UNICEF-Turkey TERMS OF REFERENCE (ToR) SHORT TERM NATIONAL INDIVIDUAL AND INSTITUTIONAL CONSULTANCY CONSULTANCY ON DEVELOPING RISKS AND NEEDS ASSESSMENT TOOL and SOFTWARE FOR CHILDREN UNDER (REF: PRO/TURA/2017-B) PROBATION Links with the Country Programme Priorities: Outcome 1: By 2020, the education, child and social protection and health systems, NGOs, communities and families provide vulnerable children with increasingly inclusive opportunities to realize their rights to protection, education, development and participation. Output 1.E - Justice for Children: Community-based alternatives are developed for children in conflict with the law. Activity 1 - Community-based alternatives for children in conflict with the law - Development of an Effective Risk Evaluation System for Children in Turkish Probation Services Project I.

BACKGROUND

Situation in the World: The United Nations Committee on the Rights of the Child frequently expresses its concern that international standards on youth justice have not been fully implemented throughout the world. Research indicates that countries do not have a clear picture of the extent to which they are adhering to international and European standards, or, indeed, whether or not any of their practices in the sphere of youth justice are truly yielding the expected results regarding youth justice standards, because they do not have sufficient data collection, monitoring and evaluation systems. Research also shows that it is more beneficial to rehabilitate a child in the community than in detention. Interventions delivered in the community are more effective at reducing reoffending than those delivered in custodial or institutional settings1. Situation in Turkey: In Turkey, the number of children in conflict with the law is around 180,000 every year. In 2015, less than half of them were tried before the specialized child courts. Approximately 145,000 children have gone through the probation system since probation services for children were introduced in 2005, and 14,342 children are currently under probation as of November 2016. The Ministry of Justice (MoJ) has been following a gradual strategy of improving its standards in order to ensure that children in the juvenile justice system are treated in a manner that is consistent with their rights and needs. The strategy is being implemented in accordance with Article 37 of the United Nations Convention on the Rights of the Child as well as the priorities set out in the Strategic Plan of Ministry of Justice. The Project: Work carried out in the above context has revealed a need to strengthen the communitybased services for children engaged in crime so as to be able to put into practice the principle that detention should only be used as a measure of last resort. With this in mind, the “Development of an Effective Risk Evaluation System for Children in Turkish Probation Services” Project has been developed to improve the probation services for children in Turkey. The Project is co-funded by the European Union, the Government of Turkey and UNICEF, and is being implemented by the Ministry of Justice Directorate General for Prisons and Detention Houses Probation Department with UNICEF technical support. The overall objective is to increase the efficiency and effectiveness of the juvenile justice system in Turkey through the development of a more effective, preventive and rehabilitative probation system. Improved services are to be developed for the reintegration of juveniles under probation in 1

Turkey which take their individual risks and needs into account and are effective, measurable and compliant with EU standards. The final beneficiaries of the project are the children in contact with the justice system and their families. The expected results area: the development and testing of a risks and needs assessment tool that will make it possible to conduct adequate and effective rehabilitation efforts in line with the needs of the juveniles and to ensure their successful reintegration in society; the dissemination of the system developed for juveniles under probation, and monitoring of the supervision and follow-up of juveniles in the community. Institutional structure: According to the legislation in place, the Ministry of Justice Directorate General for Prisons and Detention Houses Probation Department is responsible for developing policies in the field of probation services for children. The Probation Department is also authorised to monitor, review and enhance all enforcement, improvement and intervention efforts for children under probation. As the local organization of the Department, the Probation Directorates which have been established at the provincial and sub-provincial (district) levels are responsible for the enforcement of the community-based sentences and measures which come under probation services. Intended enhancements: The Probation Directorates are entitled to fulfil certain duties and provide certain services at for children in contact with law (suspects, victims, convicts, persons released from penal institutions2) at the stages of investigation, prosecution and enforcement, including the identification of risks and needs and the matching of the results with the intervention programmes available. In this context, the MoJ Directorate General for Prisons and Detention Houses has decided to enhance Probation Services for children by developing an effective risks and needs assessment tool and a greater variety of intervention programmes to ease the children’s reintegration into society, realize their potential and prevent them from reoffending. New risks and needs assessment tools: As part of the above mentioned Project and specific goal of the Directorate General for Prisons and Detention Houses Probation Department, a national Consultancy Team3 is expected to develop a risks and needs assessment tool for children and young people under probation and a software for the tool, training materials for relevant professionals (including an admin programme of the software for Probation Department to ensure sustainability of the tool), conduct the training, organize field visits to pilot provinces4 to monitor the implementation before finalizing the developed materials. UNICEF Turkey is therefore seeking short-term national individual and institutional consultancy services to complete tasks mentioned above. II.

