TOWNSHIP MEETING MAY 18, 2016 The regularly scheduled meeting of the Mayor and Committee of the Township of Oxford was held on May 18, 2016 in the Township Municipal Building, at 11 Green Street, Oxford, New Jersey. In attendance were Marc Pasquini, Robert Nyland, Bill Ryan, Michael Lavery, Michael Finelli, Dawson Bloom and Sheila L. Oberly. The flag salute was recited. Mayor Pasquini called the meeting to order at 7:01PM. Meeting Minutes: On motion by Mr. Ryan, seconded by Mr. Nyland and passed unanimously on roll call vote to approve the April 20th and May 3rd meeting minutes with changes as noted by Mr. Ryan.

Ordinances: Ordinance 2016-03 Authorizing the Lease for Hunting was read by title on second reading and opened for public comments. There being no public comments, the comment period was closed On motion by Mr. Nyland, seconded by Mr. Ryan and passed unanimously on roll call vote to adopt Ordinance 2016-03.

Ordinance 2016-04 Authorizing the Lease for Farming was read by title on second reading and opened for public comments. There being no public comments, the comment period was closed On motion by Mr. Nyland, seconded by Mr. Ryan and passed unanimously on roll call vote to adopt Ordinance 2016-04.

ORDINANCE 2016-05 ORDINANCE OF THE TOWNSHIP OF OXFORD, COUNTY OF WARREN, STATE OF NEW JERSEY TO AMEND, REVISE AND SUPPLEMENT CHAPTER 118, “ANIMALS,” SUBCHAPTER 118-3, “APPLICATION FOR LICENSE AND TAG; EXEMPTION” OF THE CODE OF THE TOWNSHIP OF OXFORD FOR WHICH THE COST FOR AN ANNUAL DOG LICENSE IS HEREBY INCREASED. WHEREAS, the Township Committee of the Township of Oxford wishes to amend Chapter 118, “Animals.” Subchapter 118-3, “Application for license and tag; exemption” of the code of the Township of Oxford to increase the annual dog licensing fee. NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Oxford, County of Warren, State of New Jersey that Subchapter 118-3, “Application for license and tag; exemption” of Chapter 118, “Animals” is hereby amended as follows: Section 1. §118-3 “A person applying for a license and registration tag shall pay a fee of $11.80 for each dog, plus $1.00 New Jersey registration fee, plus $0.20 Pilot Clinic Fund, for each annual renewal for a spayed or neutered dog for a total of $13.00. Proof of neutering or spaying must be presented at the time of licensing. For each non-spayed or non-neutered dog, the license fee shall be $13.80, plus New Jersey registration fee of $1.00, New Jersey Pilot Clinic Fund fee of $0.20, and New Jersey pet population control fee of $3.00 for a total of $18.00. All licenses, registration tags and renewals thereof shall expire on the last day of January each year. Section 2. Should any part or parts of this Ordinance be held to be invalid by any competent court of law, such invalidity shall only affect the part or parts held to be invalid, and all other parts shall remain in effect. Section 3. Severability. The various parts, sections and clauses of this Ordinance are hereby declared to be severable. If any part, sentence, paragraph, section or clause is adjudged unconstitutional or invalid by a court of competent jurisdiction, the remainder of this Ordinance shall not be affected thereby. Section 7. Repealer. Any ordinances or parts thereof in conflict with the provisions of this Ordinance are hereby repealed as to their inconsistencies only. 2

Section 8. Effective Date. This Ordinance shall take effect upon its passage and publication as required by law. On motion by Mr. Nyland, seconded by Mr. Ryan and passed unanimously on roll call vote to adopt on first reading Ordinance 2016-05; second reading, public hearing will be held on June 15th at 7:00 PM in the Oxford Municipal Building, 11 Green Street, Oxford, NJ.

Resolutions: RESOLUTION 2016-50 REDEEMED LIENS WHEREAS, several real property tax payers have redeemed liens held against their property taxes and; WHEREAS, the Tax Collector has received proof of such payments after correspondence with said property owners; NOW, THEREFORE BE IT RESOLVED that the Township Committee, of the Township of Oxford, County of Warren, State of New Jersey, hereby authorizes the Certified Finance Officer to release the amount specified to the lien holders listed below.

RESOLUTION-2016-51 A RESOLUTION OF THE TOWNSHIP OF OXFORD, COUNTY OF WARREN, STATE OF NEW JERSEY, AMENDING THE CONTRACT WITH BRENNAN ENVIRONMENTAL, INC. FOR 3

SITE REMEDIATION SERVICES TO BE PERFORMED IN ACCORDANCE WITH THE NJDEP HDRSF PROGRAM FOR THE PROPERTY KNOWN AS 50 WALL STREET, OXFORD, NJ, BLOCK 45, LOT 1 WHEREAS, the Township of Oxford entered into a contract dated January 5, 2016 with Brennan Environmental, Inc. (“BEI”) for site remediation services to be performed on the property known as 50 Wall Street, Block 45, Lot 1; and WHEREAS, the New Jersey Department of Environmental Protection Hazardous Discharge Site Remediation Fund (“NJDEP HDRSF”) program has awarded a grant to the Township of Oxford in the amount of $86,060.00; and WHEREAS, BEI has subsequently submitted to the Township of Oxford a revised proposal dated May 17, 2016 which more accurately outlines the scope of work to be performed and associated costs; NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Committee of the Township of Oxford hereby amend the executed contract with BEI dated January 5, 2016 as follows: 2.

