THE KENYA INFORMATION AND COMMUNICATIONS ACT (Cap. 411A) TASKFORCE TO REVIEW THE KENYA INFORMATION AND COMMUNICATIONS ACT (BROADCASTING REGULATIONS, 2010) APPOINTMENT IT IS notified for the general information of the public that the Cabinet Secretary, Ministry of Information Communication and Technology has appointed a Taskforce to review Kenya Information and Communications Act (Broadcasting Regulations, 2010). 1. GAZETTE N OTICE NO. 3135 THE JUDICATURE ACT (Cap. 8) THE HIGH COURT (PRACTICE AND PROCEDURE) RULES CORRIGENDA Gazette Notice No. 53 of 2013 be and is amended by: 1. Deleting Rules 1 (1), (2), (3) and (4) and inserting the following in substitution thereof: (1) The sittings of the High Court shall be three in every year.
(b) to identify and propose the need, if any, for amendments, changes and /or improvements to the Broadcasting Regulations, definitions and substantive provisions so as to accurately reflect contemporary realities and factors such as new technologies and to propose specific amendments to existing Rules and Regulations; (c) to draft the text for new Regulations in light of new conditions and emerging trends; (d) to hold consultative meetings with stakeholders and members of the Public to collect and collate their views and proposals on the draft documents in light of the foregoing; (e) to conduct any background research necessary to achieve its objectives; (f) to conduct any other background research and provide advisory information to the Ministry of Information, Communications and Technology. 3. The Taskforce shall have the powers necessary to undertake any matter incidental or ancillary to the matters stated herein. 4. The Taskforce may co-opt such other persons, who possess the appropriate competencies as are necessary for the performance of the terms of reference. 5. The Taskforce shall —

(a) prepare a detailed work plan; (b) prepare any documents related to the terms of reference; and

(4) Despite sub-rule (1), (2) and (3), the Chief Justice may determine sittings of the Court which sittings shall be advertised and notified in the matter as the Chief Justice may direct. (vi) To endeavored and develop a comprehensive, practical and inclusive strategy in extension methodology such as Farmers Field Schools to enhance dairy production. (vii) To identify and recommend ways of streamlining local and export marketing channels for dairy and dairy products. (viii) To consider, devise and recommend a programme of activities to launch and fast track milk value addition in the county. (ix) To identify and familiarize with regulations and standardizations in the county and globally for dairy production, marketing, processing and packaging to make it more competitive, profitable and rewarding to dairy farmers and other actors in the value chain. (x)
To enhance adoption of modern farming technologies and integration of Information Communication Technologies (ICT) and in dairy sector.
(xi) To lobby and recommend the appropriate and relevant legislation for promotion and commercialization of the dairy sector in the county. (xii) To assess ways of addressing the safe use and proper disposal of livestock drugs through collaboration with relevant stakeholders. (xiii) To devise ways of integrating the youth in dairy value chain. (xiv) To assess the sustainability and fast tract operationalization of dips. The board conducted suitability interview for employees of former Local Authorities and established that some employees cannot be absorbed by Migori County Government because they do not have the required qualifications. On the basis of the results of suitability interview the board recommended that casuals who are qualified should be absorbed. 8.0