PURPOSE OF THE ASSIGNMENT

The purpose of the assignment is as follows: 

Review of the existing risks and needs assessment tools and mechanisms in terms of efficiency and effectiveness to identify reoffending risks of juveniles and their needs required to reintegrate into society and reach out their full potential and set out recommendations for revision.

III.

Support the study visit to Turkey organized for the International Consultant to ensure that visits to relevant organizations and meetings with relevant professionals entitled to implement existing risks and needs assessment tools are included in the study visit programme (in collaboration with the national consultancy team responsible to develop supportive intervention programmes for children under probation). Support the organization of the study visits to the 3 selected EU countries to ensure that visits to relevant organizations and meetings with relevant professionals entitled to implement existing risks and needs assessment tools are included in the study visit programme and participate in the study visits to observe best practices examples of probation services for children and young people. Develop the risks and needs assessment tool and set out standard operational procedures (SOP) for the implementation of the developed tool. Develop a software for the tool by working in close cooperation with the national consultancy team responsible to develop supportive intervention programmes. Develop training materials for admin programme of the software for MoJ officials and general use of the tool and software for practitioners. Conduct the trainings of trainers (ToT) and supervise the trainings conducted by the trainers. Participate in the field visits to the pilot provinces to observe the implementation of developed tool. Revise the developed materials. Introduce the revisions on risks and need assessment tool and its software programme to relevant professionals. METHODOLOGY

The consultancy team will work under the guidance of UNICEF Child Protection Officers and collaborate with relevant partners in line with UNICEF standards, norms and procedures. The consultancy team will work in close contact with the UNICEF personnel and project partners. Data, reports and/or any other documents necessary for performing the activities of this consultancy shall be provided by UNICEF. The consultancy team shall follow the visibility rules of UNICEF and partners while preparing documents and conducting activities. All documents produced by the consultancy team shall be cleared by UNICEF. All documents to be produced shall respect gender equality and be in line with UN Convention on the Rights of the Child and other human rights instruments. The intellectual property rights of all documents and related materials shall belong to UNICEF and the Ministry of Justice. The tasks envisaged in these Terms of Reference require academic and field expertise at national and international levels. Therefore it is preferable for the assignment to be conducted by a team of consultants. The composition of the proposed team should be clear, the proposed team members should be identified clearly by name, and their CVs should be attached. As a part of the tender process, the consultancy team might be invited to talk about the field of assignment and the methodology for performing the tasks and achieving the targets. Methodology must be compliant with the UNICEF Procedure for Ethical Standards in Research, Evaluation, Data Collection and Analysis. During all stages of the study, the final agreed methodology will have to take ethical matters into account, especially those related to the involvement of the child in research efforts, and respect for the challenging situations in which target populations live, for ability age and ethnicity, and for socio-cultural beliefs, norms and values including those related to personal interaction and gender roles. The informed consent of the participants is required. 3

Applicants are expected to submit their technical and financial proposals and CVs to UNICEF in compliance with the format attached to this ToR after duly considering the Information Note5 and Technical Offer Template annexed to these Terms of Reference. Technical proposals are expected to explain in detail the methodology to be employed in performing the work. They should also contain brief information on (including but not limited to) the following matters:     

Main objectives General methodology including preliminary structure of the field study (if applicable) Estimated amount of time required for each task and timetable and logistic requirements (if any) Details of team members/other experts (if any) and clear division of labour with person/day calculations Risks and Assumptions

