Greetings. I feel like a broken record, but the fight to keep our benefits is long from over. We are now faced with a General Assembly who cannot seem to agree on how to fix the pension problems and Speaker Madigan continuing to pass shell bills, which are continuously filled with ridicules proposals, which keep getting voted down by an overwhelming majority. Please continue to make your phone calls and send emails to your Representatives and Senators.

The Police Benevolent & Protective Association of Illinois Board recently voted to endorse a new member benefit to provide Personal, Auto and Home Insurance program through California Casualty. Don’t let the name fool you… they are not just in California. They are a nationwide provider that has been providing exceptional coverage to public safety professionals for over 40 years.

If you haven’t done so already, please go to the PBPA page on Facebook and click the “LIKE” button, so you can be kept up to date on pension proposals and bills from Springfield. The page is updated several times per day. I am still looking for organizations which are willing to provide our members with discounts. If you know of a company, please let me know, so I or an E-Board member will reach out to them and see if a partnership can be reached. I have been receiving several entry’s for this year’s golf outing at TPC @ Deere Run which is being hosted by my local unit, so please get your registration forms in ASAP. The outing date is July 24th.

LIFETIME MEMBERSHIP Are you nearing retirement after serving your local department for 20 years or more? Would you like to become a lifetime member with the PB&PA of IL, but your unit is less than 20 years old? Did you know that you can “buy-out”, at halfprice, the years of membership dues that you would need to reach your 20-year minimum with the Association? For example: Adams County Sheriff’s Department, Unit #155 joined the Association in 1996. If one of their officers retired now after being on that department for 20 years and having paid Association dues since 1996, he or she would only have 12 years with the PB&PA of Illinois. If he or she wanted to pay for the remaining eight years in advance to become a lifetime member and receive his/her gold card, he or she would need to pay $192 (8 years x $48 per year divided by 2). He or she also has the option to continue paying yearly dues at the full membership rate (currently $48) until such time as he or she reached the 20-year minimum and receives his/her gold card at that time.

As an Illinois Law Enforcement Officer ... POLICE BENEVOLENT & PROTECTIVE ASSOCIATION OF ILLINOIS

POLICE OFFICER OF THE YEAR Help the PB&PA honor your department’s top cop(s) by sending your nomination for the PB&PA Police Officer of the Year today! This award shall be given to an individual police officer or group of officers who, in the opinion of the selection committee, are worthy of recognition for their accomplishments. In addition to the award itself, there will be two individual police officers or groups of officers selected to receive Honorable Mention Awards. Any member of the PB&PA may nominate any certified peace officer employed full-time in any agency in Illinois for the Police Officer of the Year Award. Membership in the PB&PA is not required to be nominated or to win. The nomination simply requires a letter from a member identifying the officer(s) nominated as well as completely and accurately describing the incident(s) in which the officer(s) was (were) involved where he or she demonstrated outstanding service, exemplary job performance or heroism. All nominations and supporting documentation must be submitted to the Executive Office of the PB&PA

no later than September 1, 2013.

The nominations should be for heroics or outstanding service that has taken place during the period of July 1, 2012, through July 1, 2013. These awards will be presented to the recipients at the banquet on the Saturday night of the PB&PA’s Annual Convention in October.

PBPA/PBLC Co-Host 2012 Mid-States Convention November 30th through December 2nd the PBPA and the PBLC hosted the Mid-States Police Conference in Oak Brook. This annual conference is a crucial event for law enforcement representatives across the Midwest as we battle against attacks on collective bargaining rights and retirement benefits. This year top leaders from major police organizations in Illinois, Minnesota, Michigan, Ohio, Wisconsin, Iowa, and Missouri heard presentations regarding legislative initiatives and advocacy, public relations and political activity strategies, as well as a detailed Washington Report from NAPO’s Executive Director William Johnson. While the challenges that we face vary in degrees they are all similar at their roots. Of particular interest to the group was the impact of the Americal Legislative Exchange Council (“ALEC”) and groups like American’s for Prosperity on state and regional attacks on public employees. The conference attendees were impressed by strikingly similar pieces of legislation introduced in each of our different states. For instance, several pension “reform” bills that have been proposed in Illinois have also been proposed in Iowa, Missouri, Ohio and Michigan. Clearly we have been targeted by a well funded and well coordinated campaign. Thankfully, we recognize that fact and through our national affiliation and commitment to each other - can respond from a position of strength in unity.