Inclusion and integration of minorities and marginalized groups. • A county government, public and private organization and private individual, shall observe the following principles— (a) protection of marginalized and minority groups from discrimination and from treatment of distinction of any kind, including language, religion, culture, national or social origin, sex, caste, birth, descentor status; (b) Non-discrimination and equality of treatment in all areas of economic, educational, social, religious, political and cultural life of the marginalized and minority groups; In meeting this requirement the board achieved 30 per cent as it employed people from Taita Taveta, Kisii, Kamba, Meru, Kalanjin and Luhyias. 9.0 PROGRAMMES THE BOARD HAS UNDERTAKEN OR HAS PLANNED TO UNDERTAKE TOWARDS PROMOTION OF THE NATIONAL VALUES AND PRINCIPLES (a) The board in seeking to meet 5 per cent threshold of people living with disabilities being in included in the workforce as stipulated in Persons living with disability Act and inclusivity as required in the constitution of Kenya the board seeks to create and fill a substantive positions to be held by a person living with disability to enhance mainstreaming of PWDs within the County Public Service.
Migori County Public Service Board employed all people with disability (PWDs) who applied and qualified for appointment. The deficit of 2 per cent will be filled during the subsequent recruitment. (e) Development of Strategic Plan 2014–2018 The board has developed its Strategic Plan for the Financial Year 2014-2018. (f) Development of Human Resource Policy The board has developed HR policy that is intended to give direction to the county on Human Resource Management. The policy will be presented to Migori County Assembly for approval before implementation. (g) Development of Migori County Public Service Board Bill, 2014 The board has developed Migoiri County Public Service Board Bill, 2014 that will give the board legal status. So the bill was presented to the Kenya Law reform Commission for review and has been submitted to Migori County Assembly for approval (h) Staff Establishment The staff establishment was developed during training workshop at Tom Mboya Labour College, Kisumu for CEC members, chief officers, directors and sub-county administrators, the objective of which was for the County to come up with approved staff
(b) In addition the board continues to engage with people living with disability through their umbrella organization together with engaging with members of the County Assembly representing this segment of our populace to find ways and means of assimilating people living with disability into our workforce. In this regard the board has achieved the 5 per cent requirement for PWDs. (c) The board attended training workshop on Values and Principles of Governance organized by National Cohesion and Integration Commission (NCIC) held at Tom Mboya Labour College, Kisumu (24–27th November, 2014), where the board prepared questionnaire and visited County departments to establish the extent to which values and principles of public service have been complied with within the county. 11. CHALLENGES Court Cases
Executive Summary In line with the County Governments Act No. 17 of 2012, the County Public Service Board is required to prepare and present to the County Assembly an Annual Report of all its activities for each Calendar year. Pursuant to the aforesaid, the Board in compliance with the Act has completed its report for the year 2014. During the year under review, the County Public Service Board established five committees to assist it deliver on its mandate, Recruited Chief Officers (except for Chief Officer Treasury whose recruitment was halted by a Court order),hired Heads of Departments (save for the County Payroll Manager who was yet to take up the appointment) to take up the positions of the Interim Officers who were seconded by Transition Authority, appointed Sub County and Ward Administrators, and conducted interviews for ECDE Assistants, Health Services Staff whose appointments are to be finalized by end of February,2015. In the year 2015, the board has planned a number of activities such as the finalization of the Strategic Plan, Discipline Manual and Board Charter; conducting interviews for Tourism Officers, Board’s, City Manager and the Board’s Secretariat; selections of ECDE Assistants and Health Services Staff; induction of new employees, evaluating the impact of training and development activities on service delivery, capacity Building for Board members; servicing indents as and when received from the executive. Putting in place the Board’s website and embracing Information and Communication Technology in all its activities; Promotion of Values and Principles good governance; Human Resource Staff Audit and Rationalization programme. Change management activities especially organizational behaviour.

Despite the various challenges faced during the year under review, the Board realized its objectives. The Board still remains committed to discharging its mandate and fulfilling its obligations as stipulated in the County Governments Act
A contempt of court was filled by the minority groups who felt the board had not taken care of their interest in employment, but this case was dismissed.
REPORT OF THE KISUMU COUNTY PUBLIC SERVICE BOARD TO THE COUNTY ASSEMBLY FOR THE YEAR ENDING 31ST DECEMBER, 2014.
(b) A case filed against county Government of Migori for stopping salary payment of 17 workers of former Local Authority who were irregularly engaged.
1. INTRODUCTION
During the year under review the board had been seized with civil suits,

Pursuant to the County Governments Act No.17 of 2012 Section59 (1) (d), (e), (3), (5), and (6), the County Public Service Board is required to report to the County Assembly every December of each year on its activities. 2. ESTABLISHMENT OF THE COUNTY PUBLIC SERVICE BOARD The County Public Service Board of Kisumu was established in line with The County Governments Act, section 57. The section states that: There is established a County Public Service Board in each County, which shall be— (a)
a body corporate with perpetual succession and a seal; and
(b)
capable of suing and being sued in its corporate name.
The County Public Service Board of Kisumu County came into being on 27th November, 2013 through Kenya Gazette Notice Number 14935 of the same date (27.11.2013) and thereafter, the Board members were sworn in on 28th November, 2013. 3. The Board conducted induction for the newly appointed Chief Officers and all Departmental Heads. Sub – County and Ward Administrators induction was partially done and will be completed next year 2015. 45 employees who had been dismissed by the Public Service Commission on fraud related cases and who had been given the right of Review. The Board advised them to apply to the Public Service Commission for review.

36 staff of the former Municipal Council of Kisumu who were ordered to be reinstated by the Court in its Judgment of 2012. The Board has given direction over the matter.
•
12 workers who had been suspended/interdicted by the former Municipal Council of Kisumu over alleged misappropriation of funds and other indiscipline cases. The Board referred the cases back to the Human Resource Advisory Committee for further investigations and a detailed report to enable the Board give guidance.
The Board was served with summons in respect of the following cases:•
32 sacked casual staff whose case is pending before the Kisumu Industrial Court. The Board was ordered not to fill their positions pending hearing and determination of the case