DUTY STATION

There is no certain location for the provision of the consultancy services. However, the consultancy team is expected to pay regular visits to UNICEF Turkey Office in Ankara and the relevant partners. The Consultancy Team will undertake field visits to 21 pilot provinces of the project to observe the implementation of the developed risks and needs assessment tool. The travels shall be subject to approval of UNICEF, and travel, accommodation, food and other expenses of the Consultancy Team will be reimbursed to the Consultancy Team by UNICEF upon approval of invoices and supporting documents regarding accommodation and travel expenses. Travel and accommodation expenses may only cover those items identified by UNICEF and shall not exceed the pre-determined limits of UNICEF’s daily allowance rate. The consultancy team will be responsible for travel arrangements and must ensure that they are made in line with UNICEF policy on entitlements for consultant travel. It should be noted that travel booked directly by the consultancy team cannot be reviewed by UNICEF Travel Administrators / Travel Focal Points for reasonableness pre or post booking. The consultancy team must travel on UNICEF approved airlines. V.

SUPERVISOR

Child Protection Programme Officer, Dilek Karagöz VI. DURATION & COST of ASSIGNMENT  Duration: The assignment will be for an 11-month period from February 2017 to December 2017. It is estimated that 70-90 person/days will be required for the completion of tasks. 

Payment schedule: Payments will be effected upon the delivery of the outputs.

The Information Note provides general information about the probation services for children and the details of the efforts undertaken by the probation directorates for ensuring the reintegration of juvenile suspects/defendants/convicts into the society. 4

Estimated Cost of Consultancy: The consultancy will be priced in Turkish Liras (TL). Applicants are required to present a detailed financial proposal that specifies, in TL and on the basis of the programme and deliverables tabulated below: the number of working days anticipated for each deliverable, the daily rates, the sum for each deliverable and its breakdown, the incidental expenses foreseen for each deliverable, and the total sum demanded. UNICEF will cover travel and accommodation costs arising from planned visits. Travel and accommodation expenses may only cover those items identified by UNICEF and shall not exceed the predetermined limits of UNICEF’s daily allowance rate. Other costs related to administrative tools, communications, etc. shall be covered by the consultancy team.



Reservations: UNICEF reserves the right to terminate the contract and/or withhold all or a portion of payment if the rules and the regulations regarding confidentiality, ethics and procedures of UNICEF and the partners are not followed, the performance is unsatisfactory, or work/deliverables are incomplete, are not delivered or fail to meet the deadlines. In addition, UNICEF reserves the right to work with multiple Consultants for the same assignment, if necessary. Where this is the case, all Consultants are expected to work in cooperation and coordination as required by the objective of the consultancy.

QUALIFICATIONS AND SPECIALIZATION REQUIRED FOR THE ASSIGNMENT:

The consultancy team members to complete this assignment are expected to have the following qualifications: Institutional Requirements -

Experience/knowledge in statistical analysis, data mining, development of assessment tools and evidence based modalities. Sound experience in the field of child rights, child protection system and juvenile justice is a major asset.

Minimum Requirements for the Team Members -

For the team leader, at least Doctoral degree in social and/or physical sciences.

Experience in working with universities, international organizations, civil society organizations, judicial bodies and/or public authorities. Experience/knowledge in statistical analysis, data mining, development assessment tools and development of evidence based modalities. Having sound experience in software development (At least 5 years of experience in J2EE architecture, application development experience with Swing, having experience in XML, having experience in UML, sound knowledge on object-based analysis and design)

Further Relevant Experience: -

Experience in juvenile law (criminal law, child protection law and civil law) and juvenile justice system is an asset. Experience/knowledge regarding working with children under probation and detention, is a major asset. Professional or academic experience in other children-related fields is a major asset.

Skills and personal traits: -

Respecting different cultures, accepted local norms, religious beliefs and practices, personal interaction and gender roles, disability, age and ethnic identity. Strong analytical, organizational and communicational skills. Ability to work closely with national and international actors and working group within a tight schedule to facilitate the coordination of the process. Computer literacy.