Heading into collective bargaining without a professional negotiator and the backing of a statewide police union is like confronting an armed suspect without a weapon and backup.  Your fellow officers have good intentions, but they’re no match for the experienced negotiators retained by your employer. Bargaining a fair contract requires the work of skilled negotiators and professionals trained in the arts of mediation and arbitration. You need and deserve excellent representation and with the PBLC, you’ll have it.

The PBLC commitment The PBLC is a not for profit corporation affiliated with the PB&PA.  Our highly trained, specialized staff includes experienced labor representatives and in-house legal counsel, all of whom participate in continuing legal and labor education. The PBLC’s board of directors, also known as the State Labor Committee, is organized by and for the rank and file and is composed solely of full time police officers.

Leading the way The PB&PA took the lead in securing collective bargaining rights for law enforcement officers in Illinois. By helping draft the Illinois Public Labor Relations Act and then spearheading its passage, the PB&PA has been at the forefront of police labor issues. The PBLC was created to further advance the PB&PA’s police representation and protection goals. Since its inception, the PBLC has led the way in preserving the rights and enforcing the collective bargaining agreements of Illinois law enforcement professionals.

the state value their relationship with the PBLC. They know that they can call upon their Labor Representative or an Attorney any time a problem arises — 24 hours a day, seven days a week. Collective Bargaining: Your bargaining unit is unique. The PBLC represents each individual bargaining unit based upon the needs, goals and expectations of that Unit. Your PBLC Labor Representative provides assistance, advice and advocacy at the bargaining table.

Interest arbitration: If a satisfactory bargaining agreement cannot be reached, the PBLC will provide an experienced attorney to represent your bargaining unit at interest arbitration at no additional expense to the unit.

The Legal Defense Benefit includes: • Representation at discipline and discharge proceedings at Arbitration or before the Police and Fire Board or Civil Service Commission. • Representation during internal investigation interviews. • Representation during criminal investigations and proceedings in which the criminal offense allegedly occurred during the performance of the member's official police duties. • Initial consultation and advice in civil rights violation cases, including referral to a reputable civil rights attorney for representation at a discounted rate. • Peace of mind in knowing that if you are accused, you have someone to turn to.

Grievance processing: Through a Labor Representative and, in some cases, Legal Counsel, the PBLC provides advice and assistance to bargaining units and individual members in filing and processing grievances.

Attorney-client relationship Any member who uses this benefit becomes the client of the individual attorney retained for representation. The PBLC will not infringe upon the attorney’s independent professional judgment in rendering legal services under this plan.

Grievance arbitration: There are occasions in which a compromise cannot be reached amicably. If your contract provides for grievance arbitration, the PBLC will provide and experienced attorney to represent your bargaining unit or an

Contract maintenance: Once an agreement is reached, the PBLC monitors employer/employee actions during the term of the contract to ensure compliance. Your Labor Representative takes a proactive stance by meeting periodically with both the bargaining unit and management to address concerns and prevent misunderstandings.

THE 10th ANNUAL JIM FAULKNER MEMORIAL GOLF SCRAMBLE We would like to honor and remember Jim Faulkner, a former graduate of our school’s in the Peoria Heights Community Unit School District #325. Jim lost his life in the line of duty as a member of the Peoria Police department on September 20, 2001. The Jim Faulkner Memorial Golf Scramble honors the memory and sacrifice of this proud Peoria heights alumnus. The money from this golf scramble will be given as a scholarship in his memory to a graduating senior at Peoria heights high School. last year $8,000.00 was given in scholarships. The scramble is an annual affair. everyone participating in last years Golf Scramble enjoyed a fun-filled day. our goal is to double the donations this year. We will be able to achieve our goal with the help of individuals and organizations who care about our youth. The Springfield Police Department Unit # 5 spent the holidays helping out several charitable organizations.

The Rock Island City PBPA Unit #3 combined with Rock Island County PBPA Unit #134 to win the Dewitt, Iowa Guns and Hoses softball tournament July 2012. They came back from losing the first game to win the next 5 and beat Davenport, Iowa PBPA 12-3 in the Championship game.