COMPENSATION

The TOWNSHIP shall pay to the CONTRACTOR in accordance with the attached scope of work not to exceed the sum of $86,060.00 for the environmental services completed pursuant to this Agreement. BE IT FURTHER RESOLVED, that payment to BEI for work performed according to the amended contract shall come from the NJDEP HDRSF grant of $86,060.00 received by the Township of Oxford.

NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Committee authorize the Tax Collector to waive all charges from the property owner sewer bills as stated in this resolution.

On motion by Mr. Ryan, seconded by Mr. Nyland and passed unanimously on roll call vote to adopt Resolution 2016-50, Resolution 2016-51 and Resolution 2016-52.

On motion by Mr. Ryan, seconded by Mr. Nyland and passed unanimously on roll call vote to authorize the Mayor to sign the deed, selling property (Block 1.01, Lot 3, approximately 70 vacant acres and a public trail easement) to Warren County, Department of Land Preservation off of Jonestown Road. The Committee congratulated Bob Magnuson, Superintendent of Oxford Central School for being voted “Principal of the Year” by the PTA Chapters of New Jersey. On motion by Mr. Ryan, seconded by Mr. Nyland and passed unanimously on roll call vote to approve Oxford Central School Tricky Tray on June 5th from 3:00 Pm to 5:00 PM. Mayor Pasquini will call Jeff Schaumburg, from Dynamic Earth to discuss what work is left to be completed on the dam at Oxford Furnace Lake because the account has run out of money. The Committee discussed that if further repairs to the dam are required by NJDEP, money may have to be taken out of the Capital Account.

The Committee discussed the Interlocal agreement with Washington Police. On motion by Mr. Nyland, seconded by Mr. Ryan and passed unanimously on roll call vote to approve the 10 year agreement with the conditions that if Oxford Township builds a gun range, the quarterly fee paid to Washington Township, will be reduced. Mr. Nyland will set up a meeting with Washington Township Police to discuss the amount to be deducted from the Interlocal Agreement for use of the gun range by Washington Township Police only. John Simmons wrote a letter to the Committee asking that his Mother’s garbage bill be waived since his mother Victoria Simmons is in Warren Haven. On motion by Mr. Ryan, seconded by Mr. Nyland and passed unanimously to waive the garbage fee starting May 18th. On motion by Mr. Ryan, seconded by Mr. Nyland and passed unanimously on roll call vote to pay all bills approved by the Committee. Jim Kyle attended the meeting and suggested that the Township hire 4Award Planning to provide Oxford a fiscal impact analysis on the proposed residential development project-Oxford Textile. This analysis study would be paid by Oxford Textile through their escrow account set up with the Township. 10

Mayor Pasquini will call George Vallone, Developer and Nick Guariello, owner of Oxford Textile to discuss the study. On motion by Mayor Pasquini, seconded by Mr. Ryan and passed unanimously on roll call vote to execute the contract with 4Award Planning. Mr. Kyle will follow up with New Jersey Economic Development Authority (EDA) in regards to when funds will be disbursed to the Township.

Public Comment: The Committee is investigating the procedure and timetable of removing the Township from all residents paying a County Library Tax, and just paying a fee for residents that want to belong to the Warren County Library. There was positive feedback on the new Oxford Township website.

EXECUTIVE SESSION WHEREAS, Section 8 of the Open Public Meeting Act, Chapter 231, P.L. 1975, permits the exclusion of the public from a meeting in certain circumstances, and WHEREAS, this public body is of the opinion that such circumstances presently exist. The public shall be excluded from the discussion of any action upon the hereinafter-specific subject matter. The general nature of the subject matter to be discussed is: Contractual and Shared Services. It is anticipated at this time that the above stated subject matter will be made public at the conclusion of the litigation. The motion carried with the following roll call vote. On motion by Mr. Ryan and seconded by Mr. Nyland and passed on roll call vote to end public comment and enter into Executive Session at 7:55 PM. On motion by Mayor Pasquini, seconded by Mr. Nyland and passed unanimously on roll call vote to enter into open session at 8:20 PM. 11

On motion by Mayor Pasquini, seconded by Mr. Ryan and passed unanimously on roll call vote to start a RFP process on the Block 26, Lot 83 named “Cambridge West” and Block 31, Lot 21Cambridge East. On motion by Mr. Ryan, seconded by Mr. Nyland and passed unanimously on roll call vote to adjourn the meeting at 8:30 PM.