The case of Merita Ombuor, who has sued the County Government for alleged wrongful dismissal and whose case is also pending before the Kisumu Industrial Court. She is back to work on orders of the Court awaiting determination of case.
•
The case challenging the Board’s decision to re-advertise the position of the Chief Officer, Treasury following interviews that had been conducted. The Court has ordered the County Government to either appoint one of the candidates to fill the position or inform the affected candidates why they did not qualify.
The Board, in consultation with the office of the Governor and the National Anti-Corruption Commission advertised for recruitment of representatives from the various sub- counties to sit in the County Anti- Corruption Oversight Committee. The Board has also developed the Board Charter and Discipline Manual which are awaiting public participation and launch. The Board has further developed a mandate in which it seeks to delegate some of its powers to the Human Resource Advisory Committee made up of the County Secretary (Chairperson), County Head of Human Resource (Secretary), . The Board has initiated the process of formulating a five year strategic plan (2015-2019) and has engaged the services of an expert to guide the exercise, which is expected to be completed by the end of January 2015. 9. VALUES AND PRINCIPLES OF THE PUBLIC SERVICE
The Board, in collaboration with Kisumu Urban Project has come up with the Human Resource policy manual. The Board obtained inputs of various stake holders (public participation) and the document has been forwarded to the County Executive Committee for information and operationalization.
The Board at the outset carried out a sensitization of the staff on the values and principles of the public service (Article 232) at the worksites shown below with regard to what kind of quality is required in service delivery by public service staff : efficiency, promptness, economical :
The Board embarked on an initial staff Audit and established the existing staff levels. In addition the Capacity Assessment and Rationalization Programme (CARPS) which is a joint activity between the County Governments and the National Government is working towards establishing staff competency levels which will lead to staff rationalization. Inadequate office accommodation. The Board is still housed at the City Hall (former Mayor’s Parlor). The current accommodation is grossly inadequate for the Board members. Adequate office accommodation is urgently required to also house the yet to be established Secretariat. Efforts to identify adequate office space have so far been unsuccessful.

THE KENYA NATIONAL HIGWAY AUTHORITY (KeNHA) PUBLIC NOTICE PURSUANT to Section 38 of the Wildlife Conservation and Management Act, 2013 and in consultation with the Kenya Wildlife Service (KWS), the Kenya National Highway Authority (KeNHA) is seeking to utilize part of Nairobi National Park (NNP) for the construction of the Nairobi Southern By-pass Road. The total protected area/wildlife habitat affected by the by-pass Road is 89 acres, along a distance of 4 km. stretching from Ole Sereni Hotel to Carnivore Restaurant. The shortest and longest distances that the By-pass Road dips into Nairobi National Park from the park boundary are 60 and 248 meters respectively. KeNHA in consultation with KWS has identified a parcel of land adjacent to NNP on the Ole Kasasi Adjudication Section along the Mbagathi Valley for purchase, acquisition and subsequent annexing to NNP in exchange of the land to be utilized by the By-pass Road. KeNHA has proposed to purchase and acquire the parcel of land and exchange the same with the section of Nairobi National Park Land that will be utilized for the By-pass Road, under the principle of “enhancing efficient wildlife conservation" to mitigate the impact of wildlife habitat loss to be caused by the By-pass road. The expected variation of Nairobi National Park boundary shall be to increase the park area by annexing the additional parcel of land for conservation as envisaged under section 38 of the Wildlife Conservation and Management Act, 2013. KeNHA has conducted the required Environmental Impact Assessments (EIA) in accordance with the provisions of the Environmental Management and Co-ordination Act (EMCA, 1999). The EIAs have shown that the proposed National Park land exchange shall greatly and positively enhance wildlife conservation in Nairobi National Park. Legislative Supplement contains Rules and Regulations which are issued by the Central Government. Because of this, they must be submitted to the Government Printer through the office of the Attorney-General.

Act Supplement contains Acts passed by the National Assembly.
All “copy” submitted for publication should be prepared on one side of an A4 sheet no matter how small the Notice is, each page being numbered and should be typewritten with double spacing. Copy should be clear, legible and contain no alterations. Particular attention should be paid to the following points: (i)
Signature must be supported by rubber-stamping or typing the name of the signatory in capital letters.
(iiust be correct and filled in where necessary. (iii)
Care should be taken to ensure that all headings to Notices and references to legislation are up to date and conform with the Revised Edition of the Laws of Kenya.
EXTRACT FROM THE CODE OF REGULATIONS, S ECTION D— Kenya Gazette “D 34. (1) Communications for the Kenya Gazette should reach the Government Printer not later than 9 a.m. on Friday of the week before publication is desired. The Government Printer will not publish communications received after that hour until the next subsequent issue of the Gazette. (2) Ministries will be required to pay for the Kenya Gazette and to meet the cost of advertising in it. It is emphasized that these notes are for guidance only, but it is requested that persons submitting copy for publication first satisfy themselves that such copy is complete in every respect.