Unit #5 donated over $5000 for our annual Cops, Kids and Christams. Springfield Police officers took 50 local children shopping at Meijer for coats, hats, gloves and toys. With the help of the Springfield Meijer store the police department made sure all 50 kids had the proper clothing for winter and at least a few toys to enjoy at Christmas. Pictured are Unit # 5 members Officer Mark Houston, Detective Mike Brown and Officer Steve Vespa shopping with the local kids. Unit # 5 donated $1002.61 to the local Toys for Tots organization. Members of Unit # 5 filled several shopping carts with toys to be donated to local youths at Christmas.

Chicago Police Sergeant Makes Her Mark

The stereotype of the cop going to law school and advancing his career in the justice system is alive and well. And although Heather Daniel is a Chicago police officer who just graduated from The John Marshall Law School, she’s definitely no stereotype. This sergeant on the Chicago Police Department (CPD) also holds a degree in English Language and Literature from the prestigious University of Chicago, once took computer programming courses for fun and demonstrated against nuclear weapons during high school. Oh, and she’s the January 2013 John Marshall graduating class valedictorian. Stereotype? Definitely not. More like a person who’s interested in justice, whether it’s through keeping the streets safe for law-abiding citizens, exercising her free speech rights on a moral issue or stepping up to fight the good fight. “We, as a society, have chosen the rule of law to be the foundation of our social interactions.” Daniel said in her January commencement address. “The law serves us by helping us frame our everyday conduct—it tells us what we can and cannot do. But the law also protects. The law protects the powerless, it protects our social structures, it protects our form of government; the law protects our rights as human beings.” It took Daniel more than four years of part-time law school to get through John Marshall. She worked the overnight shift at the Chicago Police Department. Her usual schedule was to head to the police district station after her evening class, work all night, sleep for a few hours, get something to eat, do homework and head back to class. Some class periods she would have her police weapon with her, but she never wore her uniform to class and doesn’t believe her weapon was visible to the other students. “I was afraid it would be distracting to wear the uniform to class so I just changed into my work clothes after class,” she said. So by night, she’d be dealing with shootings, rapes and robberies. By day, or early evening, that is, it was torts, contracts and partnerships. “Sometimes the police work is very dull but it can change in a second and you have to be prepared for it,” Daniel said. “I love the police work, the running around like you see on TV,” she said of being on patrol. “But it also was an advantage in being able to put that field knowledge to work in law school.” During her 13 years on the force, Daniel has been an analyst at the CPD’s organized crime division, providing realtime support for Chicago’s response to a sudden nationwide spike in heroin overdoses. She also served as a detective, and has earned a number of department awards. Despite the full-time job, Daniel was able to take advantage of John Marshall’s strong externship program. “I didn’t expect to have time for anything outside of class. But John Marshall offers so many ways to get real legal experience. And they work hard to find options that are a good fit.” Daniel spent six weeks as a legal intern in Washington, D.C., working for Terrence Gainer, former Illinois State Police chief and currently the U.S. Senate Sergeant at Arms. She researched constitutional limits on government conduct, among other things. In her final semester, Daniel found herself moved off nights and onto a day shift which allowed her to extern on her day off. She spent one day a week externing in the U.S. District Court for the Northern District of Illinois, preparing two draft opinions.

Daniel isn’t alone in her pursuit of a law degree combined with police work. Nearly a dozen of her John Marshall classmates are also working as police officers. “We work strange hours that can change unexpectedly. John Marshall is so flexible—they were always willing to work with me so I could keep moving forward.” Daniel is studying for the bar and would like to find a legal position in the public sector involving public policy development or litigation.

