/or RX zoning districts”

The subject property has approximately 315 feet of combined water frontage, however, the applicant’s marine improvement is located solely on the Mackenzie Canal. The subject property has 145 feet of frontage along the Mackenzie Canal and marine improvements may project a maximum distance of 23 feet into the waterway. Therefore the following formula would be used to calculate the maximum area allowed of a marine improvement. 145(water frontage) – 20 x ½ x 23(allowed projection) = 1,437 sq. ft. The applicant’s proposes to expand his marine improvement by adding additional decking on the end of the existing boat slip. The applicant indicates the new decking will accomadate a larger boat. The expansion will maintain the current length of projection of into the Mackenzie Canal. All new decking will run parallael to the applicant’s seawall. A diagram of the marine improvement is provided below.

Analysis: The Planning Division has reviewed this application according to LUDR, Section 3.16.9.B.2, Marine Improvements, and offers the following analysis for consideration: LUDR, Section 3.16.9 allows for deviations to marine improvements based upon the following:

“That the deviation will not be contrary to the public interest and will be in harmony with the general intent and purpose of this section and where conditions exist that are not the result of the applicant and which are such that a literal enforcement of the regulations involved would result in unnecessary or undue hardship”

The intent of the marine improvement ordinance is to protect the navigability of canals and the aesthetics of waterfront properties by restricting the area of marine improvements through the application of a formula that factors in canal width and the length of linear water frontage. However, the same section of the ordinance states that no marine improvement shall be larger than 1,200 sq. ft. Staff finds that the proposed marine improvement would not negatively affect the surrounding community or navigability given that the Mackenzie Canal exceeds 110 feet in width and the applicant’s marine improvement will maintain the current projection of the marine improvement. Staff also finds that the size of the applicant’s requested deviation, 35 feet, is relatively modest considering that applicant has over 300 feet of combined water frontage. Furthermore, staff finds that the expansion will not affect the visibility of surrounding properties due to the applicant’s large amount of water frontage and the width of the Mackenzie Canal. Recommendation: Planning staff finds that the proposed deviation meets the intent of the City’s LUDRs and meets the requirements for a deviation under LUDR, Section 3.16.9.B.2, therefore, the Planning Division recommends approval of the requested deviation with the following condition. 1) The proposed marine improvement shall be consistent with the drawing identified as prepared by Aquamarine Construction labeled as Exhibit “A”.

Dear Sirs: We are requesting permission to add 135 sf to our existing dock so that we can increase the size of our boat lift to accommodate our new boat. We have purchased a new lift and need to extend the dock walkways on both sides to accommodate the lift and boat. This dock will be on the corner of the Mackenzie and Bronte Canals. We currently own approximately 300 linear feet of property on this corner, composed of 4 lots. Our existing dock is 1100 sf. The dock addition will not interfere with the navigability of either of the canals. We appreciate your consideration of this request.