Hobart “Curley” Rogers Scholarship Fund for the School Year 2014/2015

Section 1. The purpose of the creation of this scholarship fund is to honor the memory of Hobart “Curley” Rogers and to provide financial assistance to the children of members of our Association. The By-laws Committee was designated as the Scholarship Committee and set forth the rules and regulations which shall determine those individuals eligible for each scholarship. The mandatory minimum guidelines shall be used to determine who receives the scholarships each year as follows: 1) The scholarship fund shall commence in the year 1995. Four (4) $1,000.00 scholarships shall be issued to four eligible applicants entering or enrolled in undergraduate studies. 2) Each year thereafter, four (4) additional scholarships shall be added until a total of sixteen (16) scholarships will be awarded by the year 1998. 3) Once the sixteen (16) scholarships have been issued, the number of scholarships issued per year shall not exceed sixteen (16). 4) All applicants must be a son or daughter of a PB&PA member in good standing with the Association. The term “son or daughter” shall be defined by the Scholarship Committee. The Scholarship Committee defines “son or daughter” to include stepson, stepdaughter, foster son, foster daughter, and legal dependents of the PB&PA member. PB&PA members are not eligible for the scholarships for themselves. 5) The Scholarship Committee shall determine when all applications must be received and set forth when the award shall be issued. The application deadline is March 1 of each year. The Scholarship Committee will meet between March 15 and May 15 of each year to review applications and determine scholarship recipients. Scholarship recipients will be notified by the Scholarship Committee within two (2) weeks following the Committee meeting. 6) Scholarship applications will be made available to each local PB & PA unit. 7) Scholarship applicants must include an essay or personal biography of no more than three pages with their application. 8) Scholarship funding will be disbursed by semester ($500.00 per semester). 9) Upon receipt of the scholarship, all scholarship recipients must complete at least twelve (12) hours of course work per semester. Recipients failing to complete twelve (12) hours of course work per semester, or equivalent thereof, will not be issued payment for those semesters. Any recipient who fails to complete twelve (12) hours per semester, or equivalent thereof, for two (2) consecutive semesters shall have their scholarship revoked. Any recipient who fails to complete two (2) twelve (12) hour semesters within two (2) consecutive years from the date of the scholarship issuance, shall have their scholarship revoked. In either case, an alternate, selected by numerical rating and validated by the Scholarship Committee for the current year in which the revocation would take place, shall receive the remaining term of the original scholarship granted the primary recipient, provided the alternate meets all of the requirements at the time of such approval. 10) Scholarship recipients must maintain a “C” average each semester and provide the office of the Executive Director of the PB&PA with a transcript of their grades each semester to maintain their scholarship, for a maximum of four (4) consecutive years. 11) Each scholarship recipient must provide proof of school registration or enrollment prior to receiving funding. 12) Educational institutions that scholarship applicants are requesting funding for must be accredited and approved by the Scholarship Committee. 13) The Executive Board retains the right to overrule any scholarship award issued by the Scholarship Committee. 14) It is expressly understood by all scholarship recipients that he or she possesses no property interest in the scholarship and said scholarship may be revoked at any time. The Scholarship Committee shall have the authority to recommend the revocation of any scholarship at any time and for any reason whatsoever.

At the 1992 Convention, the State Executive Board made a recommendation that the Youth Grant should not be used in conjunction with an agency-sponsored program. The Board felt that the intent of the grant is to provide assistance to the local PB & PA Unit sponsored programs, and not to subsidize a program that is administered by a governmental agency. At the 1996 Convention, held in Champaign, a resolution was passed by the delegates present, which raised the amount of the grants. The resolution stated that local units could apply for a youth grant requesting up to $1,000.

PBPA Executive Board Policy Regarding the Payment of Death Benefits  

  

Adopted - January 28, 2006 1. Member death benefits shall be paid to the member’s designated beneficiary, or in the event no beneficiary is designated, to the member’s estate in the following amounts: a. Members 70 years of age or over shall be paid a benefit amount of five hundred dollars ($500). b. Members under the age of 70 shall be paid a benefit amount of one thousand dollars ($1,000). c. Members under the age of 70 killed as the result of an accident shall be paid a benefit amount of two thousand dollars ($2,000). d. Members killed in the line of duty shall be paid a benefit amount of three thousand dollars ($3,000). e. No benefit shall be paid when a member’s death is caused by suicide.  

2. All claims for a member death benefit must be made within 1 year of the member’s date of death. In cases where an actual date of death cannot be determined, claims must be received within 1 year of the date of a judicial finding of presumption of death. Claims not made within this time limitation shall not be paid.  

3. Except in cases where the Executive Board determines that exigent circumstances exist which justify immediate payment of a member death benefit the following payment policy shall apply. All claims received by the Financial Secretary on or after January 1 and on or before June 30 shall be paid in the following month of July. All claims received by the Financial Secretary on or after July 1 and on or before December 31 shall be paid in the following month of January.
